The following information must be provided in order for us to proceed with our review. A) For any new hard surface area, for an asphaltic roof, or a roof containing HVAC machinery, a drainage plan for the site shall be prepared in compliance with Spokane County "Guidelines for Stormwater Management". At ~ •j' 1 a minimum the plan must contain: 1. Drainage calculations for stormwater volumes : generated on site. 2. Calculations for total impervious surfaces contained within the site. 3. B) The subject property is affected by the "Findings and Order" and the "Conditions of Approval" for the following land use action: Spokane County Zone Change No. ZE-21-93 C) The following improvements within adjacent Right of Way are required prior to the release of a building permit: 1. You must submit road and drainage plans for street improvements. These must be prepared by an engineer. Plans must be prepared for the following fi~ + streets : r a. Dishman-Mica, Typical Roadway Section No. 2, ~ Major Arterial Standard. Allrequired construction (sidewalk/curbing/pavement) within the Public Road Right of Way is to be completed prior to the _ release of a building permit or a financial guaranty in an amount estimated by the County Engineer to cover the cost of construction or improvements shall be filed with the County Engineer. Required plans are to be submitted prior to estimating the amount of the financial guaranty or permit release. 2. Applicant shall dedicate 4 feet of right-of-way on Dishman-Mica, and slope easements as necessary. 3. Pl'ease submit a copy of a recorded property deed . ~ Page 2 from the Auditors office for the subject property. Upon receipt of the deed our staff will prepare the right of way deed. 4. Approach permits must be obtained, after a site plan has been approved, and before the issuance of a building permit, from the County Engineering Department for any new or improved driveway approaches to the following streets: a. Dishman-Mica D) Insufficient information was submitted with the proposal. We are unable to proceed with our review. We will need the following before we can proceed: 1. Site Plan. 2. Drainage plan as specified. 3. Other information: a. A parking and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving as required by the County Planning Ordinance, will be required for any portion of the project which is to be occupied or traveled by vehicles. It is illegal to back out onto the Right of Way. b. The County Arterial Road Plan identifies Dishman-Mica as a Principal arterial. The existing right-of-way width of 60 feet is not consistent with that specified in the Plan. In order to~implement the Arterial Road Plan, in addition to the required right-of-way dedication, a strip of property 16 feet in width along the Dishman-Mica frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time arterial improvements are made to Dishman-Mica. c. The Proposed is in a recognized 100 year f lood plain. Contact must be made with Brenda Sims of the County Engineers office before the permit will be released. E) Utility Condition: Permittee is responsible for arranging for all necessary utility adjustments or relocation as required for completion of the improvement. F) The owner of the property or the authorized representative must complete and sign Spokane County Engineers "Agreement to Pay Fees". This document must be returned to the County Engineers Office. Plan review will not be completed until this document is executed. This document is attached to these camments. Please return the completed Agreement to your contact person at the Engineers Department. Only after all the information and requirements listed above are supplied or completed and the necessary review has been accomplished will your building permit be released. INTRODUCTION This matter has come before the Hearing Examiner Committee on July 22, 1993. The members of the Committee present are Verona Southern, ChairperSOn, Lunell Haught and Jan Reuter. PROPOSAL The sponsor, Sylvia Riddle, requests approval of a Zone Reclassificarion, ZE-21-93, from Urban Residential-3.5 (LTR-3.5) to Regional Business (B-3) within the Aquifer Sensitive Area Overlay Zone for a contractors office/yard. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located south of and adjacent to Dishman-Mica Road, approximately 100 feet northwest of the intersecrion of Bowdish Road and Dishman- Mica Road in the southwest 1/4 of Section 33, Township 25 North, Range 44 EWM, Spokane County, Washington. 2. The committee adopts the Planning Deparnnent Report as a part of this record. 3. The existing Iand uses in the area include commercial and residential. 4. The proposed use is comparible with exisring uses in the area. 5. The Comprehensive Plan designates this site as Urban. The Urban category is for the purpose of developing a"city-like" environment with various uses including neighborhood commercial and intensive residential development. 6. The proposed zoning could implement and conform to the Comprehensive Plan. 7. The Arterial Road Plan designates Dishman-Mica Road as a Principal Arterial, with a recommended right of way width of 100 feet. 8. The existing zoning of the property described in the application is Urban Residenrial-3.5 (UR-3.5), previously established as Agricultu.ral (A) zoning in 1967 and reclassified to Urban Residential-3.5 (UR-3.5) zone on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. 9. The provisions of RCW 43.21C ('The State Environmental Policy Act) have been complied with and a Determ.ination of Nonsignif'icance was issued. The Committee, after independent review, hereby adopts the DNS. 10. The legal requirements for public notice have been fulfilled. . 11. The Spokane County Planning Department shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall only be released, in full or in part, by the Planning Department. The notice should be recorded within the same time frame as an appeal and shall provide the - following: - a. At least 16 feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing and/or newly dedicated right-of-way along Dishman Mica Road. NOTE: The County Engineer has required 4 feet of new dedication. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. Lf any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interi.m uses. 7. The Planning Department shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special condirions imposed as a result of approval of a land use acrion. Applicant shall dedicate 4 feet on Dishman Mica Road for right of way and slope easements as necessary. Prior To Issuance Of A BuildinLr Pernut Or Use Of The Propertv As Prouosed: 3. Access permits for approaches to the county road system shall be obtained from the Spokane County Engineer. _ 4. The applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans. 5. The applicant shall submit for approval by the Spokane County Engineer and the Spokane Counry Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project, or portion thereof, if the development is to be phased. 6. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard u-affic engineering pracrices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 7. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 8. The County Engineer has designated Typical Roadway Section Number Two, Major Arterial standard for the improvement of Dishman Mica Road, which is adjacent to the proposed development. This will require the addition of approximately 13-15 feet of asphalt along the frontage of the development The construction of curbing and sidewalk is also required. 9. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction and other applicable County standards and/or adopted resolurions pertaining to Road S tandards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 10. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80-1592 as amended and are applicable to this proposal. . 11. ` lThe regulations of the National Flood Insurance Program shall be observed since the proposed plat is affected by a flood hazard zone. No conStruction work shall be performed within the existing or proposed public right-of-way until a permit has been issued by the County Engineer. The County Arterial Road Plan identifies Dishman Mica Road as a Principal arterial. The existing right-of-way width of 60 feet is not consistent with that specified in the Plan. In order to implement_the Arterial Road Plan, in addirion to the required ~ right-of-way dedicarion, a strip of property 16 feet in width along the Dishman Mica Road frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to Dishman Mica Road. . 15. There may exist utiliries, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligadon for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to deternune whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work.
