Union Joel, The County Engineers have reviewed the Drainage Report and Grading and Drainage Plan you recently submitted for this project. These items meet the overall requirements of the Spokane County `GSM' regarding the lot development; except the applicable Standard Notes for Construction need to be included on the plan. The road improvements appear satisfactory as shown on the plan. Please add a cross- section view of the road widening and construction note as to how the new curb grade will be derived and set. Some type of surety will be needed to allow issuance of the building permit prior to completion of the road improvements. I can set the surety amount without an engineering estimate from you. I will await (3) copies of the finalized plan for acceptance and release of the building permit by the County Engineers. These include: * The site's direct or near direct access to major arterial sy s tem s . * The height of proposed structures and the impact on surrounding residential uses. * Buffering techniques to insure compatibility and consistency between existing and proposed uses. * The existence or development of paved streets to serve the higher density development and traffic. * The positive or negative impact that the project may have on the neighborhood. 2) ZONING: North Agricultural, Established, 1942 East Agricultural, Established, 1942 Freeway Commercial, Est. 1981 West Agricultural, Established, 1942 . Two-Family Residential, Est. 1976 .South Agricultural Suburban, Est. 1968 and 1955 3) LAND USE: Site Vacant North One single family and Interstate 90. Primarily vacant between site and I-90: East Yacant back areas of large tracts fronting Mission Avenue. Three tracts have single family uses on Mission. South Three duplexes. Single family uses along and bey ond Mission Avenue. West Primarily large vacant parcels. One single family use fronts on Union Road. -1 n t ZONE RECLASSIFICATION NO.: ZE-73-83 II. BACKGROUND/ANALYSIS (continued) 4) HISTORY OF LAND USE ACTIONS: There has not been any recent activity in the area. To the east approximately 350 feet f rom the.site, along the west side of Pines Road and the north side of Mission Avenue, a 3.5 Acre site was rezoned to Freeway Commercial in 1981. The project at the time of rezoning indicates a combination motel/restaurant facility. In 1976, approximately 550 feet west of this present Multiple Family Suburban rezone request, approval for six lots zoned Two-Family Residential was granted on an approximate 2 Acre site which is approximately 250 feet north of Mission Avenue along the east side of Wilbur Road. Also, the Sardam Subdivision and rezone to Agricultural Suburban in 1968, the two lots presently proposed for rezone in this application, are within this 5 lot plat. Approval of the Agricultural Suburban zoning was in keeping with the applicant's request in 1968 of anticipated duplex use of the plat. In addition to the zoning restriction, a condition of approval appears on the face of the final plat allowing only single family anmd duplex structures. If approval is granted for this Multiple Family Suburban rezone,'then the plat language will need to be amended prior to release of fourplex building permits. 5) NEIGHBORHOOD CONSIDERATIONS: Access to the two proposed Multiple Family Suburban sites is north on Union Road f rom hlission Avenue. Union Road is currently graveled and oiled with no curbing. Mission . Avenue, an arterial, is two lane, paved, generally without curbing. If approval is granted, the County Engineer recommends the upgrading of Union Road with paving. However, these improvements can be deferred through an RID or CRP process joined in by all property owners on Union Road. Union Road currently serves two single family dwellings and three duplexes. Due to the large parcels adjoining the sites, there is still development potential to the north, west, and east. Consideration should be given to the type of uses that could occur in the limited areas between these two sites and the Freeway. CAd . ~ y ZONE RECLASSIFICATION NO.: ZE-73-83 III. The proposal i s 1 ocated on a bench overl ooki ng the Freeway which is approximately 200 feet north of the property. 2) AGRICULTURAL SUMMARY; Committed to Urban usage by the Soil Conservation Service - U. S. Department of Agricui ture. 3} SITE PLAN INFORMATION: SITE SIZE: Approximately 27,000 Square Feet 13,000 Square Feet per Lot) EXISTING BUILDINGS: None PROPOSED BUILDINGS: Twn Four-Plexes (one Four-Piex per Lot) Totai F1 oor Area : • 5,928 Square Feet per Bui 1 di ng (2,964 Square Feet per Floor) Total Site Coverage: 21 % per Lot Maximum Structure Height: 21 Feet (2 Stories) PARKING AREA: ' Parking Required: 6 Spaces per Building Parking Provided: 6 Spaces per Building (4 Spaces in Carports and 2 Open) BUFFERING TECHNIQUES: The submitted site plan indicates that a six foot high wooden fence wiil be constructed around both sites on the north, east, and south property iines. Specific purpose of the fence appears to be as a privacy measure between these sites and adjoining properties. Provisions for lawn and building landscape areas have been indicated. The additional need for buffering, in addition to the planned fence construction, doesn't appear necessary in that,the proposed use is residential and surrounding properties are generally vacant at present. A detailed landscape plan, however, will be required at the time of building permit app7ication. cv 1 ZONE RECLASSIFICATION NO.: ZE-73-83 3) SITE PLAN INFORMATION (continued) BUFFERING TECHNIQUES (continued) Buffering of parking areas has been handled adequately in the specific design and placement of carports on each parcel. Parking will be on the west side of each lot adjacent to the apartments and Union Road. Orientation of the parking areas is away from adjoining property. OTHER SITE PLAN CONSIDERATIONS: The plat dedication of Sardam Subdivision, of which this rezone involves two of the five lots, allows construction of only single family and duplex structures. This restriction was placed on the plat by the Planning Commission in their review of the Subdivision in 1968. It should not be confused with private restrictive covenants. If approvai is granted this rezone, then it should be conditioned to amend the dedicatory 1 anguage of the pl at i n order to al l ow for mul ti -fami 1y structures. The process for plat amendments would be as specified under RCW 58.12 - and would require a public meeting before the Board of County Commissioners to amend the dedicatory language.by resolution. IV CONCLUSIONS: Staff supports the proposed rezone of these two sites and the construction of two four-plex structures for several reasons. The Urban category of the Comprehensive Plan encourages multi-family uses as transitional use between non-residential and residential activities. The proposed rezone is uniquely located between an arterial, a freeway, and a large F reeway Commercial zoned tract. Possible impacts from these may - make the property less desirable for low density use. Future development in this immediate vicinity on undeveloped property, conceivably may be a - mixture of light non-residential and high density residential uses. Development of the site as outlined and compliance with recommended conditions of approval should insure consistency and compatibility with the area. . { ~ ZONE RECLASSIFICATION NO.: ZE-73-83 V. RECOMMENDED AGENCY CONDITIONS, IF APPROVED; a) COUNTY PLANNING DEPARTMENT . 1) The Zoning Administrator shall approve a specific exterior lighting plan for the approved area prior to instaliation of such lighting. (Such plan sha11 attempt to confine iilumination to the area with full consideration to adjacent properties). 2) A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. 3) The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Variations when approved by the Zoning Administrator wi 1l be permi tted, i ncl udi ng, but not 1 imi ted to the fol i owi ng changes: Building location, landscape plans, and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shall be maintained. 4) Di rect 1 i ght f rom any exteri or area 1 i ghti ng f i xture shal l not extend over the property boundary. 5) The specific development plan wili be submitted for Zoning Administrator review and approval prior to issuance of buiiding permi ts. 6) Ali current standards of the Multiple Family Suburban Zone, as amended, shall be compiied with in the development of this site. 7) Applicant shall comply with '208' recommendations concerning stormwater runoff and provide necessary landscaping for runoff. 8) Any division of land for the purpose of sale, lease,or transfer shall comply with RCW 58.17 and the Spokane County Platting Ordinances prior to issuance of building permits. 9) Applicant shall comply with all agency's regulations as amended prior to issuance of building permits. _ ~3 J ZONE RECLASSIFICATION NO.: ZE-73-83 a) COUNTY PLANNING DEPARTMENT (continued) 10) That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Commi ssi oners Resol uti on #77-1392 be i ni ti ated by the proj ect applicant within thirty (30) days of final disposition of this application, and prior to any on-site improvements, or file appropriate documents to the effect that the NOTICE OF ACTION is waived in accordance with Spokane County Commissioners' Resolution #82-0458 dated May 4, 1982. 11) Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guidelines (WAC 197-10) and the Spokane County Environmental Ordinance (SCEO), a proposed declaration of non-significance has been issued at least fifteen (15) days prior to this date; the official file, written comments and/or public testimony contain information regarding assessment of the proposal's adverse impacts to the physical environment; a finding is hereby made that no potentially significant adverse impacts upon the physical environ ment are anticipated as a result of the project; and a final declaration of non-significance is hereby to be issued. 12) That prior to release of building permits for the four-plex structures, the dedicatory language of Sardam Subdivision be legally amended to allow for multi-family uses within the Subdivision. b) COUNTY ENGINEERING DEPARTMENT Prior to the Issuance of a Building Permit 1) Access permits for approaches to the County Road System shall be obtained f rom the Spokane County Engineer. 2) Applicant shall improve Union Road in a manner consistent with Spokane County TYPICAL roadway section No. 1 minimum paving width Access Standard. 3) Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issiaance of a building permit on the property. ~ t s u ZONE RECLASSIFICATION NO.: ZE-73-83 b) COUNTY ENGINEERING DEPARTMENT (continued) 4) The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal pl an for the enti re proj ect pri or to the i ssuance of any building permit on the property. 5) A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parlcing stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 6) The word "applicant" shall include the owner or owners of the - property, his heirs, assigns, and successors. 7) To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which,purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. 8) As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. The proposed project consists of a new commercial building, paved parking lot, landscaping and site improvements. As part of the project, necessary drainage improvements will be installed. Drainage Analysis Please reference the Grading/Drainage Plan. The soil on-site is Garrison soil, per the SCS soils map (attached), which is pre-approved for the use of drywells in Spokane County. The site will have one drainage basin, which is essentially the entire site. Runoff from the site will drain to a"208" bio-filtration swale.
