The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
l. Drainage calculations for stormwater volumes generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
. the 208 swale.
5. A typical cross section of the 208 swale.
- 6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Short Plat SP-619-90
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. Approach permits must be obtained from the County
Engineering•Department for any new or improved
driveway approaches to the following streets:

BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-619-90 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subd.ivision of land, from Richard C. Behm Jr. has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the
day of February, 1990.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane Counry Director of Planning.
2. The proposal is to divide approximately 3 acres into 41ots for the development of three
single fa.mily residences, and to retain an existing church.
3. The proposal is located at the northeast corner of Pines Road and 26th Avenue, in the
SW1/4 of Section 27, Township 25, Range 44 EWM.
4. The current zoning of the property is Agricultural Suburban. The proposed lot sizes,
frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. -The
development and uses proposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.
7. No area property owners commented on the proposed Short Plat.
8. The Spokane County Arterial Road Plan identifies Pines Road as a Minor Arterial. The
existing right of way width is not consistent with that specified in said plan. To implement
the Arterial Road Plan, it is recommended that in add.idon to the required right-of-way
ded.ication, a strip of property 8 fL in width along the Pines Rd: frontage be set aside in
reserve as a future acquisition area.
9. Recognizing the recommended cond.idons and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Find.ings of Fact and Conclusions, Short Plat Application
SP-619-90 is hereby APPROVED until March 1, 1993, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is fina] unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors•in•interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
applicaaon for this proposal.
2. The final plat shall be designed substantially in conformance with the preliminary plat
of record as legally described and advertised. No increase of density or lot number
shall occur without a new applicarion submittal and approval.

3. The Spokane County Planning Director/designee shall review any proposed final plat to
ensure compliance with these Findings and Conditions of Approval.
4. The preliminary plat is given conditional approval for three (3) years, specifically to
March 1,1993. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
5. Appropriate udlity easements shall be ind.icated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies must be received
with the submittal of the final plat.
6. Three (3) current certificates of title shall be furnished the County Planning Deparnnent
prior to filing the final plat-
7. The following statement shall be placed in the final plat dedicarion: "No more than one
(1) dwelling structure shall be placed on any lot, nor shall any lot be further subd.ivided
for the purpose of creating additional lots, ownerships or build.ing sites without first
filing and receiving approval of a replat."
8. The final plat map shall indicate by a clear dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement that: "Side yard and rear yard setbacks shall be determ.ined at the time
building pernlits are requested. The setbacks ind.icated on this plat may be varied from
if proper zoning approvals are obtained."
9. A survey is required prior to the filing of a final plat.
10. Spokane County Planning Department is required to record with the County Auditor a
"Title Notice," as prepared and signed by the applicant, for a future acquisiaon area for
road right-of-way and utilides to run with the land, and the future acquisition area
reservadon shall not be removed without prior approval by the Spokane County
Planning DeparunenL Notice shall be recorded prior to the issuance of a build.ing
permit and shall provide the following:
a. 8 feet of future acquisition area for road right-of-way and utilities, in addition to the
existing right-of-way ded.ication required by the County Engineer, along Pines Road.
b. Build.ing and other setbacks required by the Spokane County Zoning Code shall be
measured 25 ft. from the easterly edge of the Future Acquisition Area that is reserved
for road right-of-way and utilities along Pines Road.
c. The following minunum unprovements necessary to support the use within the zone
classificaaon as required by the Spokane County Zoning Caie standards shall not be
located within the Future Acquisidon Area.

d. The 8 ft. Future Acquisition A.rea, until acquired by Spokane Counry, shall be private
property and may be used as allowed in the zone, except any improvements (such as
landscaping, parking, surface drainage, drainfields, signs or others) shall be considered
"interim" uses.
The property owner shall be responsible for relocating such "interim" improvements at
the time Spokane County makes roadway improvements after acquiring sa.id Future
Acquisition Area.
e. This "Title Notice" shall be signed by the applicant to serve as official nodce and
acknowledgement of said Future Acquisition Area for road right-of-way and utilities.
11. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, Spokane County
Build.ing & Safery Deparcment and Spokane County Health District. The agencies will
certify on che WATER PLAN, prior to the filing of the final plat or any phase of the
preliminary plat, that the plan is in conformance with their respective needs and
regulations. The WATER PLAN and cerdficadon shall be drafted on a transparency
suitable for reproduction and be signed by the plat sponsor.

12. The purveyor shall also certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved WATER PLAN. The time schedule shall
provide for completion of the water system and inspection by the appropriate health
authorities prior to application for building pernuts within the final plat. The
arrangements or agreements shall include a provision holding Spokane County and the
purveyor hamlless from cla.ims by any lot purchaser refused a building permit due to
the failure of the subdivision sponsor to satisfactorily complete the approved water
system.
13. The final plat dedication shall contain the following statement: "The public water
system, pursuant the WATER PLAN approved by County and State Health authorities,
the local fine protection d.istrict, County Building & Safety Department, and water purveyor, shall be installed within this subdivision, and the subdivider/sponsor shall
provide for individual domestic water service as wetl as fire protecdon to each lot prior
to sale of each lot and prior to issuance of a build.ing pennit for each lot."
14. No building permit will be issued for any lot within the final plat until certified by a
Washington State-licensed engineer that "the water system has been installed pursuant
to the approved WATER PLAN for the final plat," signed and stamped by said
engineer. The certification may be in the form of a letter, but is preferred to be certified
on a copy of the WATER PLAN as a schematic map showing the "as-built" water
system.
15. The Water Plan and the above four (4) cond.idons of approval regarding the WA'I'ER
. PLAN may be waived by the Planni.ng I?irector/designee upon receipt of letters from
the appropriate water purveyor and fire protection district stating that simple
connections to an existing, approved water system, will provide adequate domestic and
fire protecrion water to ensure the public health, safety and general welfare.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
ded.ication of right-of-way and approval of the road system as indicateri in the
preliminary plat of record.
2. The applicant should be advised that ind.ividual driveway access permits are required
prior to issuance of a building permit for driveway approaches to the County road
system. ~

3. IIedication of 2 ft. of add.itional right-of-way along Pines Rd.c~
4. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any pedtion or resolurion
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road, Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
5. As an alternadve method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
unprovements stated herein by joining and participating in a County Road Project
(CR.P) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavemment) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
6. The following statement be placed in the plat dedication: "The owner(s) or successor(s)
in interest agree to authorize the County to place their name(s) on a petidon for the
formation of a Road Improvement District (RID) by the petition method pursuant to
Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to
object, by the signing of a ballot, to the formation of an RID by the resolution method
pursuant to Chapter 36.88 RCW, which resolurion includes the owner(s)' property. If
an RID is formed by either the petirion or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;
. a
(b) that the benefits to be derived from the formation of the RID by the properry included
therein, together with the amount of any County participation, exceed the cost and
expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided furcher that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjuncdon with the fonnation of an RID by either peation
or resolurion method under Chapter 36.88 RCW, and to appeal to the Superior Court
the de,cision of the Board of County Commissioners affirnung the final assessment roll.
It is funher agreed that at such time as an RID is created or any Road Improvement
Project is sancaoned by Spokane Counry, the improvements required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execudon below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own expense, pay to
Spokane County the then estimated cost of the require.d improvements to enable the
County to complete the same, or furnish a bond or other secure methai suitable to the
County (which may include the execution of another RID waiver agreement) providing
for or securing to the County the actual construcdon of the unprovements.
All of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s).
7. The Counry Enginees has designated Typical Roadway Section Number Two,
Secondary Arterial Standard for the improvements of Pines Road, which is adjacent to
the proposed development. This will require the addition of approximately 12 to 14
feet of asphalt, along the frontage of the developmenL The construction of curbing and
sidewalk is also required.
8. The proposed plat shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 80-1592, as amended, which establishes
regulaaons for roads, approaches, drainage and fees in new construcrion.
9. The County Engineer has examined this development proposal and has deternuned that
the impact of this proposal upon the existing county road system warrants the
dedicadon of add.idonal right-of•way and the roadway improvements herein specified.
10. This plat or development proposal is located within a drainage basin which has been
identif'ied by the Spokane County Engineer's off'ice as having stormwater runoff
problems. Since this plat or development proposal is affected by or is a contributor to
stortnwater flows, property owners should participate in the planning and
implementation of a future basinwide stormwater management system. The following
statement shall be placed in the plat dedication: "That the owner(s) or successor(s) in
interest agree to join in any County-approved stormwater management program and to
pay such rates and charges as may be fixed through public hearings for service or
benefic obta.ined by the planning, design, constructing, maintaining or operation of
stormwater control facilities."
11. The shape of the parcel upon which the church is constructed (as depicted on the
preliminary plat) is not consistent with the road right-of-way records on file in the
office of the County Engineer or the County Assessor's Map. The final plat map shall
accurately depict the shape of the parcel and the County Road Right of Way.
12. The County Arterial Road plan identifies Pines Road as a Minor Arterial. The existing
right of way width of 60 ft. is not consistent with that specif'ied in the plan. In order to
implemenc the Arterial Road Plan it is recommended that in addition to the required right
of way dedicarion, a strip of properry 8 fL in width along the Pines road frontage be set
aside in reserve. this property may be acquired by Spokane County at the time when
Arterial Improvements are made to Pines Road.
COUNTY HEALTH DISTRICT CONDITIONS
1. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribuaon by the Planning Department to the utility companies, Spokane

easements by the utility companies must be received prior to the submittal of the final
plat.
2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
Councy.
3. Water service shall be coordinated through the Director of Utiliaes Spokane County.
4. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Social & Health Services.
5. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal systems
are available on the three smallesLtracts.
7. Subject to specific applicadon approval and issuance of pemzits by the health off'lcer,
the use of individual on-site sewage disposal systems may be authorized.
8. The dedicatory language of the plat will state that: "Subject to specific applicaaon
approval and issuance of pemlits by the Health Off'icer, the use of ind.ividual on-site
sewage systems may be authorized.."
9. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
10. The plat ded.ication will contain a statement to the effect that: "The public water system,
as approved by County and state health authorities and the local fire district and
purveyor, will be installed within this plat, and the subdivider will provide for
individual domesac water service, as well as fire protection, to each lot/tract prior to
sale of each lot/tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal syscems is hereby authorized. This authorization is condidoned
on compliance with all rules and regulations of the Spokane County Health District and
is further cond.itioned and subject to specific applicadon approval and issuance of
pernlits by the Health DistricL
2. The ded.ication shall state: "The owner(s) or successor(s) in interest agree to authorize
the County to place their name(s) on a petition for the forniation of ULID by petition
method pursuant to RCW 36.94, which the petition includes the owner(s)' property;
and further not to object by the signing of a protest petition against the formation of a
ULID by resoludon mechod pursuant to RCW Chapter 36.94 which includes the
owner(s)' property. PROVLDED this condition shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a ULID by either petition
or resolurion method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connecaon to future areawide collection systems."
5. This Shon Plat falls within the proposed Hillview ULID. Sewer Construction is
expected to begin in 1991.
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Requirements of Fire District No. 1 need to be satisfied during the building pernut
process.

RE: Holy Trinity Lutheran Church
Dear Mr. Reich
Please find an enclosed copy of the revised site plan for Holy Trinity Lutheran Church at
2511 south Pines. The parking lot on 26th Street has been shifted 10'-0" to the north
and the 208 Swale has been relocated to the south side of the parking lot. This change
was made to take better advantage of the natural slope of the site to the south. The
swale area has not changed and does not encroach into the landscape area.
The handicap parking stall in the northwest co;@r has been relocated to the south
parking lot. Because of this we are going to gutter-the existing roof and allow the water
to drain across the existing grass to the parking lot. This allows us to delete the swale
and drywell from the north side of the existing building.
