U60 of the Spokane County Zoning Ordinance requires 9U-feet of frontage. (The applicant has additional frontage through a private easement.) C. F INU INGS UF FACT 1. That the existing land use in the area is Central Park Condominium, si ngl e fami ly resi denti al and vacant. 2. That the Comprehensive Plan designates this area as appropriate for Urban development. 3. 7hat the exi sti ng zoni ng of the property descri bed i n the appl i cati on is Agricultural. 4. That the provisions of RCW 43.21C (The State Envirormental Policy Act) have been complied with, and the Gommittee concurs with the Ueclaration of Non-Significance. 5, That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. The Nearing Examiner Committee finds the proposed use to be in . harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 11. The following are additional findings of fact considered by the Mearing Examiner Committee: U ISCUSS IUN : Skalstad: - The subj ect site is surrounded by similar zoning as that requested for the proposed development. - That the Comprehensi ve P1 an recommends easy access to arteri al s f rom Mul ti pl e Fami 1y Suburban proj ects. - That the Heari ng Exami ner Commi ttee i s concerned about the proposed densi ty of thi s proj ect i n rel ati onshi p to the adj acent densi ty of 12.8 uni ts per acre for the Central Park Condomi ni um project and the uncertai nty of sewers bei ng avai lable to thi s si te. ln addi ti on. the Meari ng Exami ner Commi ttee i s concerned thdt al l owi ng maxi mum densi ty on thi s si te wi thout exi sti ng sewer hook-up may reduce the developer's incentive and the avai 1 abi 1 ity of bonus densi ty i n the future for projects wi th sewer hook-ups. - lt appears that this site is suited for multi-family development but that the issue appears to be that of density. Tennican: - lt is reasonable to understand the applicant's desire to maximize his development potential for this site, but the heari ng Exami ner Commi ttee must al so consi der the rel ated impacts to a neighborhood; i.e., that of a single access point, i ncreased densi ty and traffi c, and the fact of si ngl e fami ly character west of Fancher. Myers: - That i n al 1 probabi 1 i ty the proposed si te woul d not devel op i nto a single family residential area because of land costs aind the adj acent condomi ni um devel opment. - Density would be more compatible at 35 units rather than the requested 40. . - - The health District needs to do proper percolation tests for soil suitability. - If the application is approved, Fancher should be paved. D. Fancher Road shall be paved as requested by the County Engineering Department, i ncl udi ng si dewal ks on Fancher. 3. That resi dents shal l be wi 11 ing to parti ci pate i n a R IU for the improvement of Woodlawn, should someone desire to circulate a petition. 4. 7hat a redesign of the southeast boundary should be contemplated to the proposed building to make it blend into the existing Gentral I'ark's design. ~ . . , LONE KtCLASSIFICATION N0. ZE-13U-84 YARIANCE NU. VE- 1-85 a) CUUNTY pLANNING UtPAk7MtNT 1. That a 15-foot dense landscaped strip and a 6-foot wooden sight-obscuring fence be provided along the west property line. Wi thin the 1 andscape stri p, 12 - 15-foot trees pl anted 25-feet apart shall also be provided. 2. 7he Zoning Administrator shall approve a specific exterior lighting plan for the approved area prior to installation of ' such lighting. (Such plan shall attempt to confine illumination to the area with full consideration to adjacent properties). 3. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Admi ni strator shal 1 be submi tted wi th a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained such that sight distance at'access poi nts i s not obscured or i mpai red. 4. 7he applicant shall develop subject property generally.in accordance within the concept presented to the hearing Examiner Comnittee. Variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, landscape plans, and general al 1 owabl e uses of the permi tted zone. Ai 1 vari ati ons must conform to regul ati ons set forth i n the Spokane County Zoni ng Ordinance. The original intent of the development plans shall be ma1 ntai ned. 5. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permi ts. 6. All current standards of the Multiple Family Suburban Zone, as amended, shall be complied with in the development of this site. 7. 7hat the project is subject to Section 4.16A.050, the Aquifer Se nsitive Area Overlay Zone of the Spokane County Zoning Urdinance, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 4 LUNt KtCLASSIFICATION NU. Pursuant to the provisions of Ghapter 43.21C RCW, the SEPA Guidelines (WAC 197-10) and the Spokane County Envirormental Ordi nance (SCEO a proposed decl arati on of non-si gni fi cance has been issued at least fifteen (15) days prior to this date; the official ftle, written comments and/or public testimony contain information regarding assessment of the proposal's likely significant adverse impacts to the physical environment; a fi ndi ng i s hereby made that no probabl e si gni fi cant adverse impacts upon the phy sical environ ment are anticipated as a resul t of the project; and a fi nal decl arati on of non-significance is hereby to be issued. 12. That the building placement on-site shall be located on the north and east property 1 i nes away from the resi dences on the south and west as far as possible. b) COUNTY ENGINEERING UEPARTMENT Pri or To The Issuance Of A Bui 1 di ng Permi t: 1. Access permits for approaches to the County Road System shall be obtai ned from the Spokane County Engi neer. 2. Applicant shall improve Fancher Road in a manner consistent with Spokane County TYP ICAL roadway secti on No. 1 mi ni mum pavi ng width Access Standard. 3. Roadway improvements along Fancher shall be constructed from the proposed dri veway approach (Pri vate Uri ve access to Fancher) to Eighth Avenue. 4. Applicant shall submit for approval by the Spokane County Lngineer road, drainage, and access plans prior to the issuance of a bui 1 di ng permi t on the property. 5 . . . Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 6. Use of private wells and water systems is prohibited. 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. e) GOUNTY BUILDING AND SAFETY DEPARTMENT 1. The 'si te i s 1 ocated i n Fi re Di stri ct # 1. 2. Fi re hydrants which meet the fi re flow are requi red to-be i nstal 1 ed pri or to ary constructi on. These hydrants shal 1 be placed so that no portion of the building exterior is more than 175 feet from the hydrant. The bottom of the lowest outlet of the hydrant shall be no less than 18 inches above grade. A water plan showing each fire hydrant (specifying the gallons per mi nute for each fi re hydrant) and meeti ng the requi rements i n Chapter 1U.04 of the Uni form Fi re Code i s requi red prj or to constructi on of the water servi ce. Al l requi red f i re protecti on facilities shall be installed and made serviceable prior to and during the time of construction. 3. Where it is desired to have access control gates in residential developments, the following shall apply: The minimum width of roadway, inside of access gate, shall be twelve (12) feet. There shall be at least two (2) such drive approaches where the gates are located. One may be used for vehicles exiting.
