The Cotinty Engineering Department has completed a review of
the above referenced project. The followi.ng infortnation must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contai.n:
1. Drainage calculations for storntwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of c3rywe1l inlets where applicable.
8. Copy of the proposed landscape plan.
8) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the follows.ng
land use action:
Spokane County Zone Change No. ZE 27-93
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be preparea by an
engineer. Plans must be prepared €or the following
streets:
a. Sullivan Rd. Typical Roadway Section #1
b. Valley Way. Typical Roadway Section #2
Al1 required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.
2. Applicant shall dedicate 10 feet of right of way on

Valley Way as a Gollector arterial. '3'he existing right-of-way
width af 40 feet is nvt consistent wi+th that specified in the
Plan. In order to implement tYie Arterial Raad P1an, in addition
to the requixed right-af-way dedication~ astrip Qf property 5
feet in width alorig the Valley Way frontage shall be set aside in
reserve. T'his property may be acquired by Spokane County at the
time arter-ia.l improvements are made to Valley Way

for all necessary utility adjustments or relacatien as

COMdENTS

THIS MATTER, being the consideration by the Board of County Commissioners
of Spokane Counry, hereinafter refened to as the "Boani", of aa appeal of the Spokane
County Hearing Examiner Committee decision of August 23, 1993 approving Zone
Reclassificaeon File No. ZE-27-93 for the pwpose of developing an eleven (11) space
manufactured home park on appraximately 2 acres of land, hereinafter referred to as the
"Proposal"; and the Boazd of County Commissioners having held a de navo public hearing
on Uctober 19, 1993, and having fully considered aU testimony presented thereat, and the
public record files for the proposal, and further having individually visited or being famihar
with the site and vicinity in question and having rendered an oral decision on the 26th day
of October 1993 denying the appeal and thereby approving said proposal; dces hereby enter
the following:
FINDINGS OF FACT
1 The proposal is generally located north of and adjacent to Valtey Way,
approximately 200 feet west of Sullivan Road, tin the SE 1/4 of Section 14,
Township 25 North, Range 44 EWM, Spokane County, Washington.
2. The proposal consists of a zone reclassification request fram Urban Residential-3.5
(UR-3.5) and Community Business (B-Z) to Urban Residendal-7 (UR-?) for an
eteven (11) space manufactured home park.
3 The Hearing Examiner Committee held a public hearing on August 19, 1993
subsequent to which by ihe Findings of Fact, Conclusion and Decision dated
Augu.st 23, 1993, the Committee approved the praposal
4. The appellant, Cheryl Trainor, appealed the Hearing Examiner Committee decision
to the Board on August 27, 1993 Issues set forth tn the Noace of Appeal included
compatibility with the neighborhood, increased traffic, devaluation of property
values in the neighborhood, and other issues.
5 The legal requirements for pubtic notice have been fulfilled.
6. At the public hearing, the appellant objected to the pmposal based on
incompanbdity with the neighborhood, traffic impacts, devaluation of property
values in the area and other impacts
7 The Board adopts the Plannmg Department file of ZE-27-93 as part of this record,
as may be modified by this acnon.
8 'The Board takes notice of pmvisions of the Spokane Counry Generalized
Comprehensive Land Use Plan, the Spokane County Zomng Code and the Spokane
County Code
9. The existutg zoning of the property descnbed in the proposal is Urban Residential-3 St
(UR-3.5) and Community Business (B-2), as redesignated by Spokane County on L
January 1, 1991 pursuant to the Program to Irnplement the Spokane Counry Zoning
Code.

10 The proposed density of approximately 5.5 units per acre does not exceed the
maximum density of dwelling units recommended in the Spokane County 7aning
Code

11. The onginal zoning of the property descnbed in the proposal was Agncultural (A)
adopted in 1942 under the Spokane County Zoning Ordinance. The site was
redesignated to Urban Residendal-3 5(UR-3.5) and Community Business (B-2),
pursuant to the Program to Implement the Spokane County Zoning Code
12 The adopted Spokane County Generalized Comprehensive Land Use Plan
designates the area encompasses by the proposal as Urban and Major Commercial
The recommended density range of the Urban categary is 1 and 17 units per acre
As conditioned, the proposa1 is consistent with the Goals, Objectives and Decision
Guidelines of the Comprehensive Plan.
13. The existing land uses in the area of the proposal include single family residences,
duplexes, and commercial uses.
14 The proposal will represent a transitional use between the adjacent commercial
zoning to the east and the existing duplexes and single family residences located
west of the proposal. The proposal also consdtutes "fill-in development" in an area
where public services are ava.ilable
15 Conditions have substantially changed since the original zoning of the site.
Specifically, changed conditions include a Counry Road Project (CRP) along
Sullivan Rosd, the evailability of a public sewer system in the near future, the
designadon of Valley Way as an artenal and mcreased development in the area.
16 The applicant teshfied he would participate in a Utility Local Improvement District
(ULID) to enable the proposal's connecdon to a public sewer system
17. The County Arterial Road Plan designates Valley Way as a CoUector Arterial with a
recommended right of way width of 70 feet. The project has been conditioned to
dedicate right of-way and set aside adequate right of way far future acquisition.
18. The proposal is located within the Central Valley School District No. 356. Upon
development, the propasal will generate new students who will direcdy impact the
District's capital facilities.
19 The Central Walley School District is curnendy operating over its capacity and will
continue to do so when the proposal is fully developed The DcStrict does not have
sufficient facilities avwlable to accommodate addinonal Students
20 A votuntvy agreement with the Central Valley Scttool nlstnct to pay impact fees,
prior to final development, is necessary to miegate the proposal's impacts on the
di stnct
21. The prvposal will generate additional impacts on county park facdities when
developed. A voluntary agreement with the Spokane County Department of Parks,
Recreation and Fair to pay impact fees, prior to final development, is necessary to
mitigate the proposal's impacts on park facilides.
21 The proposal should be conditioned to allow only Class A Manufactured Homes, as
descnbed in Section 14 808 060 of the Spokane County Zoning Code, to render
the project compatible vvith the adjacent residendal neighborhood.
22. The provisions of RCW 43 21C (The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance was issued. The Board
concurs with the Detenninauon of Nonsignificance.
23 The applicant has demonstrated that the proposed rezone bears a substandal relaaon
to the public health, safety, and general welfaze. The pmposal wi11 provide needed
affordable housing in the communiry.

The Board dces hereby deny the appeal and thereby appraves the tione reclassification
request frocn Urban Residential-3.5 (UR 3.5) and Community Business (B-2) to Urban
Residential-? (UR-7), subject to the foUowing addidonal condidons.
1. Only Class A Manufactured Homes as described in Sechon 14.808 060 of the
Spokane County Zoning Code are pemutted.

1. The proposal shall compiy with the Urban Residential-7 (UR-'n Zone; Aqwfer
Sensidve Area (ASA) Overlay Zone; and Chapter 14.808; Manufactured Home
Standards as amended
2. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Yariations, when approved by the
Planning Director/designee, may be pernutted, including, but not lunited to budding
location, landscape Plans and general a►llowable uses of the pemutted zone. All
variations must conform to regulations set forth in the Spakane County Zorung
Code, and the original intent of the development plans shall be maintained
3. A specif'tc landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designec shall be submittied with a performance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
impaired.

boundary.

special condidons imposed as a result of approval of a Iand use action. This Title

8. The applicant shall submit to the Spokane County Flanning Department approval from
Fire District #1 that the proposed turn-around is acceptable to the Fire District.
9 Pnor to the issuance of building pennits, the applicant shalf demonstrate to the
satisfaction of the Spokane Caunly Planning Department that the exiseng structures on
site have been removed
10 The applicant shall submit for approval by the Spokane County Engineer road plans
that comply wnth all applicable standards as contained in Chapter 14 808 of the
Spokane County Zoning Code
11. The 4wner shall negohate wnth the Central Valley School District and submit a
recorclei copy of a voluntary agreement maldng provisions for parks prior to

conjunction with a County Raad Project/Road Iaaprovement District, whichever

and surface water disposal plan for the enore project, or portion thereof, if the
development is to be phased.
6. A parlcYng plan and traffic circulauon plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engine.ering pracnces. Faving or
surfacing as appmved by the Counry Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.

The construcdon of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
8. The County Engineer has designated Typical Roadway Secdon Number Two,
CoUector Arterial standani for the improvement of'Valley Way, which is adjacent to
the proposed development. This will require the addition of approximacely 10-12
feet of asphalt along the frontage of the development. The construction of curbing
and sidewallc is also required.
9. All required improvements sha11 conform to the current State of Washington
Standard Specificarions for Road and Bridge Construction and other applicable
County standards and/or adopted resoludons pertaining to Road Standards and
Storm water Management in effect at the date of constrvcdon, unless otherwise
approved by the County Engineer.
10. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioner$ Resolution No 80-1592 as
amended and are applicable to this proposal
11. No construciion work shall be performed within the exiseng or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer
12 A!l required conswction within the existing or proposed public right-of-way is to
be completed pnor to the release of a building permit, or a bond in an amount
estimated by the Counry Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer.
13. The County Arterial Road Plan tdentifies Valley Way as a Gollector Arterial 'The
exisdng right-of-way width of 40 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addhtion to the required
nght-of-way dedication, a strip of pnoperty S feet in width along the valley Way
frontage shall be set aside in reserve This property cnay be acquired by Spokane
County at the time when arterial impravements are made to valley Way.
14 There may exist utilities, either underground or overhead, affeceng the subject
property, including pmperty to be dedicated or set aside for futune acquisition
