The following information must be provided in order for us to proceed with our review. A) For any new hard surface area, for an asphaltic roof, or a roof containing HVAC machinery, a drainage plan for the site shall be prepared in compliance with Spokane County "Guidelines for Stormwater Management". At a minimum the plan must contain: l. Drainage calculations for stormwater volumes generated on site. 2. Calculations for total impervious surfaces contained within the site. 3. Finished grade elevations for structures to be constructed on site. 4. Finished grade elevations at the top and bottom of the 208 swale. 5. A typical cross section of the 208 swale. 6. Calculations to justify the number and type of drywells proposed. 7. Elevation of drywell inlets where applicable. 8. Copy of the proposed landscape plan. I Sub urface conditions not meeting Spokane County standards will re ire a design that is submitted by a Professional Engineer and ap roved by Spokane County through a design deviation from the , G'delines for Stormwater Management. The applicant should be a are that there is no guarantee a design deviation will be proved. Please contact a Professional Engineer as soon as ossible, if required, so as to not unnecessarily delay your ermit. B) The subject property is affected by the "Findings and Order" and the "Conditions of Approval" for the following land use action: Spokane County Zone Change No. ZE-7-94 C) The following improvements within adjacent Right of Way are required prior to the release of a building permit: 1. All required construction (sidewalk/curbing/pavement) within the Public Road Right of Way is to be completed prior to the release of a building permit or a financial guaranty in an amount estimated by the County Engineer to cover the cost of construction or improvements shall be filed with the County Engineer. Required plans are to be submitted prior to estimating the amount of the financial guaranty or permit release. 2. Approach permits must be obtained, after a site plan has been approved, and before the issuance of . a building permit, from the County Engineering Department for any new or improved driveway approaches to the following streets: a.Pines Road NOTE: Access permits to Pines Road must be approved by WSDOT. D) Insufficient information was submitted with the proposal. We are unable to proceed with our review. We will need the following before we can proceed: 1. Site Plan. 2. Drainage plan as specified. 3. Other information: a. A parking and traffic circulation plan shall . be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving as required by the County Planning Ordinance, will be required for any portion of the project which is to be occupied or traveled by vehicles. It is illegal to back out onto the Right of Way. b. The Washington State Department of Transportation appears to be agency of jurisdiction on this project and should therefore have their own signature block on the permit. E) Utility Condition: Permittee is responsible for arranging for all necessary utility adjustments or relocation as required for completion of the improvement. The applicant or their representative is responsible for including each item that is marked "Required By This Project" in ~ , Page 3 their submittal in accordance with the checklist descriptions. Each item submitted that is to meet the checklist shall be checked off by the applicant or their representative. Submittals which do not conform to the above requirements will be returned for further items with no review being accomplished. This will prolong the review process. Slope directions also need to be verified with spot elevations. 2) The area between swales B and C adjacent to the West property line will function as a ditch (not a Swale). 3) Sf swales B, C, and D are hydraulically connected, then they can be considered as one basin. 4) The basins for the roof drainage needs to be delineated. 5) The bottom area for each swale needs to be indicated on the site plan. Please indicate the elevation at the bottom of each swale . 6) Drywell grate elevations will also need to be provided. 7) Inlets and size calculations need to be indicated of each swale. 8) Right of Way dimensions, from centerline of adj acent roads to property lines need to appear on the plans. See attachements. " The development of this property and the reconstruction of the access makes no net increase in the runoff to the state highway. The changes to the private access road are also insignificant in terms of runoff and traffic generated. No new permit will be issued for the private road access north of this development. The members of the Committee present are: Jane Myers, Chair, and Brenda Bodenstein. PROPOSAL The sponsor, Mike Connelly requests approval of a Zone Reclassification, ZE-7-94 from Urban Residential-22 (UR-22) to Community Business (B-2) for development of a funeral home and those uses allowed in the Community Business (B-2) zone. FINDINGS OF FACT AND CONCLUSIONS ' 1. The property is generally located west of and adjacent to Pines Road (State Route 27) approximately 300 feet south of Maxwell Avenue in the NE 1/4 of Section 15, Township 25 North, Range 44 EWM, Spokane County, Washington. 2. The Committee adopts the Planning Department Report as a part of this record. 3. The existing land uses in the area are primarily businesses along the Pines Road commercial corridor and residenaal uses to the west of the corridor. 4. The proposed use is compatible with exisring uses in the area. 5. The Comprehensive Plan designates this site as Urban and Major Commercial. Approximately 80% of the site is located within the Major Commercial category of the Spokane County Comprehensive Plan, while 20% of the site is within the Urban category. Maior Commercial cateLyorv The Major Commercial category is intended to provide for the opportunity for development of commercial uses, specifically community and regional shopping centers and commercial uses directly related to major throughways. Urban cateeorv The westerly portion of the site lies within the Urban Category of the Comprehensive Plan. The Urban category,provides for development of a"city- lik e" env i r onm ent which includes various land uses includin g intensive residential development. The Urban category states that "Due to the variety and mix of land uses and activities found in the Urban Category, there are few land use activities that would be inappropriate." Performance standards are implemented to make d.iffering uses compatible. " n ` .J ' t HEC Order for ZE-7-94 Page 2 6. The proposed zoning does implement and conform to the Comprehensive Plan and is consistent with both the Urban and Major Commercial categories. 7. The Arterial Road Plan designates Pines Road (SR-27) as a State Highway. No additional right of way is requested. 8. The existing zoning of the property described in the application is Urban Residential-22 (UR-22) previously established as Residential Office (RO) zoning in 1977 (ZE-125-77) and redesignated to Urban Residential-22 (UR-22) on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. The proposal does conform to the requirements of the proposed Community Business (B-2) zone. 9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with and a Determination of Nonsignificance (DNS) was issued. The Committee, after independent review, hereby adopts the DNS. 10. The legal requirements for public notice have been fulfilled. 11. The owners of adjacent lands expressed neither approval nor disapproval of the . proposed use. 12. The applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed zone reclassification is justified. Specifically, changed conditions include the development of Pines Road as a commercial corridor, and the adoption of the Spokane County Comprehensive Plan and the Spokane County Zoning Code. 13. The proposed use will not be detrimental to the public health, safety, morals or welfare especially in light of the condirions recommended by the reviewin~ agencies. 14. The applicant, in a letter dated March 11, 1994, has agreed not to have funeral processions during peak P.M. hours as defined by Washington State Department of Transportation in conjunction with the Spokane County Engineering office. The Department of Transportation requests that the above agreement be placed as a condition of approval and supported by the State Environmental Policy Act (SEPA) to mitigate impacts to SR-27 and the intersecrion of SR-22 and I-90. 15. The Committee additionally finds/concludes: a. The Committee directs the Planning Deparnnent to work with the applicant to meet their design needs through appropriate provisions f.or administrative exceprions and variances as provided for in the Spokane County Zoning Code. b. Any use other than the funeral home proposed with the application shall require a Change of Conditions and new public hearing. HEC Order for ZE-7-94 Page 3 ~ CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The following Cond.itions of Approval apply to the real property described below: That portion of Tract 36 of Opportuniry, according to the plat recorded in Book "K" of Plats, Pages 20 through 23, in the NE 1/4 of Section 16, T 25N, R 44EWNi, Spokane County, Washington, described as follows: Commencing at the southeast corner of said Tract 36; thence N00°00'00"E, along the east line of said Tract 36, a distance of 409.70 feet; thence S89°42'00"W, 8.00, feet to the west line of Pines Road, and the POINT OF BEGINNING; thence continuing S89042'0011W, 242.00 feet; thence N00°00'00"E, 199.70 feet to the south line of the north 32.10 feet of said Tract 36; thence N89°48'41 "E, along said south line 242.00 feet to said west line of Pines Road; thence S00°00'00"W, along said west line, 199.23 feet to the Point of Beginning; containing 1.108 acres. HEARING ExAMINER COMMITTEE 1. Any use other than the funeral home proposed with the application shall require a change of conditions application and a new public hearing. SPOKANE COUNTY PLANNING DEPARTMENT 1. - The proposal shall comply with the Community Business (B-2) zone and the Aquifer Sensitive Area (ASA) overlay zone, as amended. 2. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Body. Variarions, when approved by the Planning Director/designee, may be pernutted, including, but not limited to building location, landscape plans and general allowable uses of the pernzitted zone. All variarions must conform to regulacions set forth in the Spokane County Zoning Code, and the original intent of the development plans shall be maintained. (See Hearing Examiner Condition No. 1) 3. Approval is required by the Planning Director/designee of a specific lighting and signing plan for the described property prior to the release of any building permits. 4. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired. 5. HEC Order for ZE-7-94 Page 6 SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met. 2. Air pollution regulations require that dust emissions during demolirion, construction and excavarion projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of acrivity during certain weather cond.itions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construction-related activiries. 3. SCAPCA strongly recommends that all traveled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean to minimize dust emissions. 4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. SCAPCA Regulation 1, Article V requires that a Notice of Construction and Application for Approval be submitted to and approved by our Auency prior to the construction, installation or establishment of an air pollution source. This includes . crematories. The Air Secrion does not address emissions from crematories, however the March 10, 1994 letter that is attached to the environmental checklist implies that a crematory will be installed Please contact our office for further information. 6. Debris generated as a result of this project must be disposed of by means other than burning (i.e construction waste, etc.) WASHINGTON STATE DEPARTMENT OF TRANSPORTATION 1.
