The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site. '
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Spokane County Zone Change No. ZE-48-89
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
l. Approach permits must be obtained, after a site
plan has been approved, and before the issuance of
a building permit, from the County Engineering
Department for any new or improved driveway
approaches to the following streets:
a. Argonne
b. Mullan
c. Valley Way D) Insuff icient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
l. Site Plan.
2. Drainage plan as specif ied.

3. Other information:
a. A parking and traff ic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles. It is illegal to back out onto the Right of Way.
b. Approaches that are to be abandoned must be
replaced with County standard curb and sidewalk.
E) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
F) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Off ice. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
Only after all the information and requirements listed above
are supplied or completed and the necessary review has been
accomplished will your building permit be released.

FINDINCS QF FACT_ CONCLUSIONS AND ORDER
INTRODUCTION
This matter having come before the Hearing Examiner Committee on Ja.nuary 18,
1990, and the members of the Committee present being Jane Myers, Chairperson,
Bud Skadan and Lunell Haught.
PROPOSAL
The sponsor, Prokey G. Arger, requests approval of a zone reclassification from
Agricultural (A) to Regional Business (B-3), File No. ZE-48-89 for the purpose of
developing professional offices; and a Variance from front yard setback, File
No. VE-89-89.
FINDINGS O F FACT AND CONCLUSIONS
1. The property is generally located in the Spokane Valley, south of and adjacent to
Valley Way, between Argonne and Mullan Roads in Section 17, Township 25 N.,
Range 44 EWM, Spokane County, Washington.
2. The committee adopts the Planning Department Report as a part of this record.
3. The existing land use(s) in the area are offices, commercial activities, churches and
single family dwellings.
4, The Comprehensive Plan designates this site as Major Commercial. The Major
Commercial category is for the purpose of encouraging a variety of commercial
development units.
5. The Arterial Road Plan designates Argonne and Mullan Roads as Principal Arterials.
Valley Way is designated as a Collector Arterial, with a recommended right of way
width of 70'. The existing Argonne - Mullan Corridor (one-way system) serves to
implement the Arterial Road Plan.
6. The existing zoning of the property described in the application is Agricultural,
previously established in 1947.
7. The provisions of RCW 43.21C ('Ihe State Environmental Policy Act) have been
complied with and a Deternunation of Nonsignificance was issued.
8. The proper legal requirements for advertisement and notice have been fulfilled.
9. The owners of adjacent lands expressed neither approval or disapproval of the
proposed use. 10. The Committee addirionally finds that provision of additional landscaping adjacent to streets, off-street parking areas, and site perimeter will further implement aesthetic
corridor policies of the major commercial category of the Comprehensive Plan.

' 11. The proposed use is comparible with existing uses in the area.
12. The proposed zoning does implement and conform to the Comprehensive Plan.
13. The applicant has demonstrated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified.
14. The proposed use will not be detrimental to the public health, safety, morals or
welfare.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Conditions of Approval apply to the following real property:
Opportunity, portion of Block 140, West 1/2 EXC South 1.5 Acres and EXC South
180 Ft. Lyg North of South 1.5 Acres and EXC West 90 ft. of North 115 ft. and

The proposed Regional Business (B-3) Zone serves to implement the Major
Commercial categary of the Comprehensive Plan, and is consistent with previous
land use decisions to approve Commercial and Regional Business (B-3) Zones within
the Argonne/Mullan corridor. Past decisions, however, have generally attempted
(and usually succeeded) to establish a high degree of aesthetic quality for
development in the carridor. Aesthetic conmol measures have included use
restrictions (above those of the Zoning Code), sign limitations, increased
landscaping, and various screening/buffering techniques. These policies have led to
an adopted policy through a Comprehensive Plan Amendment in December of 1988.
Aesthetic policies applicable to proposed development encourage provision of
sufficient setbacks adjacent arterials, landscaping of perimeter and off-street parlang
areas, and reduction in signage.

and approximately 11.5 feet from property line; whereas Spokane County Zoning
Code requires a setback of 65 feet from centerline and 35 feet from property line.
Variance request is supported by fact that site abuts three streets (Argorine, Mullan,
and Valley Way), thereby cneating a unique circumstance of the lot having to
maintain three front yard setbacks. In addition, only the canopy partion of the
structure intrudes into the required setback area, while the principal structure
exceeds all other required setbacks. Canopy design is "open" for drive thru access,
and will not result in solid wall within setback area adjacent to Argonne Road.
Visual impact of variance request is mitigated by open canopy design. Maintenance
of front yard setback on three sides does create a hardship for development of site,
and hard.ship is narm.ally sufficient criteria necessary to approve variance requests
of this nature. Although adopted aesthetic corridor policies reccxnmend sufficient
setbacks from adjacent arterials, the above statements should mitigate any
inconsistency with adopted policy.

The site plan submitted far review by the Hearing Examiner Committee is
general in nature. Detailed review to deternune compliance with all Ordinance
regulations and condirions of approval is recommended to be administrative and
to occur at the Building Permit stage.

III. SITE DEVELOPMENT RECOMMENDATIONS
Design: Intent of site plan is to develop a three-story building in phases, as expansion of
existing Center Pointe Business Park. Previous development by applicant (to east
and south) included cedar exteriors, minimal signage, and high degree of aesthetic
treatrnent Recommend site development consistent with existing, adjacent use to
further aesthetic continuity of Argonne/Mullan corridor. Site plan revision may be
required if Hearing Examiner Committee does not support proposed setback variance.
Recommend administraave review of subsequent site development plan, building
elevations, etc. to ensure compliance with aesthetic corridor policy.
B uffering/Landsca ping: To augment proposed landscape plan and generate
consistency with commercial aesthetic corridor policies, recommend provision of a 5
foot strip of Type I landscaping (in addition to proposed landscaping) adjacent to
streets and off-street paridng areas at site perimeter. Recommend administrative
review of detailed landscaping plan prior to release of building permit.
Signage: To implement aesthetic corridor policies, the Planning Department recommends '
compliance with B-3 standards as per Spokane County Zoning Code, with limitation
of two detached signs with a maximum height of 20 feet
Circulation/Access: Site plan illustrates one access point to both Argonne and Mullan
Roads, and three accesses to Valley Way. Traffic and circulation plan to be reviewed
and approved by Spokane County Engineer.

IV. SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Depart:ment The review considered the specifics of the proposal,
other available infarmation, County ordinances, other regulations and laws, possible
standand Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has detetmined that No
probable significant adverse unpacts" would result from the proposal being developed
and has issued a Determination of Nonsignificance ("DNS").
The "DNS" was circulated to 6 other agencies of jurisdiction and other agencies/
departments affected by the futune development for review and comment. The "DNS"
comment period ends January 16, 1990 and was advertised 15 calendar days before
said date in the newspaper, by letter to adjacent property owners within 400 feet of the
proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner
may consider additional environmental related testimony at the public hearing.
V . PLANNING DEPARTMENT SUMMARY
Proposed zone change and variance are consistent with and implement decision
guidelines of the Major Commercial category of the Comprehensive Plan. Proposed
use is consistent with existing uses in the area and previous land use actions along
Argonne/Mullan corridor. Planning Department recommends approval of proposed
zone change and variance as conditioned.

1. Reirnburse Spokane County for project review and inspection fees as specified in
Board of County Comraissioner's Resolution 80-1592 attachment C, as amended.
The fees will be based on actual satary costs incurred by Spokane County for project
reviews and / or inspections plus a ten percent administrative charge, and wili be
billed monthly as accrued.
2. The undersigned agrees that these fees are, due and payable upon receipt of the

Thank-you for the submittal of a revised landscape plan as requested for review for
compliance of the proposed Washington Trust Bank with the Zoning Code of Spokane
County and conditions of approval for zone reclassification, file no. ZE-48-89C.
Cunrently, the landscape plan is being reviewed for compliance with conditions of approval
for ZE-48-89C which requires a Type I landscape strip, five feet in width adjacent to
streets, -off-street parking areas and along the perimeters of the site.
In response to your letter dated October 18, 1993 in regard to questions an/or clarificarion's
, regard.ing clear view triangle requirements as they apply to points of site ingress/egress, .
this deparnnent has the following comments.
1) In a recent discussion with Bob Turner of the County Engineer's Off'ice, this
departiment was informed the clear view triangle is reduced in size at points of site
ingress/egress as traffic is not as intense at these locations as traffic within public
rights-of-way. Also,'traffic at points of site ingress/egress is moving at a much lower
rate of speed than traffic within public streets. Therefore, the clear view triangle at
points of site ingress/egress does not require the expanded clear view triangle dista.nces
as applied to intersections of public rights-of-way. *
2) The clear view triangle that was described to you was that noted within the AASHTO ,
design standards and as described by Bob Turner of the County Engineer's Office.
However, it does appear that the standard varies in regard to the speed of traffic into
which a vehicle wi11 be entering. The appropriate clear view triangle was drawn onto
the revised landscape plan submitted to this office on October 28, 1993 and it was
'found the described triangle was much too excessive for this project. Please, refer to
the enclosed handout copied from AASHTO, the national design standard manual for
streets and highways. In response to your discussion with Bob Turner pertai.ning to
the clear view triangle standards, his recollection of yotu conversation was that he did
