The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
9. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to 3ustify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The sub3ect property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Spokane County Zone Change No. ZE 48-86c
C) The following i.mprovements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engir.eer. Plans must be prepared for the following
streets:
a. Cataldo Ave. Typical Roadway Section #1
Local Access Standard.
Al1 required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction ar improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.
3. Applicant shall dedicate a 20 foot radius on

4. Please submit a capy of a recarded praperty deed
fram the Auditors office for the sublect property.

A. INTR ODUCTTON
This matcer having come before the Zoning Hearing Examiner Committee
0o February 4, 1988, and the members of the Committee present being
Jim Schuna, Chairman, and Ron Odell. Phillip D. Harris withdrew
because of a possible conflict of interest
B. PROPOSAL-
The spoasor, Cbarles E. SimpsoA, is requesting approval of a zone
reclassification, File No. ZE•48-86, Agricultural to Neighborhood
Business (B-1) Zone, for the purpose of retail and continued residential
use. Also, for a variance, File No. VE-112-87, to allow a
Neighborhood Business (B-l ) Zone to be located approximately 160 feet
from another B-1 Zone whereas Section 6. 24. 310 of the Zoning Code
requires a separation of at least 2,640 feet between B-1 Zones.
C. FINDTN G OF FACT
1 That the existing land use in the area is single family residences,
apartments, store, engineering/surveying office and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
MAJOR COMMERCIAL development.
3. That the existing zoning of the property described in the apglication
is Agricultural.
4 That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled
6 That the land in this area is suitable for tbe proposed use, or uses
within the proposed Zone Classification. . ~

C. EINDINCS OF FAGT ZE-48-87 & VE-112-87
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
10. The Hearing Examiner Comrnittee finds the proposed use to be in
harmony with the general purpose aad will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a1 That due to the uniqueness of the site and the fact that it has a
preexisting use as non-conforming, the Hearing Examiner
Committee does hereby direct the Zoning Administrator to use
some flexibility in implementing the 1V'eighborhood Business
(B-1) standards as stated in Planning Condition V.
b) That the Hearing Examiner Committee concurs with the "Planning
Surnmary" statements regarding the appropriateness of the zone
change and variance request.
D. CONDITIONS OR CONTINGEN[`iFS APPLIED TO THIS APPROVAL
(A.11 Conditions imposed by the Zoning Hearing Examiner Committee
shall be binding on the "Applicant", which term shall iaclude the owner
or owners of the property, heirs, assigns, and successors. )

1. Approval by the Zoning Administrator of a specific lighung and
signing plan for the described property prior to the release of any
building permits.
2 A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall be
installed and maintained such that sight dlstance at access points
is not obscured or impaired.
3. The specific development plan wiIl be submitted for Planning
Department review and approval prior to issuance of building
permits

4. All current standards of the Neighborhood Business (B-1) Zone,
as amended, shall be complied with in the development of this
site.
5. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay
Zone) of the SPOKANE COUNTY Z4NING ORDINANCE.
Accordingly, as a condition of approval, the sponsor/appiicant
shall be required to file with the Spokane County Auditor, within
thirty (30) days of the signing of Findings and Order of the final
decision in this matter, a''Notice to the Public" which shall
provide in material as follows:
PRIOR TQ THE ISSUANCE OF ANY BUILDING FERMIT OR
CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR
ANY USE ON THE PROPERTY DESCRIBED HEREINAFTER,
THE APPLICAI`TT SHALL BE RESPONSIBLE FOR
COMPLYING WITH THE PR4VISIONS OF SPOKANE COUNTY
ZONING ORDINANCE CHAPTER 4,16A (AQUIFER SENSITIVE
AREA OVERLAY ZONE). THE PROPERTY WHICH IS THE
SUBJECT OF THIS NOTICE IS M4RE PARTICULARLY
DESCRIBED AS FOLLOWS:.......
6. Any division of Iand for the purpose of sale, lease or traasfer,
shall comply with RCW 58-17 and the Spokane Couaty Platting
Ordinances prior to issuance of building permits.

7. That the portion of the site devated to business uses shall comply
witb the NeighbQrhood Business (B-1) Zone standards no Iater
than May 15, 1988. The remainder of the site shall comply at the
titne the existing use change to a B-1 use. This condition shall
ptovide some discretion to the Zoning Administrator but at a
minimunn shall include five (5) feet of landscaping along
Argonne, paved parking and sign compliance.
8. Applicant shall comply with ' 208' recommendatians concerning
stormwater runoff and provide necessary landscaping for runoff

2. Applicant shall submit for approval by the Spokane County
Eagineer road, drainage, and access plans.
3. The applicant shall snbmit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or any portion thereof, if the
development is to be phased.
4. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, location,
and arrangement of parking stalls shall be in accordance with
standard traffic engineering practices: Paving or surfacing as
approved by the County Engineer, will be required for any
portion of tbe project which is to be occupied or traveled by
vehicles.
5. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
6. All required improvements shall conform to the current State of
Washingtoa Standard Specifications for Road and Bridge
Consuuction, and other applicable County standards and/or
adopted resolutions pertaining to Road S tandards aod S tortnwater
Maaagement in effect at the date of construction, ualess otherwise
approved by the Couaty Engineer.
7. Roadway standards, typical roadway sections and drainage plan
requirements are found ia Spokane Board of County
Commissioners' Resolution No. 80-1592 as amended and are
applicable to this proposal.
8. No construction work is to be performed wlthin the existing or
proposed public right of way uatil a permit has been issued by the
County Engineer. All work within the public road right of way is
subJect to lnspection and approval by the County Engineer.
9. All required construction within the existing or proposed public
right of way is to be completed prior to the release of a building
permit or a bond in the amount estimated by the County Engineer
to cover the cost of construction of improvements shall be filed
with the County Engineer.

10. Applicant shall dedicate 10 feet on CatAldo and a 20 foot radius
on Argonne and Cataido.

b) COUNTY ENGINEERING DEPARTMENT
11. The County Engineer has designated Typical Roadway Section
Nurnber Orte, Access Street standard for the iniprovement of
Cataldo Avenue which is adjacent to the proposed development.
This will require the addition of approximately 10 to 12 feet of
asphalt along the frontage of the development. Curbing and
sidewalks must also be coasuucted.
c) COUNTY UTILITIES DEPARTMENT
S tandard:
1. Pursuant to Board of Couniy Commissioners Resolution No. 80-
0418, the use of on-site sewer disposal systems is hereby
authorized. This authorizauon is conditioned on compliance with
all rules and regulations of the Spokane County Health District
and is further condiuoned and subject to specific application
approval and issuance of permits by the Health District.
2. The Owner(s) or Successor(s) in interest agree to authorize the
County to piace their name(s) on a petition for the formation of a
ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to object
by the signing of a protest petition against the formation of a
ULID by resolution method pursuant to RCW Chapter 36.94
which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in accordance
with the Coordinated Water System Plan for Spokane Gounty, as
amended.
Special:
4. *Each new structure or change in occupancy shall be double
plumbed for connection for future area-wide collection systems.
*Only applies if modifying existing sewer system.
d) COU N TY HEALTH DISTRICT
S tandard:
1 Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.

2. Water service shall be coordinated through the Director of

by the Health 4fficer, the use of an individual on-site sewage
system may be authorized.
5. Use of private wells and water systems is prohibited.
e) COU NTY B U ILDIN G AN D S AFETY DEPARTMENT
Standard:
1. The site is located in Fire District #1.
2. No change shall be made in the character of occupancies or use of
any building which would place the building in a different
division of the same group of occupancy or in a different group of

1. Air pollution regulations require that dust emissions during

suspension of activlty during certain weather conditions. Haul
roads should be treated and emisslons from the transfer of earthen
materiat must be controlled as well as emissions from all other
construction related activities

2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or spills
occur on paved surfaces, measures must be taken immediately to
clean these surfaces
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. SCAPCA Regulation I, Article VI and SCAPCA Regulation II,
Article IV addresses emission standards. All emissioa standards
must be met.
5. Demolition and reaovation projects must comply with the
requirements of CFR 40 Part 61, Subpart M. Intent to Demolish
and Renovate forms are available at the SCAPCA office.
