B. PROPOSAL The sponsor, Perfection Tire Company; is requesting approval of a zone re- classification, File No. ZE-43-82, Agricuitural to Restricted Industrial for the purpose of developing a retread manufacturing plant. C. FINDINGS OF FACT 1. That the existing land use in the area is established commercial and industriat uses along Sprague, while at the same time is at the edge of existing large lot residentiai uses found to the south. 2. That the Comprehensive Plan designates this area as appropriate for commercial devetopment. 3. That the existing zoning of the property described in the application is Agricuitural. 4. That 'the provisions of RCW 43.21C (The State Environmentai Policy Act) have been complied with, and the Committee concurs with the Dectaration of Non-Significance. 5. That the proper iegal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the cornmercial use, or uses within the Commerciat Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingty, the pro- posed rezone is justified. 8. That the proposed request for recfassification is compatible with existing , uses in the area. 9. That the owners of adjacent lands expressed neither approval nor dis- approval of the proposed use. 10. The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. The following are additional findings of fact considered by the Hearing Examiner Committee: a) That the Hearing Examiner Committee finds the transition area between major commercial and suburban in this area inappropriate for the extension of industrial uses. b) The Hearing Examiner Committee finds from the testimony and public . record presented at this hearjng that the applicant has establfshed nonconforming use for the tire retread manufacturing operation. c) That the proposed site is more suited to accommodate commercial uses as the site is found to be in transition from suburban and major com- mercial uses as indicated on the Spokane County Comprehensive Plan. d) That while the applicant would prefer Restricted tndustrial Zoning, the commercial zoning is more in keeping with present uses and recent toning activities in the area. e) The Hearing Examiner Committee notes no Restricted Industrial Zone changes have been granted in the vicinity south of the railroad right- of-way since 1958. D. CONDITIONS OR CONT{NGENCIES APPLIED TO'THIS APPROVAL a) COUNTY PLANNING DEPARTMENT 1) The Zoning Administrator shall approve a specific exterior lighting plan for the approved area prior to installation of such lighting. (Such plan shall attempt to confine itlumination -to the area with full con- sideration to adjacent properties). 2) No free-standing sign on the premises shall exceed forty (40) square feet in area or thirty-five (35) feet in height. All signs may be illuminated provided that they shall not be animated nor flashing and shall be of low intensity, not exceeding the equivalent of four hundred twenty-five (425) milliamperes flourescent tubing behind plexiface, spaced on seven (7) inch or more centers, or of exposed neon not exceeding thjrty (30) mitliamperes. 3) A specific landscape plan, planting schedule and provlsions for main- tenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of bullding permits. 4) Direct light from any exterior area lighting fixture shall not extend over the property boundary. 5) All current standards of the Commercial Zone, as amended, shall be complied with in the development of this site. ~,~5• Gt~ ' SPl{' 6) A 6-foot sight-obscuring barrier shall be provided along the~of this 245"3""' proposal to provjde a buffer for the existing use located immedjately of this site. A comparable substitute to the cyclone fencing may be approved by the Zoning Administrator. Z15-O 2 41le No. ZE-43-82 . 7) Applicant shall comply with 1208' recommendations concerning storm- water runoff and provide necessary landscaping for runoff. 8) That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Com- missioners Resolution #77-1392 be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on-site improvements. 9) Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guide- lines (WAC 197-10) and the Spokane County Environrnental Ordinance (SCEO), a proposed declaration of non-significance has been issued at least fifteen (15) days prior to this date; the officiai file, written comments and/or public testimony contain information regarding assess- ment of the proposal's adverse impacts to the physical environment; a finding is hereby made that no potentially significant adverse impacts upon the physical environment are anticipated as a result of the project; and a final declaration of non-significance is hereby to be issued. b) COUNTY ENGINEERING DEPARTMENT 1) Applicant shall improve Cannery Road in a manner consistent with Spokane County TYPICAL roadway section No. 4 minimum paving width access standards. 2) Pior to the issuance of a building permit on the property, applicant shall dedicate ten additional feet of right-of-way along Cannery Road. ° This dedication shall not include that portion of the property occupied - by the existing building. 3) The appllcant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire proJect prior to the issuance of any building permit on the property. 4) A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrange- ment of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. S) The word "applicant" shall incfude the owner or owners of the property, his heirs, assigns, and successors. 6) To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing partlcipant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. Z15-O . 3 )ile No. ZE-43-82 , , . .r 7) As an alternative method of constructing the road improvement stated herein, the applicant may, with the approvai of the County Engineer, accomplish the road improvements stated herein by joining and partic- ipating in a County Road Project (CRP) to the extent of the required road improvement. Spokane County will not participate in the cost af these improvements. 8) The construction of the road improvements stated herein shall be . accomplished as approved by the Spokane County Engineer. 9) All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction, and other applicable county standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 10) Roadway standrds, typical roadway sections and drainage plan require- ments are found in Spokane Board of County Commissioners Resolution No. 80-1592, as amended. c) COUNTY UTILITIES DEPARTMENT 1) Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authori2ed. This authoriZation is conditioned on compliance with all rules and regulations ' of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2) The owner, his heirs or successors shall join and participate in any petition or resolution which purpose is the formation of a utility local improvement district (ULID) pursuant to RCW, Chapter 36.94, as amended. The owner, his heirs and successors shall further agree not to oppose or protest any legal assessments for any utility local improve- ment district (ULID) established pursuant to RCW Chapter 36.94, as amended. 3) Any water service for this project shall be provided in accordance with the Coordlnated Water Systern Plan for Spokane County. 4) That if the use (retread manufacturing plant) change occurs on the property, the sponser agrees to abide by the requirernent for double plumbing for connection to future area wide sewering system. d) COUNTY HEALTH DISTRICT I) A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Health District prior to the issuance of any building permit for this project. 2) Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on-site sewage system may be authori=ed. Z15-O 4 r ~ ~,~Jle No. ZE-43-82 • , : , . . 3) Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 4) Use of private wells and water systems is prohibited. 5} Dlsposal of sewage effluent beneath paved surfaces is currently prohibited. e) COUNTY BU i LD{ NG AND SAFETY DEPARTMENT i) The site is located in Fire District 1#. 2) Mains and hydrants to be instatted, in accordance with the Spokane County Department of Building and Safety. 3) Reclassification of an existing buitding shall require an application for change of occupancy permit, and subsequent inspection for approvai. f) WATER PURVEYOR 1) The site lies within Vera Water and Power service area and they indicate satisfactory arrangements have not been made to serve this proposal; however, they are able to serve this site with adequate water. g) COUNTY AIR POLLUTION CONTROL AUTHORITY 1) if the existing plant is changed or aitered, the owner or operation must file a Notice of Construction application for approval from SCAPCA. E. ORDER The Hearing Examiner Committee, pursuant to the aforementioned, finds that the appiication of ZE-43-82, for a Zone reclassification as described in the application should be denied. A) A drainage plan for the site which has been prepared in compliance with Spokane County "Guidelines for Stormwater Management". At a minimum the plan must contain: 1. Drainage calculations for stormwater volumes qenerated on site. 2. Calculations for total impervious surfaces contained within the site. 3. Finished grade elevations for structures to be ~ constructed on site. ~ 4. Finished grade elevations at the top and bottom of the 208 swale. 5. A typical cross section of the 208 swale. ~ 6. Calculations to justify the number and type of drywells proposed. 7. Elevation of drywell inlets where applicable. B) The sub7ect property is affected by the "Findings and Order" and the "Conditions of Appr.oval" for the following land use action: 1. General Overview - Proposed is the change of use from a . warehouse/storage building to enclosed mini storage areas and managers living quarters. The proposed has a 10,000 square foot basement. The basement will not be used at this time but may be used for mini-storage in the future. SiJMMARY OF DEPARTMENTAL REQIIIREMENTS: I. Planning Department (456-2205) A. Discussion/Requirements 1. Comments were given to the applicant and the Department of Buildings by Allan deLaubenfels. 2. Currently the proposed is located in a Commercial Zone. On January l, 1991 the zone will change to a B-3 Zone. If the building permit for the proposed is issued after January 1, 1991 the conditions of the B-3 Zone will have to be complied with. - 1 - ' • . 3. Parking for the proposed has not been determined. Please describe the operation and provisions for access so that parking can be determined. A copy of parking requirements were given to the applicant. 4. Allan deLaubenfels advised the applicant to include the basement area for parking requirements. 5. Parking for the proposed shall be paved. 6. Al1 parking stalls are to be located within 60 feet of a landscape feature consisting of 32 square feet in area. 7. All conditions of Zone Change ZE-43-82 must be met. A copy.,of the conditions were given to the applicant. 8. Please submit a revised site plan illustrating existing parking, paved parking areas, and landscaping. B. Permit Release Requirements 1. Conditions of Zone Change ZE-43-82 shall be met. 2. Please submit a revised site plan as described above for review and approval. 3. An estimate from a nursery including size, type, and quantity along with a promissory letter/bond from the owner stating the landscaping will be installed shall be - submitted. II. Engineering Department (456-3600) A. Discussion/Requirement 1. Comments were given to the applicant and the Department of Buildings by Bob Turner. 2. Please submit a drainage plan that is in conformance with Spokane County Guidelines for Stormwater Management for the new paved parking areas. 3. The proposed shall comply with the conditions of Zone Change ZE-43-82. 4. A condition of the zone change states that a 10 foot right of way dedication on Cannery is required. The required amount of right of way may have already been - 2 - . . • dedicated. Bob Turner will check into the matter and get back to the applicant. 5. An RID/CRP Agreement, Notice to the Public No. 6 is required along Cannery. Please submit a copy of the . recorded property deed to the Engineering Department so that the agreement can be prepared. 6. Approach permits are required for new driveway approaches along the county right of way. 7. An Aqreement to Pay Fees was given to the applicant durinq the meeting. The agreement is to be signed by the owner and returned to the Engineering Department. Plan review will not be completed until this document is executed. B. Permit Release Requirements 1. Please submit a revised site/drainage plan as described above for review and approval. 2. The proposed shall conform to the conditions of the zone change. 3. Submit a copy of the recorded property deed so that the RID/CRP Agreement can be prepared. 4. Submit a copy of the Agreement to Pay Fees signed by the owner. III. Health District (456-6040) A. Discussion/Requirements 1. Spokane County does allow direct access to sewer lines. Please contact the County Utilities Department for a permit to connect to the sewer line. If for some reason the Utilities Department denies access to the sewer line the applicant shall either abandon the existing on site sewage disposal system and install a new system or expose the existing system for inspection to verify that the system meets current regulations. 2. The Health District assumes that the proposed is connected to the public water system, please verify. - 3 - a • 3. Please verify if there are any on site wells. If a well does exist it shall be abandoned as per the requirements of the Department of Ecology. 4. The applicant is required to have a lease agreement restricting the storage of critical materials. The Health District would like to review the lease agreement prior to occupancy. 5. All construction and demolition debris is to be taken to a licensed landf ill. 6. The water purveyor for the proposed is Vera Water and Power (456-8000). B. Permit Release Requirements l. Please contact the County Utilities Department for verification that the proposed may have a direct connection to the sewer line. IV. Fire District No. 1(928-2462) A. Discussion/Requirements 1. Access on an all weather driving surface shall be provided on a minimum of three sides of the proposed. 2. The existing fire hydrant located on Cannery shall be changed from a two port hydrant to a three port hydrant. 3. A lock (Knox) box entry system for fire department personnel access is required for the proposed. V. Department of Buildings (456-3675) A. Discussion/Requirements 1. The proposed has been classified as a Type V-N building. 2. Please submit scaled drawings for the site and floor plans. This is required to determine maximum building areas permitted, easements, roads, and access, must be included. 3. Based on the site plan submitted the proposed is over the allowable area allowed by the Uniform Building Code. The applicant has the option of either sprinkling the - 4 - . . . entire building or to construct an area separation wall with a 30 inch parapet extending above the roof, or other alternatives per Section 505(e) 3(exceptions). 4. The proposed living area is to be separated from the warehouse area by a one hour fire resistive wall and openings. 5. The applicant stated that the warehouse area will not be heated. 6. If the basement is not to be used at this time there shall be no access from the main f loor to the basement area. Note: Exit travel distance cannot exceed 150 feet to exterior exit doors. 7. Please submit documentation from a licensed engineer or architect that the proposed has a floor load of either 125 p.s.i. or 250 p.s.i. 8. Please submit a lighting layout for review and approval, include exit lighting and signage. 9. The Department of Buildings will check to see if an area separation wall would be required if the building had only one tenant and get back to the applicant. 10. The basement will require sprinkler system. B. Permit Release Requirements 1. Two complete revised sets of plans addressing the items discussed during and after the meeting needs to be submitted for review and approval. COUNTY ACTION: Bob Turner will check to see if the required 10 feet of right of way has already been dedicated to the county and get back to the applicant. The Department of Buildings will check to see if area separations would be required for the proposed if the building had only one tenant and get back to the applicant. APPLICANT'8 COMMENTS/ACRNOWLEDGEMENT: - 5 - . . The applicant acknowledged that all comments/requirements were understood and had no further questions at this time regarding permit requirements. CORRECTIONS: To minutes or changes from what appears in the minutes, we should be notif ied within one day of your receipt of these minutes. To site plans as required by any or all of the above-listed departments shall be submitted to the Department of Buildings who will then distribute accordingly to those departments. ADJOIIRNMENT: There being no further business, Tom Davis thanked the applicant and the departments for their participation and reminded all that he should be contacted if there are any unforeseen problems which may arise.
