interest in the above described property or project agree to the
following:
1. Reimbuzse Spokane County for project review and inspection
fees as specified in Board of County Commissioner's
Resolution 80-1592 attachment C, as amended. The fees will
be based on actual salary costs incurred by Spokane County
for pro7ect reviews and / or inspections plus a ten percent
administrative charge, and will be billed monthly as
accrued.
2. The undersigned agrees that these fees are due and payable
upon receipt of the billing as specified above. The
monthly 'lling should be sent to the attention of:

Enclosed, please find the preliminary design for the proposed street
improvements along Maxwell Avenue. Curb design calculations have also
been included.
I spoke with Gary Nelson regarding the drainage for the improvements and
he told me to perform a quick drainage calculation on the runoff from
the existing catch basin to the end of the proposed improvements. Gary
told me that if there was more than .2 cfs of flow there would be a
drywell required. The calculated runoff was determined to be .34 cfs,
therefore, we are proposing to install a Type A drywell at the end of
the, proposed improvements.
Approval of this plan is requested. If you have any questions or

mmt~►, Parcels adjacent to Pines Road have been subject to numerous zone changes to the Local Business, Residential Office, and
Commercial since the adoption in 1981 of the Spokane County Comprehensive Plan.
These zones are within the Major Commercial Comprehensive Plan category which
extends approximately 250 feet west of Pines Road. Multiple Family Suburban and
Residential Office Zoning has been used as a buffer between business zones and
residential development within Urban Comprehensive Plan category.
Existing Multiple Family Suburban and Residential Office Zones in the area are
generally found within 650 feet of Pines Road. The proposed zone reclassification
would extend multiple family development approximately 150 feet further into the
Urban category and an existing single family residential area.
Two previous zone change requests from Agricultural Suburban to Residendal Office
and Local Business were approved for the subject property (see 7.E-125-77A,
ZE-170A-78) and provided for future development of office, business, and limited
retail uses. The proposed zone change would eliminate previous zoning approvals
and provide for multiple family development at density of 21.56 dwelling units per
acre. Accorciing to the Program to Implement the Spokane County Zoning Code, on ;
January 1, 1991 existing zoning classifications in the area will crossover to the new ,

I V. SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was reviewed by the
Counry Plarining Department. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible ~
standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guideluies. The Planning Department has deternuned that "No
probable significant adverse impacts" would result from the proposal being developed
and has issued a Determination of Nonsi.gnifiGance ("DNS").
The "DNS" was circulated to 9 other agencies of jurisdiction and other - ~
agencies/departments affected by the future development for review and commenG ~
The "DNS" comment period ends December 18th, 1990 and was advertised 15 '
calendar days before said date in the newspaper, by letter to adjacent property owners '
within 400 feet of the proposal, and by notice on a sign posted on the proposal site. ;
The Hearing Examiner may consider addiaonal environmental related testimony at the
public hearing.

V. PLANNING DEPARTMENT SUMMARY

Proposed zone change is not consistent with goals, objectives, and decision
guidelines of the Urban Comprehensive Plan category which encourage high density
residential development to locate with direct or near d.irect access to designated ~
arterials, and multi-family development that will enhance residential character of area.
Buffering and landscaping is also encouraged'to mitigate differences between
proposed and exiscing uses. Proposed design does not provide an adequate buffer to .
adjacent single family development to west and north, or provide a transition in '
density from high density multiple family ta single family uses. Design also does not
pmvide direct or near d.irect access to a designate.d arterial. Use of easement and local
access street (Maxwell Avenue) could result in excessive traffic volume and
congestion at intersecaon of Pines Road and Maacwell Avenue. Deleting the west 145
feet of subject property from the proposed zone change would reduce overall density,
provide area for density transition to fewer units and extensive landscape buffer on western portion of site and minimize extension of multiple family development into

1. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,

should be treated, and emissions from the aansfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.

A) A drainage plan for the site which has been prepared,in
compliance with Spokane County "Guidelines for Stormwater
Management". At a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site. '
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.

A) A drainage plan for the site which has been prepared in
compliance with Spokane County "Guidelines for Stormwater
Management". At a minimum the plan must contain:
l. Drafnage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
9. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.-
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
1. Spokane County Zone Change No. ZE-48-90
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. 5 feet of Right of Way dedication on Maxwell.
2. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. Maxwell (Typical Section Number One)

' Al1 required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.

3. Approach permits must be obtained from the County
Engineering Department for driveway approaches to .
the following streets: _
a. Maxwell
D) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Site Plan. •
2. Drainage plan as specified. 3. Other information:
a. Access permits to Pines Rd. must be approved by
WSDOT.
b. Submittal of a detailed on site sewage disposal
system plan and surface water disposal plan.
c. Prepare a hold-harmless agreement-for Spokane
County concerning stormwater runoff.
d. A secondary ingress and egress shall be provided
to Pines Rd. as shown on the rezone site plan.
E) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
F) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the'County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
Only after all the information and requirements listed above
are supplied or completed and the necessary review has been
accomplished will your building permit be released.

CALL TO ORDER: The meeting was called to order at approximately
11:05 a.m. by the Division of Buildings Code Compliance Coordinator
Tom Davis, with the following in attendance.

SCOPE/PROJECT DESCRIPTION:
I. General Overview - The owners Ken and Kevin Rudeen are
proposing the construction of a 110 unit apartment complex. There
will be six buildings containing two and three bedroom units. The
largest buildings will be two stories containing 24 living units.
Also proposed are a swimming pool, handball ball court building, and
garage spaces for 85 vehicles. The applicant is desiring to
commence construction as soon as possible.
SUMMARY OF DEPARTMENTAL REQIIIREMENTS:
I. Planning Department (456-2205)
A. Discussion/Requirements
1. The property is zoned UR-22. The proposal shall meet
the conditions of Zone Change ZE-48-90.
2. A three foot wide strip of Type III landscaping is
required along the adjoining B-3 Zone. Also a 20 foot
strip of Type III landscaping is required along Pines Road
and Maxwell Avenue. A copy of Type III landscaping

requirements were given to the applicant during the
meeting.
3. Landscaping may be required to be installed in the
easement off of Pines Road. Due to the approach
requirements to Pines Road from the 40 foot easement,
Lorne Lakshas will verify with Steve Horobiowski if
landscaping will be required.
4. Please submit a revised landscaping plan illustrating
the number and locations of plant material, this
information is needed for inspection purposes by the
Division of Buildings.
5. The 211 parking spaces as illustrated on the site plan
exceeds minimum parking requirements.
6. The subject parcels are required to be aggregated
through a certif icate of exemption. Forms for obtaining
the certificate of exemption were given to the applicant
during the meeting.
7. Please illustrate on the site plan the location of the
proposed sign as well as the signs height, length, and
square footage. Also please indicate that the sign will
not be lighted.
8. A lighting plan for the site shall be submitted as per
the conditions of the zone change.
B. Permit Release Requirements
1. An estimate from a nursery including size, type, and
quantity along with a promissory letter from the owner
stating the landscaping will be installed shall be
submitted. 2. The Planning Department will release their portion of
the building permit once it has been determined if
landscaping is required to be installed along the easement
off of Pines Road. Also the quantity of plants needs to
be illustrated on a revised landscape plan.
II. Division of Engineering & Roads (456-3600)
A. Discussion/Requirement
l. Comments were given to the applicant and the Division
of Buildings by Bob Turner.

2. A drainage plan has been submitted with the
Pre-Construction packet. The Division of Engineering &
Roads will review and submit its comments to the
applicant. The plan must be in compliance with Spokane
County Guidelines for Stormwater Management.
3. The applicant is,to submit a hold harmless agreement
for stormwater runoff to the Spokane County Division of
Engineering & Roads. This is found necessary due to an
existing stormwater drainage channel running through the
subject property. The applicant was advised to consider
this off-site drainage in the drainage plan.
4. The proposed shall meet the conditions of Zone Change
ZE-48-90.
5. Approach permits shall be obtained for new driveway
approaches along county right of way.
6. Please submit a copy of the approach permit issued by
the Washington State Department of Transportation for
access to Pines Road. Also submit a copy of the secondary
ingress, egress easement for Pines Road granted by the
State Department of Transportation.
7. An additional five feet of right of way dedication is
required on Maxwell Avenue. Please submit a copy of the
recorded property deed to the Division of Engineering &
Roads so that the right of way deed agreement can be
prepared. S. Road and drainage plans prepared by and engineer shall
be submitted for Maxwell Avenue. All required road
construction shall be completed prior to the release of
the building permit or a bond in an amount estimated by
the County Enqineer to cover the cost of construction
shall be submitted.
9. An Agreement to Pay Fees was given to the applicant
during the meeting. The agreement is to be signed by the
owner and returned to the Division of Engineering & Roads.
Plan review will not be completed until this document is
completed.
B. Permit Release Requirements
l. Approval of the drainage plan is required. ~

III. Health District (456-6040)
A. Discussion/Requirements
1. Daryl Way advised the applicant to apply for a
separate permit for the proposed swimming pool so that the
issuance of the building permit for the structures would
not be delayed. Daryl stated that the State Department of
Health has jurisdiction over public swimming pools in
Spokane County. However, prior to Health District release
of the swimming pool the plans for the pool must first be
reviewed and approved by the State Department of Health in
Olympia.
2. The utility plan for the proposed site has been
submitted and has been approved by all involved
departments.
3. Please submit a critical materials list to the
Division of Buildings for review.
4. All construction debris is to be taken to a licensed
landfill.
5. Public sewer connection needs to be approved by the
County Utilities Department.
8. Permit Release Requirements
l. The Health District released their portion of the -
building permit. The permit does not include the swimming
pool.

IV. Fire District No. 1(928-2462)
A. Discussion/Requirements
l. Fire flow for the proposed is 4,000 g.p.m.
2. An approved water plan for two new fire hydrants is on
file with the f ire district.
3. Fire lanes at the site have been determined. Fire
, lane signs can be obtained at the fire district.
4. The structures need to be clearly marked for
identif ication purposes.
5. A lock (Knox) box entry system for fire department
personnel access is required to be installed at a central
location. Please contact the f ire district for its
location.
V. Division of Buildings (456-3675)
A. Discussion/Requirements
1. Plan review has been completed on preliminary plans
by Ken Jeffrey.
2. Plans need to be submitted for the handicap units, the
garages and carports, racquet ball court, pool area, and
for building "F".
3. The applicant may after releases by the Planning
Department and Division of Engineering & Roads apply for
construction permits for individual buildings while plan
review is pending for the other buildings.
B. Permit Release Requirements
1. Two complete revised sets of plans addressing the
items discussed during and after the meeting needs to be
submitted for review and approval. .
COUNTY ACTION:
Lorne Lakshas will verify with Steve Horobiowski if landscaping will
be required to be installed in the easement off of Pines Road and
get back to the applicant.
