MISSION AVENUE IMPROVEMENT PROJECT—Flora Road to Barker Road
The Grantors,GERALD G.BROOKS,as his separate estate, for and in consideration
of FIVE HUNDRED AND NO/100 ($500.00)DOLLARS, conveys and grants unto the CITY
IN) OF SPOKANE VALLEY, a Washington municipal corporation, Grantee, the right,
CD privilege and temporary easement over,upon, and across the hereinafter described lands for the
purpose of sidewalk construction and regrading of property edge to connect with new grade of
street. Said lands being situated in Spokane County, State of Washington, and described as

The temporary rights herein granted shall terminate on December 30, 2019
It is understood and agreed that delivery of this Easement is hereby tendered and that the terms
and obligations hereof shall not become binding upon the City, unless and until accepted and
approved hereon in writing for the City, by its authorized agent.

TEMPORARY CONSTRUCTION EASEMENT
The City shall defend, indemnify, and hold the Grantor harmless from any and all
claims, injuries, damages, losses, or suits including attorney fees, arising out of the negligent
conduct of City in performance of the activities or operations performed by the City or arising
out of issuance of this easement, except for injuries and damages caused by the negligence of
the Grantor.

An easement for construction purposes over, across and through the South 4.00 feet of the
following description:
That portion of Tract 40 of Plat "A" Greenacres Irrigation District, as per plat recorded in
Volume "E" of Plats, Page 21, records of Spokane County, described as follows:
Beginning at the southwest corner of said Tract 40;
thence East, along the South line thereof, 165 feet;
thence North,parallel with the west line of said Tract 40, a distance of 173 feet to the south
line of the North 62 feet of the South 235 feet;
thence West,parallel with the South line of said tract, 165 feet to the west line of said Tract;
thence South, along said west line to the Point of Beginning;
TOGETHER WITH the South 12 feet of the North 62 feet of the South 235 feet of the West
47 feet of said Tract 40;
EXCEPT Greenacres Road;
AND EXCEPT a triangular piece of land being described as follows:
Commencing at the southwest corner of said Tract 40; thence East, 20.00 feet to the east right
of way line of Greenacres Road and Point of Beginning; thence North, along said east right of
way line, 20 feet distant from and parallel with the west line of said Tract 40, 23.50 feet;
thence Southeasterly, to a point on the south line of said Tract 40 and north right of way line
