the fallowing comments:
1. Submit a copy of the recorded property deed for the dedication of SO' of R1W an
Evergreen.
2. Road p1ans for Mamer Road m-List be subrnitted and approved prior ta release of the
permit. A financial surety rnust be pQsted for these irnprovements.
I 3. Provide a drainage basin map. ;fnclude all roflf areas in this map.
4. Prvvide $owstring calculations for a11 drainage basins.

FINDINGS OI' rACT, CONCLUSIONS AND ORDER
INTRODUCTION -
This matter has come before the Hearing Examiner Committee on November 16,
. 1995. The members of the Committee present are: Brenda Bodenstein, Chair,
Toni Nersesian and Harry Gibbons.
PROPOSAL
The sponsor, Richard Adams, requests approval of a Zone Reclassification,
ZE-41-95, from Urban Residential-3.5 (UR-3.5) to Urban Residential-22 (UR-22)
for a 72 unit retirement center and those uses allowed in the Urban Residential-22
(UR-22) zone.
FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located between Mamer Road and Evergreen Road, lying north of Boone Street (extended) in the NE 1/4 of Section 15, Township 25 North,
Range 44 EWM, Spokane County, Washington.
2. The Committee adopts the Planning Department Report as a part of this record. 3. The existing land uses in the area include single family, multi family and office -uses.
4. The proposed use is compatible with existing uses in the area. 5. The Comprehensive Plan category of the subject property is Urban. The Urban (U)
category is intended to provide the opportunity for development of a"city-like"
. environment which includes various land uses, intensive residential development and
public facilities and services. Residential net densities are suggested to range from 1 to
22 dwelling units per acre in the Urban category. The proposed density of '12.83 dwelling units/acre is consistent with the density range suggested by the Urban
Category. The proposal is consistent with the Goals, Objectives and Decision ,
Guidelines of the Urban category.
6. The proposed zoning does implement and conform to the Comprehensive Plan.
7. The proposal is located adjacent to Evergreen Road on the east and Mamer Road on the
west. Evergreen Road is designated as a Principal Arterial on the Spokane County
Arterial Road Plan. To implement the Arterial Road Plan the County Engineer is
requesting dedication of 50 feet of additional right of way adjacent to Evergreen Road. 8. The existing zoning of the property described in the application is Urban
Residential-3.5 (UR-3.5) established in 1991, previously established as
Agricultural (A) in 1956 (112-56) and- redesignated to Urban Residential-3.5

(UR-3.5) on January 1, 1991 pursuant to the Program to Implement the Spokane -
County Zoning Code. The proposal does conform to ihe requirements of the
proposcd zone.
9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance (DNS) was issued. The
Committee, after independent review, hereby adopts the DNS.
10. The legal requirements for public notice have been fu1fi11ed.
11. The owners of adjacent lands expressed disapproval of the proposed use.
Concerns expressed included traffic congestion, density and inadequate parking.
12. The applicant has demonstrated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified. Specifically, changed conditions include transition toward increased multi
family uses in the area and plans for an I-90 - Evergreen Road interchange.
13. The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in light of the condidons recommended by the reviewing
agencies.
14. The Cominittee additionally finds/concludes:
a. The applicant agrees with and accepts all recommended conditions of -
approval.
b. Concerns of area residents were adequately addressed by recommended
conditions of approval including restrictions to densiry and limitation of
building height to 22 feet.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. AIl Conditions imposed by the Hearing Examiner Committee shall be binding on .
the "Applicant," which term shall include the owner or owners of the property,
heirs, assigns, and successors-in-interest.
2. The Zone Reclassification and Conditions of Approval apply to the real property described below;
The North haif of Tract 101 of Vera, as per plat recorded in Book "O" of Plats, page
- 30, in Spokane County, Washington; EXCEPT the North 100 feet of the W 1/2 of said N 1\2; ALSO EXCEPT the East 25 feet thereof; TOGETHER WTTH the North 150 feet af the South 1/2 of said Tract 101 of VERA; ALSO EXCEPT the East 25 feet
thereof.

SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING
1. The proposal shall comply with the Urban Residential-22 (UR-22) zone, as
amended. - '
2. The Division of Building and Planning shall prepare and record with the Spokane-
County Auditor a Title Notice noting that the property in question is subject to a
variecy of special conditions imposed as a result of approval of a land use action.
This Title Notice shall serve as public notice of the conditions of approval affecting
the property in question. The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Division of Building and Planning. The Title Notice shall generally provide as
follows: The parcel of property legally described as [ ] is the
subject of a land use action by a Spokane County Hearing Body or
Administrative Official on [ imposing a variety of special
development conditions. File No. [ ] is available for
inspection and copying in the Spokane County Division of Building
and Planning.
3. The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be informed of code requirements administeredlenforced as authorized
by the State Building Code Act. Design/development concerns include: Addressing,
fire apparatus access roads, fire hydranVflow, approved water systems, building
accessibility, construction type, occupancy classification, exiting, exterior wall protection, and energy code regulations. (Note: The Division of Building and
Planning reserves the right to confirm the actual address at the time of building permit.)
4. The applicant shall develop subject property in strict conformance with the site plan
presented to the Hearing Body on November 16, 1995. All aspects of the concept
and proposal shall be binding on the development, including proposed use.
Variations, to be approved by the Planning Director/designee, shall only be allowed
to meet regulation standards and conditions of approval. Any other modification -
must be presented to the Hearing Body for review and approval.
5. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building pernuts.
6. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or.
impaired.
7. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.

SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior to issuance of a buildine nermit or at the rcQuest of thc Countv EnQineer in conjunction
with a Countv Road ProiecVRoad ImArovement District. whichever action comes first:
1. Applicanc shall dedicate 50 feet on Evergreen Road for right-of-way.
Prior to release of a buildinQ oermit or use of the propertv as arooosed:
2. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
3. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans. 4. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupaed or traveled by vehicles.
5. To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be willing to participate in any .
petition or resolution which purpose is the formation of a Road Improvement
District (RID) for said improvement, pursuant to RCW 36.88, as amended. .
Spokane County will not participate in the cost of these improvements. This is
applicable to Evergreen Road.
6. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road _
improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required improvement. Spokane County will not
participate in the cost of these improvements. This is applicable to Evergreen -
Road.
7. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
8. The County Engineer has designated a Special Roadway Section 5 Lane Principal
Arterial standard for the improvement of Evergreen Road, which is adjacent.to the
proposed development. This will require the addition of varying amounts of .
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required.
9. The County Engineer has designated Typical Roadway Section Local Access standard for the improvement of Mamer Road, which is adjacent to the proposed development. This will require the addition of approximately 4- 6 feet of asphalt
along the frontage of the development. The construction of curbing and sidewalk is also required.
10. A!1 required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards andlor adopted resolutions pertaining to Road Standards and

Stornzwater Management in eFfect at the date of construction, unless otherwise
approved by the County Engineer.
11. Applicant shall construct a paved and delineated approach(es) to meet the existing
pavement on Evergreen Road.
12. Roadway standards, typical roadway sections and drainage Plan requirements are
found in Spokane Board of County Commissioners Resolution No. 95-0498 as.
amended and are applicable to this proposal. -
13. o No construction work shall be performed within the existing or proposed public
. right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
14. All required construction within the existing or proposed public right-of-way is to
be completed prior to the release of a building permit, or a bond in an amount
estimated by the County Engineer to cover the cost of constcvction of improvements
shall be filed with the County Engineer.
15. Applicant shall sign and record Spokane County Notice to the Public No. 6 which
specifies the following:
The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement District (RID) by
the petition method pursuant to Chapter 36.88 RCW, which petition includes the
owner(s) property, and further not to object, by the signing of a ballot, the
formation of a RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s) property. If an RID is formed by either the
petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s) .
or successor(s) further agree:
(a) that the improvement or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the formation of the RID by the property .
included therein, together with the amount of any County participation,
exceeds the cost and expense of formation of the RID; and '
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment on the property as a
- result of the improvements called for in conjunction with the formation of the RID
by either petition or resolution method under Chapter 36.88 RCW.
This requirement applies to Evergreen Road, from which the subject parcel takes
access.
16. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicaced or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to determine whether applicant(s) or

• • . . • - the utility is responsihle for adjustment or relocation costs and to make
arrancements for any necessary work.
17. The applicant shall provide for slope easements along Evergreen Road.
SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane, County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the project and individual service will
be provided to each building. Use of individual on-site sewage disposal systems shall
not be authorized.
5. Use or private wells and water systems is prohibited. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This rnay require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads _
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.
3. SCAPCA strongly recommends that all traveled surfaces (i.e., ingress, egress,
parking areas, access road) be paved and kept clean to minimize dust emissions. 4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces. •
5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e., construction waste, etc.).
6. Demolition and renovation projects must comply with the requirements of CFR 40, Part 61, Subpart M and of SCAPCA Regulation I Article IX, both of which address
asbestos concems. Intent to Demolish and Renovate forms are available at the
SCAPCA office.
7. All solid fuel burning devices (wood stoves, pellet stoves, etc...) must comply with
local, state, and federal rules and regulations.

1. A Covenant Agreement shall be signcd stating: The name(s) on a petition for
the formation of a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to object by signing of a
protest petition against the formation of a ULID by resolution method pursuant
to RCW 36.94 which includes the Owner(s) property. Provided, this condition
shall not prohibit the Owner(s) or Successor(s) from objection to any .
assessment(s) on the properiy as a result of improvements called for in the -
conjunction with the formation of a ULID by either petition or resolution under
.
RCW 36.94.
2. A wet (live) sewer connection to the area-wide Public Sewer System is to be
constructed. Sewer connection permit is required.
3. Applicant is required to sign a Sewer Connection Agreement prior to issuance
of pernlit to connect.
4. Applicant shall submit expressly to Spokane County Utilities Department
"under separate cover" only fhose plan sheets showing sewer plans and
specificacions for: Public Sewer connections for review and approval by the
Utilities Department Prior to issuance of permit to connect.

5. Security shall be deposited with the Utilities Department for construction of
' public sewer connections.
6. Arrangements for payments of additional sewer charges must be made for prior
to issuance of sewer connection pecmit.
7. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
WASHINGTQN STATE DEPARTMENT OF TRANSPORTATION .
1. Based on the proposed 72 unit retirement apartment units, a mitiaation fee of
$20.00 per unit shall be payable to WSDOT prior to issuance of building
permits.
2. Due to the location of this development, if the construction for the proposed
Evergreen Interchange and connection to Evergreen Road south of I-90 is
assured, the fee outline in number one above shall be waived by WSDOT due to
the availability of alternative access.
3. The above SEPA mitigation fees shall be used for WSDOT to construct needed .
improvements on Pines Road (SR-27) in the vicinity of I-90 and Mission
Avenue which will be used directly by the traffic generated by this
development.
4. To ensure that this mitigation is provided for, we request a sign-off block be
included for WSDOT on the building permit.

INTRODUCTION
This matter has come before the Hearing Exaininer Committee on November 16
,
1995. The members of the Comm.ittee present are: Brenda Bodenstein, Chair,
Toni Nersesian and Harry Gibbons.
PROPOSAL
The sponsor, Richard Adams, requests approval of a Zone Reclassification,
ZE-41-95, from Urban Residential-3.5 (UR-3.5) to Urban Residential-22 (UR-22)
for a 72 unit retirement cenCer and those uses allowed in the Urban Residential-22
(UR-22) zone.
FINDINGS OF FACT AND CONCLUSIONS
1. The properry is generally located between Mamer Road and Evergreen Road, lying
north of Boone Street (extendecl) in the NE 1/4 of Section 15, TOwI1Sl11p ZJ NOI-th,
Range 44 EWM, Spokane County, Washington.
2. The Conunittee adopts the Planning Department Report as a part of this record.
3. The existing land uses in the ai-ea include single family, multi family and office
uses.
4. The proposed use is compatible with existing uses in the ai-ea.
5. The Comprehensive Plan categoq of the subject propei-ty is Urban. The Urban (U)
category is intended to provide the opportuniry for development of a"city-like"
environment which includes various land uses, intensive residential development and
public facilities and seivices. FZesidential net densities are suggested to range from 1 to
22 dwelling units per acre in the Urban category. The proposed density of 12.83
dwelling units/acre is consistent with the density range suggcsted by the Urban
Category. The proposal is consistent with the Goals, Objectives and Decision
Guidelines of the Urban category.
6. The proposed zoning does implement and conform to the Comprehensive Plan.
7. The proposal is located adjacent to Evergreen Road on the east and Mamer Road on the
west. Evergreen Road is designated as a Principal Arterial on the Spokane County
Arterial Road Plan. To implement the Arterial Road Plan the County Engineer is
requesting dedication of 50 feet of additional right of way adjacent to Evergreen Road.
8. The existing zoning of the property described in the application is Urban
Residential-3.5 (UR-3.5) established in 1991, previously established as
Agricultural (A) in 1956 (112-56) and redesignated to Urban Residential-3.5

. (UR-3.5) on January l, 1991 pursuant to the Program to Implement the Spokane
• County Zoning Code. The proposal does conform to the requirements of the
proposcd zone.
9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Determ.ination of Nonsignificance (DNS) was issued. The
Corrunittee, after independent review, hereby adopts the DNS.
10. The legal requirements for public notice have been fulfilled.
11. The owners of adjacent lands expressed disapproval of the proposed use.
Concerns expressed included traffic congestion, densiry and inadequate parking.
12. The applicant has demonstrated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified. Specifically, changed conditions include transition toward increased multi
family uses in the area and plans for an I-90 - Evergreen Road interchange.
13. The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing
agencies.
14. The Committee additionally finds/concludes:
a. The applicant agrees with and accepts all recommended conditions of
approval.
b. Concerns of area residents were adequately addressed by recommended
conditions of approval including restrictions to density and limitation of
building height to 22 feet.
C4NDITIONS OR C4NTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Exam.iner Committee sha11 be binding on
the "Applicant," which term shall include the owner or owners of the property,
heirs, assigns, and successors-in-interest.
2. The Zone Reclassification and Conditions of Approval apply to the real property
described below:
The North half of Tract 101 of Vera, as per plat recorded in Book "O" of Plats, page
30, in Spokane County, Washington; EXCEPT the North 100 feet of the W 1!2 of said
N 1\2; ALS O EXCEPT the East 25 feet thereof; TOGETHER WITH the North 150
feet of the South 1/2 of said Tract 101 of VERA; ALSO EXCEFT the East 25 feet
thereof.

SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING
1. The proposal shall comply with the Urbaii Residential-22 (UR-22) zone, as
amended.
2. The Division of Building and Planning shall prepare and record with the Spokane
Counry Auditor a Title Notice noting that the property in question is subject to a
variety of special conditions imposed as a result of approval of a land use action.
This Title Notice shall serve as public notice of the conditions of approval affecting
the property in question. The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Division of Building and Planning. The Title Notice shall generally provide as
follows:
The parcel of property legally described as [ ] is the
subject of a land use action by a Spokane County Hearing Body or
Administrative Official on [ imposing avariety of special
development conditions. File No. [ ] is available for
inspection and copying in the Spokane County Division oF Building
and Flanning.
3. The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be infom-ied of code requirements administeredlenforced as authorized
by the State Building Code Act. Designldevelopment concerns include: Addressirlg,
fire apparatus access roads, fire hydrant/flow, approved water systems, building
accessibility, construction type, occupancy classification, exiting; exterior wall
protection, and energy code regulations. (Note: The Division of Building and
Planning reserves the right to confirm the actual address at the time of building permit.)
4. The applicant shall develop subject property in strict conformance with the site plan
presented to the Hearing Body on November 16, 1995. All aspects of the concept
and proposal shall be binding on the development, including proposed use.
Variations, to be approved by the Planning Director/designee, shall only be allowed
to meet regulation standards and conditions of approval. Any other modification
must be presented to the Hcaring Body for review and approval.
5. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.
6. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
impaired.
7. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.

Spokane County Engineer.
3. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
4. A parl:ing plan aild traffic circulation plan shall be submatted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion -of
the project which is to be occupied or traveled by vehicles.
5. To construct the roadway improvements stated herein, thc applicant may, wich the
approval of the County Engineer, join in and be willing to pat-ticipate in any
petition or i-esolution which puc-pose is the formation of a Road Improvement
District (RID) for said improvement, pursuant to RCW 36.8$, as amended.
Spokane County will not participate in the cost of these improvements. This is
applicable to Evergreen Road.
6. As an altei-native method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish thc road
improvements stated herein by joining and pai-ticipating in a County Road Project
(CRP) to the extent of the required improvement. Spokane County will not
participate in the cost of these improvements. This is applicable to Evergreen
Road.
7. The constitiiction of the road improvements stated hei-eiii shall be accomplished as
1pproved by the Spokane County Engineer.
8. The County Engineer has designated a Special Roadway Section 5 Lane Principa]
Arterial standard for the improvement of Evergreen Road, which is adjacent to the
proposed development. This will require the addition of varying amounts of
asphalt along the frontage of the developmenC. The construction of curbing and
sidewalk is also required.
9. The County Engineer has designated Typical Roadway Section Local Access
standard for the improvement of Mamer Road, which is adjacent to the proposed
development. This will require the addition of approximately 4- 6 feet of asphalt
along the frontage of the development. The construction of curbing and sidewalk is
also required.
10. All required improvEments shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and

pavement on Evergrcen Road.
12. Roatiway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 95-0498 as
amendcd and are applicable to this proposal. -
13. No construction work shall be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
14. All required construction within Che existing or proposed public right-of-way is to
be completed prior to the releasE of a building permit, or a bond in an arnount
estimated by the County Engineer to cower the cost of construction of improvemenes
shall be filed with the County Engineer.
15. Applicant shall sign and record Spokane County Notice to the Public No. 6 whieh
specifies the following:
The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the fornlztion of a Road Improvement District (RID) by
the petition method pursuant to Chapter 36.88 FZCW, which petition includes the
owner(s) property, and further not to object, by the signincy of a ballot, the
formation of a RID by the resolution method pursuant to Chaptcr 36.8$ RCW,
«►hich resolution includes the owner(s) property. If an RID is formed by either the
petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree:
(a) that the improvement or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the foi-ination of thc RID by the property
included therein, together with the amount of atiy County pai-ticipation,
cxceeds the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) sha11 retain the right, as
authorized under RCW 36.88.090, to object to any assessment on the property as a
result of rhe iinprovements called for in conjunction with the formation of the RID
by either petition or resolution meChod under Chapter 36.88 RCNN'.
This requirement applies to Evergreen Road, from which the subject parcel takes
acCeSS.
16. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for fueure acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to detennine whether applicant(s) or

. • the utility is responsible for adjustment or relocation costs and to make
' arrangements for any necessary work.
17. The applicant shall provide for slope easements along Evergreen Road.
SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane, County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the project and individual service will
be provided to each building. Use of individual on-site sewage disposal systems shall
not be authorized.
5. Use or private wells and water systems is prohibited.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.
3. SCAPCA strongly recommends that all traveled surfaces (i.e., ingress, egress,
parking areas, access road) be paved and kept clean to minimize dust emissions.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e., construction waste, etc.).
6. Demolition and renovation projects must comply with the requirements of CFR 40,
. Part 61, Subpart M and of SCAPCA Regulation I Article IX, both of which address
asbestos concerns. Intent to Demolish and Renovate forms are available at the
SCAPCA office.
7. All solid fuel burning devices (wood stoves, pellet stoves, etc...) must comply with
local, state, and federal rules and regulations.

canstructed. Sewer connecrion permit is required.
3. Applicant is required to sign a Sewer Connection Agreement prior to issuance
of pernut to connect.
4. Applicant shall submit expressly to Spokane CounCy Utilities Department
"under separate cover" only those plan sheets showing sewer plans and
specifications for: Public Sewer connections for review and approval by the Utilities Department Prior to issuance of penzut to connect.
5. Security shall be dEposited with the Utilities Department for construction of
public sewer connections.
6. Arrangements for payments of additional sewer charges must be made for prior
to issuance of sewer connection permit.
7. Any water service for t11is project shall be provided in accordance with the
CoordinatEd Water System Plan for Spokane County, as amended.
WASHINGTON STATE DFPA►RTIIZENT OF 1,RANSPORTATION
1. Based on the proposed 72 uniC rctirement apartment units, a nutigation fee of
$20.0 0 per unit shall be payable to WSDOT prior to issuance of building
permits.
2. Due to the location of this dEVelopment, if the constniction for the proposed
Evergreen Interchange and connection to Evergreen Road south of I-90 is
assured, the fee outline in number one above shall be waived by WSDOT due to
the availability of alternative access.
3. The above SEPA m.itigation fees shall be used for WSDOT to construct needed
improvements on Pines Road (SR-27) in the vicinity of I-90 and Mission
Avenue which will be used directly by the traffic generated by this
development.
4. To ensure that this mitigation is provided for, we request a sign-off block be
included for WSDOT on the building pernvt.
