SPECIAL PROVISIONS FOR HIGHWAY ENCROACHVIENTS
Culvert pipc shall not be required undcr the proposed approach.
Drainage shall be providcd away from the roadway by continuing the existing
shoulder slope of approximately one-half inch to one foot to a line at least 15' from
the curb. During the construction and/or maintenance of this facility, the Grantee shall
comply with the "Manual on Uniform Traffic Control Devices for Streets and
Highways". Highway traffic shall bc protected by flaggers whenever any portion of the
traveled surface is obstructed by equipment working on this project. .
As stated in Chapter 47.32.120 RCW, "It is unlawful to erect a structure or
establishment or maintain a business, the nature of which requires the use by -
patrons or customers of property adjoining the structure or establishment unless the
structure or establishment is located at a distance ' from the right of way of any state
highway so that nonc of the right of way thereof is required for the use of the
patrons or customers of the estabiishment".
Relative to advertising adjacent to all State highways, we wish to call your attention
to the Scenic Vistas Act of 1971, •Chapter 47.42 RCW and State Transportation
Commission ruling Chapter 468-66WAC. Violation of this section of the statutes will
be sufficient cause for cancellation of this permit. On premise signs are allowed.
Grantec shall comply with county building codcs. Set-back requircments for the
location of buildings in relation to the right of way line are a function of local
authorities and they should be consulted regarding requirements that must be
adhered to. ,

Gerieral Provisions
1. The Grantee, its successors and assigns, agrees to protect the State of Washington, its officers and employees and save them harmless from
all claims, actions or damages of every kind and description which may accrue to or be suffered by any person, persons, or property by reason
of the acts or omissions of the Grantee, its assigns, agents, conVactors, licensees, employees or any person whomsoever, in connection with
Grantee's, its assigns', agents', contractors', licensees' or employees' construction, installation, maintenance, operation, use or occupancy of the
right of way or in the exercise of this permit. In case any suit or action is brought against the State of Washington, its officers and employees,
arising out of or by reason of any of tfie above causes, the Grantee, its sucoessors or assigns will, upon notice of such action, defend the same
at its sole cost and expense and satisfy any judgement against the State of Washington, its officers, or employees: PROVIDED, that if the claims
or damages are caused by or result from the ooncurrent negligence of (a) the State of Washington's agents or employees and (b) the Grantee
or Grantee's agents or employees,`this indemniry provision shall be valid and enforceable only to the extent of the negligence of the Grantee or
the Grantee's agents or employees. .
The Grantee, and on behalf of its assigns, agents, licensees, contractors and employees agrees to waive any daims for losses, expenses,
damages or lost revenues incurred by it or its agents, contractors, licensees, employees or customers in connection with Grantee's, its assigns',
agents', contractors', licensees' or employees' construction, installadon, maintenance, operation, use or occupancy of the right of way or in the
exerase of diis permit against the State of Washington, its agents or employees except the reasonable costs of repair to property resulting from
the negligent injury or damage to Grantee's property by the State of Washington, its agents, contractors or employees.
2. During the progress of the work, such barriers shall be erected and maintained as may be necessary or as may be directed for the protection of
the traveling public; the barriers shall be properly lighted at night.
3. Except as herein authorized, no excavation shall be made or obstacle placed within the limits of the State highway in such a manner as to interfere
with the travel over said road.
4. If the work done under this permit interferes in any way with the drainage of the State highway, the Grantee shall wholly and at its own expense
make such provision as the Department may direct to take care of said drainage.
5. On completion of said wor{c herein contemplated, all rubbish and debris shall be immediately removed and the roadway and roadside shall be
left neat and presentable and satisfactory to the Department.
6. All of the work herein contemplated shall be done under the supervision and to the satisfaction of the Department, and the entire expense of said
supervision shall be borne by the party or parties to whom this permit is issued.
7. The Department hereby reserves the right to order the change of location or the removal of any structure or structures authorized by this permit
at any time, said change or removal to be made at the sole expense of the party or parties to whom this permit is issued, or their successors and
assigns.
8. All such changes, reconstruction, or relocation by the Grantee shall be done in such manner as will cause the least interference with any of the
DepartmenYs work, and the Department shall in no wise be held liable for any damage to the Grantee by reason of any such work by the
Department, its agents or representatives, or by the exercise of any rights by the Department upon roads, streets, public places, or structures
in question.
9. This permit or privilege shall not be deemed or held to be an exclusive one aod shall not prohibit the Department from granting other permits or
franchise rights of like or other nature to other public or private companies or individuals, nor shall it prevent tfie Department from using any of
its roads, streets, or public places, or affect its right to full supervision and control over all or any part of them, none of which is hereby surrendered.
10. The Department may revoke, amend, or cancel this permit or any of the provisions thereof at any time by giving written notice to the Grantee.
The Grantee shall immediately remove all facilities from the right of way. Any facilities remaining upon the right of way 30 days after written notice
of canoellation shall be removed by the Department at the expense of the Grantee.
11 . The party or parties to whom this permit is issued shall maintain at its or their sole expense the structure or object for which this permit is granted
in a condition satisfactory to the Department.
12. Any breach of any of the conditions and requirements herein made, or failure on the part of the Grantee of this permit to proceed with due diligence
and in good faith after its acceptance, with construction work hereunder, shall subject this permit to cancellation as herein provided.
13. This permit is subject to all applicable provisions of Chapter 47.32 RCW and/or Chapter 47.44 RCW and amendments thereto.
15. The Grantee hereby certifies that the facilities described in this permit are in aompliance with the Control Zone Guidelines.

The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a'roof containing HVAC machinery, a drainage plan for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale. .
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
, Order" and the "Conditions of Approval" for the following
land use action:
1. Spokane County-Zone Change No. ZE-32-91
2. Final Plat PE 1309-79
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:

SCOPE/PROJF.CT DESCRIP'TION:
I. General Overview - The owner, Northwest Restaurant Group Inc., is proposing to
construct a new 1,250 square foot building for a Pizza Hut. Proposed will be a one story
wood frame slab on grade building. There will be no seating provided for customers, as the
business will be for carry out/delivery only. Proposed will be provided with 25 parlcing
spaces. There will be 3 approaches, of which 2 are existing.

I. Planning Department (456-2205)
A. Discussion/Requirements
1. The progosed is located in a B-2 zone. The proposed use is allowed in the
zone.
2. The proposed is located on parcel number 22543-2407.
3. 24 parking spaces are required for the proposed. The 25 parking spaces
indicated on the site plan are adequate.
4. The setbacks indicated on the site plan are adequate.
; 5. Please submit an.estimate from a nursery including size, type, arid.quantity of
landscaping, itemized cost of the - irrigation system, and the cost of labor along with a promissory letter from the owner stating the landscaping will be installed.

A 20 foot wide strip of Type I landscaping is required along the east property
line. A 5 foot wide strip of Type III landscaping is required along the county
right of way.
6. Progosed must comply with the requirement of Zone Change No. ZE-32-91.
7. Please submit a signage plan for any proposed signs indicating height and
dimensions of the signs. Applicant can accomplish this by noting the height and
dimensions of the signs on the site plan.
8. Please submit a lighting plan for the proposed indicating location, direction,
and illumination of the lights, including a footprint of the illumination, as light
may not shine on any adjacent property.
9. Fencing must be provided on the east and south boundaries of the property.
B. Permit Release Requirements
1. An estimate from a nursery including size, type, and quantity of landscaping
along with a promissory letter from the owner stating the landscaping will be
installed shall be submitted.
2. Please submit a revised site plan illustrating the correct boundaries of the
parcel, landscaping, signs, lighting, fencing, and setbacks for review and
approval.
II. Division of Engineering & Roads (456-3600)
A. Discussion/Requirements
1. Cornments were given to the applicant and the Department of Buildings by

2. Please submit a drainage plan for the site that is in compliance with Spokane
County Guidelines for Stormwater Management.
' 3. Please obtain an approach permit for the new approach off of 12th Avenue.
4. Please clarify if proposed will be accessing the property to the south. If so, a
reciprocal agreement must be obtained to travel between the two properties. If
no access will be made between the two properties, then the two need to be
separated by a fence or a curb.
5. An Agreement to Pay Fees was given to the applicant during the meeting.
The agreement is to be signed by the owner and returned to the Division of
Engineering & Roads. Plan review will not be completed until this document is
executed.
B. Permit Release Requirements

A. Discussion/Requirements
1. Proposed must connect the the existing sewer, which is stubbed to the
property. Please contact Billy Urhausen (456-3604) for the sewer stub location.
B. Permit Release Requirements
1. The Division of Utilities is ready to release their portion of the building
permit.
IV. Health District (456-6040)
A. Discussion/Requirements
1. The water purveyor for the proposed is Modern Electric Water Company
(456-8000). Please contact the water purveyor to review requirements for back
flow preventers.
2. Proposed must connect to the available sewer.
3. Please submit a critical materials list to the Department of Buildings for
review.
3. All construction debris shall be taken to a licensed landfill.
4. No on-site burning or burial of debris will be allowed.
5. A cesspooUseptic tank may still be located on the property. If the tank is
located, please properly abandon it.
6. Please submit a menu for review.
7. The drain in the dumpster pad must be plumbed to a 208 swale and must
contain a basket strainer.
8. A hot and cold freeze proof mixing valve must be provided in the dumpster
area.
B. Permit Release Requirements
1. PYease submit a menu for review.
2. Please indicate the plumbing to a 208 swale and the hot and cold mixing
valve for the dumpster pad area on the site plan.
V. Fire District No. 1(928-2462) _
A. Discussion/Requirements ~
` 1. The one existing fire -hydrant meets the minimum requirements: -

. 2. A lock (Knox) box entry system for fire department personnel access is required to be installed. Forms for ordering are available from the fire district.
The box sha11 be installed prior to occupancy.
VI. Department of Buildings (456-3675)
A. Discussion/Requirements
1. Plan review has been completed on the submitted plans and a letter will be
sent to the architect by Jun Mascardo. A copy was given to the builder at the
conference.
2. Please submit a soil test report on the disturbed earth (fill) over the old
basement for review and determination of the need for compaction tests. If
compaction tests are required, they must be done by an approved testing labora-
tory.
3. The proposed shall meet the minimum requirement of the Regulations for
Barrier-Free Facilities. A minimum of one handicap parking space is required,
and it must be located adjacent to the building, with no travel through vehicle or
traffic areas. Please make necessary changes on site plan.
4. Please indicate on the foundation plan that the perimeter insulation extend to
the top of the slab or that an expansion joint is proposed.
5. Signs must be provided for on the main exit staang: "This door to remain
unlocked during business hours".
6. Please submit an updated critical materials list for review.
7. Please submit shop drawings for the truss diagrams for review and approval.

INTRODUCTION . ,
This matter has come before the Hearing Examiner Committee on September 19, 1991. The members of the Committee present are B ud Skadan, Chairperson, Phil
Harris and Verona Southern.
PROPOSAL
. The sponsor, Pizza Hut Restaurants, Inc., requests approval of a Zone Reclassification
ZE-32-91, from Urban Residential-22 (UR-22) to Community Business (B-2).
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located at the southeast corner of Pines Road and 12th
Avenue, east of and adjacent to Pines Road and south of and adjacent to 12th Avenue
in Section 22, Township 25 N., Range 44 EWM, Spokane County, Washingtoil.
2. The committee adopts the Planning Deparnnent Report as a part of this record.
, 3.The existing land use(s) in the area are commercial and office.
4. The Comprehensive Plan designates this site as Major Commercia].. This category is
for the purpose of commercial uses.
5. The existing zoning of the propez-ty described in the application is Urban Residential-
22 (UR-22), previously established in 1991. 6. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance was issued.
7. The legal requirements for public notice have been ful.filled. _
8. One owner of adj acent property was present at the public hearing.
9. The proposed use is compatible with existing uses in the area. .
10. The proposed zoning does implement and conform to the Comprehensive Plan.
11. Condirions have substantially changed since the original zoning of this area and
accordingly, the proposed zone reclassificarion is justified.
12. The proposed use will, not be detrimental to the public health, safety, morals or
welfare.

. 13. T'he subdivision proposal is generally consistent with RCW 5_8.17 and the Counry subdivision regulations, promoting the public health, safety and general welfare in
- accordance with standards established by the state and Spokane County.
14. The neighbor adjacent to the east requested that additional buffering be required such
as a fence to reduce impacts to her si.ngle family residence, to reduce noise and light.
15. The Cornmittee add.itionally finds/conciudes:
a. The proposal is supported by the Comprehensive Plan and surrounding uses. ,
b. That a fence shall be required to help reduce light and noise as generated by the

CONDITIONS OR CONTINGENCIES APPLLED TO THIS APPROVAL
1. All Cond.itions imposed by the Hearing Examiner Committee shall be bi.nding on the
"Applicant," which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Conditions of Approval apply to the real property described below:

1. A fence is required along the east property line to be six feet in height as al.lowed by
• the Zoning Cod.e. This fence shall be a site obscuring solid fence. After three years

the project. -

1. The proposal shall comply with the Communiry Business (B-2) zone as amended.
2. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variarions, when approved by the
. Planning Director/designee, may be pennitted, including, but not limited to builcling
location, landscape plans and general allowable uses of the pernutted zone. All .
variations must conform to regulations set forth i.n the Spokane County Z,oning
Ord.inance, and the original intent of the development plans shall.be maintained.
3. Approval is required by the Planning Director/designee of a specific lighting and

4. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a performance

1. Sewage disposal method shall be as authorized by the Duector of Utilities, Spokane County. - 2. Water service shall be coord.inated through the Director of Utilities, Spokane

3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. A public sewer system will be made ava.ilable for the plat/project, and individual
service will be provided to each lot/tract prior to sa1e. Use of individual on-site

6. The applicant shall contact the food Program Coord.inator at the Spokane County

SPOKANE COUNTY AIR POLLUTIOrI CONTROL AUTHORITY ,
1. All air pollution regulations must be met. This includes but is not limited to the
following:
2. Air pollution regulations require that dust emissions during demolition, construction
and excavarion projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather condirions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construcrion-related activities.
3. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
4. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.
5. Debris generated as a result of this project must be disposed of by means other than
burning.
WA STATE DEPARTMENT OF'TRANSPORTATION CONDITIONS
1. Only one access poirit onto/from SR-27 shall be uti.l.i.zed to access the proposed
development-
2. The proposed access point shall be approvetl by our Maintenance Superintendent in
