The County Engineering Department has completed a review of
the above referenced project. The following•information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
l. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.

B) The subject property is affected bythe "Findings and
Order" and the "Conditions of Approval" for the following
land use action:

C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainaqe plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:

Access Standard.
All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount

924-6252 SCOPE/PROJECT DESCRII'TION:
1. General Overview - The owner, McCormick Progerties, is proposing to construct a new
14,000 square foot building as part of Phase I of the planned development of the property. An
Environmental Checklist was completed at the time of the rezone and a determination of
non-significance was made at that time. The applicant will be removing the old structure
(garage) that is in the vicinity of the proposed building. An office will not be located in the
structure. No new signs, exterior storage areas, or roof top mechanical equipment is
proposed.

S Y OF DEPAR'IfMENTAL REQUIREMENTS :
I. Planning Department (456-2205) - Francine Shaw
A. Discussion Items
1. The proposed is located in an I-1 zone. The proposed use is allowed in the
zone.
2. The proposed is located on parcel numbers 15542-1317, 1418, and 1419
which are effected by Zone Change ZE-6-91C for which there are conditions.
The Planning Department report is also part of the record. A variance was also
previously applied for. The Planning Department has issued a letter approving
the rearyard setback at 20 feet and approving the waiver of landscaping along the
south property line.
3. Please aggregate the three parcels into one parcei through a Certificate of
Exemption as parcel lines are running through the proposed building.
4. A fifty (50) foot front yard setback is requireti along Desmet. Since the
Division of Engineering & Roads is requiring an additional ten (10) foot wide
dedication, the proposed Phase II building as illustrated on the site plans will
need to be reduced in size. Since moving the building back would encroach into
the needed parking and circulation areas, as an alternative the applicant may
apply for a variance through the Planning Department.
5. An easement may be required on the western portion as access to the site is
through the adjacent property. An alternarive would be to complete a Certificate
of Exemption for a minor lot line adjustment or by aggregating all of the parcels
into one parcel.
6. Parking as illustrated on the site plans is adequate. 75 parking stalls D
illustrated and 69 are required. The applicant stated that he is proposing to
"phase" the installation of the parking stalls to correspond with building phasing,
and is proposing to install parking stalls to the end of the proposed building at
this time. Please submit a floor plan for the building, identifying the vanous
uses of the building, so a determination can be made as to the required number of
parking stalls required in this "phase" of the parking. Please illustrate all traffic
control devices on the revised site plans.
Three (3) bicycle racks are required for the entire parking lot.

7. Any roof top mechanical devices must be screened from view.
8. All utilities on the site are required to be located underground. .
9. Proposed must meet the noise standards in WAC 173-60.
10. Please illustrate the location and direction of illumination for any proposed
exterior lighting.
11. Please submit elevation drawings as per Spokane County Zoning Code
14.630.390. A copy of this regulation regarding architectural treatment was
given to the applicant. This provision of the code requires the following:

' The exterior architectural design''and appearance of buildings shall include
strong vertical or horizontal lines to convey a definite feeling of
~ massiveness and volume. Building wa11s should be the dominant
architectural form; roofs should be a secondary element, and preferably
flat with moderate parapets. Exposed side and rear walls shall be finished
in a style, design, and material complimentary to the front of the building.
The color of the building and screening walls shall be limited to brick red,
white or earth tones.
12. A condition of the Zone Change restricts fencing to a height of four (4) feet.
A six (6) foot high fence is illustrated on the site plans. A variance may be
applied for.
13. Landscaping as illustrated on the revised site plans is acceptable. The
Planning Department is waiving the requirement of a ten (10) foot wide strip of
Type II landscaping along the west property line (adjoining a B-1 zone).
A minimum of 10% of the parking area is to be landscaped. All parking stalls
are to be located within 60 feet of a landscape feature consisting of 32 square feet
in area. Landscaping located between the parlcing lot and the building will not
meet this requirement. All landscaping features must be surrounded by six (6)
inch curbing. Please illustrate the curbing and irrigation system on the revised
site plans.
The applicant commented that the required landscaping features would impede
the plowing of snow, and asked if the landscaping along the proposed buildings
would work. Francine Shaw responded that the Zoning Code is quite specific on
this requirement in that landscaping along buildings cannot be considered as a
landscape feature for parking.
B. Permit Release Requirements 1. Please submit an estimate from a nursery including size, type, curbing,
quantity of landscaping, itemized cost of the irrigation system, and the cost of
labor along with a promissory letter from the owner stating the landscaping will
be installed.
2. Please submit a Certificate of Exemption aggregating the parcels into one
parcel.
3. Please submit a reciprocal easement agreement allowing access to the Esite
through the adjacent property or apply for a Certificate of Exemption.
4. Please submit a revised site plan illustrating the use of the building, the .
square footage of use, traffic control devices, bicycle racks, lighting, elevation
drawings, fencing, landscaping, and setbacks for review and approval.
II. Spokane County Air Pollution Control Authority (456-4727) - Kelle Vigeland
A. Discussion Items
1. Comments were given to the Department of Buildings by Kelle Vigeland and
were presented at the meeting by Tom Davis who summarized the following:

- Proposed must meet all air pollution regulations, including those dealing
with dust emissions during construction and excavation projects.
- Any processing or equipment which produces air emissions may require
a Notice of Construction and application for approval.
- Measures must be taken to avoid the deposition of dirt and mud from
unpaved surfaces onto paved surfaces.
- All traveled surfaces are required to be paved.
- The applicant stated that he intends to install a 100 horsepower boiler.
He was advised to contact SCAPCA, as this may require a permit.
III. Division of Engineering & Fcoads (456-3600) - Bob Turner
A. Discussion Items
1. Comments were given to the applicant and the Department of Buildings by
Bob Turner.
2. Please submit a drainage plan for the site that is in compliance with Spokane
County Guidelines for Stormwater Management as detailed in the handout given
to the applicant at the meeting and also attached to the applicant's copy of these
minutes. Please illustrate grades and calculations.

3. Please submit road and drainage plans prepared by an engineer for road
improvements to Desmet. Desmet shall be improved to Typical Roadway
Section No. 1, Local Access Standard. All required road construction shall be
completed prior to permit issuance or a bond in an amount estimated by the
County Engineer to cover the cost of construction shall be submitted. The
applicant was advised to submit the road and drainage plans as soon as possible
so that permit issuance would not be delayed. The applicant stated that Simpson
Engineering is in the process of finalizing the design work and will be submitting
the plans very shortly.
4. A ten (10) foot wide strip of land is required to be dedicated along Desmet as

3. The applicant has an approved water plan. This system must be installed
prior to occupancy.
4. The Fire District will be accessing the site on the east and the west. A
dedicated fire lane with a curb cut constructed of all weather driving surface with
signage is required on the east. The fire lane needs to be twenty (20) feet wide
with a minimum of a 20 degree turning radius. The gate accessing this fire lane
must have a lock (Knox) padlock for Fire District personnel access.
5. A lock (Knox) box entry system for fire department personnel access is
required to be installed. Forms for ordering was given to the applicant. The
completed forms are to be returned to the Fire District prior to release of the
building permit. Keys to access all buildings at each address need to be placed in
the lock box on each site. A lock (Knox) padlock is also required as detailed
above. The box shall be installed prior to occupancy.

1. The order form for the lock (Knox) box entry system shall be submitted to the
Fire District prior to release of the building permit.
VI. Department of Buildings (456-3675) - Bobby Stone
A. Discussion Items
1. Plan review has been completed on the site plan only by Bobby Stone.
2. The proposed building is being classified as a B-2 occupancy, Type V-1HR
construction.
3. The proposed shall meet the minimum requirement of the Regulations for }
Barrier Free Facilities. Proposed should also comply with the provisions of the
American Disabilities Act. The Department of buildings will not be requiring
compliance with this act until it is adopteri as part of the Washington State
Barrier Free Regulations, which is not expected to occur until July, 1992. For
information about the Americans with Disabilities Act, call 1-800-435-7232.
Specifically, the handicap parking stalls need to be moved so that there is no
crossing of travelways.
4. Please submit an updated critical materials list for review. E
5. Structural calculations should be submitted to justify the adequacy of the
structural system (including foundation) for seismic, wind, dead, snow and live
loads. (UBC Chapter 23)
6. If any portion of the building is heated to over 50 degrees Fahrenheit,
requirements of the Washington State Energy Code must be met.
7. The west wall is six (6) feet from the property line, and will therefore require
a one-hour fire-resistive wall with 3/4 hour fire-rated openings. If the parcels
are aggregated into one parcel or adjusting the property line, this would eliminate

would have to be considered.
8. Interior separation walls are required to be of two-hour fire-resistive
construction.
9. Please submit boiler specifications and specifications on the fire separation
wall separating the boiler room and the other rooms in the building.
10. The front page (cover sheet) of the construction drawings shall contain, at a
minimum, the professional stamp with an oriQinal dated signature. This cover
sheet shall include the building address, legal description and index of pages
being submitted under the professional stamp.

interest into the separate property of each.

Since January l, 1975 the partners have transacted business

eAPITAL ACCOUNTS DRAWING ACCOUNT
A. Capital accounts. A capital account shall be main-
tained for each partner. The capital interest of each partnez
shall consist of his original contribution increased by (1) his
additional contributions to capital and (2) his share of partner-
shig profits transferred to capital, and decreased by (1) distri-
butions to him in reduction of his partnership capital and (2) hi.s
share of partnexship losses, if transferXed from his drawing
account.
B. prawincj_accounts. An individua1 drawing account
should be maintained for each partner. Each partner's withdrawals
and share of profits and losses shall be credited or charged to
his drawing account.

three partners sha11 be required and sufficient to bind the

Article VII.
COMPENSATION TO PAR'I'NERS
Gurrently large amounts of personal service are not
required in the conduct of the partnership business. However, as
the partnership develops its business furthez, partners may render
services.
LARRY D. McCORMICK may be active in contracting to erect
improvements on partnership real praperty. LARRY W. McCORMICK and
JOHN H. McCORrixCK may become active in managing newly erected
improvements. Possibly BONNIE J. McCORMICK and BETH L4UISE McCORMICK may render services of some variety in the future. To
the extent any partners render services they shall be compensated
- at the same level of fees, salaries, or wages which would be paid
to independent contractors, managers, or persons rendering similar
services in the Spokane area. Compensation will be determined not
only with respect to the amount of time spent but a1.so with respect
to the imagination, expertise, experience and extraordinary skill
and effort which the respective partner contributes and which .
qualities contribute to the appreciation in the val.ue of the
partnership business and properties.

DEATH OR WITHDRAWAL 4F A PARTNER
Except as provided in a separate cross-purchase agree-
ment, if a partner dies, becomes incapacitated, withdraws, or
becomes bankrupt, the partnership shall dissolve, and then con-
duct only activities necessary to wind up its affairs and liquidate.
However, it the remainder of the partners so vote, the partneXShip
shall not be dissolved but the interest of the withdrawing partner
shall be purchased pursuant to the separate purchase agreement.
No party shall sell, give, alienate, or borrow against
his partnership interest without complying with the terms of the
partnership buy-sell agreement.
Article IX.
VOLUNTARY DISSQLUTI4N
A. Windinq up the partnershiE. On any voluntary dis-
solution, the partnership shall immediately begin to wind up its
affairs. The partners shall caritinue to share profits and lasses
during the peziod of liquidation in the same proportions as
before dissolution. The proceeds from liquidation of the partner-
ship assets shall be appla.ed as follows:
1. Payment t:o creditors of the partnership, other .
than partners, in the order of priority provided by law.
2. Payment to partners for unpaid salaxies and for
the credit balances in their drawing accounts.
3. Payment to partners of their credit balances
and capital accounts. B. Gains or losses in process of liquidation. Any gain
or loss on disposition of partnership property and liquidation
shall be credited oz charged ta the partners in the proportions of
their interests in profits or losses as specified in Article IV•
Any property distributed in kind in liquidation shall be valueu
and computed as though the property were sold and the cash proceeds

1. Au- pollution regularions require that dust emisszons during demolition, construcrion
and excavation projects be co►ltrolled. This may require use of water sprays, larps,
spnnk]ers or suspension of activity during cei-tain weathez- conditions. Haul roads
sho«ld be treated, and emissions from thc nansfer of eai-then matenal must be
controlled, as well as emissions from all other construction-related activities.

2. Measures must be taken to avoid the deposition of dirt and mud fYOm unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
3. SCAPCA Reguladon I, Article V, requires that a Notice of Construction and
Applicafion for Approval be submitted to and approved by our agency prior to the
construction, installatiorl or establishment of an air pollution source.
4. SCAPCA Regulation 1, Article VI, and SCAPCA Regulation II, Article N, address
enaission standards. All emission standards must be met.
5. Debris generated as a result of t1is project must be ciisposed of by means other than
burning.

pernvt is required.
