Dear Mr. Nelson:
Pursuant to our conversation yesterday morning, please accept this letter as
acknowledgement of certain conditions relative to the deve`lopment of the
aforementioned property.
First, is the recognition of and acceptance of Spokane County Zoning Hearing
Examiner Committee action on ZE-26-87 & VE-41-87, dated July 1, 1987 as it
pertains to this property.
As you are aware we have applied for a building permit to construct one(1) of
the units included in the examiner action ZE-26-87. This unit will be used to
conduct a'pre-sales' program with construction of Phase one, 57 units,
contemplated no later.than 1 July, 1988. At that time all of the conditions
delineated in ZE-26-78 & VE-41-87 will be adhered to with the submittal of
plans for building permit.
You should also be aware that certain elements of this application for
building permit will be removed and/or modified such as to bring the
development in accordance with the zoning action but that these elements are
necessary at this time due to cost perameters associated with the construction
of one unit as opposed to the construction of the 57 units contemplated with
Phase one next spring.
The vehicle access associated with this request is temporary and will be
eliminated with construction next spring. The surface of the traffic area caill
also change with the sub'sequent construction. The drainage plan and 208 Aquifer
protection requirements, required per ZE-26-87 will be advanced as part of the
subsequent permit application next spring. Too, I have-asked the property
owner for a copy of the title such that dedication of 7' along Adams Road and
10' along Fourth Street can be expedited and will forward to you as soon as
it is received. They recognize that this will be necessary for any development
and have indicated a willingness to dedicate this property at this time.

COMMITMENT
Conditions and Stipulations
1. The term "mortgage," when used herein, shall include deed of trust, tnast deetl, or other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other
matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown
in Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be
relieved from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company
is prejudiced by failure to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to
the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien, encumbrance,
adverse claim or other matter, the Company at its option may amend Schedule B of this Commitment accordingly,
but such amendment shall not relieve the Company from liability previously incurred pursuant to par•agraph 3 of
these Conditions and Stipulations.
3. Liabilitv of the Companv under this Commitment shall be only to the named proposed Insured and such parties
included under the definition of Insured in the form of policy or policies committed for and only for actual loss
incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof, or (b) to
eliminate exceptions shown in Schedule B, or (c) to acquire or create the estate of interest or mortgage thereon
covered by this Commitment. In no event shall such liability exceed the amount stated in Schedule A for the
policy or policies committed for and such liability is subject to the Insuring provisions, exclusion from coverage,
and the Conditions and Stipulations of the form of policy or policies committed for in favor of the proposed
I nsured which are hereby incorporated by reference and are made a part of this Commitment except as expressly
modified herein.
4. Any claim of loss or damage, whether or not based on negligence, and which arises out of the status of the title
to the estate or interest or the lien of the insured mortgage covered hereby or any action asserting such claim,
shall be restricted to the provisions and conditions and stipulations of this Commitment.

Proposed is the construction of a retirement center. The
applicant was not present at the meeting, however it is believed
that the center would be built in phases.
SUMMAEtY OF DEPARTI+EN'rAL REQUIRFMENTS :
I. Building and Safety (456-3675)
A. Discussion/Requirements
1. A complete and detailed set of plans needs to be
submitted for review and approval.
2. Fire protection of the buildinq and fire district
access will need to be worked out.
3. As Adams Road will be closed at.a future date,
leaving only one access (4th Avenue), there may be a
problems with the fire district. Bob McCann,
Engineering, stated that at the Zone Change hearing,
only one access was proposed at that time with no
objections.

l. Provisions need to be made for f ire apparatus.
. EMS will need readily available access to the site.
2. The current design of the center totally encloses
the area and could potentially prevent a fire from
being stopped.

is estimated to be at 6,000 g.p.m. Exact flow cannot
be calculated at this time due to lack of design detail
for the buildings.
4. If the proposal is built in phases, a layout of
the proposed water supply system will need to be
submitted. Presently, it looks as though eight to ten
hydrants will'need to be installed. One does already
exist on 4th Avenue (through Vera Water), Hydrants
would need to be located on the outside of the site,
with access to the inside on the south and east sides.
Protection (hydrants) will also need to be provided in
the middle of the complex.
III. Engineering (456-3600)
A. Discussion/Requirements
1. A copy of comments were given to the applicant and
Building and Safety by Gary Nelson.
2. The applicant must comply with all the conditions
of the zone change.
3. A road and drainage plan will need to be submitted
for review and approval.
4. Adams and 4th Avenue will need to be widened,
using curbing, swale, and the sidewalk being last.
This may cause a problem with hydrant locations.
Should the project be built in phases, it is possible
the applicant could obtain a bond in order that the
road improvements would not have to be completed all at
once.

IV. Health District (456-3600) ,
A. Discussion/Requirements ,
1. The project will be connected to the Valley Sewer
system.
2. If food service is provided to the public in the
recreation center, kitchen plans will need to be
submitted for review and approval.
3. The applicant shall coordinate with a refuse
company serving the area for access to the refuse
containers.
V. Planning Department (456-2205)
A. Discussion/Requirements
1. The Planning Department was not present at the
meeting, however they informed Building and Safety that
comments regarding the proposal are available at their
department. The applicant should contact Pat
Frankovic.
VI. Utilities (456-3604)
A. Discussion/Requirements
l. The Utilities Department was not present at the
meeting, nor were comments received. However, Tom
Davis noted that a sewer connection permit will be
required at the time connection to the sewer is made.
ADJOURNMENT: There being no further business, Tom Davis thanked
the applicant and thm- departmm-nts for their garticipaticn and
reminded all that he should be contacted if there any unforeseen
problems which may arise. Also, should there be any changes from
what appears in the minutes, we should be notified within one day
