A. INTR p
This matter having come before the Zoning Hearing Examiner Committee
on February 4, 1988, and the members of the Committee present being
Jim Schurra, Chairman, Phillip D. Harris and Ron Odell.
B. pROPOSAL
The sponsor, Pring Corporation, is requesting approval of a zone
reclas sification, File No. ZE- 5 7- 8 7, Residential Office to Regional
• Business (B-3) Zone, for the purpose of developing a used car lot and '
future retail center. Also, for a Change of Conditions, File No. ZE-
13 6 A- 8 0, change of condition s rn a commercial zone.
C. FINDINC S QF FACT
1. That the existing land use in the area is single family residences,
apartments, Sprague Avenue, Subaru Car Sales, Travel Office, retail,
tree cover and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
MAJOR COMMERCIAL development.
3. That the existing zoning of the property described in the application
is Residential Office and Commercial.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land use in this area is suitable for the proposed use, or
uses within the proposed Zone Classification.

C. FINDINGS OF FACT ZE-57-87 & ZE-136A-$Q---
7. That the applicant has demonstrated that conditions have -
substantially changed since the original zoning of this area and
accordingly, the proposed rezone is justified. "
8. That the proposed use is compatible with existing uses in the area. ~
9. That the owners of adjacent lands expressed both approval and -
disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:

a) That the Board of County Commissioners has the authority to decide on the use of the 12 feet of right of way shown on the site
plan.
b) That the frontages along Sprague Avenue have been changing to
higher intensive uses; the Hearing Examiner Committee has .
required conditions of approval dealing with landscaping, down-
lighting, signage controls, building height limits and parking
standards to screen this use from the adjoining residences to the -
north. ;
c) The Hearing Examiner Committee strongly encourages the ~
applicant to strictly comply with all applicable conditions of
approval in the development of this site.
D. CQNDITIQHS OR CONTINCENCIES APPLIED TO THIS APPROVAII
(All Conditions imposed by the Zoning Hearing Examiner Committee
shall be binding on the "Applicant", which term shall include the owner
or owners of the property, heirs, assigns, and successors. )
a) COUNTY PLANNING DEPARTMENT
S tandard: 1. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning Adminis-
trator shall be submitted with a performance bond for the project
prior to release of building permits. Landscaping shall be in-
stalled and maintained such that sight distance at access points is
not obscured or impaired.
2. The applicant shall develop subject property generally in accor-
dance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Adminis-
trator will be permitted, including, but not limited to the follow

lowable uses of the permitted zone. All variations must conform
to regulations set forth in the ZONING CODE FOR SPOKANE
COUNTY. The original intent of the development plans shall be
maintained.
3. Direct light from any exterior area lighting fixture shall not extend
over the property boundary. ;
4. The specific development plan will be submitted for Planning De-
partment review and approval prior to issuance of building
permits.
5. All current standards of the Regional Business (B-3) Zone, as
amended, shall be complied with in the development of this site;
described as follow s :
Lot 5, Block 6, Opportunity Plat #3, EXCEPT the East 135 feet,
EXCEPT the South 150 feet, and EXCEPT streets, situate in
Spokane County, Washington, all in Section 17-25-44.
6. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Section 7.06 (Aquifer Sensitive Area Overlay ,
Zone) of the ZONING CODE FOR SPOKANE COUNTY. Ac- ~
cordingly, as a condition of approval, the sponsor/applicant shall
be required to file with the Spokane County Auditor, within thirty
(30) days of the signing of Findings and Order of the final deci-
sion in this matter, a"Notice to the Public" which shall provide in
material as follow s :
PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR
CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR
ANY USE ON THE PROPERTY DESCRIBED HEREINAFTER,
THE APPLICANT SHALL BE RESPONSIBLE FOR COMPLY-
ING WITH THE PROVISIONS OF THE ZONING CODE FOR
SPOKANE COUNTY SECTION 7.06 (AQUIFER SENSITIVE
AREA OVERLAY ZONE). THE PROPERTY WHICH- IS THE
SUBJECT OF THIS NOTICE IS MORE PARTICULARLY
DES CRIBED AS FOLLOWS . . .
7. Applicant shall comply with ' 208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
8. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.

S pecial:
9. That the applicant petition the County to vacate the 12 foot strip
along Sprague Avenue and receive approval OR that the building
size be reduced now accordingly to comply with available on-site
parking to accommodate the County' s future improvement right of way of 12 feet OR that a revised site plan be submitted for review
and approval by the Zoning Administrator which demonstrates
that the site can comply with parking requirements, relocate re-
quired landscaping, ' 208' and lighting on site when the 12 foot
strip is needed for roadway improvements.
10. That landscaping be provided as follows:
Five (5) feet within the property along Walnut Road; five (5) feet
along Sprague Avenue (location to be determined by #9 above),
and ten (10) feet of dense, tall landscaping with a six (6) foot
sight-obscuring residential fence along the north property line.
11. That advertising signs be limited to one (1) free-standing sign not
to exceed 35 feet in height, and 150 square feet in surface area on
a face. All other signs shall be attached to the structure.
12. That the use of the 12 foot strip along Sprague Avenue shall be .
decided by the Board of County Commissioners and this site plan
approval shall not be used as a precedent in that decision. ~
13. That the height of the structures on site be limited to 1 1/2/
stories.
b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit Or Use Of The Pronertv As Provosed: '
1. Access permits for approaches to the County Road System shall
be obtained from the Spokane County Engineer.
2. Applicant shall submit for approval by the Spokane County Engi-
neer road, drainage, and access plans.
3. The applicant shall submit for approval by the Spokane County
Engineer and the S pokane County Health District a detailed com- ,
bined on-site sewage system plan and surface water disposal plan i
for the entire project or any portion thereof, if the development is ~
to be phased. ;

4. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location,
and arrangement of parking stalls shall be in accordance with
standard traffic engineering practices. Paving or surfacing as ap

5. The construction of the rvad improvernents stated herein shall he
accomplished as apprvved by the Sgokane County Engineer.
6. All required improvements shall conform io the current State of
Washingtvn 5tandard Specifications far Road and Bridge Con-
struction, and other applicable County standards andlar adopted
resoIutions pertaining to Road 5tandards and Starmwater Man-
agement in effect at the date of canstruction, ❑nless atherwise
approved by the County Ertgineer.
7. Roadway stan+dards, typical roadway sections and drainage plan
requirements are faund in Spokane Board of County
Commissioners' Resolution No, 80-1592 as arnended and are
applicable to this proposal.
8. No construction work is to be performed within the existing or
proposed public right of way untii a permit has bceri issued by tne
County Ertgineer. ,A~l work within the public road right of way is
subject to inspection and apgrvval by the County Engineer.

sidewalks must also be eonstructed.

d ) COUNTY HEALTH DISTRICT
S tandard:
1. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
2. Water service shall be coordinated through the Director of
Utilities, Spokane County.
3. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department
of Social and Health Services. :
4. Use of private wells and water systems is prohibited.
S pecial:
5. A public sewer system will be made available for the project and
individual service will be provided to each lot prior to construc-
tion. Use of individual on-site sewage disposal systems shall not
be authorized.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District #1. ,
2. The applicant shall provide verification from the Fire District to
the Department of Building and S afety that provisions have been
made for adequate fire protection prior to the release of building
permits.
3. Exterior walls of any existing or proposed buildings shall have
fire resistance and opening protection from the property line as
set forth in the Uniform Building Code.
f ) WATER PURVEYOR
1. Water Purveyor is Modern Electric Water Company and they will
supply the site with adequate water for domestic, fire and
irrigation uses.
g) SPOKANE COUNTY AIR FOLLUTION CONTROL AUTHORTTY
All air pollution reQUlations must be mec. This includes but is not limited to the ;
followin Er: {
1. Air pollution regulations require that dust emissions during de-
molition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or sus-
pension of activity during certain weather conditions. Haul roads

g) COUNTY AIR POLLUTION CONTROL AUTHORITY
should be treated and emissions from the transfer of earthen
material must be controlled as well as emissions from all other
construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or spills
occur on paved surfaces, measures must be taken immediately to
clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean. '
4. Some objectionable odors will likely result during the construc-
tion phase of the project and from motor vehicles using the site
following completion of the project and from occupants of the
proposed project.
5. SCAPCA Regulation I, Article VI and SCAPCA Regulation II,
Article IV addresses emission standards. All emission standards
must be met.
6. Demolition and renovation projects must comply with the re- -
quirements of CFR 40 Part 61, S ubpart M. Intent to Demolish '
and Renovate forms are available at the S CAPCA office.

FINDINGS AND ORDER
A. INTROD 1 _TTnN
This matter having come before the Zoning Hearing Examiner Committee
on February 4, 1988, and the members of the Committee present being
Jim Schurra, Chairman, Phillip D. Harris and Ron Odell.
B. PROPOSAT,
The sponsor, Pring Corporation, is requesting approval of a zone
reclas sification, File No. ZE- 5 7- 8 7, Residential Office to Regional
Business (B-3) Zone, for the purpose of developing a used car lot and
future retail center. Also, for a Change of Conditions, File No. ZE-
136A-80, change of conditions in a commercial zone.

C. FINDIN tS QF FACT '
1. That the existing land use'in the area is single family residences,
apartmen ts, S prague Avenue, S ubaru Car S ales, Travel Office, retail,
tree cover and vacant.
2. That the Comprehensive Ptan designates this area as appropriate for
MAJOR COMMERCIAL d~veiopment.
3. That the existing zoning of the property described in the application
is Residential Office and Commercial.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Determination of Non-Significance. `
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land use in this area is suitable for the proposed use, or
uses within the proposed Zone Classification.

C. FINDINCS OF FACT ZE-57-87 & ZE-136A-80
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed both approval and
disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimenN to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a) That the Board of County Commissioners has the authority to
decide on the use of thc 12 feet of right of way shown on the site
plan.
b) That the frontages along Sprague Avenue have been changing to
higher intensive uses; the Hearing Examiner Committee has
required conditions of approval dealing with landscaping, down-
lighting, signage controls, building height limits and parking
standards to screen this use from the adjoining residences to the
north.
c) The Hearing Examiner Committee strongly encourages the
applicant to strictly comply with all applicable conditions of
approval in the development of this site.

D. CnNnITrnNS OR CONTINCENCIES APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee
shall be binding on the "Applicant", which term shall include the owner
or owners of the property, heirs, assigns, and successors.)

a) COUNTY PLANNING DEPARTMENT
S tandard:
1. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning Adminis-
trator shall be submitted with a performance bond for the project '
prior to release of building permits. Landscaping shall be in-
stalled and maintained such that sight distance at access points is
not obscured or impaired.
2. The applicant shall develop subject property generally in accor-
dance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Adminis-
trator will be permitted, including, but not limited to the follow

ing changes: Building location, landscape plans, and general al-
lowable uses of the permitted zone. All variations must conform
, to regulations set forth in the ZONING CODE FOR SPOKANE
COUNTY. The original intent of the development plans shall be
maintained.
3. Direct light from any exterior area lighting fixture shall not extend
over the property boundary.
4. The specific development plan will be submitted for Planning De-
partment review and approval prior to issuance of building
permits.
5. All current standards of the Regional Business (B-3) Zone, as
amended, shall be complied with in the development of this site;
described as follows:
Lot 5, Block 6, Opportunity Plat #3, EXCEPT the East 135 feet,
EXCEPT the South 150 feet, and EXCEPT streets, situate in
S pokane County, Washington, all in S ection 17-25-44.
6. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Section 7.06 (Aquifer Sensitive Area Overlay
Zone) of the ZONING CODE FOR S POKANE COUNTY. Ac-
cordingly, as a condition of approval, the sponsor/applicant shall
be required to file with the Spokane County Auditor, within thirty
(30) days of the signing~`of Findings and Order of the final deci-
sion in this matter, a"Nbtice to the Public" which shall provide in
material as follows:
PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR
CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR
PERTY DESCRIBED HEREINAFTER,
ANY USE ON THE PRR
THE APPLICANT SHALL BE RESPONSIBLE FOR COMPLY-
ING WITH THE PROVISIONS OF THE ZONING CODE FOR
SPOKANE COUNTY SECTION 7.06 (AQUIFER SENSITIVE
AREA OVERLAY ZONE). THE PROPERTY WHICH IS THE
SUBJECT OF THIS NOTICE IS MORE PARTICULARLY
DESCRIBED AS FOLLOWS:.......
7. Applicant shall comply with ' 208' recommendations concerning stormwater runoff and provide necessary landscaping for runoff.
8. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.

Special:
9. That the applicant petition the County to vacate the 12 foot strip
• along Sprague Avenue and receive approval OR that the building
size be reduced now accordingly to comply with available on-site
parking to accommodate the County's future improvement right of
way of 12 feet OR that a revised site plan be submitted for review
and approval by the Zoning Administrator which demonstrates
that the site can comply with parking requirements, relocate re-
quired'iandscaping, ' 208' and lighting on site when the 12 foot
strip is needed for roadway improvements.
10. That landscaping be provided as follows:
Five (S) feet within the property along Walnut Road; five (5) feet
along Sprague Avenue (location to be determined by #9 above),
and ten (10) feet of dense, tall landscaping with a six (6) foot
sight-obscuring residential fence along the north property line.
11. That advertising signs be limited to one (1) free-standing sign not
to exceed 35 feet in height, and 150 square feet in surface area on
a face. All other signs shall be attached to the structure.
12. That the use of the 12 foot strip along Sprague Avenue shall be
decided by the Board of County Commissioners and this site plan
approval shall not be used as a precedent in that decision.
13. That the height of the structures on site be limited to 1 1/2/
stories. '
b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Qf A Building Permit Qr Use Of The Pronertv As Proposed:
1. Access permits for apprbaches to the County Road System shall
be obtained from the Spokane County Engineer.
2. Applicant shall submit for approval by the Spokane County Engi-
neer road, drainage, and access plans.
3. The applicant shall submit for approval by the S pokane County
Engineer and the Spokane County Health District a detailed com-
bined on-site sewage system plan and surface water disposal plan
for the entire project or any portion thereof, if the development is
to be phased.
4. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, location,
and arrangement of parking stalls shall be in accordance with
standard traffic engineering practices. Paving or surfacing as ap

b) COUNTY ENGINEERING DEPARTMENT
proved by the County Engineer, will be required for any portion
of the project which is to be occupied or traveled by vehicles.
5. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
6. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge Con-
structiQn, and other applicable County standards and/or adopted
resolutions pertaining to Road Standards and Stormwater Man-
agement in effect at the date of construction, unless otherwise
approved by the County Engineer.
7. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County
Commissioners' Resolution No. 80-1592 as amended and are
applicable to this proposal.
8. No construction work is to be performed within the existing or
proposed public right of way until a permit has been issued by the
County Engineer. All work within the public road right of way is
subject to inspection and approval by the County Engineer.
9. All required construction within the existing or proposed public
right of way is to be completed prior to the release of a building
permit or a bond in the amount estimated by the County Engineer
to cover the cost of construction of improvements shall be filed
with the County EngineLr.
S pecial:
10. The County Engineer has designated Typical Roadway Section
Number One, Access S reet standard for the improvement of
Walnut Road which is a~jacent to the proposed development.
This will require the addition of approximately 10 to 14 feet of
asphalt along the frontage of the development. Curbing and
sidewalks must also be constructed.
c) COUNTY UTILITIES DEPARTMENT
S pecial:
1. Applicant must connect to Valley Sewer.

d ) COUNTY HEALTH DISTRICT
y S tandard:
1. Sewage disposal method shall be as authorized by the Director of
. Utilities, Spokane County.
2. Water service shall be coordinated through the Director of
U tilities, S pokane County.
3. Water service shall be by an existing public water supply when
approv\ed by the Regional Engineer (Spokane), State Department
of Social and Health Services.
4. Use of private wells and water systems is prohibited.
S pecial :
5. A public sewer system will be made available for the project and
individual service will be provided to each lot prior to construc-
tion. Use of individual on-site sewage disposal systems shall not
be authorized.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District #1.
2. The applicant shall provide verification from the Fire District to
the Department of Building and Safety that provisions have been
made for adequate fire protection prior to the release of building
permits. '
3. Exterior walls of any existing or proposed buildings shall have
fire resistance and opening protection from the property line as
set forth in the Uniform Building Code.
f ) WATER PURVEYOR ~
1. Water Purveyor is Modern Electric Water Company and they will
supply the site with adequate water for domestic, fire and
irrigation uses.
g) SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORTTY

l. Air pollution regulations require that dust emissions during de-
molition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or sus-
pension of activity during certain weather conditions. Haul roads

g) COUNTY AIR POLLUTION CUNTROL AUTHORITY
should be treated and emissions from the transfer of earthen
material must be controlled as well as emissions from all other
construction related activities.

2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or spills
occur on paved surfaces, measures must be taken immediately to
clean these surfaces.

3. All tra~velled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the construc-
tion phase of the project and from motor vehicles using the site
following completion of the project and from occupants of the
proposed project.
5. SCAPCA Regulation I, Article VI and SCAPCA Regulation II,
Article IV addresses emission standards. All emission standards
must be met.
6. Demolition and renovation projects must comply with the re-
quirements of CFR 40 Part 61, Subpart M. Intent to Demolish
and Renovate forms are available at the SCAPCA office.

1. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning Adminis-
trator shall be submitted with a performance bond for the project
prior to release of building permits. Landscaping shall be in-
stalled and maintained such that sight distance at access points is
not obscured or impaired.
2. The applicant shall develop subject property generally in accor-
dance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Adminis-
trator will be permitted, including, but not limited to the follow

lowable uses of the permitted zone. All variations must conform

maintained.
3. Direct light from any exterior area lighting fixture shall not extend
over the property boundary.
4. The sp~cific development plan will be submitted for Planning De-
partment review and approval prior to issuance of building
permits.
5. All current standards of the Regional Business (B-3) Zone, as
amended, shall be complied with in the development of this site;
described as follows:
Lot 5, Block 6, Opportunity Plat #3, EXCEPT the East 135 feet,
EXCEPT the South 150 feet, and EXCEPT streets, situate in
Spokane County, Washington, all in Section 17-25-44.
6. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Section 7.06 (Aquifer Sensitive Area Overlay
Zone) of the ZONING CODE FOR SPOKANE COUNTY. Ac-
cordingly, as a condition, of approval, the sponsor/applicant shall
be required to file with the Spokane County Auditor, within thirty
(30) days of the signing of Findings and Order of the final deci-
sion in this matter, a"Notice to the Public" which shall provide in
material as follows:

and approval by the Zoning Administrator which demonstrates
that the site can comply with parking requirements, relocate re-
quiredNlandscaping, ' 208' and lighting on site when the 12 foot
strip is needed for roadway improvements.
10. That landscaping be provided as follows:
Five (5) feet within the property along Walnut Road; five (S) feet
along Sprague Avenue (location to be determined by #9 above),

Prior To The Issuance Of A Buildine Permit Or Use O£ The Pronern As ProDOSed:
1. Access permits for appioaches to the County Road System shall
be obtained frorn the Spokane County Engineer.
2. Applicant shall submit for approval by the Spokane County Engi-
neer road, drainage, and access plans.
3. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed com- '
bined on-site sewage system plan and surface water disposal plan
for the entire project or any portion thereof, if the development is
to be phased.
4. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, location,
and arrangement of parking stalls shall be in accordance with
standard traffic engineering practices. Paving or surfacing as ap

proved by the County Engineer, will be required for any portion
of the project which is to be occupied or traveled by vehicles.
` 5. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
6. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge Con-
struction, and other applicable County standards and/or adopted
resoluhons pertaining to Road S tandards and S tormwater Man-
agement in effect at the date of construction, unless otherwise
approved by the County Engineer.
7. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County
Commissioners' Resolution No. 80-1592 as amended and are
applicable to this proposal.
8. No construction work is to be performed within the existing or
proposed public right of way until a permit has been issued by the
County Engineer. All work within the public road right of way is
subject to inspection and approval by the County Engineer.
9. All required construction within the existing or proposed public
right of way is to be completed prior to the release of a building
permit or a bond in the amount estimated by the County Engineer
to cover the cost of construction of improvements shall be filed
with the County Engineer.
Special:
10. The County Engineer has designated Typical Roadway Section
Number One, Access Street standard for the improvement of
Walnut Road which is hdjacent to the proposed development.
This will require the addition of approximately 10 to 14 feet of
asphalt along the frontage of the development. Curbing and
sidewalks must also be constructed.

' S tandard:
1. Sewage disposal method shall be as authorized by the Director of
~ Utilities, Spokane County.
2. Water service shall be coordinated through the Director of
Utilities, Spokane County.
3. Water service shall be by an existing public water supply when
approNed by the Regional Engineer (Spokane), State Department
of Social and Health Services.
4. Use of private wells and water systems is prohibited.
Special:
5. A public sewer system will be made available for the project and
individual service will be provided to each lot prior to construc-
tion. Use of individual on-site sewage disposal systems shall not
be authorized.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
l. The site is located in Fire District #1.
2. The applicant shall provide verification from the Fire District to
the Department of Building and S afety that provisions have been
made for adequate fire protection prior to the release of building
permits. ~
3. Exterior walls of any existing or proposed buildings shall have
fire resistance and opening protection from the property line as
set forth in the Uniform Building Code.
f ) WATER PURVEYOR `
1. Water Purveyor is Modern Electric Water Company and they will
supply the site with adequate water for domestic, fire and
irrigation uses.
g) SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
All air nollution regulations must be met. This includes but is not limited to che
followin e:
1. Air pollution regulations require that dust emissions during de-
molition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or sus-
pension of activity during certain weather conditions. Haul roads

should be treated and emissions from the transfer of earthen
material must be controlled as well as emissions from all other
construction related activities.

2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or spills
occur on paved surfaces, measures must be taken immediately to
clean these surfaces.
3. All traLelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the construc-
tion phase of the project and from motor vehicles using the site
following completion of the project and from occupants of the
proposed project.
5. SCAPCA Regulation I, Article VI and SCAPCA Regulation II,
Article IV addresses emission standards. All emission standards
mu s t be met.
6. Demolition and renovation projects must comply with the re-
quirements of CFR 40 Part 61, Subpart M. Intent to Demolish
and Renovate forms are available at the SCAPCA office.

CALL TO ORDER: The meeting was called to order at approximately
10:00 a.m. by the Department of Buildings Code Compliance
Coordinator Tom Davis, with the following in attendance.

SCOPE/PROJECT DESCRIPTION:
I. General Overview - The owner Sears is proposing the
construction of a 15,000 square foot automotive building. The
proposed will contain 10 service areas for cars. The applicant will
pave the proposed parking area.
SUMMARY OF DEPARTMENTAL REQUIREMENTS:
I. Planning Department (456-2205)
A. Discussion/Requirements
1. The proposed site was re-zoned in 1988, an
Environmental Checklist was completed at that time.
2. The proposed shall comply with conditions of Zone
Change No. ZE-57-87.
3. The proposed shall comply with B-3 zoning requirements
as per the requirements of the zone change. The lighting
standards shall be removed, also a condition of the zone
change.

4. Please indicate the height of the proposed structure
on the plans.
5. The applicant wanted to know if the parking could be
calculated by different uses. Laurn Lakshas asked the
applicant to submit the square footages of the uses and
she would get back to tre applicant with a determination.
B. Permit Release Requirements
1. The proposed shall comply with the conditions of Zone
Change ZE-57-87.
2. Please submit a revised site plan illustrating
landscaping and the height of the structure.
II. Engineering Department (456-3600)
A. Discussion/Requirement
1. Comments were given to the applicant and Building and
Safety by Scott Egger. .
2. Please submit a revised drainage plan that is in
conformance with Spokane County Guidelines for Stormwater
Management. The applicant stated that he talked with Gary
Nelson regarding 208 drainage for a portion of the parking
area that is currently existing on the proposed site.
Scott Egger stated that he would verify the waiver with
Gary Nelson and get back to the applicant.
3. Additional paving is required on Walnut Road. Al1
paving is to be completed prior to the release of the
building permit or a bond in an amount estimated by the
County Engineer to cover the cost of construction shall be
filed with the County Engineer.
4. Approach permits shall be obtained for new driveway
approaches along Sprague Avenue.
5. A License Agreement is required for the use of the
county right of way.
6. The proposed shall comply with the conditions of Zone
Change ZE-57-87.
7. The lighting standards located on the site shall be
removed as per the requirements of the zone change. The
applicant asked if it would be possible for the lighting

st3ndards to remain on the site. Scott Egger stated that
he would get a determination from the Engineering
Department and get back to the applicant.
8. An Agreement to Pay Fees was given to the applicant
during the meeting. The agreement is to be signed by the
owner and returned to the Enqineering Department. Plan
review will not be completed until this document is
executed.
B. Permit Release Requirements
1. Please address the comments on the drainage check
print and return it to the Engineering Department.
Comments on the check print regarding 208 drainage for the
parking area may be disregarded once verification has been
~ made with Gary Nelson.
2. A License Agreement for the use of county right of way
shall be submitted prior to permit release.
3. The proposed shall comply with conditions of the zone
change.
4. Please submit a copy of the Agreement to Pay Fees
signed by the owner.
III. Health District (456-6040)
A. Discussion/Requirements
1. Daryl Way stated that he had a concern with refuse
containment for the proposed. The applicant stated that
refuse containment would be located inside the proposed
building.
2. Please submit a critical materials list to the
Department of Buildings for review.
3. The interior floor drains located in the proposed
' shall be connected to a grit trap with an oil/water
separator.
4. The Health District needs verification that the
residence located on the site will be moved to a legal
site. Please submit a copy of the relocation permit.
5. All demolition and construction debris must be taken
to a licensed landfill.

6. Daryl Way has a concern with Detail 1 on the site
plan. The detail shows a 208 drainage swale adjacent to
the sidewalk with a eight inch drop. Daryl asked the
applicant to be aware of the situation and possibly come
up with some alternatives for the hazard.
B. Permit Release Requirements
1. The Health District is ready to release their portion
of the building permit.
IV. Fire District No. 1(928-2462)
A. Discussion/Requirements
1. Fire f low for the proposed is 4500 g.p.m.
2. The existing hydrants located at the site are
sufficient to provide the required fire flow however one
or more of the hydrants may need to be converted to a
three port hydrant.
3. A lock (Knox) box entry system for fire department
personnel access to the proposed is required.
V. Department of Buildings (456-3675)
A. Discussion/Requirements
1. Plan review has been completed on preliminary plans
and a letter was sent to the applicant by Tom Postlewait.
2. Special inspections are required for fill areas,
concrete with a design strength of over 2,500 p.s.i., and
structural welding. Please indicate the name of the
testing laboratory and submit inspection reports to the
Department of Buildings.
3. The east exterior wall shall be of one-hour
fire-resistive construction and a parapet for the wall
shall be provided.
4. Floor drains shall be reviewed by the Department of
Ecology and the Health District.
5. Please submit a critical materials list to the
Department of Buildings for review.

6. The proposed shall meet the minimum requirements of
the Regulations for Barrier-Free Facilities.
7. Cross connection devises are required on equipment
which may cause pollution of the domestic water supply.
8. Drawings shall be directly stamped and signed by the
architect (wet stamp).
B. Permit Release Requirements
1. Two complete revised sets of plans addressing the
items discussed during and after the meeting and other
items from the plan review letter needs to be submitted
for review and approval.
COUNTY ACTION:
Laurn Lakshas of the Planning Department will let the applicant know
if the parking can be calculated using the separate uses for the
proposed.
Scott Egger of the Engineering Department will verify that a waiver
for 208 drainage in the parking area has been granted by Gary
Nelson. Scott will also get a determination from the Engineering
Department on whether or not the lighting standards are required to
be removed.
APPLICANT'S COMMENTS/ACRNOWLEDGEMENT:
The applicant acknowledged that all comments/requirements were
understood and had no further questions at this time regarding
permit requirements.
CORRECTIONS:
To minutes or changes from what appears in the minutes, we should be
notified within one day of your receipt of these minutes.
To site plans as required by any or all of the above-listed
departments shall be submitted to the Department of Buildings who
will then distribute accordingly to those departments.
ADJOURNMENT: There being no further business, Tom Davis thanked the
applicant and the departments for their participation and reminded
all that he should be contacted if there are any unforeseen problems
which may arise.
