I currently have approval for construc- tion of 3 bedroom houses on these lots with a qualifying drain- dield of 180'. Because of the need to add an additional bedroom to these houses I have obtained drainfield easements on these lots allowing the eventual lot owner to place the replacement drainfield within 4' of the property line. This action will in no way disturb the adjoining lots if a replacement drainfield should be required. Although all utilities are overhead there would be no potential conflict even if they were eventually placed underground. I bring your attention to paragraph 303 (e) of the 1979 Uniform Building Code, adopted in part by Spokane County which states: "The buildinq official may, in writing, suspend or revoke a permit issued under the provisions of this code whenever the permit is issued in error or on the basis of incorrect information supplied, or in viola- tion of any ordinance or regulation or any of the provisions of this code." In your application for Building Permits Numbered 80-6870, 80-6871 and 80-6873 you submitted Site Plans with incorrect lot dimensions and consequently do not have the minimum set back require- ments that are required under the Spokane County Zoning Ordinance. The Site Plan you submitted withayour application for permit number 80-6872 requires a variance from the Spokane County Planning Department. The con- tractor has indicated that he only intends to build on Lots 10 and 15 until such time as the zoning issue has been resolved, which I anticipate to be on August 12th. If the Board of Adjustment does not rule in favor of the contractor, the six existing lots would probably be converted into four lots and still make his current projects (i.e., the two residences on Lots 10 and 15) legal. Engstrom herein referred to as the "Applicant." [V I T N E S S E T H WHEREAS, Steve D. Engstrom has applied to Spokane County for a building permit to construct one single family residence on Lot 15, Block 53 of Kokomo Townsite, Spokane, Washington; and WHEREAS, Spokane County has received and objected to the issuance of this building permit and other building permits (Lots 10 thru 14 of Block 53) by Paul Baker through their attorney Roger Coombs; and WHEREAS, the appellant Paul Baker, has challenged Spokane County's determination that single family residences may be constructed on lots 10 thru 15 and has further challenged Spokane County's determination that said lots are buildable lots under the Spokane County Zoning Ordinance; and WHEREAS, the appellant has filed an appeal with the Spokane County Board of Adjustment to review the administrative decision of the Spokane County Planning Department that these lots are buildable lots and that a building permit for a single family residence may be issued under the Spokane County Zoning Ordinance; and WHEREAS, the applicant specifically acknowledges that he is aware that Spokane County has received an objection a C 01 J to the issuance of the above mentioned building permits. The applicant further acknowledges that he is aware that the Planning Department's decision as to the buildability of these lots has been appealed to the Board of Adjustment; and WHEREAS, with the knowledge of these objections and appeals the applicant desires to proceed with the construction of the single family residences; NOW, THEREFORE, for and in consideration of Spokane County through the Spokane County Building Codes Department releasing a building permit for a single family residence on Lot 15, Block 53 of Kokomo Townsite the applicant hereby agrees as follows: 1. The applicant, with the intention of binding himself, successors and assigns, expressly releases, dis- charges, and holds harmless Spokane County its officers, and employees from all claims, demands, actions, judgments, and executions that the applicant ever had or now has or may have known or unknown or that anyone claiming through or under him may have, or claim to have against Spokane County or its officers and employees created by or arising out of Spokane County's issuance of the building permit for the construc- tion of a single family residences on Lot 15, Block 53 of Kokomo Townsite.
