liability company, for and in consideration of TWO THOUSAND NINE HUNDRED AND
"�. NO/100 ($2,900.00) DOLLARS, convey(s) and grant(s) unto the CITY OF SPOKANE
VALLEY, a municipal corporation of the State of Washington, the right, privilege and
-►a NI temporary easement over, upon, and across the hereinafter described lands for the purpose of
construction access, a staging area and temporary construction. Said lands being situated in the
City of Spokane Valley, Spokane County, State of Washington, and described as follows:

See Exhibit A attached hereto and made a part hereof.
The temporary rights herein granted shall terminate on October 31, 2019.
It is understood and agreed that delivery of this temporary easement is hereby tendered and that
the terms and obligations hereof shall not become binding upon the City of Spokane Valley
unless and until accepted and approved hereon in writing for the City of Spokane Valley, by
its authorized agent.

TEMPORARY CONSTRUCTION EASEMENT
The City of Spokane Valley(City)shall defend,indemnify, and hold the Grantor harmless from
any and all claims, injuries, damages, losses, or suits including attorney fees, arising out of the
negligent conduct of the City in performance of the activities or operations performed by the
City or arising out of issuance of this easement, except for injuries and damages caused by the
negligence of the Grantor.
