The County Engineering Department-has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished qrade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Spokane County Zone Change No. ZE-33-89
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. Barker Road, Typical Roadway Section No. 1,
Secondary Arterial Standard. This will require the addition of
approximately 4 to 6 feet of asphalt, curbing and sidewalk must
also be constructed.
b. Alki Avenue, Typical Roadway Section No. 1,
Access Street Standard. This will require the addition of
approximately 10 to 14 feet of asphalt, curbing and sidewalk must
also be constructed.

All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.
2. Applicant shall dedicate 2 feet on Barker Road and
10 feet on Alki Avenue for right of way.
3. Please submit a copy of a recorded property deed
from the Auditors off ice for the subject property.
Upon receipt of the deed our staff will prepare the
right of way deed.
4. Approach permits must be obtained, after a site
plan has been approved, and before the issuance of
a building permit, from the County Engineering
Department for any new or improved driveway
approaches to the following streets:
a. Alki Avenue
D) Insuff icient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Site Plan.
• 2. Drainage plan as specified.
3. Other information:
a. A parking and traffic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles. It is illegal to back out onto the Right of Way.
b. The County Arterial Road Plan identif ies
Barker Road as a Minor arterial. The existing right-of-way width
of 62 feet is not consistent with that specified in the Plan. In
order to implement the Arterial Road Plan, in addition to the
required right-of-way dedication, a strip of property 8 feet in
width along the Barker Road frontage shall be set aside in
reserve. This property may be acquired by Spokane County at the
time arterial improvements are made to Barker Road.
E) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.

F) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
Only after all the information and requirements listed above
are supplied or completed and the necessary review has been
accomplished will your building permit be released.

HEARING EXAMINER COMMITTEE
FINDIN(YS OF FACT. CON .L ISIONS AND ORDER
INTRODUCTION
This matter having come before the Hearing Examiner Committee on December 21,
1989, and the members of the Committee present being Chairperson Verona
Southern, Lunell Haught and Don Neraas.
PROPOSAL
The sponsor, Jce K. Staley, requests approval of a zone reclassification from
Agricultural (A) to Regional Business (B-3), File No. ZE-33-89, for the purpose of
truck repair, boat storage and future commercial use.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located in the Greenacres area of the Spokane Valley, east
of and adjacent to Barker Road and south of and adjacent to Allci Avenue in Section
17, Township 25 North, Range 45 EWM, in Spokane County, Washington.
2. The committee adopts the Planning Department Report as a part of this record.
3. The existing land uses in the area are fuel oil bulk facility, storage, boat sales and gas
station, storage building, single family residences and vacant.
4. The Comprehensive Plan designates this site as Urban. The Urban category supports
a variety of uses ranging from predominandy single family residences to
neighborhood, commercial and light industrial. The more intensive uses should be
located along heavily traveled smeets.
5. The Arterial Road Plan designates Barker Road as an arterial, with a recommended
right of way width of 100 feet The County Engineer is requiring 2' additional
dedication with 8' set aside for future acquisition.
6. The exisang zoning of the property described in the application is Agricultural,
previously established in 1975.
7. The provisions of RCW 43.21 C('The State Environmental Policy Act) have been
complied with and a Deternzination of Nonsignificance was issued.
8. The proper legal requirements for advertisement and notice have been fulfilled.
9. The owners of adjacent lands expressed disapproval of the proposed use. '
10. The Conunittee additionally finds:
a. That the proposal as conditioned implements the Comprehensive Plan and the
landscaping along Alki Avenue will enhance the area as well as buffer the existing
uses.
b. The proposal is compatible with past zone changes in the area.

c. That recent zoning activity along Alla Avenue (Restricted Industrial File
#ZE-26-88C) has changed the area and the type of traffic on Allo Avenue.
11. The proposed use is comparible with existing uses in the area.
12. The proposed zoning does implement and conform to the Comprehensive Plan.
13. The applicant has demonstrated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified.
14. The proposal does not result in spot zoning.
15. The proposed use will not be detrimental to the public health, safety, morals or
welfare.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant", which term shall include the owner or ovmers of the property, heus,
assigns, and successors-in-interest.
2. The following Conditions of Approval apply to the following described real property:
Lot 6, Except the N. 159 ft.; Lots 2& 3 and the N. 150 ft. of Lots 7, 8& 9, Block 5
Corbin Add.ition to Greenacres, Section 17, Twp. 25 N., R. 45 E:WM, Spokane
County, Washington.
HEARING EXAMINER COMMITTEE
1. Only 3 access points be allowed from the zone change site to Alld Avenue; 2 for truck
traffic and one for automobile traffic.
2. A 3 foot undulating and meandering berm be incorporated into the 10 foot wide
landscaping strip along Alla Avenue.
3. Signs for the portion of the site fronting Allci Avenue be limited to 100 sq. ft.
maximum in surface area and that no detached signs are pemutted.
COUNTY PLANNING DEPARTMENT /
✓
1. Snecial: That a 20' wide landscape strip, Type II, with a mix of high and low
deciduous and evergreen vegetation be provided along Allci Avenue. '208'
stormwater drainage swales may be incorporated within said 20' but not to exceed a
10' width. Said landscaping shall be provided as soon as weather conditions '
pernut but no later than April 15, 1990.
2. Approval is required by the Planning Dire.ctor/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.
3. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance

bond for the project prior to release of building permits. Landscaping shall be
installed and maintained such that sight distance at access points is not obscured or
impaired.

4. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Examiner Committee. Variations, when approved
by the Planning Director/designee, will be pernutted, including, but not limited to
the following changes: building location, landscape plans, and general allowable
uses of the perniitted zone. All variations must confonn to regulations set forth in
the ZONING CODE FOR SPOKANE COUNTY. The original intent of the
development plans shall be maintained.
5. The specific development plan will be submitted for Planning Department review
and approval prior to issuance of building pernuts.
6. All curnent standards of the B-3 Zone, as amended, shall be complied with in the
development of this site.
7. The project is subject to Section 14.706, the Aquifer Sensitive Area Overlay Zone
of the ZONING CODE FOR SPOK:ANE COUNTY, which sets forth various
measures for Aquifer protection; specifically, measures dealing with wastewater
d.isposal, spill protection measures, and stonnwater runoff.
8. The present proposal is not detailed enough to deternune whether or not the use of
or materials stored on the site are in compliance with Section 14.706 (Aquifer
Sensitive Area Overlay Zone) of the ZONIlVG CODE FOR SPOKANE COUNTY.
Accordingly, as a condition of approval, the sponsor/applicant shall be required to
file with the Spokane County Auditor, within thirty (30) days of the signing of
Findings and Order of the final decision in this matter, a"Notice to the Public"
which shall provide in material as follows:

OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON TBE PROPERTY
DESCRIBED HEREINAFTER, THE APPLICANT SHAI.L BE RESPONSIBLE
FOR COMPLYING WITH THE PROVISIONS OF THE ZONIlVG CODE FOR
SPQKANE COUN'I'Y SECTION 14.706 (AQUIFER SENSITIVE AREA
OVERLAY ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS
NOTICE IS MORE PARTICLJI.ARLY DESCRIBED AS FOLLOWS:....".
9. Applicant shall comply with '208' recommendations concerning stormwater runoff
and provide necessary landscaping for runoff.
10. Any division of land for the purpose of sale, lease or transfer, shall comply with
RCW 58.17 and the Spokane County Platting Ordinances prior to issuance of
building permits. •
11. Spokane County Planning Department record with the County Auditor a"Tide

12. At least 8 feet of future acquisition area for road right of way and utilities, in
addition to the existing right of way, along Barker Road.
13. Building and other setbacks required by the Spokane County Zoning Code shall be
measured from the future acquisition area reserved for road right of way and
utilities.
14. No requircd landscaping, parlcing, '208' areas, drainfield or allowed signs shall be
within the future acquisition area for road right of way and utilities. If any of the
above unprovements are made within this area, they shall be relocated at the
applicant's expense when roadway improvements are made.
15. The future acquisition area, until acquired by Spokane County, shall be private
property and may be used as allowed in the zone except any improvements (such as
landscaping, parking, surface drainage, drainfields, signs, or others) shall be
considered "interim" uses.
16. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway unprovements after
acquiring said future acquisition area.
17. This "Title Notice" shall be signed by the applicant to serve as official notice and
acknowledgrnent of said future acquisition area for road right of way and uriliries.
18. Required landscaping shall be placed as far away from future right of way
improvements as possible such that they may remain after roadway improvements
are made.
19. The Spokane County Planning Department shall prepare and record with the
Spokane County Auditor a"Title Notice" noting that the property in question is
subject to a variety of special conditions imposed as a result of approval of a land
use action. This "Title Notice" shall serve as official public notice regarding
conditions of approval affecting the property in question. The "Title Notice" shall
be recorded within fifteen (15) days of final disposition of the approved land use
action and shall only be extinguished by the Spokane County Planning Deparnnent.
The "Title Noace" shall generally provide as follows:
The parcel of property legally descri6ed as (legal descriprion and tax parcel
number) is the subject of a land use action, imposing a variety of
special development conditions, by a Spokane County Hearing Body
or Administrative Official on (date) and as maybe amended, altered or
supplemented by official action or as already changed. File No. (Planning
Department File Number) is available for inspection and copying in the
Spokane County Planning Department. '
COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit Or Use Of The Propertv As Pronosed:
1. Applicant shall dedicate 2 feet on Barker Road for right of way.

Applicant shall dedicate 10 feet on Allci Avenue for right of way.
2. The County Engineer has designated Typical Roadway Section Number One,
Secondary Arterial Standard for the improvement of Barker Road which is adjacent
to the proposed development. This will require the addition of approximately 4 to 6
ft. of asphalt along the frontage of the development. Curbing and sidewalk must
also be constructed.
The County Engineer has designated Typical Roadway Section Number One,
Access Street Standard for the improvement of Alki Ave. which is adjacent to the
proposed development. This will require the add.ition of approximately 10 to 14 ft
of asphalt along the frontage of the development. Curbing and sidewalk must also
be constructed.

3. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location, and arrangemerr-af~arlpng stalls
, shall be in accordance with standar+d traffic engineering practices- iin!gsurfacing as approved by the County Engineer, will be required fo~any of
the project which is to be occupied or traveled by vehicles.
4. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
5. Access pemzits for approaches to the County Road System shall be obtained from
the Spokane County Engineer.
Applicant shall submit for approval by the Spokane County Engineer roa.d,
~ drainage, and access plans.

7. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project or any portion thereof, if the
development is to be phased.
8. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction, and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
9. Roadway standards, typical roadway sections and drai.nage plan requirements are
found in Spokane Board of County Commissioners' Resolution No. 80-1592 as
amended and are applicable to this proposal.
10. No construction work is to be performed within the existing or proposed public '
right-of-way until a pernut has been issued by the County Engineer. All work is
subject to inspection and approval by the County Engineer.
11. All required construction within the exisring or proposed public right of way is to
be completed prior to the release of a building permit or a bond in the amount
estimated by the County Engineer to cover the cost of construcrion of improvements
shall be filed with the County Engineer.

12. The County Arterial Road plan identifies Barker Road as a Minor Arterial. The
existing right of way width of 62 ft. is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan it is recommended that in addition to
the required right of way dedication, a strip of property 8 ft. in width along the
Barker Road frontage be set aside in reserve. This properry may be acquired by
Spokane County at the time when Arterial Improvements are made to Barker Road.
COUNTY UTILTTIES DEPARTMENT
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use
of on-site sewer disposal systems is hereby authorized. This authorizaaon is
conditioned on compliance with all rules and regulations of the Spokane County
Health I?istrict and is further cond.itioned and subject to specific application
approval and issuance of permits by the Health DistricL
2. The Owner(s) ar Successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a ULID by petition method pursuant to
RCW 36.94 which the petition includes the Owner(s) property and further not to
object by the signing of a protest peririon against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s)
property. PROVIDED, this condition shall not prohibit the Owner(s) or
Successor(s) from objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the fomiation of a ULID by either
petirion or resolution method under RCW Chapter 36.94.
3. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall be approved by
the County Engineer and the Spokane County Health District prior to the issuance
of any on-site sewage disposal system or building permit for this project,
2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
3. Water service shall be coordinated through the Director of Utilities Spokane
County.
4. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Social & Health Services.
5. Disposal of sewage effluent beneath paved surfaces is currently prohibited. '
6. Subject to specific application approval and issuance of permits by the health
officer, the use of an individual on-site sewage disposal system may be authorized.

COUNTY BUILDING AND SAFETY DEPARTMENT
1. The applicant shall contact the Deparement of Build.ing and Safety at the earliest
possible stage of design/development in or-der to be informed of Code requirements
administered/enforced by the deparcment, e.g., State Build.ing Caie Act regulations
such as requirements for fine hydrantJflow, fire apparatus access roads, street
address assignment, barrier-free regulations, energy code regulations, and general
coordination with other aspects of project implementation.
2. Requirements of Fire District No. 1 need to be satisfied during the building permit
process.
WATER PURVEYOR
1. Water Purveyor is Consolidated Irrigation District No. 19 and they will supply the
site with adequate water for domestic, fire and imgation uses.
