PROJECT OVERVIEW
This building will be a retail & wholesale paint store. Store was formerly located at University City. Latex, water-based paints,
solvent reduced paints & coatings, stains, varnish, specialized products & limited quantities of aerosols are some products in the store.
There will be no bulk miaing or dispensing. All products are pre-manufactured and shipped in closed containers from pint to S gal.
sizes. Tinting will be from automatic or manual dispensers. Tint will be agitated only in closed, sealed containers. Applicant wip
hook up to sewer. Applicantwill take out a separate sign permit. Buildingwill be sprinkled.

The County Engineering Department has completed a review of
the above referenced project. The following information must be provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action: o
Spokane County Zone Change No. ZE-83-82, ZE-83B-82
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. Valleyway, Typical Roadway Section No. 1,
Access Standard.
Al1 required construction (sidewalk/curbing/pavement) within .
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the f inancial quaranty or permit release.
2. Applicant shall dedicate 10 feet of right of way on
Valleyway.

3. Please submit a copy of a recorded property deed
from the Auditors office for the subject property.
Upon receipt of the deed our staff will prepare the
right of way deed.
4. Approach permits must be obtained, after a site
plan has been approved, and before the issuance of
a building permit, from the County Engineering
Department for any new or improved driveway
approaches to the followinq streets:
a. Valleyway
b. Pines (Approach permit must be issued by
the Washington State DOT)
D) See comments on the attached check print. Please return
the check print to your contact person at County
Engineering.
E) Insuff icient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Site Plan.
2. Drainage plan as specified.
3. Other information:

be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles.
F) IItility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
G) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Off ice. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
The applicant or his representative has been given a minimum
requirements list. This list is not inclusive of all the
requirements needed but should be used as a minimum guideline.
Without the "minimum" requirements the Engineers Department may
not be able to perform a complete review of the project and could
result in prolonging the period before permit issuance. Only
after all the information and requirements listed above are
supplied or completed and the necessary review has been
accomplished will your building permit be released.

The sponsor, North Pines Venture by John Sweitzer, requests approval of a change
of conditions File No. ZE-83B-82, for the purpose of allowing 20 feet of landscaping
on Pines and signs to conform with Section 14.804.120 of the Zoning Code, Sign
Standards for Business (B-2 & B-3) Zones..
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located in the Opportunity area of the Spokane Valley, west
of and adjacent to Pines Road and south of and adjacent to Allci Avenue in Section
16, Township 25N., Range 44 EWM, Spokane County, Washington.
2. The committee adopts the Planning Deparanent Report as a part of this record.
3. The exisring land uses in the area are vacant and graded, school, gas station and
store, office building, apartments/single family, vacant, open and single family
residences.
4. The Comprehensive Plan designates this site as Major Commercial.
5. The Arterial Road Plan designates Pines Road as a State Highway
6. The existing zoning of the property described in the application is Commercial,
previously established in 1982. The request for mod.ification of sign requirements
and landscaping along Pines Road and Alki Avenue as shown on the site plan would
conform to the crossover zoning standards effecrive in 1991.
7. The provisions of RCW 43.21C ('The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance was issued.
8. The proper legal requirements for advertisement and notice have been fulfilled.
9. The owners of adjacent lands were not present.
10. The Committee add.itionally finds:
That the requested change of conditions for landscaping along Pines Road 20 feet
wide and along Allci Avenue 10 feet wide, both Type III, and the signs to conform to
standards of Section 14.804.120 Sign Standards for Community Business (B-2) and
Regional Business (B-3) Zones would provide for a controlled and unified
development while conforming to the original intent of the zone change on the
property.

15. The proposed use will not be detrimental to the public health, safety, morals or
welfare.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Conditions of Approval apply to the following described real property:
The East 326 feet MOL of Block 116, Opportunity, except the East 278.67 feet of the
South 200 feet.
COUNTY PLANNING DEPARTMENT Changed Conditions and Existing Conditions Are:
1. All curnent standards of the Commercial Zone, as amended, shall be complied with in
the development of this site. The site shall conform to cond.itions stated herein and
after January 1, 1991 shall comply with the Crossover Zone for this site.
2. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Exaininer Committee. Variations when approved by
the Zoning Administrator will be pernutted, including, but not limited to the following
changes: Building location, landscape plans, and general allowable uses of the
pem-iitted zone. All variations must confonn to regulations set forth in the Spokane
County Zoning Ordinance. The original intent of the development plans shall be
maintained. (Site plan contained in ZE-83A-82 and ZE-83B-82 for south 100' for car
wash.)
3. The specific development plan will be submitted for Planning Department review and
approval prior to issuance of building pernuts.
4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Spokane County Zoning Administrator shall be submitted with a
performance bond for the project prior to release of building pernuts. Landscaping
shall be installed and maintained such that sight distance at access points is not
obscured or impaired.
a. Landscaping shall be provided along Pines Road 20' wide and 10' wide along
Alki Avenue, Type III.
b. Landscaping shall be provided along at least two sides of all buildings within
this project or as approved by the Zoning Administrator. This condition shall
be such that the quality of the project be maintained but flexibility is allowed to
provide an alternative in aesthetics for the project.
5. Approval by the Zoning Administrator of a specific lighting and signing plan for the
described property prior to the release of any building pernuts.

6. A 6-foot sight-obscuring fence be provided along the west property line; except said
fence to be 3 feet in height within the front 35 feet from Alki Avenue and Valley Way
and that a 40 foot wide access easement be shown on the site plan along the western
property line. Landscaping and easement improvement to be determined by the
Planning Department. Landscaping shall be located along the edge of the access
easement and shall be Type II and shall be improved as the need presents itself.
7. The present proposal is not decailed enough to determine whether or not the use of or
materials stored on the site are in compliance with Chapter 4.16A (Aquifer Sensitive
Area Overlay Zone) of the SPOK:ANE COUNTY ZONING ORDINANCE. -
Accordingly, as a condition of approval, the sponsor/applicant shall be required to file
with the Spokane County Auditor, within thirty (30) days of the signing of Findings
and Order of the final decision in this matter, a"Notice to the Public" which shall
provide in material as follows:

10. The Sgokane County Planning Deparnnent shall prepare and record with the Spokane
County Auditor a"Tide Notice" noting that the property in question is subject to a
variety of special cond.itions imposed as a result of approval of a land use action.

aPProval affecting the Property in question. The "Title Notice" shall be recoried
within fifteen (15) days of final disposition of the approved land use action and shall

standand traffic engineering practices. Paving or surfacing as approved by the
County Engineer, will be required for any portion of the project which is to be
occupied or a-aveled by vehicles.
10. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns, and successors.
11. The construction of the road improvements stateti herein shall be accomplished as
approved by the Spokane County Engineer.
12. All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bridge Construction, and other applicable county

2. Connection is to be made to the North Pines U.L.I.D. Sewer plans must be
approved by Utiliries Department, and a sewer connection pernut must be taken out
prior to construction.
COUNTY HEALTH DISTRICT
No New Conditions; Existing Conditions as Follow:
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
a
County.
2. A public sewer system will be made available for the project. Use of individual on-
site sewage disposal systems shall not be authorized.
, 3. Water service shall be coordinated through the Director of Urilities, Spokane County.
4. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Social and Health Services.
5. Use of private wells and water systems is prohibited.
COUNTY BUILDING AND SAFETY DEPARTMENT
No New Cond.itions; Existing Conditions as Follow:
1. The site is located in Fire District No. 1.
2. Approved numbers or addresses shall be placed on all new and existing buildings in
such a position as to be plainly visible and legible from the smeet or road fronting the
property. Said numbers shall contrast with their background.
3. Due to the sensitive storage requirements over the Aquifer, and this site lies within the
Waste Water Management Area, we feel that some language should address the
possible storage or flammable or critical materials within these structures. (See
COMMENTS.)
4. Trash enclosures shall not be located adjacent to combustible construction or
underneath windows or nonprotected eaves.
5. Building permits will be required for each structure.

6. Fire hydrants which meet the fire flow are required to be installed prior to any
construction. These hydrants shall be placed so that no portion of the building
exterior is _more than 175 feet from the hydrant. The bottom of the lowest outlet of
the hydrant shall be no less than, 18 inches above grade. A water plan showing each
fire h.ydrant (speci,fying the gal~Yons per <un ~ute for each f re hydrant) and meeting the
req~uirernents in Chapter 10.04 of the Uniforin Fire Code is reyuired prior to
c_onstructi on of the water, serVice. A~11 req;uired fire protection facilities shall be
installed and made serviceabl'e prior to and during the time of construcrion.

All air pollution regulations must be met This includes but is not limited to the following:
1. Air pollution regulations req.uire that dust erni-ssions during demolition, excavation
and construction projects be controlled. This may require use of water sprays, tarps,
sprinklers, or suspension of activ:ity during cerrain weather conditions. Haul roads
shoul'd be treated and em~i.ssions froorn the transfer of earthen material must be
controlled as well as emissions from all other construcrion related activities.
2. Measures must be taken to avoid the deposidon of dirt and mud from unpaved
seurfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures
must be taken immediately to clean these surfaces.
3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved and
kept clean.
4. Some objectionable odors will likely result during the construction phase of the
project and from motor vehicles using the site following completion of the project and
from occupants of the proposed project.
STATE DEPARTMENT OF TRANSPORTATION

1. The proponent will be required to obtain a road approach pernut prior to accessing the
adjacent State Highway. Road approach applications are available through the

A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
December 9, 1982, and the members of the Committee present being

B. PROPOSAL

Family Suburban, with no proposed development at this time.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, Junior High School,
churches, commercial, and vacant.
2. That the Comprehensive Plan designates this area as appropriate for Major
Commercial and Urban development.
3. That the existing zoning of the property described in the application is
Agricultural Suburban. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with, and the Committee concurs with the Declaration of
Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda ltem
have been fulfi I led .
6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have substanti.ally

any on-site improvements, or file appropriate documents to the effect
that the NOT(CE OF ACTION is waived in accordance with Spokane
County Commissioners' Resolution #82-0458 dated May 4, 1982.
6. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guide-
• lines (WAC 197-10) and the Spokane County Environmental Ordinance
(SCEO), a proposed declaration of non-significance has been issued at
least fifteen (15) days prior to this date; the official file, written
comments and/or public testimony cbntain information regarding assess-
ment of the proposal's adverse impacts to the physical environment; a
finding is hereby made that no potentially significant adverse impacts
upon the physical environment are anticipated as a result of the zone
change; and a final declaration of non-significance is hereby to be
issued.
7. Detailed site plan review shall be in a public hearing before the
Hearing Examiner Committee which shall include the proposed use,
design, orientation, landscaping, lightirlg, parking location, points of
access and efevation of the proposed buildings.
8. Site plan review shall consist of either the entire proposal or
the two use parcels individually. Piecemeal review, in respect
to the commercial property, will not be allowed.

2. The owner, his heirs or successors shall join and participate in any
petition or resolution which purpose is the formation of a utility local
improvement district (ULID) pursuant to RCW, Chapter 36.94, as
amended. The owner, his heirs and successors shall further agree not
to oppose or protest any legal assessments for any utility locat
improvement district (ULID) established pursuant . to RCW Chapter
36 . 94, as amended.
3. Any water service for this project shall be provided in accordance with
- : the Coordinated Water System Plan for Spokane County.
4. Each unit shall be double plumbed for connection to future area-
wide collection system.
d) COUNTY HEALTH D1STRtCT
1. A combined surface water and sewage disposal detailed plan sha11 be
approved by the County Engineer and the Health District prior to the
issuance of any building permit for this project.
2. Sewage disposal method shall be as authorized by the Director of

Health Officer, the use of an individual on-site sewage system may be
authoriZed.

/I Provide a benchmark for the elevations. This point must be an existing point (i.e. - top of the
fire hydrant, top of the slab for the transformer, etc.)
Provide spot elevations along the "valley line" to ensure 1% minimum grade. There are some
areas where the slope is less than 1%. Please revise the grades to achieve 1% minimum.
4 Provide an architects stamp.

-5~ The WSDOT has been added as a separate signature block. The building department needs
to be informed when approval of your approach permit application is given. -
6. The '208' calculations have some problems.
4) The common area does not need to be included in the calculations. If you
do include it there will not be enough swale area.
46) The swale area provided is approximately 6' x 270' (1,620 so. This would
be sufficient for the improvements proposed at this time, not including the
common area.
C) Provide another type 'B' drywell to meet requirements. You are probabfy
limited to where you can put it, due to the utilities located in the swale area.
Maintain a minimum 30' (on center) between the drywells.
7. The following items need to be revised or added to your swale cross-section:
Provide a elevation at the edge of property. This must be 12" to prevent the
~ swale for overflowing onto the property to the south. ~b) The top of the drywell should be at the 6" level. Therefore, the lid elevation
should be 97.7' + 0.5' = 98.2'.
~ Swale sideslopes should be 3 to 1, but we can allow up to 2 to 1 for sites with
tight room.
✓d) Show the curb on your cross section.
Provide a detail of the curb along the western edge of pavement. Change the label on this curb
/ to extruded.
Provide Type I curb inlets at each curb drop and call out each one on your plan. Include
elevation at the curb drops. Provide a detail or reference the standard drawing.
1/0. Add the following to the landscape note: Provide edging material to separate the landscaped
~ areas from the lawn areas and '208' swale.
What size gutter is being used and what slope will it be installed at? Specify this on your plan
/ or in the notes.

~4. The electrical line is of some concern due to its locatwn within the swale. Contact the
Department of Labor and Industries for minimum cover, and conduit material for this situation.
Make a note on the plans to maintain the minimum cover specified by that department.

2& 3: In all cases it would be prudent, pcior to submittll of tl1e application, for die applicant to inquire
of the department whether the application needs additional infornlation. The department reserves the
right to request clarification or additional information during vle application review process. Failure to
provide the requested information within the time limits specified in thc request shall result in

1. Identification and signature of property owner and applicant. Names of the propercy owner(s),
developer(s), applicant, the transportation and legal consult:ints representing the applicant (if any),
and the local government representative(s) responsible for processing the development's approval
shall be provided as part of the application. If a property owner desires to have a representative sign
the application, a notarized letter of authorization from ttie applicant is to be provided with the
application. When the owner or applicant is a company, corporation, or other public agency, the
name, address, and names of the individuals signing the application and their titles shall be typed or
printed directly below their signature. . . •
. .~2. Property uses and trafric information. The ultimate planned property use shall be indicated in
sufficient detail to determine the appropriate permit classification. Estimated average weekday
vehicle trips generated by the development, based on the planned property use, consistent with the
latest trip generation information published by the Institute of Transportation Engineers,
Washington D.C., shall be included as appropriate. If local or special trip generation rates are
used, the latest and best information shall be used and all documentation for the rate development
shall be submitted with the application. For residential developments with ten or fewer units, ten
trips per day, per unit, may be assumed. The requirement for an- average weekday vehicle trip
estirnate may be waived for agricultural uses where no retail marketing is proposed. .
3: ' Site plan. The applicant shall include a plan to scale, or a schematic drawing showing critical
dimensions (allowable on Category I permit only), the location of the property, and existing
conditions and the character and extent of work proposed. The location of existing and proposed
driveway location(s) and the highway shall be shown. - Minimum information of the plan shall
include: .

• cross secrion showing lane widths, shoulders & side slopes . • posted legal speed limit
• locations of any existing or future public or private roads abutting or entering the propeny;
the horizontal and vertical curvature of the road(s) noting the location of existing and

b. Property Lnformation • location of all existing and proposed buildings, and other structures such as gasoline
pumps, lights, trees, etc., with respect to right of way lines

engineer, registered in accordance with Chapter 18.43 RCW. "The following traffic data may
be required: • vehicle turning movements for present and future traffic conditions
• amount and type of traffic that will be generated by the proposed development including a
breakdown of anticipated peak hour traffic and an analysis of the impact on the level of
'service on the highway
• analysis of off-street parking and craf~ic eiiculation, including distances to secondary
access points and their impact on the operation of the highway
• if traffic signals are requested, signal permits are required, andthe following studies may
be necessary: traffic signal warrants; phasing and timing analysis; signal progxession
analysis; signing and lighting plans in conformance with department standards
• traffic analysis to detemline the need for off-site related roadway and geometric
improvements and mitigation requirements
• traffic conrrol plan conform.ing to current department standards set forth in the "Manual
on Uniform Traffic Control Devices," detailing how the pennitee will provide for safe and
efficient uaffic flow during construction of the connection
