The Grantor(s), Gale F. Diener, a married man, as his sole and separate estate, for
and in consideration of TWO HUNDRED AND FIFTY DOLLARS AND NO/100 ($250.00),
convey(s) and grant(s) unto the CITY OF SPOKANE VALLEY, a Washington municipal
corporation, Grantee,the right, privilege and temporary easement over, upon, and across the

TEMPORARY CONSTRUCTION EASEMENT
The City shall defend, indemnify, and hold the Grantor harmless from any and all claims, injuries,
damages,losses,or suits including attorney fees,arising out of the negligent conduct of City in performance of the
activities or operations performed by the City or arising out of issuance of this easement, except for injuries and
damages caused by the negligence of the Grantor.

Irrigation District, as per Plat recorded in Volume "E"of Plats,Page 21,records of Spokane County;
Situate in the City of Spokane Valley, Spokane County, Washington;
The lands herein described contain an area 558 Square Feet more or less,the specific details
concerning all of which are to be found on sheet 4 of 8 that certain plan entitled Mission
Avenue Improvement Project, now of record and on file in the Department of Public Works
