The following information must be provided in order for us to proceed with our review. A) For any new hard surface area, for an asphaltic roof, or a roof containing HVAC machinery, a drainage plan for the site shall be prepared in compliance with Spokane County "Guidelines for Stormwater Management". At a minimum the plan must contain: 1. Drainage calculations for stormwater volumes generated on site. 2. Calculations for total impervious surfaces contained within the site. 3. Finished grade elevations for structures to be constructed on site. 9. Finished grade elevations at the top and bottom of the 208 swale. 5. A typical cross section of the 208 swale. 6. Calculations to 3ustify the number and type of drywells proposed. 7. Elevation of drywell inlets where applicable. 8. Copy of the proposed landscape plan. INTR ODUCTTON This matcer having come before the Zoning Hearing Examiner Committee 0o February 4, 1988, and the members of the Committee present being Jim Schuna, Chairman, and Ron Odell. Phillip D. Harris withdrew because of a possible conflict of interest B. PROPOSAL- The spoasor, Cbarles E. SimpsoA, is requesting approval of a zone reclassification, File No. ZE•48-86, Agricultural to Neighborhood Business (B-1) Zone, for the purpose of retail and continued residential use. Also, for a variance, File No. VE-112-87, to allow a Neighborhood Business (B-l ) Zone to be located approximately 160 feet from another B-1 Zone whereas Section 6. 24. 310 of the Zoning Code requires a separation of at least 2,640 feet between B-1 Zones. C. FINDTN G OF FACT 1 That the existing land use in the area is single family residences, apartments, store, engineering/surveying office and vacant. 2. That the Comprehensive Plan designates this area as appropriate for MAJOR COMMERCIAL development. 3. That the existing zoning of the property described in the apglication is Agricultural. 4 That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Determination of Non-Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled 6 That the land in this area is suitable for tbe proposed use, or uses within the proposed Zone Classification. . ~ s . e C. EINDINCS OF FAGT ZE-48-87 & VE-112-87 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is justified. 8. That the proposed use is compatible with existing uses in the area. 9. That the owners of adjacent lands expressed neither approval nor disapproval of the proposed use. 10. The Hearing Examiner Comrnittee finds the proposed use to be in harmony with the general purpose aad will not be otherwise detrimental to the public health, safety, and welfare. 11. The following are additional findings of fact considered by the Hearing Examiner Committee: a1 That due to the uniqueness of the site and the fact that it has a preexisting use as non-conforming, the Hearing Examiner Committee does hereby direct the Zoning Administrator to use some flexibility in implementing the 1V'eighborhood Business (B-1) standards as stated in Planning Condition V. b) That the Hearing Examiner Committee concurs with the "Planning Surnmary" statements regarding the appropriateness of the zone change and variance request. Accordingly, as a condition of approval, the sponsor/appiicant shall be required to file with the Spokane County Auditor, within thirty (30) days of the signing of Findings and Order of the final decision in this matter, a''Notice to the Public" which shall provide in material as follows: PRIOR TQ THE ISSUANCE OF ANY BUILDING FERMIT OR CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICAI`TT SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PR4VISIONS OF SPOKANE COUNTY ZONING ORDINANCE CHAPTER 4,16A (AQUIFER SENSITIVE AREA OVERLAY ZONE). The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices: Paving or surfacing as approved by the County Engineer, will be required for any portion of tbe project which is to be occupied or traveled by vehicles. 5. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 6. All required improvements shall conform to the current State of Washingtoa Standard Specifications for Road and Bridge Consuuction, and other applicable County standards and/or adopted resolutions pertaining to Road S tandards aod S tortnwater Maaagement in effect at the date of construction, ualess otherwise approved by the Couaty Engineer. 7. The County Engineer has designated Typical Roadway Section Nurnber Orte, Access Street standard for the iniprovement of Cataldo Avenue which is adjacent to the proposed development. This will require the addition of approximately 10 to 12 feet of asphalt along the frontage of the development. Curbing and sidewalks must also be coasuucted. c) COUNTY UTILITIES DEPARTMENT S tandard: 1. Pursuant to Board of Couniy Commissioners Resolution No. 80- 0418, the use of on-site sewer disposal systems is hereby authorized. This authorizauon is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further condiuoned and subject to specific application approval and issuance of permits by the Health District. 2. The Owner(s) or Successor(s) in interest agree to authorize the County to piace their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane Gounty, as amended. No change shall be made in the character of occupancies or use of any building which would place the building in a different division of the same group of occupancy or in a different group of occupancies, without first obtaining a change in use permit from the Department of Building and Safety. Water Purveyor is Hutchinson Irrigatzon District #16, and they will supply tbe site with adequate water for domestic, fire and irrigation uses g) C4UIYTY AIR POLLUTION CONTR4L AUTHORITY All air pollution re„gulations must be met. This includes but is nat limitcd ta the followingz 1. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activlty during certain weather conditions.
