walk, curb, stormwater, etc.) which must be constructed fn association with your building
permit. This checklist will be filled out by the Engineer's staff and a copy will be re-

LES SCNwAB 7IkE CEN ) THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane County, i n heari ng appl i cati on VE-] 83-84, he reinafter referred to as the
"Proposal and the Zoni ng Adj ustor of Spokane Caunty havi ng hel d a publ ic
hearing on March 19, 1985 and having fully considered all testimony presented
thereat, and further having visited the site and vicinity in question, and
having rendered a decision on the 26th day of March, 1985, denying the
applicant's full request but APPROYING a modified, less extensive proposal,
makes the following:
FINUINGS UF FACT
1. That the proposal is generally located between Eastern and DyrO
Roads, south of Al ki Avenue and north of Atl as Street i n the Spokane Val 1 ey
between the Broadway and Sprague Avenue interchanges on Interstate yU, west of
Interstate yU, and is further described as Assessors Parcel #13U3-U1U3 and
13533-U7U5 being more specifically described by several documents contained
in Zoning Ljustor File YE-1b3-84.
2. That the proposal as set forth by the applicant proposes to ]ocate
the canopy beyond the fl anki ny street property 1 i ne and i nto a ri ght-of-way
leased from and owned by the Washington State Departinent of Transportation,
whereas the zoni ng Ordi nance requi res a canopy to mai ntai n a 1 U foot setback
from the fl anki ng street property 1 i ne.
3. 7hat the DepartinEni of TransFartati on right-of-way has replaced the
D.re'koad ri ght-of-way i n thi s area and i s the ri ght-of-way wi th regard to
which the flanking street measurements are based.
4. That the adopted Spokane County Future Land Use Plan designates the
area of the.proposal as Industrial and the proposal is consistent with the
County's enti re Gomprehensi ve Pl an, i ncl udi ng the Future Land Use Pl an.
5. That the si te i s zoned 14anuf acturi ng whi ch woul d al 1 ow the proposed
use upon approval of thi s appl i cati on.
b. 7hat the existing land uses in the area of the proposal include
Ri tchi e ki 1 ey and Shook Ti re Center to the north, several heavy Corronerci al and
, outdoor storage areas to the west and the south, and several interior and
outdoor storage heavy cornnercial enterprises to the east, most notably the GMC
truck and a related recreational vehicle dealer, all of which are compatible
with the proposal. 7. That the Zoning Adjustor finds special circumstances do exist
regarding this proposal, which give reason to grant some level of variance,
although not to the full extent requested.
8. That i t i s the presence of the Wasni ngton ueparunent oT
Transportati on ri ght-of-way wlii ch 'has caused the appl i cant to submi t a request
in order to construct even a minirnumly sized canopy; that the applicant has
requested that considerable new paving be applied to the unpaved areas in
order to improve the working and safety conditions for employees as they
attempt_ to jack up heavy equipment on soft ground, and Lhat the Zoning
Adjustor i s taki ng no posi ti on wi th regard to addi ti onal concrete sl ab area
except to recognize that much of the right-of-way on the east side of previous
Dy{rlp koad i s al ready completely paved betweeri the street surface and the face
of the adjacent buildings and to further note that greatly improved safety
conditions would exist for employees if more concrete slab area could be
provided on the east side of the present Les Schwab Tire Center building.

y. 7hat an interview with a representative of the Washington Department
of Transportion indicated that the Uepartment of Transportation right-of-way
i n thi s area can serve no real purpose i n improvi ng the i nterchange.desi gns at
ei ther Broadway Avenue or Sprag'ue Avenue; and that thi s stretch of
ri ght-of-way wi 11 most 1 i kely become surpl us property i n the next few years
and revert back to the existing private and public entities (Spokane County)
for ownership and control; that the Zoning Adjustor assumes that in the long
te nn, the fo rnier right-of-way for Uy re Avenue will be established as a County
road right-of-way with an alignment similiar to that which exists north of
Alki Avenue, and that the Zoning Adjustor both inspected the site and the
vi ci ni ty twi ce, once on March. 14, and agai n on March 18, 1 y85, and al so
conducted on I4arch 18th an i ntervi ew wi th the manager of the Ki tchi e Ki 1 ey and
Shook Tire Center, East 6328 Springfield.
1U. That Ritchie Kiley and Shook Tire Center is essentially the same kind
of operati on, havi ng i ts f ronti ng street address on and east-west street and
consi deri ng Dyre)Road to be a fl anki ng street; that Iti tchi e Ri 1 ey Shook
operates i ts pri mary heavy duty truck servi ce from i ts fl anki ng street
location on Dy,re ,Avenue; that they use a small concrete pad for worki ng on
large rigs as well as utiliziny inost of the unpaved flanking street yard out
. to the edge of the paved roadway; and finally that the manager volunteered
that worki ng on a non-concrete area wi thout a canopy to protect from i ncl ement
weather was hazardous to his employees.
11. The Ritchie Riley Shook building appears to be located on the allowed
building setback line of 2U feet from the flanking street property line,
whereas the Les Schwab Tire building appears to be located 40 feet from the
old Uy;re- koad right-of-way property line;that the Zoning Adjustor does not
wi sh to set a precedent of establ i shi ng a canopy aRy cl oser to the al i grment
of ol d Uy~"r_g-',-Road than woul d be permi tted outri ght for the properti es
imedi atety north of Al ki ( permi ts a canopy to extend to wi thi n 1 U feet of the
Dyfe`Road right-of-way line); but that it would be in the public inte rest to
create i mproved of empl oyee worki ng condi ti ons to the greatest extent possi bl e
whi 1 e nat establ i shi ng i ntr•usi ons i nto th2 ri ght-of-way, nor r ntrusions
further into the flanking street yard than would be allowed under the terms of
the Zoni ng Urdi nance.
12. That there i s nu si mi 1 i ar coinmonly enj oyed pri vi 1 ege of havi ng a
canopied wo rk space in the vicinity of the project (except the applicant',s own
canopi ed automobi l.e work space on the north si de of the exi sti ng bui 1 di ng
but there are exti nuati ng ci rcumstances of hazardous worki ny condi ti ons that
militate in favor of granting a variance which would substantially improve the
worki ny condi ti ons of the workers i f such a vari ance woul d not be rnateri al 1y
detrimental to the public welfare.
13. That it is the unique shape and size of the property as currently
defined by the DeparUnent of Transportation right-of-way which has greatly
contibuted to the applicant',s seeking a variance.
14. That without the.circumstances of the Department of Transportation
right-of-way the applicant would be allowed out right a canopy approximately
30 feet from the face of the building.
15. 7hat the Zoni ng Ad,justor has summari zed maRy of the above
ci rcumstances i n the VE-1 83-84 fi 1 e on Exhi bi t A"Deci si on Surnmary" ( Attached
16. 7hat the proposal is exempt from the provisions of Chapter 43.21C RCW
pursuant to WAC 197-11-8UO(6)(b).
17. That the applicant has been made aware of the recommendations of
various County/State agencies reviewing this project and has indicated they
can comply'with those recommendations.
18. That no one appeared to oppose the proposal nor were any written
comments adverse to the proposal received.

2U. That the creati on of new paved area subject to vehl cle oi 1, .
anti freeze and other 1 eaks, has a cununl ati ve detrimental impact to the sol e
source aquifer, and that the Zoning Adjustor can impose such conditions as
necessary to mi ti gate a 1 i kely detri rnental ef fect upon the publ i c wel fare.
From the Fi ndi ngs of Fact, the Zoni ng Adjustor comes to these:
CUNCLUSIONS
1. The proposal as set forth by the apNlicants may be detrimental to and
not compatible with the public health, safety and general welfare; but the
proj ect as suggested to be modi fi ed by the Zoni ng Adjustor wi 11 not be
detrimental to and i s compati bl e wi th the publ i c heal th, safety and general
welfare as it would set no unacceptable precedent with regard to similiar
future structures on Dryer, ftoad, whereas granti ng a vari ance for the
appl i cant's proposal woul d establ i sh.e' such a precedence.
2. The subject property is not deprived of privileges commonly enjoyed
by other properti es i n the same vici ni ty and zone and a vari ance need not be
granted to remedy ar~y di fferences i n pri vi 1 eges, but there are unsafe worki ng
conditions at the site which could be partially remedied by approval of a
1 arge canopy. 3. Due to the excessive setback of the existing structure f rom the old
Dyrg,Road al i gnment, a canopy coul d be added to the bu i 1 di ng, and whi 1 e i t
would extend into the Uepartment of Transportation right-of-way, it would only
extend to within 1U feet of Dy,re Road property line, which would be allowed by
