The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Spokane County Zone Change No. ZE-6-93C
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. Sprague Avenue, Special County Section.
All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.
2. As an alternative to the required road improvements
the County will accept an RID/CRP agreement
"Notice to Public No. 6" on Sprague Avenue.

3. Please submit a copy of a recorded property deed
from the Auditors office for the subject property.
Upon receipt of the deed our staff will prepare the
RID/CRP agreement.
4. Approach permits must be obtained, after a site
plan has been approved, and before the issuance of
a building permit, from the County Engineering
Department for any new or improved driveway
approaches to the following streets:
a. Sprague Avenue.
D) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Site Plan.
2. Drainage plan as specif ied.
3. Other information:
a. A parking and traffic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles.
b. An acceptable turn-around for this development
shall be approved in writing by Fire District #1 prior to
building permit approval.
c. The County Arterial Road Plan identifies
Sprague Avenue as a Principal arterial. The existing right-of-way
width of 110 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addition
to the required right-of-way dedication, a strip of property 10
feet in width along the Sprague Avenue frontage shall be set
aside in reserve. This property may be acquired by Spokane County
at the time arterial improvements are made to Sprague Avenue.
E) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
F) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.

The applicant or his representative has been given a minimum
requirements list. This list is not inclusive of all the
requirements needed but should be used as a minimum guideline.
Without the "minimum" requirements the Engineers Department may
not be able to perform a complete review of the project and could
result in prolonging the period before permit issuance. Only
after all the information and requirements listed above are
supplied or completed and the necessary review has been
accomplished will your building permit be released.

FINDINGS nF n$j1E$
INTRODUCTION
This matter has come before the Hearing Examiner Committee on Apri122, 1993.
The members of the Committee present are Lunell Haught, Chairperson, Jan Reuter
and Jane Myers.
PROPOSAL
The sponsor, Wally S. Jamieson, requests approval of a Zone Reclassification from
Urban Residential-3.5 (UR-3.5) to Urban Residential-12 (tTR-12) (ZE-6-93) with
variance for road frontage (VE-2-93) within the Aquifer Sensitive Area Overlay
(ASA) Zone.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located north of and with access to Sprague Avenue in the
Sgokane Valley, between McCabe Road and Blake Road, in the SE 1/4 of Section
15, Township 25 North, Range 44 E.WM, Spokane County, Washington.
2. The committee adopts the Planning Deparnnent Report as a part of this record. The
Planning Department has recommended that the proposed rezone be approved without
support for variance request.
3. The existing land use(s) in the area are residential, commercial and office.
4. The proposed use is comparible with existing uses in the area.
5. The Comprehensive Plan designates this site as Major Commercial. The Major
Commercial category is for the purpose of commercial use but does provide for
multifamily development with the use of proper screening and performance
standards.
6. The proposed zoning dces implement and conform to the Comprehensive Plan.
7. The Arterial Road Plan designates Sprague Avenue as a Principal Arterial, with a
recommended right of way width of 130 feet.
8. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5), previously established as Agricultural Suburban (AS) zoni.ng in 1957 and
reclassified to Urban Residential-3.5 (UR-3.5) on January l, 1991 pursuant to the
Program to Implement the Spokane County Zoning Code.
9. The provisions of RCW 43.21 C(The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance was issued. The Comm.itt~ee,
after independent review, hereby adopts the DNS.

10. The legal requirements for public notice have been fulfilled.
11. The owners of adjacent lands expressed both approval and disapproval of the
proposed use. Owners of adjacent property expressed concern regarding access to
the site, traffic and congesrion on Sprague and also adequate fire apparatus access.
Concern over compliance with the minimum frontage request was also expressed.
Testimony was presented to attest to the credibility of the applicant and support for
the project.
12. The applicant has demonstrated that condiuons have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified. Specifically, changed conditions include development of commercial use
along Sprague Avenue and availability of public sewer system.
13. The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing agencies.
14. The Committee additionally finds/concludes:
a. That the Planning Department does not support the road frontage variance but
no adverse comments were received by the County Engineer or fire district
concerning access to and from the site which is a primary reason for frontage
requirements of the zone.
b. That adequate provisions will be made for fire apparatus access and the school
district as required by this decision and implemented at the time of building
pemut issuance.
CONDIT'YONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Condirions imposed by the Hearing Examiner Committee shall be binding on the -
"Applicant," which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Conditions of Approval apply to the real property described below:
A portion of Lot 16 Block 1 of McCabe's Home Tracts Subdivision as recorded in
Book 1 of Plats, page 89 in Spokane County, Washington as described;
Lot 16 Block 1 of McCabe's Home Tracts Subdivision EXCEPT the following
portion of Lot 16 begin at the SE corner of said lot 16; thence North along the East
line of said Lot a distance of 213.00 feet; thence West parallel with the South line of
said Lot a distance of 67.46 feet; thence South parallel to East line of sa.id Lot a
distance of 33.00 feet; thence West parallel to South line a distance of 35.00 feet;
thence South parallel with West line of said Lot a distance of 180.00 feet to South line
of Lot 16; thence east along South line a distance of 102.45 feet to the Point of
Beginning.

SPOKANE COUNTY PLANNING DEPARTMENT 1. The proposal shall comply with the Urban Residential -12 (UR-12) zone as amended.
1 a. Approval of a variance for 20 feet of firontage from the 60 feet required in the
Urban Residential-12 (UR-12) zone exempts the zone reclassification of record
from compliance with the mini.mum frontage requirement.
2. The existing structure located on the southern boundary of the lot shall be removed
prior to the issuance of a building permiL
3. The applicant shall develop subject property generally in accordance within the .
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be permitted, including, but not limited to building
location, landscape plans and general allowable uses of the permitted zone. All
variations must conform to regulations set forth in the Spokane County Zoning
Ord.inance, and the original intent of the development plans shall be maintained.
4. A specific landscape plan, planring schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained so that sight d.istance at access points is not obscured or
impaired.
5. Direct light from any exterior area lighting fixture shall not extend over the properry
boundary.
6. The Sgokane County Planning Department shall prepare and record with the
County Auditor a Title Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall
only be released, in full or in part, by the Planning Department. The notice should
be recorded within the same time frame as an appeal and shall provide the
following:
a. At least 10 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Sprague Avenue.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.

HEC Order for ZE-6-93 Page 4 7. The Planning Department shall prepare and record with the Spokane County
Auditor a Tide Notice noting that the property in question is subject to a variety of
special conditions imposed as a result of approval of a land use action. This Title
-Notice shall serve as public nodce of the conditions of approval affecting the
properry in question. The Title Notice should be recorded within the same rime
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Notice shall generally provide as follows:

is the subject of a land use action by a Spokane County Hearing
Body or Administrative Official on April 22, 1993, imposing a
variety of special development conditions. File No. ZN-6-93 and
VE-2-92 is available for inspection and copying in the Spokane
County PIanning Department. .
8. a. The Owner shall negotiate with the Central Valley School I?istrict and submit a
recorded copy of the agreement making provisions for public schools prior to
issuance of a building permit.
b. The Owner shall also notify any potential purchasers who have made an
agreement to purchase property within said rezone site.
c. Voluntary agreements between the Owner and the School District shall confonn to
the requirements of the Revised Code of Washington Chapter 82.02.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior To Issuance Of A Buildzng Pernut Ch I Tse Of The ProaMV As Proposed ;
1. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
2. The applicant shall submit for approval by the Spokane County Engineer, drainage
and access plans.
3. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard u-a.ffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
4. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
5. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construcrion, unless otherwise
approved by the County Engineer.
6. Applicant shall construct a paveri and delineated approach(s) to meet the existing
pavement on Sprague Avenue. -

7. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolurion No. 80-1592 as
amended and are applicable to this proposal.
8. No construction work shall be performed within the existing or proposed public
right-of-way until a pemut has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
9. The County Arterial Road Plan identifies Sprague Avenue as a Principal arterial.
The existing right-of-way width of 110 feet is not consistent with that specified in
the Plan. In order to implement the Arterial Road Plan, in addition to the required
right-of-way dedication, a strip of property 10 feet in width along the Sprague
Avenue frontage shall be set aside in reserve. This property may be acquired by
Spokane County at the time when arterial improvements are made to Sprague
Avenue.
10. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant or the utility is
responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
11. An acceptable turn-around for this development shall be approveti in writing by Fire
District #1 prior to building permit approval.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Applicant shall make connection to public sewer system. Sewer connecrion permit
is required. Plans and specifications are to be reviewed and approved by the
Urilities Depanment.
SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by [the Director of Urilities,
Spokane County.
2. Water service shall be coordinated through the Director of Utilities, Spokane
County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the project, and inciividual service
will be provided to each lot prior to sale. Use of individual on-site sewage d.isposal
systems shall not be authorized.
5. Use of private wells and water systems is prohibited.

SPOKANE COUNTY DIVISION OF BUILDINGS
1. The applicant shall contact the Department of Buildings at the earliest possible stage
of design/development in order to be infornied of code requirements
administeredlenforced by the department, e.g., State Building Code Act
regulations, such as requirements for fire hydrantlflow, fire apparatus access roads,
street address assignment, barrier-free regulations, energy code regulations and
general coordination with other aspects of project implementation.
V'VATER PURVEYOR
1. A water plan and utility easements shall be required.
FIRE DISTRICT NO. 1
1. Provide a turn around as ind.icated on the drawing.
2. Provide one fire hydrant at the entrrance on Sprague prior to franung. If the calculated
fire flow for these buildings is greater than 1500 GPM an addirional on-site hydrant
may be required.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollurion regulations must be met
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related acrivities.
3. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean thesc surfaces.
4. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.
5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e. construcrion waste, etc.)
6. All solid fuel burning devices (wood stoves, pellet stoves, etc...) must comply with
local, state, and federal rules and regularions.
7. Demolition and renovation projects must comply with the requirements of CFR 40, Part
61, Subpart M and SCAPCA Regulation I, Arricle IX. Intent to Demolish forms are
available at the SCAPCA office.
