PLAIVS: A detailed landscaping plan is required. No junipers or
pines are allowed in or around the 208 swale.
Provide a detail of the roof drainage system. Do the roof gutters
all lead to the back of the building and into the swale at a common
point?
Show sufficient spot elevations on all hard surfaced areas, i.e.
parking lot and private road, to verify grades and assure a minimum
of 1% qrade.
Provide more detail on how the runoff is to be channeled to the 208
swale. This applies to the private road, specifically detail and
call out the inlet for Basin A, and the parking lot. Basin A is
confusing because you have flow arrows indicatinq that flow qoes
into the parking area yet the road detail calls out no curb
adjacent to Basin A, more detail is required.
Your drywell sizes appear to be reversed. 5,000 square feet of hard
suxface needs a type I drywell. 15, 000 square feet of hard surface
needs a type II drywell.

. INTRODUCTION
This matter having come before the Hearing Examiner Committee on August 8,
1980, and the members of the Committee present being Ted McCoury Acting,
Chairman, Eldon Thonnas and Kenneth Kennedy.
. PROPOSAL
The sponsor, Lyle L. Johnson is requesting approval of a ione reclassification,
File No. ZE-101-80, Agricultural Suburban to Restricted Industrial, for the
purpose of developing 6 warehouse structures.
FINDINGS aF FACT
1. That the existing land use in the area is residential, schooi.. I-90, and junk
yard.
2. That the Comprehensive Pian designates this area as appropriate for
residential development.
3. That the existing zoning of the property described in the application is
Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been compiied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have substantiatly
changed since the original zontng of this area and accordingly, the pro-
posed rezone rs justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed approvai, disapproval both of
the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the pubtic
health, safety, and welfare.

D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a) COUNTY FI RE MARSHAL
1. The site is located in Fire District #1.
2. Adequate water for fire protection ahd distribution of such water shall
be required for this project. A plot plan showing water distribution
and emergency vehicle access is required for approvat prior to any
land development or use.
b) COUNTY ENGINEER
1. Applicant shall dedicate 5 feet for road right-of-way along Ella Road
adjacent to the applicant's property to be at the time there would be a
( LI D) Local Improvement District or ( R i D) Road Improvement District
p roposed .
2. Recommend vacation of existing Boone Avenue from a point 230 feet
west of the centerline of existing Ella Road as directed by the County
Engineer, which shall be accomplished prior to issuance of any
building permits.
3. Applicant shall construct and pave a delineated approach to Park
Road.
4. A detailed combined on-site sewage system and surface water disposal
plan for the entire project shall be approved by the Spokane County
Engineer and the Spokane County Health District prior to the issuance
of any buildfng permit.
5. That all areas on site which will be traversed by vehicular traffic shall -
be paved. 6. Access to Ella Road to be prohibited at this time.
c) WATER PURVEYOR
1. Purveyor is Washington Water Power District #1 and they will supply
the site with adequate water for domestic fi re and irrigation uses.
d) COUNTY HEALTH DISTRICT
1. Findings:
a) This project lies over the Spokane Aquifer.
b) It is within Critical Water Supply Service Area No. 3, and within
the service area of Washington Water Power Company.
Groundwater resources appear adequate to support development at
this density.

4n Thursday, February 25, 1993, 8i11 Hemmings axYd Bob Turner met with Lyle
Johrtson. The subject of the meeting was the storm drainaqe requirements for
the project on N. 1104 Park Road. Mr. Johnson praduced an on-site road plan
for the site prepared in 1981. The road plan shvwed road drainage gving to
rlrywells in the curbline but the pian had no appraval stamp from the Caunty
Engineers Degartment. Mr. Johnson cantendted that site plan, including the on-
site raac3 plan, dane in 1981 shauld meet all the drainage requirernents for
his current per,mit application. Mr. Johnson was told that we could not aecept '
the plans done in 1981 because the road pl.an was neuer apgsoved.and the time
allowance fvr projects af two years wa.th a two year e~ensxan had been
exceeded.
Mr. Johnson was told many times that his permit application far the warehouse
was approvable i€ he would prepare an adequate drainaqe plan far the
wareb►ouse and the associated parkinq and travel surfaces. 1Kr. . Johnson wanted
approval for the entire parcel af propexty based on his 1981 plans. We told
Mr. J+ahnson that each site wouid be required to submit an individual eite
drainage plan vr the entire site sbould be cavered with one site drainage
plan. Mr. Johnson said that he would involve his lawyer in the matter.

The County Engineering Department has completed a review of
the above referenced project. T'he following information must be
provideci in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in complfance with
Spokane County "Guidelines for Stormwater Manaqement". At
a mini.mum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the followinq
land use action:
1. Spokane County Zone Chanqe No. ZE-101-80
C) The following improvements within adjacent Riqht of Way
are required prior to the release of a building permit:
1. 5 feet of Right of Way dedication on Ella.
2. Please submit a copy of a recorded property deed
from the Auditors office for the subject property.
Upon receipt of the deed our staff will prepare the
Right of Way docwnent.
D) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Drainage plan as specified.
2. Other information: .
a. The site is in an identified flood plain.
Please contact Brenda Sims to determine your
requirements prior to building permit release.

b. A parking'and traffic circulation plan shall
be submitted and apprcved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles.
E) Utility Condition: Permittee is responsible for arranqing
for all necessary utility adjustments or relocation as
required for completion of the improvement.
F) The owner of the property or the authorized
representative must complete and siqn Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Enqineers Offfce. Plan revfew will
not be completed until this document is exeauted. This
document is attached to these comments. Please return
the completed Aqreement to your contact person at the
Engineers Department.
Only after all the information and requirements listed above
are supplied or completed and the necessary review has been
accomplished will your building permit be released.

Gary, I need to summarize what is happeninq with this project for you and get
your input on some larger questions. First, the agreement to pay fees was
conditioned by Mr. Johnson to a limit of $120.00. He got this fiqure from my
estimate of 2-4 hours review (which was made before the plans were submitted)
and Steve Cases' information about my billing rate. I had Lyle come in to the
office to discuss this and he was unwillinq to sign an agreement to pay fees
that didn't bave a limit on it. We agreed that the conditioned aqreement to
pay fees would be used. We agreed that if the $120.00 limit was reached then
he would come in to sign another agreement or discuss the situation further
with the County Lngineer.
~ I asked Srenda Sims what charges she might have accrued against this project
in issuinq Lyle a flood permit. She said that she didn't feel comfortable
charging Mr. Johnson for her consultation ti.me associated with the flood
permit. However, she did bring up the point that the original drainage plan
of 2 0+ drywells on sf te was never installed. She pointed out that Mr. Johnson
admitted that the site flaods regularly and that he never installed any
° drywells on site as the drainage called for. Brenda said that she wouldn't
want 20+ drywells to be installed now anyway.
I do not have a copy of the original drainaqe plan. I do have a copy of a
site plan with your note saying that, "Drainage plan concept has been
approved by the County Engineer. Building permit may now be issued from the
standpoint of the count Engineer's Department" May 27, 1981. I have received
a site plan for the new buildinq for which they are trying to qet a permit.
The drainage plan shows 208 for the building and parking lot but not the
° extension of the internal road to the building. The 208 design is the 112 inch
rule" which takes the f irst 2 inches af runoff instead of the f irst 1/ 2 inch.
This design eliminates the need for a drywell.
My questions about this site are first, do we want to pursue an overall
drainage plan? Do we want to allow the original 20+ drywells or implement
208? Do we want to allow the plan as submitted and then take care of the
~ drainage problems as new permits come in? There is some concern about letting
new permits take care of the drainage. The property has been aggreqated
thorough a C of E into one parcel and Lyle could possibly put in more
buildings without a new permit.

deteamined. The fire hydrants shall be installed as pa an approved water plan.
Prior to the prepantion of the waLer plan, the applicant shall oontact Spokkanne
County Water Dishici No. 3(536-0121) as soon as possible to obtain the
purveyor requiremeants including specifiicatioxts. The waw plan sball contain the
location of the hydrant, hydrant a,ssernbly detail, and plumbing detail. The water
plan shall be submitted to the fire distiict and water purveyor for approval prior

a roof containinq HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
i. Drainaqe calculations for stormwater volumes

3. Finished grade elevations for structures to be
constructed on site.
4. Finfshed grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.

8. Copy of the proposed landscape plan.

Gentlemen:
We are proposing to build a warehouse at the above location
which is to be built per the site plan enclosed. The area
to the rear of the building is scheduled to be used as a
track vehicle storage. There areno egresses oringresses
from the storage area to the public roadwaX and it will be
of road oi1-pave on crushed rock. The area wYll be a pre-
ared weed-killed base from the building to the barked
area and will be serviced annuall . This area will not
be used by the general public which will alleviate any
due adverse air quality.
The plan shows the proposed action size of.areas and
general requirements with the project scheduled to be
less than 6 months in duration subject to weather condi-
tions.
We trust you will review in our favor and we will take the
necessary steps to heed the regulations.

Request #PW036
After review of the paving waiver request application, #PW036, that was provided to us by
Lyle L. Johnson, SCAPCA makes the following recommendation.
It is SCAPCA's opinion that the travelled surfaces, parking areas, and storage areas at the site
be paved. These recommendations are based on the facts listed below.
1. The site is in the Spokane County PM 10 Non-Attainment Area. In faci it is an area
where the air quality is impacted by fugitive dust emissions. The fugitive emissions
result from vehicular travel on unpaved surfaces and also from re-suspended road dust
which can occur when dirt and mud are tracked from unpaved surfaces onto paved
roadways.
2. The site is located on Park Road which is a fairty busy street with many businesses
and residences on it. Also, the proposed site is adjacent to a school and recreational
facility.
3. The proponent proposes to use gravel to control dust. While this may be a fairly
effective technique, it requires repeated applications and monitoring for effectiveness.
Paving is a more effective, long-term solution to dust probiems. The proponent also
plans to fence the unpaved areas.
4. The applicant states that the site will be leased and cannot estimate the traffic
counts through the unpaved areas. Leased warehouse space may have minimal traffic
with certain uses, however there is no guarantee of this, and future uses of the site
may increase traffic.
5. Historically peving waivers have been granted in very limited circumstances, for
instance if there is cleated vehicle use, if the srte is unmanned and visited infrequently,
if the site is very remote, etc... None of these special circumstances are appticable to
this case.
