AMENDMENT TO SUMMARY OF DEPARTMENTAL REQUIREMENTS:

"30' setback required on Cataldo; 25' setback required on Robie. "
ADDITIONAL COMMENT:
This setback would be required only if Robie Road was to become a private road
access easement. If the additional 25 feet of right of way is dedicated as per the
County Engineer's condition of approval for this building permit, the underlying zone
would determine the applicable setbacks. The UR-22 zone requires either a 25 foot
setback from the property line -OR- 55 feet from the centerline of the road right of
way, whichever provides the greater setback. In this case, the appropriate setback
would be 55 feet from the centerline of Robie Road after the additional right of way
dedication.

The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
l. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by.the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Spokane County Zone Change No. ZE-116-78
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. Robie: There are various options for Robie
that include the following:
1. The ex.isting 25 feet of right of way for
Robie could be vacated. This action would have to be initiated by
the apartment complex since they originally dedicated the right
of way. This option would then allow both the Elderly Care
facility and the apartment complex to install private roads
(minimum separation between private roads is 7 feet).

2. The Elderly Care facility would dedicate
the required right of way and construct a minimum 20 feet of
paving. This option would require a Notice To The Public No. 4,
which allows a private road in a public right of way and
relinquishes Spokane County of responsibility to maintain the
road.
3. The third option is for Robie to be
constructed to full County standards. This would require 30 feet
of paving, curb and sidewalk.
b. Cataldo, Typical Roadway Section No. 2, Access
Standard.
All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or imprvvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.
2. Applicant shall dedicate a 20 foot radius on the
northeast corner of Robie and Cataldo and 25 feet
of right of way dedication on Robie.
3. Please submit a copy of a recorded property deed
from the Auditors office for the subject property.
Upon receipt of the deed our staff will prepare the
right of way deed.
4. Approach permits mu'st be obtained, after a site
plan has been approved, and before the issuance of
a building permit, from the County Engineering
Department for any new or improved driveway
approaches to the following streets:
a. Robie
b. Cataldo
D) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Site Plan.
2. Drainage plan as specified.
3. Other information:
a. A parking and traffic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles.

E) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
F) The owner of the property or the authorized
representative must complete and sign Spokane County
' Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
Only after all the information and requirements listed above
are supplied or completed and the necessary review has been
accomplished will your building permit be released.

The motion for approval to adopt the Staff's findings as the Planning
Commission's Findings of Fact as well as the conditions stated in the Staff's
findings, and that a Final Declaration of Non-Significance be issued, was
lost for lack of a quorum vote. In the discussion which followed, it was
brought out that approval of the proposal would be an intrusion into an area
of single famfly residences by permitting apartment houses.(Mrs . Byrne

WHEREAS, The Spokane County Planning Commission did, after public
hearing on September 22, 1978, forward to the Board of County Commissioners a
recommendation that the Zoning Map not be changed from the existing Agricultural
Suburban classification on property described as follows (The motion for approval
wa s lost for lack of a quorum vote.).
The North 400' of the E 1/2 of the E 1/2 of Block. 75 of
Opportunity, EXCEPT the West 65' thereof, together with the E 1/2
of said Block 75, EXCEPT the S 1/2 of said E 1/2 and EXCEPT the North 400' of the E 1/2 of the E 1/2 of said Block 75, EXCEPT the
West 65' of said E 1/2 of the E 1/2 of Block 75, and EXCEPT road,bl
in Section 16, Township 25 N,, Range 44, E, W, M., Spokane County,

~ WHEREAS, The applicant before the Planning Commission, Kenneth C.
Thiemann, did subsequently request a hearing before the Board of County
Commissioners to present evidence and testimony in favor of this application, and
WHEREAS, The Board did hold a public hearing on November 13, 1978,
to consider the recommendation of the Planning Commission and testimony and
evidence of the applicant and other interested parties, and
WHEREAS, At said hearing opportunity was afforded those favoring and
those opposing the above-described zone reclassification, and the Board of County
Commissioners fully considered the testimony given, the records, and the ,
minutes of the Planning Commission and all evidence presented, and having
individually acquainted themselves with the site and vicinity in Question, does
hereby find:
1) The Board has concluded that the property be zoned to Multiple

2) That the Board of County Commissioners upholds the conditions of

This being the time set by the Board of County Commissioners of Spokane
County, 14ashington, to render its decision concerning the request of
Kenneth C. Thiemann, Morth 1210 Argonne Road, Spokane, Wasfiington for the
above captioned zone reclassification; and
The Board having received the recornmendation of the Spokane County
Planning Commission to deny said zone change, said denial set forth in
the Planning Commis-sion's minutes of September 22, 1978; and
The Qoard having conducted its otqn public hearing on yovember 13, 1978,
at the request of the sponsor, Mr. Thiemann, and after visiting the site
and reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to approve this zone chanoe subject to conditions developed
by the Planning Staff.
The Board directed that the sewage treatment system for this project be
situated to facilitate possible future connection, at the property line,
to a general sevrer system if and at such time as one is available for this
area.
The Board after careful revi evi, wi th the County Heal th Di stri ct and the
. County Utilities Department, authorized the Chairman of the 6oard to
sign a Proposed Declaration of PJon-Significance.
Tlie Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent illeeting, setting forth more
definitively the Board's action in this matter.

PROJECT DESCRIPTION
This project involves improvements to a 2.4-acre parcel at the southwest corner of
, Cataldo Avenue and Robie Street (abandoned) in the Spokane valley. The improvements
are to include construction of a 24,000 sq. ft. building with four radial wings, asphalt
parking areas, and landscaping.
The site, which is basically flat, will be regraded to provide pavement grades of one to two
percent, and to direct stormwaLer from the west side of the building around the north and
south wings of the building. Four grassed drainage ponds will be constructed, each with
one drywell. The ponds will be sized to provide "208" treatment to the first 1/2R of water
over the entire asphalt sur.Face and roof area. Hydrology calculations inctude the concrete
areas along with the building roof, asphalt driveways and parking areas as "impervious" surfaces. The rema.inder of the site is regardeci as "pervious" surface, being comprised of
lawn, shrubs and trees.
