FINDINCS ()F FA .T. C)NCL.tISjONS AND ORDER
INTRODUCTION
This matter having come before the Hearing Examiner Committee on September 21,
1989, and the members of the Committee present being Verona Southern,
Chairperson, Phil Harris and Ron Odell.
PROPOSAL
The sponsor, Edwin J. Rosell, requests approval of a zone reclassification from
Residential Office (RO) to Regional Business (B-3), File No. ZE-38-89, for the
purpose of developing retail sales and service.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located at the northwest corner of Sprague Avenue and
Sunderland Road in the southwest 1/4 of Section 17, Township 25 N., Range 44,
EWM, Spokane County, Washington.
2. The Hearing Examiner Committee adopts the Planning Depamnent Report as a part
of this record.
3. The eacisting land use(s) in the anea are medical offices, single family residences,
restaurant, and retail sales.
4. The Comprehensive Plan designates this site as Major Commercial. The Major
Commerci.al category is designed to provide opportunities for a variety of retail and
office uses.
5. The Arterial Road Plan designates Sprague Avenue as a Principal Arterial (without
controlled acoess that, to mact Arterial Road Plan objectives, should eventually have a
100' to 130' ft. right of way width. Sprague Avenue's existing 130' ft. right of way
is adequate to implemenL the Arterial Road Pian.
6. The existing zoning of the pmperty described in the application is Residential Office
previously established in 1969.
7. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Detercnination of Nonsignificance was issued.
8. The proper legal requirements for advertisement and notice have been fulfilled.
9. The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use.
10. The proposed use is compatible with existing uses in the area.
11. The proposed zonins dces implement and conform to the Comprehensive Plan.

12. Thc applicant has dcmonstrated that condieons have substantially changed since the
original zoning of this area and accordingly, the proposed z,one reclassification
isjustified.
13. The proposal does not result in spot zoning.
14. The pr-oposed use will not bc detrimental to the public health, safety, or welfare.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-inLerest.

1. Spokane County Engineering Condition #5 was amended to read as follows:
All required construction within the existing or proposed public right of way is to be
completed prior to the relea5c of a building pemvt or a bond in the amount estirnated

filed with the County Enginocr. Applicant shall construct Spokane County Standard
sidewalk along the frontage on Sunderland Road.

Sensidve Area Overlay Zone) of the ZONING CODE FOR SPOKANE COUNTY.
Accondingly, as a condition of appnoval, the sponsor/applicant shall be required to
file with the Spokane County Auditor, within thirty (30) days of ihe signing of
Findings and Onier of the final decision in this matter, a"Notice to the Public"
which shall provide in material as follows:

shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by thc County Eng-ineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
3. Roadway standands, typical roadway scctions and drainage plan requiranents arc
found in Spokane Board of County Commissioners' Resolution No. 8(}-1592 as
amended and are applicable to this proposal.
4. No constrtiction work is to be perforn-&d within the exiscing or proposed public
right-of-way until a pernut has been issued by the County Engineer. All work is
subject to insgection and approval by the County Engineer.
5. All required construction within the existing or proposed public right of way is to
be completed prior to the release of a building pernut or a bond in the amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer. (Amended by Hearing Examiner

COUNTY UTILITIES DEPARTMENT
1. Any water service for this project shall be provided in accord.ance with the
Coondinated Water System Plan for Spokane County, as amended.
