MICHAEL HUFFMAN being first duly sworn on oath deposes and says that he is the EDITOR of the Spokane Valley News
Herald, a weekly newspaper. That said newspaper is a legal newspaper and it is now and has been for more than six months prior
to the date of publication hereinafter referred to, published in the English language continually as a weekly newspaper in Spokane
County, Washington, and it is now and during all of said time was printed in an office maintained at the aforesaid place of
publication of said newspaper, which said newspaper had been approved as a legal newspaper by order of the Superior Court of
the State of Washington in and for Spokane County. That the following is a true copy of a Legal Notice as it was published in

retaining boulders in several areas; install
new brick patio and crushed rock pathway;
remove and replace an existing boathouse;
repair a rail system associated with the
boathouse; and repair an existingpier style
dock on the Spokane River.

Determination: Pursuant to Title 21 (Envi-
ronmental Controls) of the Spokane Valley
Municipal Code (SVMC), the lead agency
has determined that this proposal does not
have a probable significant adverse impact
on the environment. An Environmental Im-
pact Statement (EIS) is not required under
ROW 43.210.030(2)(c). This decision was
made after review Of the completed envi-
ronmental checklist, the application, SVMC
Tiles 19, 21 and 22, site assessment, and
comments from thepublicand affected
agencies. This information is available to
• the public on request This DNS is issued
using the optional DNS process in WAC
197-11-355. There is no further comment
period on the DNS.

Appeal: An appeal of this determination
shall be submitted to the City of Spokane
Valley within fourteen (14) calendar days
atter the date issued. The appeal must be
written and make specific factual objections
to the City's threshold determination. Ap-
peals shall be conducted in conformance
withSVMC 17.90 Appeals, and any required
fees pursuant to the City's adopted Fee
Schedule shall be paid at time of appeal
submittal. Pursuant to WAC 197-11.680,
appeals shall be limited to a review of a
final threshold determination.
