INTROniJCTION
This matter has come before the Hearing Examiner Commirtee on June 27, 1991,
1991. The members of the Committee present are Phil Hatris, Chairperson, Verona
Southern and Jane Myers. .
PROPOSAL
The sponsor, LDS Church, requests approval of Rezone No. ZE-21-91; Zone
Reclass~cation from Urban Residential-3.5 (UR-3.5) to Urban Residential-12 (UR-
12) with a variance request File No. VE-11-91 to allow a(private) school on 50 feet
of frontage whereas the Zoning Code requires 60 feet of frontage.
FINDINGS OF FACT AND CONCLUSIONS
1. The properry is generally located along the west side of Herald Street and
approximately SO feet north of lOth Avenue.in Section 20, Township 25 N., Range
44 EWM, Spokane County, Washington..
2. The committee adopts the Plan.ning Department Report as a part of this record.
3. The existing land use in the area are single family residential and a public high school.
4. The Comprehensive Plan designates this site as Urban. The Urban category is for the
purpose of residential development, includ.ing residential densities of 1 unit per acre
to 17 units per acre.
5. The Arterial Road Plan designates Herald Street as a Collector arterial, with a
recommended right of way width of 70 feet and an existing 60 foot right of way. The
County Engineer has recommended a 5 foot Future Acquisition Area.
6. The existing zoning of the property described in the application is Urban Residential-
3.5 (UR-3.5), previously established in 1991.
7. The provisions of RCW 43.21 C(The State Environmental Policy Act) have been
coriiplied with and a]JJeternunation of Nonsignificance wa.s issued.
8. The legal requirements for public noece have been fulfilled.
9. The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use.
10. The proposed use is compatible with existing uses in the area.
11. The proposed zoning does implement and conform to the Comprehensive Plan. ~

12. "rhe applicant has demonstrated that condi6ons have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified.
13. The proposed use wili not be detrimental to the public health, safety, morals or
welfare.
14. The Comnvttee additionally finds/concludes:
a. The proposed private school for religious education will not adversly impact the
predominately single family neighborhood due to existing activities held at
University High School.
b. The requested variances are appropriate to allow the proposeri uses Maintaining
the residential character of the site will lessen the need for buffering for adjacent
uses. -
c. Students will walk to class from University High School which reduces the need
for parking.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant," which term shall include the owner oT owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Condirions of Approval apply to the real property described below:
University Place Lot 5, Block 9.

1. Planning Condition No. 2 and 7 have been modified as shown.

1. The proposed private scflool is the only use permitted in this zone reclassification.
Any change of use or revision to residential use shall require a public hearing and
zone change request.
2. The site shall maintairl its residential character. Enlargement of the primary
stnicture to accommodate additional classroom space shail require a public hearing.
3. Any evening or weekend classes shall require a reciprocal parking agreement with
University High School for use of their parking facilities. No parking related to on-
site acbvity shall be on-street.

4. All conditions imposed by the Hearing Exanuner Committee shall be binding on the
"Applicant", which term shall include the owcler or owners of the property, heirs,
assigns and successors.
5. The zone change applies to the following real property:
6. The proposal shall comply with the Urban Residential-12 (tTR-12) zone as
amended.
7. The applicant shall develop subject property in general conformance with the site
plan and testimony presented to the Hearing Body on June 27, 1991. All aspects of
the concept and proposal shall be binding on the development, including proposed
use. Minor exterior alterations andlor variations required to meet regulations and
cond.itions of approval shall require approval of the Planning Director/designee.
Other modifications sha11 be presented to the Hearing Body for review and
approval.
8. The Spokane Counry Planning Department shall prepare and record with the
Counry Auditor a Title Notice specifying a future land acquisition area for road
. right-of-way and utilities. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Planning Department. The notice should be
recorded within the same time frame as an appeal and shall provide the following:
a. At least 5 feet of reserved future acquisition area for road right-of-way and
utilities, in add.ition to the existing right-of-way along Herald Street.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
-utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
9. The Planning Department shall prepare and record with the Spokane County
Auditor aTitle Notice noting that the property in quesvon is subject to a variety of
special conditions imposed as a result of approval of a la.nd use action. This Title
Notice shall serve as public notice of the conditions of approval affecting the
property in question. The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Noace shall generally provide as follows:
The parcel of property legally described as [ ] is the subject
of a land use action by a Spokane County Hearing Body or
Administrative Official on [ imposing a variety of

inspection and copying in the Spokane County Planning Department.
10. The applicant shall provide verification From Fire District No. 1 to tbe Department
of }3uilding and Safety that provisions have been made for adequate fire protection
prior to the release of building permits. -
SPOKANE COUNTY ENGINEER'S OFFICE
Prior To The Issuance Of A Buildine Pennit Or Use Of The Provertv As Pronosed:
1. Access pemuts for approaches to the county road system shall be obtained from the
Spokane County Engineer.
2. The applicant shall subnvt for approval by the Spokane County Engineer road,
drainage and access plans.
3. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project, or portion thereof, if the
development is to be phased.
n/,4. A parking plan and tra~f'ic circulation plan shall be submitted and approved by the
, Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the Caunty Engineer, will be required for any portion of
the project whieh is to be occupied or traveled by vehicles.
5. y To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be willing to participate in any
pedtion, or.msolurion which purpose is the fonnation of a Road Improvement
District~~RID) .6 said improvement, pursuant to RCW 36.88,-as amended.
Spokane, Counry will noc parricipate in che cost of these improvements. This is
applicable to Herald Street.
6. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engine,Er, accomplish the road
improvernents stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required improvement. Spokane County will not
participate in the cost of these improvements. This is applicable to Herald Street.

7. The construction of d1e road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
8. Z,he County Engineer has desigriateci 1,ypical Roadway Section Niimber Two,
collector Arterial standard for the improverzient of Herald Avenue, which is adjacent
to the proposed development. This will require the addition of approximately 10-12
feet of asphalt along the frontage of the development. The construction of curbing
and sidewalk is also required.

9. All required improvements shall conforn-i to che current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County sta.ndards andior adopted resoluLions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
10. Applicant shall constnict a paved and delineated approach(es) to meet the existing
pavement on Herald Avenue.
11. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution.No. 80-1592 as
amended and are applicable to this proposal.
12. This subdivision or development proposal is located within a drainage basin which
has been identified by the Spokane County Engineer's office as having stormwater
runoff problems. Since this plat or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the planning
and implementation of a future basinwide stormwater management system.
The owner(s) or. successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design,
construcring, maintaining or operation of stormwater control facilities.
13. No construcrion work shall be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
, 14 Applicant shall sign and record Spokane County Notice to the Public No. 6 which
specifies the following:
The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement District (RID) by
the petition method pursuant to Chapter 36.8$ RCW, which perition includes the
owner(s) property, and further not to object, by the signing of a ballot, the
formation of a RID by the resolution method pursuant to Chapter 36.88 RCW,
which resolution includes the owner(s) property. IF an RTD is formed by either the
petition or resolution nlethod, as provided for in Chapter 36.88 RCW, the owner(s)

right-of-way dedication,p of property 5 feet in widtb along the Herald Zy n~
frontage shall be set aside in reser"ve.s prbperty may be acquiredby 5pokane
County at the rime when arterial improvements are made to Herald Avenue.
16. There may exist utilities, either underground or overhead, afffecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligatian for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to detemline whether applicant(s) or
the utility is responsible for adjustment or relocarion costs and to make
arrangetnents for any necessary work.
SPOKANE COUNTY UTILITIES DEPARTMENT
1. Sewerage facilities are not affected by this proposal; therefore, no recommendarion.
SPOKArIE COUNTY HEALTH DISTRICT l. . Sewage disposal method shall be as authorized by the Director of Utiliries, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane
County.
3. Water service shall be by an exisring public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
5. Subject to specific application approval and issuance of permits by the health
officer, the use of (an) individual on-site sewage disposal system(s) may be
authorized. Note: The existing on-site sewage disposal system can be utilized to
serve the seminary based on the number of students a.nd staff stati,d in the
application for zoning reclassification.
SPQKANE COUNTY BUILDING AND SAFETY DEPARTMENT _
1. The applicant shall contact the Department of Building and Safety at the earliest
possible stage of design/development in order to be informed of code requiremerits
administered/enforced by the department, e.g., State Building Code Act

regulations, such as requirements for fire hydrant/flow, fire apparatus access roads,
street address assignment, barrier-free regulations, energy code rcgulations and
general coordination with other aspects of project implementation.
2. Requirements of Fire District No. 1 need to be satisfied during the building permit
process.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met. This includes but is not limited to the
following:
2. Air pollution regulations require that dust emissions during demolirion, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinkl.ers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.
3. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaees onto paved surfaces. If tracking or spills occur on paved surfaees,
measures must be taken immeciiately to clean these surfaces.
4. Al.l travelled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.
5. Debris generated as a result of this project must be d.isposed of by means other than
burning.
6. Demolition and renovation projects must comply with the requirements of CFR 40,
Part 61, Subpart M. Intent to Demolish and Renovate forms are available at the

I. General Overview - The owner, Church of LDS, is proposing a Change of Use from a
house to a seminary, and in addition, is proposing to construct an addition to the eacisting
building. Neither the applicant nor the owner were present at the conference meeting.
Proposed will be used as a seminary during the week (Monday through Friday).

1. Planning Department (456-2205)
A. Discussion/Requirements
1. The proposed is located in a UR-22 zone. The proposed use is allowed in the
zone.
2. The proposed is located on parcel number 20544-0904.
3. The proposed must comply with Zone Change ZE-21-91 and with Variances
VE-11-91 and AVE-19-90.
4. Please specify if the existing trees/landscaping along the north property line
will remain.
5. Please submit an estimate from a nursery including size, type, and quantity of
landscaping, itemized cost of the irrigation system, and the cost of labor along
' with a promissory letter (attached) from the owner stating the landscaping will be -

along with a promissory letter from the owner stating the landscaping will be
installed shall be submitted.
2. Please submit a revised site plan including a logo illustrating the conect
boundaries of the parcel, the use of the building, the square footage of use,
landscaping, and setbacks for review and approval.
II. Division of Engineering & Roads (456-3600)
A. Discussion/Requirements
1. Comments are attached from Bob Turner.
2. Please submit a drainage plan for the site that is in compliance with
Spokane County Guidelines for Stormwater Management. ~
3. Please record RID/CRP agreement "Notice to Public No. 6". A coPY of the

recorded property deed need to be submitteti to the Division of Engineenng &
Roads, so the agreement can be prepared.
4. Applicant shall construct a paved approach to meet the existing approach on
Herald Avenue.
5. An additional 5 foot strip of property needs to be set aside along Herald.
Please contact Bob Turner at the Division of Engineering & Roads for informa-
tion on completing this.
6. An Agreement to Pay Fees was given to the applicant during the meeting.
The agreement is to be signed by the owner and returned to the Division of
Engineering & Roads. Plan review will not be completed until this document is
executed.

III. Health District (456-6040)
A. Discussion/Requirements
1. Proposed will be served by an on-site sewage disposal system that is sized for

at the Health District. The flow from the converted commercial use of the
building must not exceed the design flow of the disposal system.
2. Please clarify with the Health District if any food service will be provided
from this premises.
3. Please submit a complete set of plans for review and approval.
4. All construction debris shall be taken to a licensed landfill.
B. Permit Release Requirements
1. Please contact the Health District regarding the on-site sewage disposal
system.
2. Please notify the Health District about any food service that may/may not be
provided.
3. Please submit a complete set of plans for review and approval.
IV. Fire District No. 1(928-2462)
A. Discussion/Requirements
1. Fire flow is estimated at 1,000 G.P.M..
2. A lock (Knox) box entry system for fire department personnel access is
required to be installed. Forms for ordering are attached. The completed forms
are to be returned to the fire district. The box shall be installed prior to occu-
pancy.
V. Department of Buildings (456-3675)
A. Discussion/Requirements
1. Plan review has been completed on the site plan only and a letter is
attached from Tom Postlewait.
2. The proposed shall meet the minimum requirement of the Regulations for
Barrier-Free Facilities. Specifically, a ramp from the parking lot to a primary
entrance of the building shall be not steeper than one vertical to 12 horizontal in
the direction of travel, nor one vertical to 48 horizontal transverse to the direc-
tion of travel.
3. Please submit a revised site plan addressing the items in the attached plan
review letter.
4. Drawings shall be directly stamped and signed by the architect. (Pen and ink
- not copy)

1. Two complete revised sets of plans addressing the items discussed during
the meeting and other items from the plan review letter needs to be submitted for
review and approval.
APPLICANT'S COMMENTS/ACKNOWLEDGEMENT:
The applicant acknowledged that all comments/requirements were understood and had no
further questions at this time regarding permit requirements.
CORRECTIONS:
To minutes or changes from what appears in the minutes, we should be notified within one
day of your receipt of ~hese minutes.
To site plans as required by any or all of the above-listed departments shall be submitted to the
Department of Buildings who will then distribute accordingly to those departments.
ADJO T: There being no further business, Tom Davis thanked the applicant and the
departments for their participation and reminded all that he should be contacted if there are
any unforeseen problems which may arise.

Dear Mr. Cramblit:
As we had discussed and agreed to on November 10, 1988, this office
would issue a Certificate of Occupancy for the building located at the
above referenced address upon signing a"letter of intent" to
complete the drainage requirements at the time Dishman Road was
improved. This agreement was concluded upon finding that possible
grade problems do exist and furthermore the as-built swale will
prevent stormwater from causing any problems to adjacent properties.
Enclosed is a copy of the "letter of intent" for your signature. If
you have any questions regarding the letter please call.
Finally, a final inspection of the building will need to be made and
to verify that the caulking under the toilet and installation of the
grab bar alongside the toilet, as listed on a correction notice
dated 6/20/88, has been completed.
Please call me to arrange a time for our inspector to finalize the
building.

In accordance with the condition of my building permit, number
88000707, regarding drainage facilities and our understanding as
siated in your letter of December 8, 1988, I hereby agree to make
the required correction to the drainage swale at the time Dishman
Road is improved and grades are established. That such correction
would be in accordance with an approved drainage plan. Further, I am aware that failure to comply with the above
mentioned condition may result in the revocation of the Certificate
of Occupancy and as a consequence, I could be charged with a
misdemeanor and be subjected to the penalty provisions contained in
Tile 3 of the Spokane County Code.

(A) CONVEYANCE 1

Buyer shall not be obligated to incur any penaley by forfeiture of earnest money, or otherwise be obligated to complete the purchase of the property described 59
herein, unless Seller has made available to Buyer a written statement issued by FHA or VA, as applicable, setting forth an appraised valuE of the property 60
(excluding closing costs) of not less than the purchase price The Buyer shall, however, have the privilege and option of proceeding with the consummation of 61
the contract without regard to such appraised value, nrovided the difference in excess of the appraised value be paid in cash. Neither the FHA nor the VA 62
warrant the value or the condition of the property. The Buyer should satisfy himself that the price and condition of the property are acceptable. 63
Seller understands that FHA and VA may require that the property comply with governmental requirements including but not limited to local codes of the 64

9, We st Di shman. It wi 11 be an automoti ve repai r shop and
parking lot.
Methodology:
Drai nage wi 11 flow as i ndi cated on the drai nage drawi ng.
All runoff from the building roof and the parking lot will
be contai ned i n the grass percolation area with overflow to
the drywe 1 1 .
Soils:
McB - Marble Sandy Loam, 0t0 8 percent slopes, d e e p a n d
moderately deep, moderately coarse textured, somewhat exces-
si vely drai ned soi 1 formed f r o m sandy gl aciofl uvi al
material; soil- is underlain by thick beds of coarse sand.
Topographic Data:
Exi sting ground is nearly flat. New slopes are shaped for
runoff drainage removal to grass percalation areas.
Demographic Data:
The land is curreni.ly unoccupied. A 50 x 30 automotive
repair shop is to be built. Sun Rental is north of the
site, Dishman Road to the west, and the Milwaukee RaiI road
to the east.
Rainfall Data:
Data u sed i s i n accor.dance wi th Fi gure 2, "Gui de 1 i ne s for
Stormwater Management." A 10 year return frequPncy event is
used.
Methods of Runoff Control:
Control wi1l• be by overland flow to grassed percolation
areas.
Methods of Disposal:
Disposal is to a grassed percolation area large enough t;o
hold the fi rst 1/2" of runoff of al 1 impervious areas.
Excess runoff will flow into a double depth, type B drywell.

PEAK FLOW, VOLUME AND DISPOSAL CALCULATIONS
a. Hydrology Cornputations:
A time of concentration was calculaCed which is less than 5
mi nutes, due to the small area. The Qowstri ng Method was
used to size the drywell.
b. Inlet Capacities:
Drywell inlet capacities -are calculated to be 1.6 CFS for a
flow depth of .-2 feet. Grass percolation areas are sized to
have a free board of 2 i nche s above the drywe l1 1 i d.
c. DPtention/Retention storage capacities:
The yrass percolation area is sized to holci the f i r s t 112"
of runoff of impervious areas with excess flowing into a
drywell. The grass percolation area is to be trapezoidal in
cross-section, have a 3:1 slope, and be grass sodded.
Remarks:
The above de scri bed system of stormwater control wi 11
provi de qual i ty a n d quantity control s as de scri bed i n
"Guidelines for Stormwater Management," (G,S.M.)

Benefits to be-hereafter derived do for themselves, their heirs, granCees 'and
assigns, hereby agree to the following: ~ The owner(s.)':or successor(s) in interest agree to authorize Spokane CounCy
to.place -the'ir name(s) on a petition for the formation of a Road
Improveraent Di*strict (RID) by the petition method pursuant to Chapter
36.88 RCW; which petition inciudes the owner(s) property, and furCher noC-
to object, by the signing of a ballot, to the formation of a RID by the
resolution method pursuant to Chapter 36.88 RCW, which resolution includes
the owner(s) property. If a RID is formed by either the petition or
resolution method, as provided for in Chapter 36.-88 RCW, the owner(s) or
successor(s) further agree: (1) that the improvements or construction
contemplated within the proposed RID is feasible, (Z) Chat the benefits to be derived from the formation of the RID by the property included
therein, together with the amount of any County participation, exceeds the
cost and expense of formation of the RID, and (3) that the property
within the proposed RID is suff iciently developed. Provided, further, the owner(s) or successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result of
the improvements called for in con,junction with the formation of a RID by
either petition or resolution method'under Chapter 36.88 RCW and to appeal
to the Superior Court the decision of the Board of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving to existing
.pavement) will be at the sole expense of the undersigned owner, their
heirs, grantees and assigns without participation by Spokane County.
