Subject: Belleaire 1st Addition,Phase III, 50 lots; PE-1998-07
Dear Mr. Dahm,
The Hearing Examiner Findings, Conclusions, and Decision (the "Hearing Examiner Decision")
for the above referenced subdivision require certain traffic impact mitigation to the intersection
of Sprague Avenue and Barker Road from Summit Properties prior to final plat approval.
Alternatively, the Hearing Examiner Decision allows the City of Spokane Valley (City) and
Summit Properties to agree to other forms of traffic mitigation as determined appropriate.
Summit Properties has submitted Phase III of Belleaire 1st Addition to Spokane County for final
plat approval. By this letter agreement, the City agrees to accept voluntary traffic mitigation as
described below as acceptable mitigation, provided such acceptance is solely for mitigation for
Phase III.
The voluntary mitigation fee has been established for the Sprague,Avenue and Barker Road
intersection improvements at $365.50 per P.M. peak hour trip. The Parties agree that for the 50
lots of Phase III, the total mitigation fee is $18,275.00 ($365.50 per P.M. peak hour trip x 1 P.M.
peak hour trip per lot x 50 lots).
The City (1) has identified future road projects necessitated by the above referenced subdivision;
and (2) has identified a reasonable relationship between impacts generated by the above
referenced subdivision to the transportation system:and the financial'contribution toward those
impacts. To mitigate the direct impacts of the above referenced subdivision upon existing
transportation facilities, the Parties are voluntarily entering into this letter agreement pursuant to
RCW 82.02.020.
The Parties agree the mitigation identified herein is solely related to Phase III and that additional
mitigation is still necessary for all subsequent phases of the above referenced subdivision. The
Parties agree to continue negotiating other appropriatemitigation for all other subsequent phases
of the above referenced subdivision.
