FAST TRACK PERMIT APPLICATION

Fast Track permits as provided for in Section 303(a) of the Uniform Building Code and Title 3 of the
Spokane County Code allows for construction of a project to commence concunent with and/or prior to a
complete plan review by the Building Official.
Whi1e this system is intended to experiite the plan review requirements, it is in no way intended to imply
expeditivus review and approval of a project by other departments involved in the permit process. Final-,
approval of a proposed project by all applicable departments must be obtained prior to the issuance of-a
Fast Track permit. If applicable, State Environmental Policy Act requirements must also be met.
All Fast Track projects must have full supervision by the architect or engineer of record for the project and
documentation certifying such shall be suppZied to the department prior to the release of any building
permit. After submitting and receiving initial approval from the Building Official and approval of the
proposat from other applicable departments, a phasing schedule shall be established such that future phases
of construction and associated plans are coordinated and approved through the plan check section of the
department. No work is to be accomplished beyond that specified on the approved plans prior to obtaining
approval from the Building Official, and in any case, all work must meet minimum code requirements
prior to issuance of a Certificate of Occupancy. As such, revisions may be necessary in either the as-built
project or proposed plans for the praject should code problems surface during plan review. Spokane
County assumes no liability for any such revisions. Any agencies or laboratories performing special
inspections on the project shall be identified prior to permit issuance. Upon completion of construction,
the architect or engineer of record shall notify the Building Official in writing that any construction
authorized by the building permit conforms to the codes adopted by Title 3 and plans approved by the
Building Official prior to the issuance of a Certificate of 4ccupancy.
Review and approval of the project and payment of all required fees is necessary prior to the release of a
permit. Construction concurrent with and/or prior to the completion of the plan review will be authorized
subject to:
(1) Approval of site plan, (4) Approval of all necessary groundwork; &
(2) Approval of basic building plan and concept, (5) Payment of all fees prior to the issuance of
(3) Approval of structural system, the building permit

HEARING EXAMINER COMMITTEE
FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Nearing Examiner Committee on
August 7, 1986, and the members of the Committee present being
Phillip D. Harris, Chairman, Ron Odell and Gary N. Anderberg.
B. PROPOSAL
The sponsor, Zaremba Midwest, is requesting approval of a zone
reclassification, File No. ZE-15-86, Agricultural and Cormnercial to
Regional Business (B-3), for the purpose of developing a Commercial
Center.
C. FINDINGS OF FACT
l. That the existing land use in the area is residential, commercial,
storage sheds and vacant.
2. That the Comprehensive Plan designates this area,as appropriate for
Major Commercial development.
3. That the existing zoning of the property described in the application
is Agricultural and Commercial.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulf i 1 led.
6. That the land in this area is suitable for the proposed~ use, or
uses within the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone is justified.
8. That the proposed use is compatible with existing uses in the
area.

9. That the owners of adjacent lands expressed approval of the proposed
use.
lU. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a) That the four property owners through their agent, Mr. Glen
Cloninger, and Mrs. Beulah Coman being present at the hearing
have accepted the conditions of approval and have agreed to
develop a Retail Center. Piecemeal development of the site is
not alloweci within this approval.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
1. That, if proposed development of the site deviates substantially f rom
the approved site plan, a public hearing shall be scheduled for
f urther review by the Zoning Hearing Examiner Committee.

a) COUNTY PLANNING DEPARTMENT
1. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of
such lighting. (Such plan shall attempt to confine illumination
to the area with full consideration to adjacent properties).
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired.
3. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Administra-tor
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. Al1 variations must
conform to regulations set forth in the ZONING CODE FOR SPOKANE
COUNTY. The original intent of the development plans shall be
maintained.
4. All current standards of the B-3 Zone, as amended, shall be
complied with in the development of this site.
5. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
cornpl iance with Section 7.06 (Aquifer Sensitive Area Overlay
Zone) of the ZONING CODE FOR SPOKANE COUNTY. Accordingly, as a
condition of approval, the sponsor/applicant shall be required
to file with the Spokane County Auditor, within thirty (30) days
of the signing of Findings and Order of the final decision in
this matter, a"Notice to the Public" which shall provide in
material as follows:
PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR
CERTIFICATE OF OCCUPANCY FOR AiVY BUILDING OR ANY USE
ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT
SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROVISIONS
OF THE ZONING CODE FOR SPOKANE COUNTY SECTION 7.06
(AQUIFER SENSITIVE AREA OVERLAY ZONE). THE PROPERTY
WHICH IS THE SUBJECT OF THIS NOTICE IS MORE PARTICULARLY
DESCRIBED AS FOLLOWS:....".

a) COUNTY PLANNING DEPARTMENT (continued)
6: Applicant shall comply with '208' recorrmendations concerning
stormwater runoff and provide necessary landscaping for runoff.
7. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
8. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTION is
waived in accordance with Spokane County Commissioners'
Resolution #82-0458 dated May 4, 1982.
b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit:
1. Applicant shall dedicate 15 feet on Evergreen Road for
right-of-way prior to any use of the property.
2. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer,
3. The County Engineer has designated Typical Roadway Section
Number One, Major Arterial standard for the improvement of
. Evergreen Road which is adjacent to the proposed development.
This will require the addition of approximately 14 feet of
asphalt, curb and sidewalk along the f rontage of the development.
4. The County-.Engineer has designated Typical Roadway Section
Number One, Major Arterial standard for the improvement of
Sprague Avenue which is adjacent to the proposed development.
This will require the addition of sidewalk along the frontage of
the development.
5. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.
6. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any
' building permit on the property.

b) COUNTY ENGINEERING DEPARTMENT (continued)
7: A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of tne project which is to be occupied
or traveled by vehicles:
8. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
9. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer,
10. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
11: Roadway standards; typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
12. The applicant shall reserve a 40 foot wide strip of land along
the rea r property as depicted on the site plan. When the
abandoned Chicago, Milwaukee and St. Paul right of way is
developed as a transportation corridor, this setback will
facilitate right of way acquisition for the corridor and
construction within it.
13. That in the future it may be necessary to upgrade the
intersection of Evergreen and Sprague because of traffic
generated by this development. The applicant will be required
to share in the cost of those improvements. Participation will
be determined by the percentage of overall volume of traffic
generated by the development.
c) UTILITIES DEPARTMENT
1. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
2. This project is a part of the Sprague Avenue ULID now under
construction. Building sewer plans and sewer connection permit
is required.

' d) COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
2. A public sewer system will be made available for the project.
Use of individual on-site sewage disposal systems shall not be
authorized.
3. Water service shall be coordinated through the Director of
Utilities, Spokane County.
4. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
5. Use of private wells and water systems is prohibited.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
l. The site is located in Fire District # l.
2. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible
and legible from the street or road fronting the property. Said
numbers shall contrast with their background.
3. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
4. Fire hydrants which meet the fire flow are required to be
installed prior to any construction. These hydrants shall be
placed so that no portion of the building exterior is more than
175 feet f rom the hy drant. The bottom of the lowest outlet of
the hydrant-shall be no less tnan 18 inches above grade. A
water plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 6 of Title 3 of the Spokane County Code is required
prior to construction of the water service. All required fire
protection facilities shall be installed and made serviceable
prior to, and during the time of, construction.
f) WATER PURVEYOR
1. Water Purveyor is Vera Irrigation District #15, and they will
supply the site with adequate water for domestic, fire and
irrigation uses, although satisfactory arrangements have not
been made.

g) COUNTY AIR POLLUTION CONTROL AUTHORITY
All air pollution regulations must be met. This includes but is not
1 imited to the fol lowing:
l. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions f rom
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
3. Al1 travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the
construction phase of the project and from motor vehicles using
the site following completion of the project and from occupants
of the proposed project.
E. ORDER
The Zoning Hearing Examiner Committee, pursuant to the aforementioned,
finds that the application of Zaremba Midwest, for a zone reclassification
as descrined in the application should be APPROVED to the REGIONAL
BUSINESS (6-3) ZONE.
