accordingly initiated these Coi ferences. Comments to date iiidicate the conferences are successful and do

23 was completed a month ago, ro,ughly, and the

20 we would prefer a Mullan address.

22 address.

6 Medical Buildinq is located on Parcel
7 45172.1223. The zone of this parcel is B-2 in
8 which a medical office and retail use is
9 allowed. Related Planning Department actions
10 include a recent zone change, File No.
11 ZE-23-92C, for which there are conditions which
12 the applicant shall meet.

16 Also a certificate of exemption has
17 been approved for a minor lot line adjustment
18 for this site, File No. CE-286-92.
19 The Planninq Department is going to

22 in regard to the Flanking street yard setback

24 You have it dimensioned out at 35
25 feet. I have scaled it at 34 feet. And the

9 qet I don't know if we'll get 35 or 34. I
10 suppose it depends on where you're measuring,

13 the northwest corner of the buildinq over
14 because that is the closest to the property
15 line.
16 MR. SILVEY: I would say at this
17 point it may be 34 feet. If we need an
18 administrative setback for that, we'd want
19 that.

24 for the administrative exception once you've

2 dimensions state it's 35 feet, and it's scaled
3 at 34 feet. And what we would need you to do
4 is verify what you want to do; the scaled
5 dimension or the called-out dimension.
6 And I notice also that on the Site
7 Plan submitted for the rezone, it was called
8 out at 35 feet, but it was caught at 34 feet.
9 It's somethinq you're qoing to have
10 to determine.

12 MS. SHAW: All right. We need you
13 to note buildinq heiqht, not only in stories,
14 but in feet above grade. The Code requires
15 structures within the B-2 zone which are within
16 150 feet of a residential zone to be no higher
17 than 35 feet. That's maximum roof peak to
18 grade. 19 MR. DAVIS: Excuse me, Francine.
20 Did the construction drawings have an
21 elevation?

17 Plan indicates a sign at the corner of Broadway
18 and Mullan.

24 that sign, the Planninq Department will require

3 A 20-foot, Type 1 landscaped strip
4 is required along the east and north property
5 lines due to the fact that adjacent zoning is
6 UR-3.5.
7 However, durinq the 2one change an
8 administrative decision was made which allowed
9 those areas to be reduced in width because over
10 15 percent of the site has been dedicated to
11 landscaping. And Code allows us to make an
12 administrative waiver based upon that.
13 However, a Type 1 is still required.
14 And a Type 1 landscape strip is a dense
15 screeninq of for a buffer for adjacent
16 residential uses.
17 You need to beef up the landscaping
18 such that the Type 1 definition is met.
19 MR. SILVEY: On the east?
20 MS. SHAW: North and east. I also
21 am concerned about the Type 3 landscape strip
22 along Mullan and Broadway. It shows swaled
23 areas in sod and trees.
24 Type 3 requires you to include
25 shrubbery, evergreen and deciduous. So if you

1 could put in a~diti'onal plantings, such as the
2 Type 3 definition, I would appxeciate that.
3 MR. SILVEY: Do we have to? Could
4 it be from a maintenance standpoint
5 MS. SHAN: I can see what relief the
6 Planning Department can give in regard to that.

19 passibi~ity. , We can f t have anything of a
20 decxduous tree in the bottom of the 208. ~e

24 shade killing the grass. The grass is the

3 different area. We're not concerned about that
4 as we are the bottom.
5 MR. SILVEY: But from a practical
6 standpoint, that becomes real impractical to
7 have a row of these at the edqe of the top
8 slope, because all the bark and junk rolls down
9 into the 208, and it gets real nasty. We•ve
10 done that before, and it's a problem.
11 MR. WISENOR: How about the heiqht
12 in this five foot here, for traffic, or is that
13 for site

15 clearview triangle, there, and he does not have
16 plantings in there, and that's okay.
17 MR. SILVEY: I think we are
18 althouqh I don't recall off the Plan but I
19 think we're thinkinq more decorative, you know,
20 small flowering trees along in there that would
21 be in that area. '

23 what you're saying. I believe what you've done
24 is a very good attempt.

4 spirit of what you're asking better than to put
5 the shrubs up around the top and have it look
6 I mean, you can look at some of them at the
7 Circle K and see what those landscaped
8 sidebanks are lookinq like riqht across the
9 street, and they look bad.
10 MS. SHAW: I'll see what I can do

17 that is not going to be used as curb access.
18 Therefore that sidewalk should be replaced.

24 move the existing approach that's there on the

9 up the site on Mullan. That would have to be

14 Your Plan is showinq a handicap access on the
15 corner of Broadway and Mullan. That does not
16 exist at that point in time. We're assuminq
17 that that's what that indicated. And unless at
18 this point in time you're agreeinq to put one

21 planning on it. ,
22 MR. HARPER: It's just a point of
23 information. The other thing,is to show
24 existing utilities. We also have and in

8 the site on Mullan Road (indicating). .

3 this cleanout is reversed and it's qoinq

8 going upstream. I did note this note over
9 here, but what you're going to do is put a line
10 in that's totally separate from the building,
11 sewer, and then what you do is cut this line in
12 the future and put the fitting in.

14 they want us to stub this future sewer to?
15 MR. WAY: Unless we've completed our
16 field review, we'll send it to the Utilities
17 Department. They draw in on the Plan where
18 they want it and specify the type of materials.

20 or Mullan. We have no idea whether there will
21 ever be a sewer on North MullaT). Hopefully
22 there will be.

for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order " and the "Conditions of Approval" for the zone
change ZE-23-92. This permit shall comply with all
conditions of the zone change.
C) Approach permits must be obtained from the County
Engineering Department for driveway approaches to

FINDINGS ()F F C nNCL[JSXONS AND QRDEk- INTRODUCTION
This matter has come before the Hea.ring Examiner Committee on 7une 18, 1992.
The members of the Committee present are Phil Harris, Chairperson, Lunell Haught
and Verona Southern.
FROPOSAL
The sponsor, Mike Silvey, requests approval of a Zone Reclassif'icadon, ZE-23-92,
from Urban Residenrial-3.5 (UR-3.5) to Regional Business (B-2) within the Aquifer
Sensitive Area 4verlay zone.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located in the Spokane Valley, on the northeast corner of the
interseetion of Broadway Avenue and Mullan Road in Section 17, Township 25 N.,
Range 45 EWM, Spokane County, Washington.
2. The committee adopts the Planning Department Report as a part of ttus record.
3. The existulg land use(s) in the area are a Circle K convenience store and a
medical/professional building to the west and established single family
neighborhoods to the east.
4. The Comprehensive Plan designates this site as Major Cocnmercial. The Major
Commercial category is for the purpose of promoting commercial development,
including medical and professional office buildings.
5. The Arterial Road Pla.n designates MullZn Road and Broddway Aventle as I'rincipal
artcnals, with a recommended nght of way width of 100 feet.
6 The existing zoning of the property described in the application is Urban Residential-
3.5 (UR-3.5), previously establishecl in 1991.
7. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Determanation of Nonsignificance was issued
8. The legal requzrr.ments for public iiorice havc been fulfilled.
9. The owners of adjacent Iands expressed neither approval nor disapproval of the
proposed use.
10. The proposed use is compatible with existing uses in the area.
11. The proposed zoning does implement and conforrn to the Comprehensive Plan

12. The applicant has demonstrated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified.
13. The proposed use will not be detrimental to the public health, safety, morals or
welfare.
CONDITIONS OR CONTINGENCIES APPLIED TO THYS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
`"A'pplicant," which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Conditions of Approval apply to the real property described below:
That portion of the East half of Tract 61 of OPPORTUNITY, as per plat thereof
recorded in Volunne K" of Plats, page 20, described as follows: Beginning at
a poi.nt 217.75 feet West and 334.02 feet South of the Northeast corner of Tract
61; thence South 314.02 feet to the South line of Said Tract; thence West 103.68 feet more or less to the West line of the East half of Tract 61; thence '~torth'ion tie West Iine of the East half oF said Tract and thence East~t""o`~ie point

westerly to a point lying 10 feet north of the south line of Block 61, and 23 feet ~
west of the east line of the West Half of block 61; thence northwesterly to a
point lying 25 feet north of the south line of Block 61, and 40 feet wes-t of the r east line of the West Half of Block 61; thence northeasterly on aline to a point .'}1}~ing 1.0 feet west of the east line of rhe West ~-~alf of Block 61; and 334.07 feet ,
south of the north line of Block 61; thence southerly along the east line of the
VVest Half of Block 61, to the Point of Beginning. Located in the Northwest
Quarter of Section-17, Township 25 North, Range 44 E.W M.
SP4KANE COUNTY PLANNING DEYAR'rMENT
1. The proposal sha.ll comply with the Community Business (B-2) zone(s) as
amended.
2. The appltcant shall develop subject property generally in accordance wlthin the
concept presented to the Hearing Body. Wariations, when appraved by the
Planning Director/designee, niay be pennitted, including, but not limited to building
location, landscape plans and general allowable uses of the permitted zone. All
variations must confonn to regulations set forth in the Spokane County Loning
Ordinance, and the original intent of the development plans shall be maintained.
3. Approvcii is required by the Planning Director/designee of a specific lighbng and
signing plan for the described property pnor to the release of any building permits

The landscape plan as submitted is in general compliance with the Zoning Code
considering the 15% rule within the landscaping section.
4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for tiie project prior to release of building permits. Landscaping sha,l.l be
installed and maintained so that sight distance at access points is not obscured or
impaired.
5. Direct light from any exterior area lighting fixture sha.ll not extend over the properry
; boundary. 6. The Spokane County Planning Department shall prepare and record with the
County Auditor a Title Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Planning Department. The notice.should be
recorded within the same time frame as an appeal and shall provide the follounng:
a. At least lb feet of reserved future acquisition area for road right-of-way and ~
utilities, in addition to the existing and/or newly dedicated right-of-way along
Broadway Avenue. NOTE: The County Engineer has required right of way
dedication equalling 34 feet from the centerline of Broadway Avenue. ~C
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition azea.
c. No requiz-ed la.ndscaping, parking, '208' areas, drainfield or allowed signs
shouid be located within the future acquisition area for road right-of-way and
utilides. If ai1y of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acqulsition area, until acquired, sllall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The proper(y owner shall be responsible for relocating such "interim"
improvements at the time Sgokane County makes roadway improvements
after acquiring sa.id future acquisition area.
SF'OKANE COUNTY DIVISION OF ENGINEERING ANll ROADS
Pnor to Issuance af a buildine permit or at the reauest to the Countv Ene-ineer in coniunction
with a Countv Road Proiect/road Imvrovement District, whichever action comes first

1. Applicant shall dedicate right of way which equals 34 feet from centerline on
Broadway Avenue for right-of-way purposes.

3. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
4. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
5. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project, or portion thereof, if the
` development is to be phased.
6. A parking plan and traffic circularion plan shall be subnutted and approved by the
Spokane County Engineer. The design, locarion and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
7. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
8. Applicant shall construct a paved and delineated approach(es) to meet the existing
pavement on Broadway Avenue and Mullan Road.
9. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
10. No construcrion work shall be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by t11e
County Engineer.
11. The County Arterial Road Plan idenlifies Broadway Avenue as a Pnncipal Artenal
The existing right-of-way width of 55 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addltion to the required
right-of-way dedication, a strip of property to equal 50 feet from centerline in widul y
along the Broadway Avenue frontage shall be set aside in reserve. This property
may be acquired by Spokane County at the fime when arterial improvements are
made to Broadway Avenue. -
12. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisltion.
Spokane County assumes no financial obligarion for adjustinents or relocation
regarding these utilines. Applicant(s) should check with the applicable utihty
purveyor and the Spokane County Engineer to detern-iine whethr;r appllcant(s) or
the utility is responsible for adjustrnent or relocation costs and to make .
arrangements for any necessary work.

SPOKANE COUNTY DIVISION OF UTILITIES
1. Pursuant to the Board of County Commissioners Resolurion No. 80-0418, the use
of on-site sewer disposal systems is hereby authorized. This authorization is
conditioned on compliance with all rules and regulations of the Spokane County
Health I?istrict and is further conditioned and subject to specific application
approval and issuance of permits by the Health District.
2. The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petirion method pursuant to
` RCW 36.94, which petition includes the owner(s)' property; and further not to
object by the signing of a protest petition against the formarion of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED, this cond.ition shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property a5 a result of
improvements called for in conjunction with the formation of a ULID by either
petition or resolution method under RCW Chapter 36.94.
3. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
4. Each new unit shall be double-plumbed for connection to future areawide collection
systems.
SPOKANE COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan sha11 be approved by
the Spokane County Engineer and the Spokane County Health District prior to the
issuance of any on-site sewage disposal pernut or building permit for this project
2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
3. Water service shall be coordi.nated through the Director of Utilities, Spokane
County.
4. Water service shall be by an existing publlc water supply when approved by the
Regional Engineer (Spokane), State Departt-iient of Health.
5. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
6. Subject to specific application approval and issuance of pernuts by the health
officer, the use of individual on-site sewage disposal system(s) may be authonzed
7. Use of private wells and water systems is prohibited.
SPOKANE COUNTY DIVYSION OF BUILDINGS
l The applicant shall contact the Department of Building and Safety at the earliest
possible stage of design/development ln order to be informed of code requlremeiits

administereti/enforced by the department, e.g., State Building Code Act
regulations, such as requirements for fire hydrant/flow, fire apparatus access roads,
street address assignment, barrier-free regularions, energy code regularions and
general coordinarion with other aspects of project implementanon.
2. Requirements of Fire District No. 1 need to be satisFied during the building pernut
process.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. ` All air pollution regulations must be met. This includes but is not lunited to the
following:
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
conrrolled, as well as emissions from all other construction-related activities.
3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean tlese surfaces.
5. Demolinon and renovation projects must comply with d1e requirements of CFR 40,
Part 61, Subpart M. Intent to Demolish and Renovate forms are available at [he
office.
