In ortler to implemen# the Arterial Road Plan, the County Engineer has requested a strip of t2le subject peoperty 12 feet in width alang the Sullivan Road frontage be set aside as a Future Acquisition Area. `Fherefore, as condttioned, (such as improvements and acquisition areas) the propasal conforms to the Road Plan. 10. The required public notice was pravided for this propasal and agencies having a poter~tia1 interest in the project were natified and recommendatians soiicited. No written comments were received from any adjoining property owner(s) regarding this proposal. 11. An Environmenta! Checklist was subrrtitted by the sponsor and was revievved by t1he Spakane County Division af Building and Plannzng. The review considered t.he spe~'tflcs of the proposal, other available information, Coun#y ordinances, other regutations and laws, possible standard Conditions of Appraval, the Generalized Comprehensive Plan, and other County policies and . s guidelines. The Building and Planning Division has determined that "No probable significant adverse impacts" would result from the proposal being developed and issued a Determination of Nonsignificance (DNS) on June 25, 1999 The DNS was circulated for review and comments to those agencies of jurisdiction affected by this proposal. The DNS was also advertised in the newspaper to the public 15 calendar days before the comment period ended on July 9, 1999. In response to the environmental review, written comments were received from Spokane County Air Pollution Control Authority, Washington State Department of Ecology, and Washington State Boundary Review Board for Spokane County. 12. In conjunction with the conditions of approval and Spokane County development standards, the proposed binding site plan is not detrimental to the public health, safety and general welfare. Moreover, this proposal implements the underlying zoning, as well as the Comprehensive Plan and complies with the provisions of Chapter 12.500 (Binding Site Plans) of the Spokane County Subdivision Ordinance. DECISION Based upon the above Findings of Fact and Conclusions, Binding Site Plan Application BSP-64-98 is hereby APPROVED for five (S) years, specifically until August 1, 2004, and subject to the conditions noted below. This decision is final unless appealed in writing, consistent with adopted appeal procedures. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns and successors. The preliminary Binding Site Plan was given conditional approval for tive (5) years, specifically to Augusi i, 2004. The appiicant may submii ari extrnsian or' time appiication at 'teast thirty (30) days prior to the above expiration date. Application(s) for extension of time shall be processed under the provisions of Chapter 12.100.115 (Extension of Time) of the Spokane County Subdivision Ordinance. If the applicant comp!ies with the criteria of Chapter 12.100.118, the preliminary approval and conditions will be changed to reflect the adopted policy and development regulations at the time of the extension application. 3. Prior to recording the final binding site plan, the applicant shall submit to the Building and Planninb Director/designee for review any proposed final binding site plan xo ensure compliance with these Firidings and %.-Iunriition5 ui A~provall. 4. The initial overall final binding site plan shall be designed substantially in conformance with the "Preliminary Binding Site Plan of Record." The initial recording of this fnal binding site plan shall show, at a minimum, the perimeter boundary of the total site and any specific internal parcels that can comply with the development standards at that time. 5. Any subsequent divisions of land within the recorded original final binding site plan shall be reviewed by the Building and Planning Director/designee. The number of parcels proposed will be determined by the development standards, such as the Zoning Code and shall be fleYible within the terms of the original final binding site plan's conditions of approval. After the Division of Building, and Planning has reviewed the specific parcel(s) and determined their compliance with all Findings and Decision BSP-64-98 2 applicable regulations and provisions of the original final binding site plan, an "Amendment to the Final Binding Site Plan by Survey" may be recorded with the Spokane County Auditor. 6. A survey is required of the subject property prior to recording the final binding site plan. 7. Appropriate road name and street address for each parcel shall be indicated on the final binding site plan map. 8. Appropriate utility easements shall be indicated on the final binding site plan map. Written approval of utility easements by utility companies must be received prior to recording the final binding site plan. 9. The final binding site plan map shall indicate by a dashed line the required setbacks from all private and public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final binding site plan. The setbacks indicated on this binding site plan may be varied from if proper zoning or variance approvals are obtained." 10. Four (4) current certificates of title shall be furnished to the County Division of Building and Planning prior to recording the final binding site plan. 11. The applicant shall contact the Division of Building and Planning at the earliest possible stage in order to be informed of code requirements administered/enforced as authorized by the State Buildina Code Act. Design/development concerns include: addressing, fire apparatus access roads, fire hydrant/flow, approved water systems, building accessibility, construction type, occupancy classification, exiting, exterior wall protection, and energy code regulations. 12. A specific and detailed Site Development Plan will be submitted to the llivision of Building and Planning for review and approval prior to issuance of a building permit, Change of Use Permit or Certificate of Occupancy. . 13. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscapina, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements a£ter acquiring said future acquisition area. Findings and Decision BSP-64-98 3 G L 14. The final short plat dedication shall contain the following statement: "The subject property is within 1000 feet of designated agricultural, forest or mineral resource land, on which a variety of commercial activities may occur that are not compatible with residential development. Potential disturbances or inconveniences may occur 24 hours per day and include but are not limited to: noise, odor, fumes, dust, smoke, insects, operation of machinery including aircraft, application of pesticides, herbicides, fertilizers and removal of vegetation. Agricultural and forest related activities which are performed in accordance with local, State and Federal laws shall not be subject to legal action as a public nuisance." SPOK.ANE COUNTY DIVISION OF ENGINEERING AND ROADS 1. Conditional approval of the Binding Site Plan by the County Engineer is given subject to dedication of right-of-way and approval of the road system as indicated in the Preliminary Binding Site Plan of Record. 2. Road plans, profiles and cross sections as designed to County standards showing proposed street centerline and curb grades be submitted to the County Engineer for acceptance prior to construction and/or the release of a building permit. Road plans to be prepared under the direction of a licensed professional Civil Engineer. 3. Drainage plans and design calculations showing the alignment of drainage facilities be submitted to the County Engineer for acceptance prior to construction and/or the release of a building permit. Drainage plans to be prepared under the direction of a licensed professional Civil Engineer. 4. All construction within the existing or proposed public right-of-way is to be completed prior to filing the final Binding Site Plan or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements, construction certification, "As Built" plans and monumenting the street centerlines shall be filed with the County Engineer. 5. Appiicant shall dedicate a minimum oi 48 feet of right-of-way for the eactension of Marietta Avenue. Dedication sliall include right-of-way for a standard cul-de-sac ati ihe ierminus oi Marietta Avenue. 7. The County Engineer has designated a Commercial Local Access Roadway Section for the improvement of Marietta Avenue which is to be constructed within the proposed Binding Site Plan. This will require the instatlation of 40 feet of asphalt and the construction of a standard cul- de-sac. The construction of curbing and sidewalk is also required. The applicant shall grant applicable border easements adjacent to Spokane County right-of-way per Spokane County Standards. 8. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 95-0498, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 9. The County Arterial Road plan identifies Sullivan Road as a 100 foot Principal Arterial. The existing right-of-way width of 80 feet is not consistent with that specified in the plan. In order to implement the Arterial Road Plan it is recommended a strip of property 12 feet in width along the Sullivan Road frontage be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to Sullivan Road. Findings and Decision BSP-64-98 4 ' ~ ♦ ~ 10. The applicant should be advised that there may exist utilities either underground or overhead affecting the applicant's property, including property to be dedicated or set aside future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should check with the applicable utilities and Spokane County Engineer to determine whether the applicant or utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 11. Prior to filing of a final binding site plan the applicant shall enter into a Developer Agreement with Spokane County which will address off-site mitigation for the Sullivan RoadlInterstate 90 Interchange, based upon traffic impacts from this proposal. The final binding site plan dedication shall contain the following statement: "The developer of this binding site plan has executed a Developer Agreement for off-site transportation mitigation fees based on a per trip calculation for each proposed land use within the binding site plan. This fee shall be collected prior to the issuance of a building permit." SPOKANE COUNTY DIVISION OF UTILITIES 1. A wet (live) sewer connection to the area-wide Public Sewer System is to be constructed. Sewer connection permit is required. Commercial developments shall submit historical and or estimated water usage prior to the issuance of the connection permit in order to establish sewer fees. 2. The final binding site plan dedication shall contain the following statement: "Public sewer shall be constructed to provide for the connection of each parcel to the County's system of sewerage. Uses on properties within the project shall be required to connect to the sewer and pay applicable charges per the County Sewer Ordinance. Sewer connection permits shall be required." 3. The final binding site plan dedication shall contain the following statement: "A Public Sewer System will be made available for the plat, and individual services will be provided to each parcel prior to sale. Use of individual on-site disposal systems shall not be authorized." 4. The final binding site plan dedication shall contain the following statement: "Individual parcels shall be, subject to payment of cUrrPIlt ?Pr1ira~ile Ca~/PC !`C~t?!~Pction c:darbPS a.nidIer ~-^e:a, charges prior to the issuance of a sewer connection permit." 5. Sewer plans aGCeptable to the Division of Utilities shall be submitted prior to recording r_h_e final binding site plan. SPOKANE REGIONAL HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of the Spokane County Division of Utilities. 2. Water service shall be coordinated through the Spokane County Division of Utilities. 3. Water service shall be by an existing public water supply when approved by the R.egional Enaineer (Spokane), State Department oi Heairh. 4. Prior to recording the fnal binding site plan, the applicant shall demonstrate to the satisfaction of the Spokane Regional Health District that an adequate and potable water supply is available to each tract of the plat. 5. Prior to recording the final binding site plan, the applicant shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 6. A plan for water facilities adequate for domestic use, domestic irrigation use and fire protection use shall be approved by the water purveyor. Said water plan must have been approved by the fire protection district and the appropriate health authorities. ' , . ~ 99 0626 DEVELOPMENT AGREEMENT This Development Agreement (the "Agreement") is entered into on the date last written below by and between and Robert Bonuccelli, ("Bonuccelli"), having offices for the transaction of business at 2901 North Argonne Road, Suite #5, Spokane, Washington and Spokane County ("County"), a political subdivision of the State of Washington. Recitals 1. Bonuccelli is the owner of certain real property generally located west of and adjacent to Sullivan Road and north of the Union Pacific Railroad, and legally described in Exhibit A attaclled hereto and by reference made a part hereof. Said property consists of 21.14 acres + or and shall hereinafter be referred to as "The Property". II. The County had previously enacted a zone classification of I-3 on The Property. Bonuccelli has received approval of a Binding Site Plan under BSP-64-98 fronl County in order to subdivide said property and allow for development of those uses which are allowed in the I-3. III. The development of the property under BSP-64-98 for uses allowed in the I-3 will directly impact transportation infra-structure for the Sullivan Road corridor from and including the ramps at I-90 to Trent Avenue. Spokane County Engineering Condition of Approval No. 11 of BSP-64-98 provides that Bonuccelli: Prior to filing of a final binding site plan the applicant shall enter into a Developer Agreement with Spokane County which will address off-site mitigation for the Sullivan Road /Interstate 90 Interchange, based upon traffic impacts from this proposal. The following language shall appear on the final binding site plan: "The developer of this binding site plan has executed a Developer Agreement for off-site transportation mitigation fees based on a per trip calculation for each proposed land use within the binding site plan. This fee shall be collected prior to the issuance of a building permit." , , . . 11V. Said improvements to I-90 and Sullivan Road are not only reasonably necessary and directly related to BSP-64-98, but they are reasonably capable of being accomplished by Bonuccelli. V. Pursuant to RCW 43.21 C.060, RCW 82.02.020, and Article XI 11 of the Washington State Constitution, the County has the authority to impose mitigation fees for the costs of certain road projects made necessary by development, provided: (1) the County has identified future road projects necessitated by planned development in certain areas of Spokane County; (2) enacted through conditions of approval of a land use action including a State Environmental Policy Act review, a reasonable relationship between impacts to the transportation system from the proposed development and the financial contribution toward those impacts; and (3) provide an equitable formula by which developers within an area proportionally contribute to the cost of road projects through the payment of voluntary mitigation fees. NOW THEREFORE, the Parties agrce as follows: l. Mitigation Fee Bonuccelli shall pay a per trip fee based upon the PM peak hour trip generation from any proposed land use on The Property. The determination of this PM Peak Hour shall be determined by the County Engineer utilizing the Institute of Transportation Engineering, Trip Generation Mafzacal, 6th Addition, (as amended). This traff c mitigation fee shall be expended towards the construction of the revised west bound loop ramp at Sullivan and I-90 or for improvements to Sullivan Road north of I-90 and south of Trent Avenue. 2. Payment The funds shall be paid as follows: (a) A portion of the traffic mitigation fee as determined by the County Engineer shall be paid by Bonuccelli at the time an initial building permit application is made to the County for each parcel of property within BSP-64-98. • - . ' (b) The traffic mitigation fee due with each building permit application shall be based on the number of PM Peak Hour trips generated by the type of land use on The Property as determined by the County Engineer based upon the Institute of Transportation Engineering, Trip Generation Manual, 0 Addition, (as amended), and Gross Floor Area which will provide net new trips generated. These new trips will be multiplied by $ 764.76 to equal the mitigation fee, (see attached Exhibit B for example of this calculation). The $764.76 was calculated through a traffic analysis providing proportionate share of trips and cost estimate done for the proposed west bound on-ramp for Sullivan Road and I-90. 3. Compliance ivith Conditions The County agrees that Bonuccelli's execution of the Agreement and payment of all mitigation fees pursuant to this Agreement constitutes compliance with Engineers Condition Number 11 of BSP-64-98. 4. Compliance with RCW 82.02.020. (a) Each payment collected by the county shall be held in a mitigation fee reserve account and may only be expended to fund the construction of a revised west bound loop ramp at Sullivan /I-90 or capacity improvements to Sullivan Road north of. I-90 and south of Trent Avenue, (the "Improvement"). (b) The payment collected upon submittal of each building permit application shall be expended by the County within five years of collection. The County shall be entitled to reimbursement from the mitigation fee reserve account for any funds it may expend for the construction of the improvement prior to the collection of the fee. (c) Any funds in the mitigation fee reserve account not expended within five years shall be refunded with interest as provided in RCW 82.02.020. 5. General terms: (a) No modification or amendment of this Agreement shall be effective unless executed in writing with the same formalities attendant to execution of this Agreement. (b) This Agreement shall be binding on and inure to the benefit of the successors and the assigns of the parties. (c) This Agreement shall be construed in accordance with the laws of the State of Washington. Any action for enforcement of this Agreement shall be brought in a . I • L / court of competent jurisdiction in Spokane County, Washington or as otherwise provided by statute. (d) No waiver or any breach of this agxeement shall be held to be a waiver of any other subsequent breach. 6. Miscellaaeous. (a) The County shall not collect any other traffic mitigation fees for the property within BSP-64-98, for the Improvement so long as the proposed uses remain similar to the list of land uses attached as Exhibit B. 7. Termination of Agreement The right to collect mitigation fees under this Agreement shall terminate ten (10) years after its execution by the parties herein, at such time if a formal impact fee is adopted by the Board of County Commissioners under RCW 82.02.050 this new fee shall be collected at time of building permit. If said impact fee has been authorized and Bonuccelli chooses prior to the ten (10) year terminafiion of the Agreement to participate in this new impact fee structure for transportation system impact fees, Bonuccelli shall request in writing his inclusion into the new impact fee area. Applicant shall dedicate a minimum of 48 feet of right of way for the extension of Marietta Avenue. Dedication shall include right of way for a standard cul de sac at the terminus of Marietta Avenue. 7. The County Engineer has designated a Commercial Local Access Roadway Section for the improvement of Marietta Avenue which is to be constructed within the proposed Binding Site Plan. This will require the installation of 40 feet of asphalt and the construction of a standard cul de sac. The construction of curbing and sidewalk is also required. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. 8. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 95-0498, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 9. The County Arterial Road plan identifies Sullivan Road as a 100 foot Principal Arterial. The existing right of way width of 80 feet is not consistent with that specified in the plan. In order to implement the Arterial Road Plan it is recommended a strip of property 12 feet in width along the Sullivan Road frontage be set aside in reserve. This property may be acquired by Spokane County at the time when Arterial Improvements are made to Sullivan Road. lo . The applicant should be advised that there may exist utilities either underground or overhead affecting the applicants property, including property to be dedicated or set aside future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should check with the applicable utilities and Spokane County Engineer to determine whether the applicant or utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 11. Prior to filing of a final binding site plan the applicant shall enter into a Developer Agreement with Spokane County which will address off-site mitigation for the Sullivan Road/Interstate 90 Interchange, based upon traffic impacts from this proposal. The following language shall appear on the final binding site plan: "The developer of this binding site plan has executed a Developer Agreement for off-site transportation mitigation fees based on a per trip calculation for each proposed land use within the binding site plan. This fee shall be collected prior to the issuance of a building permit."
