The County Engineering Department has completed a review of .
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.

drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Spokane County Zone Change No. ZE-83B-82C
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. Approach permits must be obtained, after a site
plan has been approved, and before the issuance of
a building permit, from the County Engineering
Department for any new or improved driveway
approaches to the following streets:
a. Pines Road, (WSDOT)
D Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Site Plan.
2. Drainage plan as specified.
3. Other information:

a. A parking and traffic circulation plan shall be
submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles. It is illegal to back out onto the Right of Way.
b. The Washington State Department of
Transportation appears to be an agency of jurisdiction on this
project and should therefore have their own signature block on
the permit.
c. The applicant must provide a copy of an
easement allowing access across the existing curb cut that is on
the adjacent parcel.
E) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
F) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
The applicant or his representative has been given a minimum
requirements list. This list is not inclusive of all the
requirements needed but should be used as a minimum guideline.
Without the "minimum" requirements the Engineers Department may
not be able to perform a complete review of the project and could
result in prolonging the period before permit issuance. Only
after all the information and requirements listed above are
supplied or completed and the necessary review has been
accomplished will your building permit be released.

Dear Larson:
Thank you for the opportunity to respond to the above mentioned development. The
Washington State Department of Transportation (WSDOT) has the foltowing
comments:
• Due to the fact that Pines Road is a State Highway (SR.27), a valid WSDOT road
approach permit for the intende,d property usage is required for any d'uect access to
Pines Road. This road approach permit needs to obtained prior to tha issuance of
any building permits for this site. This epproach must atso conform to current
WSDOT Access Mgnagement Standards for approach spacing.
• This approach will need to be designed and constructed to (see attached) WSDOT
Type "D" commercial approach standards.
If you should have any questions or to apply for a road approach permit, please feel

KNOW ALL MEN BY THESE PRESENTS that North Pines Venture, a
partnership, and A. J. Gerard and Patricia M. Gerard, husband and '
wife (hereinafter referred to as the "Gerards" do hereby
declare the following Reciprocal Easement Agreement (hereinafter
referred to as "Agreement"):
WITNESSETH:
WHEREAS, North Pines Venture is the owner of the following
described property, to-wit:
The East 326 feet of Tract 116, OPPORTUNITY, according
to plat recorded in Volume "K" of Plats, page 20, in
Spokane County, Washington;
EXCEPT the South 400.14 feet;
AND EXCEPT those portions conveyed to the State of
Washington for SR 27 by Deeds recorded under Recording
Nos. 8404230052, 8407310118, 8407310119, 8407310120,
8407310125, 8407310126 and 8407310127; and
TOGETHER WITH a 52.68 percent interest in and to the
West 40 feet of the South 199.99 feet of the East
326.675 feet of Tract 116, OPPORTUNITY, according to
plat recorded in Volume "K" of Plats, page 20, in
Spokane County, Washington; and
WHEREAS, the Gerards are acquiring from North Pines Venture
that portion of the above-described property leqally described as
follows:
The South 100 feet of the North 222.7 feet of the East
326 feet of Tract 116, Opportunity, according to Plat
recorded in Volume "K" of Plats, Page 20, in Spokane
County, Washington.
Except any portion lying within the South 400.14 feet
and except those portions deeded to the State of

1 WHEREAS, the parties hereto wish to enter into a reciprocal
easement agreement providing for ingress and egress over and
across a portion of the properties as hereinafter provided;'
NOW, THEREFORE, the parties hereto do hereby make this
Agreement, which Agreement shall run with the land comprising the
properties described above and be binding upon all current and
future owners of all or any portion of the properties and upon
all parties who shall have any interest therein as lessee,
mortgagee, licensee or otherwise.
1. North Pines Venture and the Gerards hereby grant and
convey to each other, their successors and assigns, in
perpetuity, a nonexclusive easement for the purpose of pedestrian
and vehicular traffic over, upon and across the following
described property (hereinafter referred to as the "Easement
Property"), to-wit:
The South 40 f eet of the North 142.7 f eet of the East
75 feet of Tract 116, OPPORTUNITY, according to Plat
recorded in Volume "K" of Plats, Page 20, in Spokane
County, Washington;
EXCEPT those portions conveyed to the State of
Washington for SR 27 by Deeds,recorded under Recording
Nos. 8404230052, 8407310118, 8407310119, 8407310120,
8407310125, 8407310126, and 8407310127.
2. The Easement'Property shall be used for ingress and .
egress to the properties described above from Pines Road (SR 27)
and shall not be used for the parking of unattended vehicles
without the written consent of the owners of the properties
benefited by said easement. All improvements made to the
Easement Property shall be as agreed upon by the owners benef ited
by the easement.
3. This easement is being granted primarily for the
benefit of the property being acquired by the Gerards although
subsequent use may be made thereof by the owner of the adjoining
property to the north. Accordingly, all costs associated with
the construction, repair and maintenance of the Easement Property
shall be borne by the Gerards, their successors and assigns.
4. It is presently understood by the parties hereto that
it may not be necessary to utilize the entire 75 foot depth of
trie Easement Property (running from east to west) to properly
construct appropriate access for ingress and egress to and from
Pines Road. To the extent that it is determined that less than
the full 75 foot depth of the Easement Property is actually
needed for an appropriate access for ingress and egress, the
parties hereto or their successors and assigns shall work
together to modify this Agreement to remove from the legal

description of the Easement Property that portion thereof which
is deemed no longer reasonably necessary to be included therein.
5. All of the easements hereby granted and the
restrictions hereby imposed shall create mutual benefits and
servitudes upon the Easement Property running with the land and
shall be binding upon and inure to the benef it of the owners of
the respective properties described herein and their respective
personal representatives, heirs, successors in interest, and
assigns.
6. Nothing contained in this Agreement shall be deemed to
constitute a gift or dedication of any portion of the described
properties to the general public or for the benefit of the
general public or for any public purpose whatsoever, it being the
intention that this Agreement will be strictly limited to the
purposes expressed herein.
7. The provisions of this Agreement are for the exclusive
benefit of the owners, their successors and assigns, and not for
the benefit of any third person, nor shall this Agreement be
deemed to have conferred any rights, express or implied, upon any
third person. It is expressly understood and agreed that no
modif ication or amendment, in whole or in part, shall require any
consent or approval on the part of any occupant or permittee
other than an owner.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement as of the day of , 1994.

HEARING EXAMINER COMMITTEE
FINDIN tS OF FA _T. CONCLUSIONS AND ORD .R
INTRODUCTION
This matter having come before the Hearing Examiner Committee on December 21,
1989, and the members of the Committee present being Chairperson Verona
Southern, Lunell Haught and Don Neraas.
PROPOSAL
The sponsor, North Pines Venture by John Sweitzer, requests approval of a change
of conditions File No. ZE-83B-82, for the putpose of allowing 20 feet of landscaping
on Pines and signs to conform with Section 14.804.120 of the Zoning Code, Sign
Standards for Business (B-2 & B-3) Zones..
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located in the Opportunity area of the Spokane Valley, west
of and adjacent to Fines Road and south of and adjacent to Allci Avenue in Section
16, Township 25N., Range 44 EWM, Spokane County, Washington.
2. The committee adopts the Planning Deparnnent Report as a part of this record.
3. The exisring land uses in the area are vacant and graded, school, gas station and
store, off-ice building, apartments/single family, vacant, open and single fami.ly
residences.
4. The Comprehensive Plan designates this site as Major Commercial.
5. The Arterial Road Plan designates Pines Road as a State Highway
6. The existing zoning of the property described in the application is Commercial,
previously established in 1982. The request for modification of sign requirements
and landscaping along Pines Road and Alla Avenue as shown on the site plan would
conform to the crossover zoning standards effective in 1991.
7. The provisions of RCW 43.21 C('I'he State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance was issued.
8. The proper legal requirements for advercisement and notice have been fulfilled.
9. The owners of adjacent lands were not present
10. The Committee add.itionally finds:
That the requested change of conditions for landscaping along Pines Road 20 feet
wide and along Allci Avenue 10 feet wide, both Type III, and the signs to conform to
standards of Section 14.804.120 Sign Standards for Community Business (B-2) and
Regional Business (B-3)- Zones would provide for a controlled and unified
development while conforming to the original intent of the zone change on the property.

15. The proposed use will not be detrimental to the public health, safety, morals or
welfare.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL .
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Conditions of Appnoval apply to the following described real property:
The East 326 feet MOL of Block 116, Opportunity, except the East 278.67 feet of the
South 200 feet.
COUNTY PLANNING DEPARTMENT
Changed Conditions and Existing Conditions Are:
1. All current standards of the Commercial Zone, as amended, shall be complied with in
the development of this site. The site shall conform to conditions stated herein and
after January 1, 1991 shall comply with the Crossover Zone for this site.
2. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Examiner Committee. Variations when approveti by
the Zoning Administrator will be pennitted, including, but not li.mited to the following
changes: Building location, landscape plans, and general allowable uses of the
pennitted zone. All variations must conform to regulations set forth in the Spokane
County Zoning Ordinance. The original intent of the development plans shall be
maintained. (Site plan contained in ZE-83A-82 and ZE-83B-82 for south 100' for car
wash.)
3. The specific development plan will be submitted for Planning Department review and
approval prior to issuance of building pernuts.
4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Spokane County Zoning Administrator shall be submitted with a
performance bond for the project prior to release of build.ing perniits. Landscaping
shall be installed and maintained such that sight distance at access points is not
obscured or impaired.
a. Landscaping shall be provided along Pines Road 20' wide and 10' wide along
Alki Avenue, Type M.
b. Landscaping shall be provided along at least two sides of all buildings within
this project or as approved by the Zoning Administrator. This condiaon shall
be such that the quality of the project be maintained but flexibility is allowed to
provide an alternaave in aesthetics for the project.
5. Appmval by the Zaning Administrator of a specific lighting and signing plan for the
described property prior to the release of any building permits.

6. A 6-foot sight-obscuring fence be provided along the west property line; except said
fence to be 3 feet in height within the front 35 feet from Alki Avenue and Valley Way
and that a 40 foot wide access easement be shown on the site plan along the western
pnoperty line. Landscaping and easement improvement to be determined by the
Planning Department. Landscaping shall be located along the edge of the access
easement and shall be Type II and shall be improved as the need presents itself.
7. The present proposal is not detailed enough to determine whether or not the use of or
materials stored on the site are in compliance with Chapter 4.16A (Aquifer Sensitive
Area Overlay Zone) of the SPOK:ANE COLJNTY ZONIIVG ORDINANCE.
Accordingly, as a condirion of approval, the sponsor/applicant shall be required to file
with the Spokane County Auditor, within thirty (30) days of the signing of Findings
and Order of the final decision in this matter, a"Notice to the Public" which shall
provide in material as follows:
PRIOR TO TBE ISSUANCE OF ANY BUILDING PERMIT OR CERTIFTCATE
OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY
DESCRIBED HEREINAFT'ER, TBE APPLICANT SHALL BE RESPONSIBLE
FOR COMPLYING WITH TBE PROVISIONS OF SPOKANE COUNTY
ZONING ORDINANCE CHAPTER 4.16A (AQUIFER SENSTI'NE AREA
OVERLAY ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS
NOTICE IS MORE PARTICULARLY DESCRIBED AS FOLLOWS:....".
8. Applicant shall comply with '208' recommendarions concerning stormwater runoff
and provide necessary landscaping for runoff.
9. Any division of land for the purpose of sale, lease or transfer, shall comply with
RCW 58-17 and the Spokane County Platting Ordinances prior to issuance of
build.ing pemuts.
10. The Spokane County Planning Department shall prepare and record with the Spokane
County Auditor a"Tide Notice" noting that the property in question is subject to a
variety of special cond.itions imposed as a result of approval of a land use action.
This "Tide Notice" shall serve as official public notice regarding cond.itions of
approval affecting the property in question. The "Title Norice" shall be recorded
, within fifteen (15) days of final disposidon of the approved land use action and shall
only be extinguished by the Spokane County Planning Department. The "Title
Notice" shall generally provide as follows:
The parcel of property legally described as (legal description and tax parcel
number) is the subject of a land use action, imposing a variety of
special development conditions, by a Spokane County Hearing Body
or Administrative Official on (date) and as maybe amended, altered or
supplemented by official acrion or as already changed. File No. (Planning
Department File Number) is available for inspection and copying in the
Spokane County Planning Department.
11. Signs for this project shall conform to standards as set forth in the Zoning Code
Section 14.804.120.

COUNTY ENGINEERING DEPARTMENT
No New Conditions; Existing Conditions as Follow:
Prior Ta The Issuance Of A Building Permic 4r Use Of The Prooertv Aa Proposed:
1. Applicant shall dedicate 10 feet on alki and Valley Way for right-of-way prior to any
use of the propert}r.
2. Applicant shall dedicate a 20 foot radius on Alla and Pines Road/Valley Way and
Pines Road prior to any use of the property.
3. Access permits for approaches to the County Road System shall be obtained from the
Spokane County Engineer.
4. Access permits and improvements to Pines Road must be approved by the
Washington Departinent of Transportarion.
5. Applicant shall improve Alld Avenue in a manner consistent with Spokane County
Typical roadway section No. 1 minimum paving width Access Standard.
6. Applicant shall improve Valley Way in a manner consistent with Spokane Typical
roadway Section No. 1 minimum paving width Access Standard.
7. Applicant shall submit for approval by the Spokane County Engineer road, drainage,
and access plans prior to the issuance of a building permit on the property.
8. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan and
surface water disposal plan for the entire project prior to the issuance of any building
permit on the property.
9. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer prior to the issuance of a building pennit on the property.
The design, location, and amangement of parking stalls shall be in accordance with
standard traffic engineering practices. Paving or surfacing as approved by the
Counry Engineer, will be required for any portion of the project which is to be
occupied or traveled by vehicles.
10. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns, and successors.
11. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
12. All required improvernents shall conform to the curnent State of Washington Standard
Specifications for Road and Bridge Construction, and ocher applicable county
standards andlor adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless othenwise approved by the
County Engineer.

13. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners' Resolution No. 80-1592 as
amended.
COUNTY UTILITIES DEPARTMENT
No New Conditions; Existing Conditions as Follow:
1. Any water service for this project~ shall be provided in accond.ance with the
Coordinated Water System Plan for Spokane County, as- amended.
2. Connection is to be made to the North Pines U.L.I.D. Sewer plans must be
approved by Utilities Department, and a sewer connection pemut must be taken out
prior to construction.
COUNTY HEALTH DISTRICT
No New Condiaons; Existing Conditions as Follow:
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. A public sewer system will be made available for the project. Use of individual on-
site sewage disposal systems shall not be authorized.
` . 3. Water service shall be coordinated through the Director of Utilities, Spokane County.

propeny. Said numbers shall contrast with their background.
3. Due to the sensitive storage requirements over the Aquifer, and this site lies within the
Waste Water Management Area, we feel that some language should address the
possible storage or flammable or critical materials within these structures. (See

4. Trash enclosures shall not be located adjacent to combustible construction or
underneath windows or nonprotected eaves.

6. Fire hydrants which meet the fire flow are required to be installed prior to any
construcaon. These hydrants shall be placed so that no pordon of the building
exterior is more than 175 feet from the hydranf. The bottom of the lowest outlet of
the hydrant shall be no less than 18 inches above grade. A water plan showing each
fise,4hydrant (specifying the gallons per minute for each fire hydrant) and meeting the
requir:ements in Chapter 10.04 of the Uniform Fire Code is required prior to
' construction of the water service. All required fire protection facilities shall be
installed and made serviceable prior to and during the time of construcrion.
COMMENTS: The proposed car wash and mini-storage sttuctures must meet all
requireinents of Chapter 4.16 of the Spokane County Zoning Ordinance for storage
and, discharge of effluent; (i.e., waste oil, grease interceptors).

1. Water Purveyor is Modern Electric Water Compan.y, and they will supply the site
with adequate water for domestic, fire and irrigation uses. However, sausfactory
arrangements have not been made to serve this proposal.

All air pollution regulations must be met This includes but is not limited to the following:
1. Air pollution regulations require that dust emissions during demolition, excavarion
arid construction projects be controlled. This may require use of water sprays, tarps,
sprinklers, or suspension of activity during certain weather conditions. Haul roads
. should be treated and emissions from the transfer of earthen material must be
; conmolled as well as emissions from all other construction related activities.
• 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If rracking or spills occur on paved surfaces, measures
, must be taken immediately to clean these surfaces.
3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved and
kept clean.
4. Some objectionable odors will likely result during the construcrion phase of the
• project and from motor vehicles using the site following completion of the project and
from occupants of the proposed project.
STATE DEPARTMENT OF TRANSPORTATION

1. The proponent will be required to obtain a road approach permit prior to accessing the
adjacent State Highway. Road approach applications are available through the
District Maintenance Engineer.

A. {NTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
December 9, 1982, and the members of the Committee present being
Kenneth Kenndy, Chairman, F. Lynn Tennican and Ronald L. McVicker.
B. PROPOSAL
The sponsor, North Pines Venture, is requesting approva{ of a zone reclassi-
fication, File No. ZE-83-82, Agricuitural Suburban to Commercial and Muitiple
Family Suburban, with no proposed deveiopment at this time.

C. FINDINGS OF FACT
1, That the existing 4and use in the area is residential, Junior High School,
churches, commerciai, and vacant.
2. That the Comprehensive Plan designates this area as appropriate for Major
Commercial and Urban develapment.
. 3. That the existing zoning of the property described in the application is
Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with, and the Committee concurs with the Declaration of
Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have substantially
changed since the original zoning of this area and accordingly, the pro-
posed rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed neither approval nor dis-
approvaf of the proposed use.
10. The Hearing Exa-miner Committee finds the proposed use to be in harmony
with the general purpose and wilf not be otherwise detrimental to the public
health, safety, and welfare.

11. The foliowing are additional findings of fact considered by the Hearing
Examiner Committee:
a) That the project is of such size and location that the Hearing Examiner
Committee feels the project should be developed utilizing a design
appearance which would be consistent throughout the project far the
cornmercial site.
D. CONDITIONS OR CONTfNGENCIES APPLIED TO THIS APPROVAL
a) COUNTY PLANNING DEPARTMENT
1. All current standards of the Commercial and Multiple Family Suburban
Zones, as amended, shall be complied with in the development of this
site.
2. Landscaping shall be provided for this site, in conformance with
Standards as identified in Section 4.07A.120 Landscaping.
3. Applicant sha11 comply with `208' recommendations concerning storm-
water runoff and provide necessary landscaping for runoff.
4. The applicant shall comply with RCW 58-17 and the Spokane County
Platting Ordinances prior to issuance of building permits.
5. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the 6oard of Spokane County Commis-
sioners Resolution #77-1392 be initiated by the project applicant within
thirty (30) days of final disposition -of this application, and prior to
any on-site improvements, or file appropriate documents to the effect
that the NOTICE OF ACT14N is waived in accordance with Spakane
County Commissioners' Resolution #82-0458 dated May 4, 1982.
6. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guide-
lines (WAC 197-10) and the Spokane County Environmental Ordinance
(SCEO), a proposed declaration of non-significance has been issued at
least fifteen (15) days prior to this date; the ofificial file, written
comments and/or pubfic testimony contain information regarding assess-
ment of the proposal's adverse impacts to the physical environment; a
finding is hereby made that no potentially significant adverse impacts
upon the physical environment are anticipated as a result of the zone
change; and a final declaration of non-significance is hereby to be
issued.
7. Detaiied site plan review shal( be in a public hearing before the
Hearing Examiner Committee which shall include the proposed use,
design, orientation, landscaping, lighting, parking location, points of
access and elevation of the proposed buildings.
8. Site plan review shall consist of either the entire proposal or
the two use parcels individually. Piecemeal review, in respect
to the commercial property, will not be allowed.
