The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Spokane County Zone Change No. ZE-6A-62
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. Willow Road, Typical Roadway Section #1,
Local Access standard
Al1 required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the f inancial guaranty or permit release.
2. As an alternative to the required road improvements

the County will accept an RID/CRP agreement
"Notice to Public No. 6" on the property.
3. Applicant shall dedicate 5 feet on Willow Road
for right-of-way.
4. Please submit a copy of a recorded property deed
from the Auditors office for the subject property.
Upon receipt of the deed our staff will prepare the
right of way deed and/or the RID/CRP agreement.
5. Approach permits must be obtained, after a site
plan has been approved, and before the issuance of
a building permit, from the County Engineering
Department for any new or improved driveway
approaches to the following streets:
a. Willow Road
D) See comments on the attached check print. Please return
the check print to your contact pezson at County
Engineering.
E) Insufficient information was subm3tted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Revised site plan.
2. Drainage plan as specif ied.
3. Other information:
a. A parking and traffic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parki3tg stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles. It is illegal to baclc out onto the Right of Way.
F) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
G) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
The applicant or his representative has been given a minimum
requirements list. This list is not inclusive of all the
requirements needed but should be used as a minimum guideline.
Without the "minimum" requirements the Engineers Department may
not be able to perform a complete review of the project and could
result in prolonging the period before permit issuance. Only
after all the information and requirements listed above are
supplied or completed and the necessary review has been
accomplished will your building permit be released.

A review of the above referenced project has been accomplished. The list below is
a summary of the items that need to be addressed. Please refer to the enclosed check

4-1. The calculations provided need to be stamped by a P.E.

project. You list the total area as 100' x 85'. The plans show

INTRODUCTION
This matter has come before the Hearing Examiner Committee on November 18,
1993. The members of the Committee present are Verona Southern, Chauperson,
Phil Harris and Jan Reuter.
FROPOSAL
The sponsor, Dr. Kenneth Gudgel, requests approval of a Change of Conditions,
ZE-6A-62, to an existing Urbdn Residential-22 (UR-22) zone to allow a four unit
addition to an exisring 21 unit aparnnent complex. The addhtional units are applied
for under the Bonus Density provisions of the Spokane County Z.oning Code, based
on availability of sewer, rnass transit, and shopping fac~llties as specified in the
Zoning Code.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located east of and adjacent to Willow Road, approximately
250 feet north of Sprague Avenue in the SW 1/4 of Section 17, Township 25 North,
Range 44 EWM, Spokane County, Washington.
2. The conlmittee adopts the Planning Department Report as a part of this record.
3. The existing land uses in the area are single family residences, undeveloped properry
and commercial uses including offices and retail stores
4. The proposed use is comparible with exisring uses in the area, and provides a
transitional use between the commercial uses to the south and the low density
residential uses to the north.
5. The Comprehensive Plan designates this site as Urban and within the Priority Sewer
Service Area (PSSA). The Urban category is intended to provide the opportunity for
development of a"city-like" environment which includes various land uses and
intensive residential development. Urban areas will have public wat~er systems,
sanitary sewer systems, storm sewer systems and other public semces available.
This category promotes "fill-in" within established development areas where utilities,
arterials, schools and community faciliries are existinb. The proposal is consistent
with the Urban category, speci.f~ically with Goal 1. l. wluch encourages a variety of
housing types and densities.
6. The proposed zoning does implement and conform to the Comprehensive Plan. The
proposal can be defined as fill in development and is consistent with the Goals and
Objectives of the Comprehensive Plan.
7. The Arterial Road Plan designates Willow Road as a local access street, and the County
Engineer has requested dedication of an additional5 feet of right-of-way along Wil~ow

Road. Sprague Avenue, located approximately 250 feet to the south of the proposal, is
designated as a Principal Arterial.
8. The existing zoning of the property described in the application is Urban Residential-22
(UR-22), previously established as Multi Family Suburban (NiFS) zoning in 1962 and
redesignated to Urban Residennal-22 (UR-22) on January 1, 1991 pursuant to the
Program to Implement the Spokane County Zoning Code. The proposal does conform to
the requirements of the existing Urban Residential-22 (LJR-22) zone.
9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Determinanon of Nonsigni.ficance was issued. The Committee,
after independent review, hereby adopts the DNS.
10. The legal requirements for public notice have been fulfilled.
11. The owners of adjacent lands expressed neither approval or disapproval of the
proposed use.
12. The applicant has demonstrated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified. Specifically, changed conditions include the availability of public sewer,
mass transit and shopping facilities.
13. The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing agencies.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Condlrions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant," which tenn shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Condiaons of Approval apply to the real property described below:

W.M., Spokane County, Washington
SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Urban Residential-22 (UR-22) zone as
amended.
2. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Bod.y. Vanations, when approved by the ~
Planning Director/designee, may be pernutted, includ.ing, but not limited to builduig
location, landscape plans and general allowable uses of the permitted zone. All
variations must conform to reguladons set forth in the Spokane County Zoning
Code, and the onginal intent of the development plans shall be maintained.
3. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building pernuts.

4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the project prior to release of building pernzits. Landscaping shall be
installed and maintained so that sight d.istance at access points is not obscured or
impaired.
5. Direct light from any exterior area lighting fixture shall not extend over the property .
boundary.
6. The Planning Department shall prepare and record with the Spokane Counry
Auditor a Title Norice noting that the property in quesaon is subject to a variety of
special conditions imposed as a result of approval of a land use action. This Title
Notice shall serve as public norice of the conditions of approval affecting the
property in question. The Title Notice should be recorded witlun the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Notice sha11 generally provide as follows:
The parcel of property legally described as [ ] is the subject
of a land use action by a Spokane County Hearing Body or
Administrative Official on [ J, imposing a variety of
special development conditions. File No. ( ] is available for
inspection and copying in the Spokane County Planning Department.
7. The Owner shall negotiate with the Spokane County Parks Department and submit
a recorded copy of a voluntary agreement making provisions for public parks prior
to issuance of build.ing pemvts. The agreement shall provide a written description
of the subject property to which the agreement applies and also state the dollar
amount and any other agreed to mitigating measures.
Voluntary agreements between the Owner and Spokane County Parks Department
shall confonn to the requirements of the Revised Code of Washington Chapter
82.02.
SPOKANE COUNTY DIVISION OF ENGINEERING
Pnor to issuance of a building permit of at the request of the County Engineer in conjuncrion
with a County Road ProjectlRoad Improvement District, whichever action comes first:
1. Applicant shall dedicate 5 feet on Willow Road for right-of-way.
Prior to release of a building pemut or use of the property as proposed:
2. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans. .
3. A parking plan and trafFic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or tr~aveled by vehicles.

4. To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be willing to participate in any
peririon or resolucion which purpose is the formation of a Road Improvement
District (RID) for said improvement, pursuant to RCW 36.88, as amended.
Spokane County will not partmcipate in the cost of these improvements. This is
applicable to Willow Road.
5. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Eng7neer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the requireci improvement. Spokane County will not
participate in the cost of these improvements. This is applicable to Willow Road
6. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
7. The County Engzneer has designated Typical Roadway Section Number 4ne, Local
Access standard for the improvement of Willow Road, which is adjacent to the
proposed development. This will require the add.ition of approximately 10 - 12 feet
of asphalt along the frontage of the development. The construction of curbing and
sidewalk is also requued.
8. All required improvements shall conform to the current State of Washington
Standard Specificarions for Road and Bridge Construction and other applicable
County standards and/or a.dopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
9. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
10. No construction work shall be performed within the existing or proposed public _
right-of-way until a pernlit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
11. Applicant shall sign and record Spokane County Notice to the Public No. 6 which
specifies the following•
The owner(s) or successor(s) in interest agree to authorize the County to place theu-
name(s) on a petition for the formation of a Road Improvement District (RID) by
the petition method pursuant to Chapter 36.8$ RCW, wh,ich petition includes the
owner(s) property, and further not to object, by the signing of a ballot, the
formation of a RID by the resolurion method pursuant to Chapter 36.88 RCW,
which resolution includes the owner(s) property. If an RID is formed by either the
perition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree:
(a) that the improvement or construction contemplated within the proposed RID is
feasible;

(b) that the benef ts to be derived from the formation of the RID by the property
included therein, together with the amount of any County partlcipation,
exceeds the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment on the property as a
result of the improvements called for in conjunction with the formation of the RID
by either petition or resolution method under Chapter 36.88 RCW.
This requirement applies to Willow Road, from which the subject parcel takes
access.
12. There may exist utiliries, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligaaon for adjustments or relocation
regarding these utiliries. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to determnne whether applicant(s) or
the utiliry is responsible for adjustment or relocation costs and to ma.k-e
arrangements for any necessary work.
SPOKANE COUNTY UTILITIES DEPARTMENT
1. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
2. Applicant shall make connection to public sewer system. Sewer connection permit
is required. Plans and specif~ications are to be reviewed and approved by the
Utiliries DepartmenL
SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utiliries, Spokane
County.
2. Water service shall be coordinated through the Du-ector of Utiliries, Spokane County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the project and individual service will
be provided to each lot prior to sale. Use of authorized on-site sewage disposal
systems shall not be authorized. '
5. Use of private wells and water systems is prohibited.

SPOKANE COUNTY DIVISInN OF BUILDINGS 1. The applicant shall contact the Department of Buildings at the earliest possible stage in
order to be informed of code requirements administeredJenforced as authonzed by the
State Building Code Act Design/development concerns include: Addressing, fire
apparatus access roads, fire hydrant/flow, approved water systems, building
accessibility, construction type, occupancy classification, exiting, exterior wall
protecrion, and energy code regulations. (Note: The Department of Buildings reserves
the right to confum the actual address at the time of building pernut.)
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met.
2. Au pollution regulations require that dust emissions dunng demolition, constTUCtion
and excavation projects be controlled. This may require the use of water sprays, tarps,
sprinklers or suspension of activity during certain weather condiaons. Haul roads
should be treated and emissions from the transfer of earthen materials must be
controlled as well as emissions from all other construction related activYties.
3. All traveled surfaces (i.e., ingress, egress, parking areas, access roads) should be
paved and kept clean.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces
onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be
taken immediately to clean these surfaces.

5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e., construction waste, etc.).
6. All solid fuel burning devices (wood stoves, pellet stoves, etc. must comply with _
local, state, and federal rules and regularions.

Conclusion, A.PPROVES the applicarion of Dr. Kenneth Gudgel for Change of
Conditions to an existing Urban Residential-22 (UR-22) zone to allow a four unit
addition to an existing 21 unit apartment complex under the bonus density provisions
of the Spokane County Zoning Code based on the availability of sewer, mass transit
and shopping faciliries, as described in the application ZE-6A-62.
