SPOKANE, WA Jeff,• - Thank you sincerely for the time that you spent with Dennis Scott, Shiela Whisler, Dr. Wolf in the offices of Dennis Scott at 10:00 A.M. on Wednesday, January 18, 1998 to review and discuss the above project. INTRODUCTION: As discussed, This letter is a request for a bui(ding permit under Section 14.408 of the Zoning Code of Spokane County to add parking and make ADA accessibility modifications to the above described property. Site plan and Floor Plan drawings are attached with zerox copies of photographs of the existing building. This letter is the result of an inquiry for additional information through the Application for a Building Permit Process. Much research, time and dialogue with the Crisis Pregnancy Center, County Division of Building & Planning and surrounding neighbors has been accomplished to prepare this report. In addition, following is the requested justification for the Crisis Pregnancy Center to occupy the existing building referenced above under the definition of the Community Residential Use as permitted under Section 14.605.020 of the Spokane County Zoning Ordinance. , BACKGROUND: The existing single family residence at Eat 12124 6`hAve. is currently owned by the Pines Baptist Church located on a contiguous site. The residence is approximately 1,026 SF single story wood frame structure with a single car capacity attached garage. A review of the above purposes quite clearly indicates tliat tfie Life Services CPC use strictly itieets ttte purposes of the Zoning Ordinance of Spokane Couiity. (ZC: 14.100.104,pg.1) The CPC use complies with the definition provided in the Zoning Code of Spokane County undec Chapter 14.300, pg.6; Definitions is as follows: - I , . ' . . . _ . PQgG' 4 Mr•. Following is a breakdown of this definition and compliant responses: Atcy Dsvellitrg: The existing building is a dwelling as def ned under ZC;14.300, pg.9; as "a building tliereof designed exclusively for residential purposes on a permanent basis as distinguished form a transient basis and which therefore does not include hotels, motels, dormitories, convalescent homes or accessory buildings or structures. . This is not a medical facility. Tlie above detailed breakdown of the "Community Residential Use" Definition clearly indicates that the Crisis Pregnancy Center is an allowed use in the UR 3.5 Zone with 8 or (ess residents. Tliis Crisis Pregnancy Use is less intensive and less restrictive than a group care facility -490 and boarding home. It does not required near the amount of support services for food deliveries, linen supplies, thus providing a substantially less impact to the surrounding neighborhood. . . _ . PageS Mi•. Jeff Forey, Seitror Bitildi,rg 7eclndciait Mo»day, Febi•rrary 2, 1998 This facility wi(1 be less of a fire hazard ti1an a boarding home or group care facility. The existing building is not large enougii to support the additional proposed uses aliowed under the "Cornmunity Residential Facility" category. The area of this residence is 1,026 SF. The proposed use is consistent with the Urban Designation of the Compreliensive Plan tlle purpose of which is to implement the lower density range of the Urban Category of the Compreiie»sive Plaii. Ttie intent of the UR 3.5 zone is to promote areas of primarily (but not exclusively) single family residential use in an urbanized neigliborhood setting, having a high level of public service. Altliough it is commonly accepted that sleeping is a permitted function in a residence, S~e &d nothing could be found in any of the definitions or terms utilized in the "Community Residential Facility" deficiition expressly requiring a steeping function in aCommunity Residential Facility. If the Community Residentiat Facility definition is interpreted to require a sfeeping fiinction, then please produce that ordinance that etearly and concise(y requires matidatory sleeping within a residence or abode. I» a broader sense, lhis use is a community service Urovided itr ai•esidettce facilitv.. thet•efore a Conrrurnritv Residerrtial Tacililv. Tlie recommetided "Temparary Use I'ermit" was not requested because the definition of a reauest states tllat the Crisis Preeciancv use does not conform to the reQUlations prescribed within the ZoninR Ordinance (Section 14.510). This use complies with the Community Residential Facility Deficiition and the allowed uses within the UR 3.5 & UR 7.0 Zone. COMPLIANCE WITH SURRROUNDING NEIGHBORS: In order to meec the intent of the Zoning Code, a petition was circulated to surrounding neighbors icnmediately adjacent to the site to inform them of the intended use and assure tllat neigliborhood concerns would be satisfied. This petition was submitted to you along with a previous letter arid is also included herein. There were no objections from any of tfie neighbors for the occupancy of the existing residence building. , SUMMARY: -~a Tlte Lrfe Services CPC use n.ssures a batance behveen the need.s o f tlte general nublic for protectiort of the fitie quali o li e in Spokane Countv crnd ilee neerfs o{tlie private pronertv oiviier fur ata ovporiuiiitv to reRSOtiablv rese and belteflt /'roil: the use ortl:eir . proncrtt.
