General Overview - Walgreen's Company, a prospective tenant, is proposing to remodel an existing building, primarily consisting of a cosmetic work to the exterior and a modest interior remodel. The building contains approximately 3,300 square feet on the main floor with a partial basement and a second floor. The second floor of the building will not be leased by Walgreens. Walgreen stores are typically 1,500 to 1,800 square feet -in size. The applicant has not decided if they will use the entire main floor for retail and/or if they will utilize the . basement at all. A drive-through window is proposed for dispensing of prescription drugs. Francine Sttaw read the following se~c#.ion from the zoning code regarding sign standards in a B-3 zorie: "On-prernise signs shall be 1imited as folivws for individual business sites: wa1l signs shall no exceed the auter limits of the wa11 and shall not caver mare than two (2) walls; the total area of a11 ather signs shall not exceed two (2) square feet per 1irreal foat of street frontage, up to a rnaximurn o€ 250 square feet nor 354 in height above grade, unless the frantage exceeds 200 feefi when additional signage is permi,tted fvr freestanding signs. Please submit calculations determining the feet of stre~~ frontage of the site. It was nvted that the total size of all proposed signs is added together to determine the Cotal square footage. The applicant proposes to instal1 a reader board. He was advised by Pat Harper . , to cgntact the Washington State Department of Transportation at 456-6000 as Pines Rvad is under their junsdictian. This -2 - 1 • si'gn may not be located in a manner that would obstruct vision on the corner of Sprague and Pines. a ' Francine Shaw stated that there are no limitations to the number of free-standing signs that are allowed on the site and that any sign that is not attached to the buildings is defined as free-standing. Pat Harper, Division of Engineering, suggested the applicant contact the Washington State Department of Transportation at 456-3000 regarding sign restrictions since Pines Road falls under their j urisdiction. 7. Any proposed exterior refuge storage areas are required to be screened on three (3) sides by a site obscuring fence and have a site obscuring gate on the fourth side. The applicant stated that exterior refuge storage area is existing and questioned why they (as tenant) must bring it up to current standards now. 8. There are no requirements for exterior lighting within the zone of the proposed. However, the Planning Department would like to review the location and direction of illumination for any proposed lights so a determination can be made that no conflict will exist between the proposed exterior light and traffic signals in the area. 9. Landscaping will be required if the cost of the proposed remodel exceeds 50 % of the assessed value of the existing building. The applicant stated that the cost will not exceed that percentage. Please illustrate the existing planter (located south of the building) and identify the vegetation present. No additional landscaping will be required. B. Permit Release Requirements 1. If required, please submit an estimate from a nursery including size, type, curbing, quantity of landscaping, itemized cost of the irrigation system, and the cost of labor along with a promissory letter from the owner stating the landscaping will be installed. 2. Please aggregate the two parcels into one parcel through a Certificate of Exemption. 3. Please submit a revised site plan illustrating the correct property dimensions of the parcel, the use of the building, the square footage of each type of use, floor plans for the building, parking, signage, lighting, landscaping, and setbacks for review and approval. II. Division of Engineering & Roads (456-3600) - Bob Turner A. Discussion Items 1. Comments were given to the applicant and the Department of Buildings by Pat Harper. Vur2. Noroad improvements are required, however, it appears as if the existing b cut is being relocated. This could cause a conflict between the 12 inch power pole and the storm drainage inlet that exist on the site. Please submit -3- r ~ plans prepared by an engineer for review and approval if tihe cucb cLit is • relocated. 3. Approach permits shall be obtained along Sprague Avenue if the existing approach is modified. 4. Please submit a traffic and circulations plan for review and approval. It appears that a conflict may exist between ingress to the site and the location of the drive through window. The applicant stated that statistics indicate that they serve between 3-4 customers per hour at their drive through windows and that this number does not tremendously fluctuate during their hours of operation. Alternatives may include relocating the drive through window ~4 hich would extend the length of the drive through lane, relocating the curb cut t the east to allow for greater visibility, or limiting traffic to one-way exiting onto Sprague. The applicant would prefer not to have one-way traffic. Discussion was also held regarding requirements for stacking. The applicant inquired of Francine Shaw if the vehicle stacking could be counted towards meeting the parking requirements. She advised the applicant to submit a letter to the Planning Department requesting that the vehicle stacking be included as part of the parking requirement, and identify the number of stacked vehicles on the revised site plans. The applicant asked if this would be an Administrative Interpretation. Francine Shaw responded affirmatively, although it could also be a variance. 5. An Agreement to Pay Fees was given to the applicant during the meeting. The agreement is to be signed by the owner and returned to the Division of Engineering & Roads. Plan review will not be completed until this document is executed. B. Permit Release Requirements 1. Please submit road plans prepared by an engineer for review and approval if the curb cut is relocated. 2. Approach permits shall be obtained for any modification of driveway approaches along Sprague Avenue. 3. Please submit a copy of the Agreement to Pay Fees signed by the owner. III. Health District (324-1577) - Daryl Way A. Discussion Items 1. Comments were given to the Department of Buildings by Daryl Way and presented to the applicant by Bill Benish. 2. The proposed is currently served by Modern Electric Water Company (45 6- 8000) . . 3. Proposed is currently connected to the Spokane County public sewer system. 4. The applicant stated that no food is vended from the premises. -4- ♦ • . 5: All -construction debris shall be taken to a licensed landfill. 6. Please handle all asbestos insulation materials in accordance with SCAPCA ' requirements. B. Permit Release Requirements 1. The Health District has authorized the Department of Buildings to release their portion of the building permit. IV. Fire District No. 1(928-2462) - Eric Olson A. Discussion Items 1. Fire flow for the proposed was determined previously and adequate protection exists to serve the site. 2. A lock (Knox) box entry system for fire department personnel access is required to be installed. Forms for ordering was given to the applicant. The completed forms are to be returned to the Fire District prior to release of the building permit. The box shall be installed prior to occupancy. 3. The Fire District would like to review the exiting from the basement after it's use is determined. Additional exits may be required. 4. The applicant indicated that the address to the site will be located on the building and not on a free-standing sign. 5. The Fire District would like the applicant to install protection around the gas meter and line that exist on the site. B. Permit Release Requirements 1. The order form for the lock (Knox) box entry system shall be submitted to the Fire District prior to release of the building permit. V. Department of Buildings (456-3675) - Bobby Stone A. Discussion Items 1. Plan review has been completed 6n the site plan only Bobby Stone. 2. The proposed building is being classified as a B-2, Type VN construction. 3. Please submit a critical materials list for review. 4. Permits issued after 7/1/92 must meet the requirements of the 1991 UBC. 5. The proposed shall meet the minimum requirement of the Regulations for Barrier Free Facilities. Proposed should also comply with the provisions of the American Disabilities Act. The Department of buildings will not be requiring compliance with this act until it is adopted as part of the Washington State Barrier Free Regulations, which is not expected to occur until July, 1992. The applicant indicated that they intend to install new exits from the bui4ding • and not use the existing exits. Please verify that the proposed exits comply with Table 33A, which requires that two exits be placed no less than half the diagonal , . distance across the occupied space. Since the building is 100 feet wide, the two exits may not be less than 50 feet apart. 7. No determination has been made on exiting requirements from the basement or second floor. The applicant, as a tenant, expressed concerns regarding their lack of control over another tenant. Bill Benish will review the previously issued permits for the site to ascertain code compliance status for the second floor. 8. Structural calculations should be submitted to justify the adequacy of the structural system (including foundation) for seismic, wind, dead, snow and live loads. (UBC Chapter 23) 9. In order for the Department of Buildings to expeditiously process this project, it is important that submittals include all necessary drawings and documents. The receipt of comprehensive site plans, construction drawings, and structural calculations will greatly assist the plan review function and insure that it is completed in the least amount of time. 10. The front page (cover sheet) of the construction drawings shall contain, at a minimum, the professional stamp with an oriizinal dated signature. This cover sheet shall include the building address, legal description and index of pages being submitted under the professional stamp. B. Permit Release Requirements 1. Two complete revised sets of plans addressing the items discussed during the meeting and other items from the plan review letter needs to be submitted for review and approval. The proposed traffic circulation plan ip not acceptable. The drive ~ through window is too close to Sprague. This location has a high potential to ' back up traffic on Sprague because of the short maneuvering area. Suggested ' alternatives could be moving the drive through window back to the southern ~ portion of the building. This will give traff ic more circulating room. - Another option would be to make the access on Sprague a one way only, - allowing cars to exit but not enter. This option would still be difficult because signage and directional arrows alone are usually not a strong enough deterrent. A revised site plan which resolves the traffic circulation concerns will have to be received before your permit can be released. The results of the computer analysis show that for a maximum runoff rate of .89 CFS, the headwater developed reaches a depth of .66' (see attached calculations). This dep th is greater than .75' below the grate elevation, therefore the pipe, as shown, should provide for adequate conveyance of the drainage. The proposed traffic circulation plan ip not acceptable. The drive through window is too close to Sprague. This location has a high potential to back up traffic on Sprague because of the short maneuvering area. Suggested alternatives could be moving the drive through window back to the southern portion of the building. This will give traffic more circulating room. Another option would be to make the access on Sprague a one way only, allowing cars to exit but not enter. This option would still be difficult because signage and directional arrows alone are usually not a strong enough deterrent. A revised site plan which resolves the traffic circulation concerns will have to be received before your permit can be released. SECTXON 3- LEASEHOLD EXCISE TAX The Licensee hereby acknowledges to the extent that this license is subject to the "Leasehold Excise Tax" as set forth in Chapter 82.29A RCW as now or hereafter amended the same shall promptly be paid by the Lzcensee. SECTION 4- COMPLIANCE WITH LAWS The Licensee shall comply with and abide by ALL federal, state, county, municipal and other statutes, ordinances, laws and regulations effecting the premises, including but not limited to the Spokane County Zoning Ordinance. SECTION 5- MAINTENANCE OF RECORDS The licensee shall make available to the County or the Washington State Auditor or their duly authorized representatives, at any time during their normal operating hours, all records, books or pertinent information which the Licensee shall have kept in conjunction with this agreement and which the County may be required by law to include or make part of its auditing procedures, an audit trial or which may be required for the purpose of funda.ng the services contracted for herein. SECTION 6 - MODII'ICATION No modification or amendment to this agreement shall be valid until the same is reduced Co writing and executed with the same formalities as this present agreement. SECTION 7 - VENUE STIPULATION This agreement has and shall be constructed as having been made and delivered in the State of Washington, and the laws of the State of Washington shall be applicable to its construction and enforcement. Any action at J.aw, suit in equity or judicial proceeding for the enforcement of this agreement of any provision hereto shall be instituted only in the courts of competent jurisdiction within Spokane County, Washington. . SECTION 8 - WAIVER No officer, employee, agent or otherwise of the County, has the power, right or authority to waive any of the conditions or provisions to this agreement. No waiver of any breach oi this agreement shall be held to be a waiver of any other or subsequent breach. All remedies afforded in this agreement or at law shall be taken and constructed as cumulative, that is, in addition to every other remedy provided herein or by law. Failure of the County to enforce at any time any of the provisions of this agreement or to require at any time performance by the Licensee of any provision hereof, shall in no way be constzued to be a waiver of such provisions, nor in any way affect the validity of this agreement or any part hereof, or the right of the County to hereafter enforce each and every such provision. _ SECTION 9 - LIABILITY Use of the premises under this agreement wi.].1 be entirel.y at the Licensee's own risk and the Licensee expressly agrees to indemnify and hold harmless Spokane County and all its officers, agents, empJ.oyees or otherwise, from any and all liability, ].oss or damage that they may suffer as a result of claims, demands, actions, damages or injuries of every kind or nature whatsoever by or to any and all persons or property or judgments against them which result f rom, arise out_ of, or are in any way connected with the use of the premises by the Licensee under the terms of this agreement. . ~ SECTION 10 - NOTICES Al1 notices called for or provided for in this agreement shall be in writing and must be served on any of the parties either personally or by certified mail sent to the parties at their respective addresses hereinabove given. Notices sent by certif ied mail shall be deemed served when deposited in the United States mail, postage prepaid. SECTION 11 - HEADINGS The article headings in this agreement have been inserted solely for the purpose of convenience and ready reference. In no way do they purport to, and shall not be deemed to, def ine, limit or extend the scope or intent of the articles to which they appertain. - SECTION 12 - ALL WRITINGS CONTAINED HEREIN This agreement contains all the terms and conditions agreed upon by the parties. No other understandings, oral or otherwise, regarding the subject matter of this agreement shall be deemed to exist or to bind any of the parties hereto. The Licensee has read and understands all of this agreement, and now states that no representation, promise, or agreement not expressed in this agreement has been made to induce the Licensee to execute the same.
