WIAVER OF VIOLATION
WVS-2-80, SIDEYAAD SETBACK VIOLATION
ZONING ADJUSTOR DECISION: After public testimony and review, the decision
of the Zoning Adjustor is to approve the applicant's request for a waiver of violation.
FINDINGS: Pursuant to Section 4.25.030 of the Spokane County Zoning Ordinance,
the Zoning Adjustor has the responsibility of determining that the granting of this
application will not be detrimental to the surrounding properties. In assuring com-
patibility, the Zoning Adjustor based his decision an the testimony presented at the
above noted Zoning Adjustor Hearing as well as criteria set forth in the Spokane
County Zoning Ordinance for review of this application. The Zoning Adjustor hereby
finds the following:
1. Letters from adjacent property owners indicate that no hardship or nuisance is
created by the present location of the structure.
2. The applicant stated he was not aware a building permit for this shelter was re-
quired and did not willfully violate permit requirements of Spokane County.
3. There is no bebeficial public purpose to be served by requiring the applicant to
relocate or otherwise correct the present zoning violation.
B: ORDER:
Applicant's request is hereby approved and with the following stipulation:
1. Applicant shall obtain a building permit for the boat shelter.
2. Applicant shall obtain an approved site plan for sewage disposal from the
Spokane County Health District.
