FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Building and Planning. 2. The proposal is to divide approximately 30 acres of land into 2 lots. One lot will be created for development of a new grocery store and the other lot will be created to include the existing University City shopping center. 3. The Binding Site Plan Chapter of the Spokane County Subdivision Ordinance allows any number of parcels to be recorded over time, individually or in groups; provided each parcel and the proposed use can meet the minimum development standards of Spokane County. Specific parcels can be recorded at different times, but prior to sale, lease or transfer of the particular parcel. The applicant intends to develop up to 30 lots for commercial uses allowed in the underlying zone. 4. The proposal is located south of and adjacent to Sprague Avenue and west of adjacent to University Road in the NE 1/4 of Section 20, Township 25N.; Range 44 EWM., Spokane County, Washington. 5. The existing zoning of the property described in the application is Regional Business (B-3), which was established pursuant to a zone reclassification approval in 1989 (file no. ZE-18-89). The underlying land use action (ZE-18-89) sets forth various conditions for development of the property. The applicant is currently requesting a"change of conditions" to the underlying land use action. Approval of this binding site plan application will include a condition of approval that requires compliance with all existing conditions of the underlying zone reclassification, as may be modified through a"change of conditions" approval. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing Regional Business (B-3) zone. 6. The Spokane County Comprehensive Plan designates this area as Major Commercial and Urban. The development and uses, as proposed and conditioned, are in accord with the Major Commercial and Urban categories. This proposal is also compatible with the surrounding land uses, which are primarily commercial. A transit center is also located south of the proposal. 7. The site is located within the Public Transportation Benefit Area (PTBA) of Spokane County. The Pence-Cole Valley Transit Center is located south of the proposal at the intersection of 4`h Avenue and University Road. The transit center offers access to numerous routes. 8. The Spokane County Arterial Road Plan identifies University Road as a Principal Arterial with controlled access. The future right of way width of University Road at this location is 100 feet. The County Engineer has requested dedication of necessary right-of-way. Therefore, as conditioned the proposal conforms to the Road Plan. 9. The Spokane County Arterial Road Plan identifies the South Valley Arterial as a Principal Arterial with controlled access. The future right of way width of South Valtey Arterial at this location is 130 feet. The County Engineer has requested dedication of necessary right-of-way. Therefore, as conditioned the proposal conforms to the Road Plan. 10. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. No written comments were received by any adjoining property owners. 11. An Environmental Checklist was submitted by the sponsor and was reviewed by the Spokane County Division of Building and Planning. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Building and Planning Division has determined that "No probable significant adverse impacts" would result from the proposal being developed and issued a Determination of Nonsignificance ("DNS") on March 9, 1998. The "DNS" was circulated for review and comments to those agencies of jurisdiction affected by this proposal. In response to the environmental review, written comments were received from the Spokane County Air Pollution Control Authority. Their comments have been reviewed and are included as part of this record. 12. In conjunction with the conditions of approval and Spokane County development standards, the proposed binding site plan is not detrimental to the public health, safety and general welfare. Moreover, this proposal implements the underlying zoning, as well as the Comprehensive Plan and complies with the provisions of Chapter 12.500 (Binding Site Plans) of the Spokane County Subdivision Ordinance. DECISION Based upon the above Findings of Fact and Conclusions, Binding Site Plan Application BSP- 56-97 is hereby APPROVED for five (5) years, specifically until April 6, 2003 and subject to the conditions noted below. This decision is final unless appealed in writing, consistent with adopted appeal procedures. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING 1. The proposal shall comply with the Regional Business (6-3) zone and other applicable Zoning Code chapters, as amended. 2. The preliminary Binding Site Plan is given conditional approval for five (5) years, specifically to April 6, 2003. The applicant may submit an extension of time application at least thirty (30) days prior to the above expiration date. Application(s) for extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary approval and conditions will be changed to reflect the adopted policy and development regulations at the time of the extension application. Findings and Decision BSP-56-97 2 3. Any development of the site shall conform to the conditions of approval set forth in the underlying zone reclassification approval no. ZE-18-89, or as amended by any 'change of conditions' action. 4. Prior to recording the final binding site plan, the applicant shall submit to the Building and Planning Director/designee for review any proposed final binding site pian to ensure compliance with these Findings and Conditions of Approval. 5. The initial overall final binding site plan shall be designed substantially in conformance with the "Preliminary Binding Site Plan of Record". The initial recording of this final binding site plan shall show, at a minimum, the perimeter boundary of the total site and any specific internal parcels that can comply with the development standards at that time. 6. Any subsequent divisions of land within the recorded original final binding site plan shall be reviewed by the Building and Planning Director/designee. The number of parcels proposed will be determined by the development standards, such as the Zoning Code and shall be flexible within the terms of the original final binding site plan's conditions of approval.. After the Division of Building and Planning has reviewed the specific parcel(s) and determined their compliance with all applicable regulations and provisions of the original final binding site plan, an "Amendment to the Final Binding Site Plan by Survey" may be recorded with the Spokane County Auditor. 7. A survey is required of the subject property prior to recording the final binding site plan. 8. Appropriate road name(s) and street address for each parcel shall be indicated on the final binding site plan map. 9. Appropriate utility easements shall be indicated on the final binding site plan map. Approval of utility easements by utility companies must be received prior to recording the final binding site plan. 10. The final binding site plan map shall contain the following statement: "Setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final binding site plan. Any setbacks indicated on this binding site plan may be varied from if proper zoning or variance approvals are obtained." 11. Four (4) current certificates of title shall be furnished to the County Division of Building and Planning prior to recording the final binding site plan. 12. The applicant shall contact the Division of Building and Planning at the earliest possible stage in order to be informed of code requirements administered/enforced as authorized by the State Building Code Act. Design/development concerns include: addressing, fire apparatus access roads, fire hydrant/flow, approved water systems, building accessibility. construction type, occupancy classification, exiting, exterior wall protection, and energy code regulations. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior to release of a building permit, use of property as proposed or filing of a Final Binding Site Plan: r f 1 Applicant shall deliver for acceptance by the County Engineer a clear and unencumbered right-of-way deed for University Road which was constructed in conjunction with CRP #2298. DR4 ` The applicant and Spokane County are currently negotiating the required right-of-way for the Valley Couplet and Dartmouth Road as shown on the adopted Right-of-Way Plan for Spokane County Road Project No. 2396. A copy of the approved plan is attached to these conditions shall be referred to as `Exhibit A'. This condition revised May 5, 1998. 3. Applicant shall comply with all conditions for the underlying zone change found in ZE- 18-89 and ZE-18A-89. 4. That conditional approval of the Binding Site Plan by the County Engineer is given subject to dedication of right-of-way and approval of the road system. 5. That drainage plans and design calculations showing the alignment of drainage facilities be submitted to the County Engineer for acceptance prior to the release of any building permit. Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 6. A statement shall be placed in language of the Binding Site Plan that no direct access be allowed from lots to the Valley Couplet Right-Of-Way until the Valley Couplet is constructed and established by the Board of County Commissioners. 7. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 95-0498, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 8. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. SPOKANE COUNTY DIVISION OF UTILITIES 1. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 2. A wet (live) sewer connection to the area-wide Public Sewer System is to be constructed. Sewer connection permit is required. 3. Applicant shall submit expressly to Spokane County Division of Utilities "under separate cover", only those plan sheets showing sewer plans and specifications for public sewer connections and facilities for review and approval. 4. The plans shall be submitted prior to the finalization of the project. 5. Arrangements for the payments of applicable sewer charges must be made for prior to issuance of sewer connection permit. SPOKANE REGIONAL HEALTH DISTRICT 1. The final binding site plan shall be designed as indicated on the preliminary binding site plan of record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary binding site plan of record for distribution by the Planning Department to the utility companies, Spokane County Engineer, and the Spokane Regional Health District. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Prior to filing the final binding site plan, the sponsor shall demonstrate to the satisfaction of the Spokane Regional Hea(th District that an adequate and potable water supply is available to each lot of the binding site plan. 7. Prior to filing the final binding site plan, the sponsor shall present evidence that the binding site plan lies within the recorded service area of the water system proposed to serve the binding site plan. 8. A public sewer system will be made available for the binding site plan and individual service will be provided to each lot prior to sale. Use of individual on-site sewage disposal systems shall not be authorized. 9. A statement shall be placed in the dedication to the effect that: "A public sewer system will be made available for the binding site plan and individual service will be provided to each lot prior to sale. Use of individual on-site sewage disposal systems shall not be . authorized." 10. The dedicatory language on the final binding site plan dedication shall state: "Use of private wells and water systems is prohibited." 11. The final binding site plan dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Division of Building and Planning, and water purveyor, shall be installed within this binding site plan, and the applicant shall provide for individual domestic water service as well as fire protection to each lot prior to sale of each tract and prior to issuance of a building permit for each lot." SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY (SCAPCA) 1. SCAPCA Regulation I, Article V requires that a Notice of Construction and Application for Approval be submitted to and approved by our Agency prior to the construction, installation or establishment of an air pollution source. There are numerous businesses that are allowed in a commercial zoning that are air pollution sources. Before any business is established at the site, SCAPCA should be contacted to determine if a Notice of Construction is required. 2. SCAPCA Regulation I, Article VI, and SCAPCA Regulation II, Article IV, address air pollution emission standards. All emission standards must be met. 3. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require the use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. SCAPCA strongiy recommends that all traveled surfaces (i:e: ingress, egress, parking areas, access roads) should be paved and kept clean to minimize emissions. 5. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 6. SCAPCA Regulation I, Article IV may require registration with this agency depending upon the type of equipment or business that may be established on the site. An approved Notice of Construction suffices to meet this requirement. 7. Debris generated as a result of this project must be disposed of by means other than burning (i.e. construction waste, vegetative waste etc.) 8. Demolition and renovation projects must comply with the requirements of CFR 40, Part 61, Subpart M and SCAPCA Regulation I, Article IX. 9. Depending on the type of business or equipment established on the site, some objectionable odors may result from this project. SCAPCA's regulations state that effective control apparatus and measures must be used to reduce odors to a minimum. 10. All solid fuel burning devices (fireplaces wood stoves, pellet stoves, etc.) must comply - with local, state and federal rules and regulations. APPROVED THIS 6`h DAY OF APRIL, 1998. Approval of utility easements by utility companies must be received prior to recording the final binding site plan. 10. The final binding site plan map shall contain the following statement: "Setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final binding site plan. Any setbacks indicated on this binding site plan may be varied from if proper zoning or variance approvals are obtained." 11. Four (4) current certificates of title shall be furnished to the County Division of Building and Planning prior to recording the final binding site plan. 12. The applicant shall contact the Division of Building and Planning at the earliest possible stage in order to be informed of code requirements administered/enforced as authorized by the State Building Code Act. Applicant shall deliver for acceptance by the County Engineer a clear and unencurnbered right-of-way deed for University Road which was constructed in conjunction with CRP #2298. That conditional approval of the Binding Site Plan by the County Engineer is given subject to dedication of right-of-way and approval of the road system. 5. That -drair-rage-plans and design calculations showing the alignment of drainage facilities be submitted to the County Engineer for acceptance prior to the release of any building permit. Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 6. A statement shall be placed in tanguage of the Binding Site Plan that no direct access be allowed from lots to the Valley Couplet Right-Of-Way until the Valley Couplet is constructed and established by the Board of County Commissioners. 7. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 95-0498, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. s. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. . SPOKANE COUNTY DIVISION OF UTILITIES 1. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 2. A wet (live) sewer connection to the area-wide Public Sewer System is to be constructed. Sewer connection permit is required. 3. Applicant shall submit expressly to Spokane County Division of Utilities "under separate cover", only those plan sheets showing sewer plans and specifications for public sewer connections and facilities for review and approval. 4. The plans shall be submitted prior to the finalization of the project. 5. Arrangements for the payments of applicable sewer charges must be made for prior to issuance of sewer connection permit. SPOKANE REGIONAL HEALTH DISTRICT 1. The final binding site plan shall be designed as indicated on the preliminary binding site plan of record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary binding site plan of record for distribution by the Planning Department to the utility companies, Spokane County Engineer, and the Spokane Regional Health District. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Prior to filing the final binding site plan, the sponsor shall demonstrate to the satisfaction of the Spokane Regional Health District that an adequate and potable water supply is available to each lot of the binding site ptan. 7. Prior to filing the final binding site plan, the sponsor shall present evidence that the binding site plan lies within the recorded service area of the water system proposed to serve the binding site plan. 8. A public sewer system will be made available for the binding site plan and individual service will be provided to each lot prior to sale. Use of individual on-site sewage disposal systems shall not be authorized. 9. A statement shall be placed in the dedication to the effect that: "A public sewer system will be made available for the binding site plan and individual service will be provided to each lot prior to sale. Use of individual on-site sewage disposal systems shall not be . authorized." 10. The dedicatory language on the final binding site plan dedication shall state: "Use of o private wells and water systems is prohibited." 11. The final binding site plan dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Division of Building and Planning, and water purveyor, shall be installed within this binding site plan, and the applicant shall provide for individual domestic water service as well as fire protection to each lot prior to sale of each tract and prior to issuance of a building permit for each lot." SPOKANE COUNTY AIR POLLUTION CONTROL AUTNORITY (SCAPCA) 1. SCAPCA Regulation I, Article V requires that a Notice of Construction and Application for Approval be submitted to and approved by our Agency prior to the construction, installation or establishment of an air pollution source. There are numerous businesses that are allowed in a commercial zoning that are air pollution sources. Before any business is established at the site, SCAPCA should be contacted to determine if a Notice of Construction is required. 2. SCAPCA Regulation I, Article VI, and SCAPCA Regulation II, Article IV, address air pollution emission standards. All emission standards must be met. 3. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require the use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. Findings and Decision BSP-56-97 5 4. SCAPCA strongly recommends that all traveled surfaces (i:e: ingress, egress, parking areas, access roads) should be paved and kept clean to minimize emissions. 5. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 6. SCAPCA Regulation I, Article IV may require registration with this agency depending upon the type of equipment or business that may be established on the site. An approved Notice of Construction suffices to meet this requirement. 7. Debris generated as a result of this project must be disposed of by means other than burning (i.e. construction waste, vegetative waste etc.) 8. Demolition and renovation projects must comply with the requirements of CFR 40, Part 61, Subpart M and SCAPCA Regulation I, Article IX. 9. Depending on the type of business or equipment established on the site, some . objectionable odors may result from this project. SCAPCA's regulations state that effective control apparatus and measures must be used to reduce odors to a minimum. 10. All solid fuel burning devices (fireplaces wood stoves, pellet stoves, etc.) must comply with local, state and federal rules and regulations. Because of the plans for an east/west street couplet and using Sprague Avenue for the west bound direction, ~ presents a critical need for Dartmouth to be a public street. The Fire District needs this street so our Fire Station #1 (10319 , E. Sprague) fire apparatus have an immediate change in direction so they can head east for emergency responses. If Dartmouth is not-a through street the District's f ire apparatus will have to travel to Farr Road before turning to head east. This situation will cause unnecessary delays for timely fire and emergency medical (paramedic) responses. The Fire District officials have had several discussions with county off icials and one discussion with Architect Gary Bernardo, owner's contact. We have been consistently told that the Dartmouth issue would be resolved in our favor. However, a March 91 1998 memo from Stacy Bjordahl, Senior Planner, circulating the architect's revised site plan.-showing Second Avenue's right away, but still does not show Dartmouth as through street. ~ It is the District's intention to request the hearing examiner not to allow the project to proceed until this public life safety • and f ire protection issue is resolved. • If you have any questions, please do not hesitate to contact me. The 50% rule is invoked if the project permitting costs divided by the appraised value of the structure, as recorded in the records of the Spokane County Assessor, is over 50%. The current records show the appraised value of U City at $4,455,300 (See attached record). When you divide $2,700,000 by $4, 455, 300 you are at approximately 61%. You therefore fall in the 208 requirement. Your project plans should include 208 treatment of stormwater as explained above.
