I have reviewed the information available concerning the traffic issues for the convenience
store proposed for your property located adjacent to Sullivan Rd. and Marietta Ave. The
primary source for trip generation is the Institute of Transportation Engineer's Trip
Generation Manual (TGM) and is routinely used by the Transportation Engineering
Section. The TGM contains information on trip generation rates and various other trip
characteristics based on surveys from across the country.
The TGM has two land-use codes which are appropriate for developing traffic projections
for the above mentioned convenience store. Land-use #853 (Convenience Store w/
Gasoline Pumps) and #845 (Gasoline/Service Station w/ Convenience Market) have trip
characteristics reported in the February,1995 update to the TGM; Tables VII-9 and VII-7
respectively.
The reported pass-by rates for these land uses are 66% for a Convenience Store wl Gas
Pumps and 56% for a Gasoline/Service Station wl Convenience Nlarket. The average
pass-by rate for these two land-uses is 61 As a comparison, we typically use 50% in
most traffic studies.
Taking into account the location of the site and existing traffic patterns we have determined
that a 70% pass-by rate would be appropriate for a convenience store on the Banuccelli
property. This is a higher rate than provided in the ITE Trip Generation Manual and the
rate typically used by Spokane County. The 70% rate is believed to conservative enough
to ensure all trips are counted, yet provides for the exceptional characteristics of the site.

As provided for in Resolution 99-0926, authorizing a development agreement between Robert
Bonuccelli and Spokane County for road improvements in connection with BSP 64-98, I have
calculated the fee associated with the 21,621 ft2 warehouse building shown as phase 11 on the
site plan for the Phase II Building Permit.
The mitigation fee, as shown below, is $8,432.78 and is based on the size and use of the
proposed building. Since the fee is calculated using the specific use, any change in use or in
size of the building will require the fee to be recalculated. This fee does not include the Phase
III building.

WITH BINDING SITE PLAN NO. 64-98 )
WHEREAS, the development of Binding Site Plan No. 64-98 involves the financial participation
in the improvement of Sullivan Road and Interstate 90 Interchange; and
WHEREAS, the developer and county staff have prepared a"Development A~reement"
enumecating the requirements and obligation of the parties in the project and the County F_ngineer
recommends approval and acceptance of the agreement.
THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Spokane County,
Washington that the "Development Agreement" between Spokane County and Robert Bonuccelli is
hereby authorized to execute the same by and on behalf of Spokane County.

99 06 26 DEVELOPMENT AGREEMENT
~
~
This Development Agreement (the "Agreement") is entered into on the date last
written below by and between and Robert Bo.nuccelli, ("Bonuccelli"), having offices for
the transaction of business at 2901 North A.rgonne Road, Suite #5, Spokane, Washington
and Spokane County ("County"), a political subdivision of the State of Washington.
Recitals
I.
Bonuccelli is the owner of certain real property generally located west of and
adjacent to Sullivan Road and north of the Union Pacific Railroad, and legally described
in Exhibit A attached hereto and by reference made a part hereof. Said property consists
of 21.14 acres + or and shall hereinafter be referred to as "The Property".

The County had previously enacted a zone classification of I-3 on The Property.
Bonuccelli has received approval of a Bi7ding Site Plari <<ndar BSP-64-98 irom County in
order to subdivide said property and allow for developcrteiit or ihose uses which are
allowed in the I-3.
III.
The development of the property under BSP-64-98 for uses allowed in the I-3 will
directly impact transportation infra-structure for the Sullivan Road comdor from and
including the ramps at I-90 to Trent Avenue. Spokane County Engineering Condition of
Approval No. 11 of BSP-64-98 provides that Bonuccelli: Prior to filing of a final binding
site plan the applicant shall enter into a! Developer Agreement with Spokane County
which will address off-site mitigation for the Sullivan Road /Interstate 90 Interchange,
based upon traffic impacts from this proposal. The following language shall appear on
the final binding site plan: "The developer of this binding site plan has executed a
lleveloper Agreement for off-site transportation mitigation fees based on a per trip
calculation for each proposed land use within the binding site plan. This fee shall be
collected prior to the issuance of a building permit."

Said improvements to 1-90 and Sullivan Road are not only reasonably necessary
and directly related to BSP-64-98, but'they are reasonably capable of being accomplished
by Bonuccelli. '
V.
Pursuant to 12CW 43.21 C.060, RCW 82.02.020, and Article XI 11 of the Washin~ton
State Constitution, the County has the authority to impose mitigation fees for the costs of
certain road projects made necessary by development, provided: (1) the CoLinty has
identified future road projects necessitated by planned development in certain areas of
Spokane County; (2) enacted through conditions of approval of a land use action
including a State Environmental Policy Act review, a reasonable relationship betNveen
impacts to the transportation system from the proposed development and the financial
contribution toward those impacts; and (3) provide an equitable formula by which
developers within an area proportionally contribute to the cost of road projects througtl
the payment of voluntary mitigation fees.
NOW THEREFORE, the Parties agree as follows;
1. Mitigation Fee Bonuccelli shall pay a per trip fee based upon the PNI peak hour trip generation
from any proposed land use on The Property. The determination of this PM Peak Hour
shall be determined by the County Engineer utilizing the Institute of Transportation
Engineering, Trip Generation Manual, '6` Atlditiori, (as amended). This traffic mitigation
fee shall be expended towards the construction of the revised west bound loop ramp at
Sullivan and I-90 or for improvements to Sullivan Road north of 1-90 and south of Trent

2. Payment

The funds shall be paid as follows:
(a) A portion of the rraffic mitigation fee as determined by the County Engineer
shall be paid by Bonuccelli at the time an initial building permit application is
made to the County for each parcel of property within BSP-64-98.

(b) The traffic mitigation fee due with each building permit application shall be
based on the number of PM Peal: Hour trips generated by the type of land use
on The Property as determined by tlie County Engineer based upon the
Institute of Transportation Engineering, Trip Generation Manual, 6`'
Addition, (as amended), and Gross Floor Area which will provide net new
trips generated. These new trips will be multiplied by $ 764.76 -to equal the
mitigation fee, (see attached Exhibit B for example of this calculation). The
$764.76 was calculated through a traffic analysis providing proportionate
share of trips and cost estimate done for the proposed west bound on-ramp for
Sullivan Road and I-90.
3. Compliance rvith Conditions
The County agrees that Bonuccelli's execution of the Agreement and payment of all
mitigation fees pursuant to this Agreement constitutes compliance with Engineers
Condition Number 11 of BSP-64-98.
4. Compliance `vith RCVV 82.02.020.
(a) Each payment collected by the county shall be held in a mitigation fee reserve
account and may only be expended to fund the coizstruc:liori of a revised west
bound loop ramp at Sullivan /I-90 or capacity improvements to Sullivari Road
north of I-90 and south of Trent Avenue, (the "Improvement").
(b) The payment coller,ted upon submittal of each building permit application shall
be expended by the County within five years of collection. The County shall be
entitled to reimbursement from the mitigation fee reserve account for any funds it
may expend for the construction of the improvement prior to the collection of the
fee. (c) Any funds in the mitigation fee reserve account not expended within five years
shall be refunded with interest as provided in RCW 82.02.020.

5. General terms: ~

(a) No modification or amendment of this Agreement shall be effective unless
executed in writing with the same fornlalities attendant to execution of this
Agreement.
(b) This Agreement shall be binding on and inure to the benefit of the successors and
the assigns of the parties.
(c) This Agreement shall be construed in accordance with the laws of the State of
Washington. Any action for enforcement of this Agreement shall be brought in a

I have reviewed the information available concerning the traffic issues for the convenience
store proposed for your property located adjacent to Sullivan Rd. and Marietta Ave. The
primary source for trip generation is the Institute of Transportation Engineer's Trip
Generation Manual (TGM) and is routinely used by the Transportation Engineering
Section. The TGM contains information on trip generation rates and various other trip
characteristics based on surveys from across the country.
The TGM has two land-use codes which are appropriate for developing traffic projections
for the above mentioned convenience store. Land-use #853 (Convenience Store w/
Gasoline Pumps) and #845 (Gasoline/Service Station w/ Convenience Market) have trip
characteristics reported in the February,1995 update to the TGM; Tables VII-9 and VII-7
respectively.
The reported pass-by rates for these land uses are 66% for a Convenience Store w/ Gas
Pumps and 56% for a Gasoline/Service Station vv; Convenience Market. The average
pass-by rate for these two land-uses is 61 As a comparison, we typically use 50% in
most traffic studies.
Taking into account the location of the site and existing traffic patterns we have determined
that a 70% pass-by rate would be appropriate for a convenience store on the Bonuccelli
property. This is a higher rate than provided in the ITE Trip Generation Manual and the
rate typically used by Spokane County. The 70% rate is believed to conservative enough
to ensure all trips are counted, yet provides for the exceptional characteristics of the site.
I hope this provides you with the needed rationaJe in determining the pass-by rate for the
convenience store. If you have any questions or need anything else, please don't hesitate

Pve compiled a small list of items that need to be addressed in the form of agreements, in
order for the County to allow the use of a combined public/private storm sewer:
1. A cash account, dedicated to the County, would have to be set up to cover
maintenance costs in case maintenance is not performed as prescribed. The amount of
the escrow account will be determined by the County.
2. A detailed list of maintenance requirements for each part of the system, along with the
recommended maintenance schedule, needs to be outlined. Recommended drainage
items in the list include drywells, pipes, catch basins, spillways, manholes, grass turf,
imgation system, fencing, and pond.
3. A release of liability needs to be drawn up, releasing the County from any liability
associated with the maintenance activities.
4. The responsibilities in case of contamination or plugging of the pond need to be defined.
5. Annual maintenance reports must be submitted to the County, in a form acceptable to
the County. -
6. The terms for severance of the agreement and disconnection of the private storm lines
need to be defined.
7. Access rights to the system must be granted to the County.
8. A license agreement must be approved by the Board of County Commissioners.
Items 1-7 must be drafted and submitted to the County by Mr. Bonucelli or his
representatives. The County can work on Item 8 when agreement is reached on the
preceding items. Additional items will be added to this list at the discretion of the County,

The property owners within this plat shall maintain all water quality swales ("208" swales)
and drainage ditches situated on their respective properties, and any portion of a`208'

Any building that is constructed on a lot in this plat shall be set at such an elevation so as
to provide positive drainage away from any drainage entry point to the building (including
but not limited to a window well, a window unprotected by a window well; or a
doorway). Said positive drainage shall consist of a minimum slope of 3% away from the
building for a distance of at least 10 feet from the building. The lots shall be graded so
that either a) all runoff is routed away from the building, and conveyed over the lot to a
natural drainage swale or approved drainage facility, or b) drainage intercepted on the lot
is disposed of on the lot in an approved drainage facility. All drainage facilities for this
plat, including any `208' swales, shall be constructed in accordance with the approved
plans on file at the Spokane County Public Works Department. Any proposed changes to

The Border Easement as shown hereon are hereby granted to
Spokane County and its authorized agents, and to the publ,ic for
road purposes, including but not limited to curbs, sidewalks,
drainage, signage, and other usage deemed necessary by the
Spokane County Engineer for the safety and welfare of the Public.
No fence or portion thereof will be constructed withi'n said
easement without permission of the Spokane County Engineer, nor
will any objects be placed in said easement that would obstruct
the sight distance necessary for safe and efficient vehicular
movement. Any other easements granted or dedicated within this
Border Easement area will be subordinate to the rights created by
this easement and are subject to Spokane County Engineers!permit
process prior to usage. ~

CONTRACT
CIVIL ENGINEERING SERVICES
Requirements: Construction Phase Review Civil Engineering
Project Location: Marietta Avenue west of Sullivan Road, Spokane, Washington
Client Name: Robert A. Bonuccelli
Purpose: Provide construction phase civil engineering review of construction for
development of commercial and industrial lots, including drainage improvements,
pavement, and utility trenches.
1. Cost Estimate: The cost for the professional services (billed at $75/hour) are estimated
to be a maximum of $3, 000. 00. Services in addirion to those in this contract will be
incurred only with prior authorization at a rate of $75 per hour plus expenses. Limited
travel to/from site is covered under this contract.
2. Terms: Lump Sum total 15 days after receipt of invoice. To be progress billed at the
end of each calendar month for work performed to the date of invoice.
3. Scope of 'work: See letter dated September 11, 1997. If the client requests
implementation of any additional work, said work shall follow standard engineering
practice.
4. Project Schedule: TechCon will begin work on the project upon notification by the
owner or the owner's representative. Work will be completed within two weeks of completion of construction, unless delayed by actions outside the control of TechCon.
5. Client Requirements: The client shall provide TechCon, Inc. (TechCon) the following:
• Fax copy of the signed agreement to TechCon denoting authorization to proceed.

• Access to existing records, documents, and/or files regarding the project, as
necessary to complete the engineering report.
• The client will be responsible for any permit fees regarding this project.
