I have reviewed the site plans regarding any road improvements and the access plan to the
County road system. Following are my comments and revisions needed:
• The proposed three access points on 32"d Avenue are acceptable as to location and
channelization. Bob Brueggeman, Traffic Engineer, confirmed that the driveway
traffic volumes and arterial street conditions warrant that a high-volume approach
style be used rather than just the curb cuts. (See County Std. Plans B-18 & B-18a)
• A construction note needs to be added for the replacement of any broken or settled
curb & sidewalk sections on Pines Road. Better yet, any sections to be replaced
should be pre-identified on the plan.

I've reviewed the drainage report just received and the site drainage plans received back
on August 15th. These items meet or exceed the County stormwater guidelines and are
acceptable for construction.
I did notice that a Type A drywell could be substituted for the Type B one for Basin 4,
and the Type A drywell in the small swale for Basin 7 could be eliminated.
As customary for commercial projects, record drawings will be required for the drainage
system prior to issuance of the Certificate of Occupancy. I may be reached at 477-7257

altered access points to 32^d Avenue and Pines Road.
7. Parking and traffic circulation patterns shall be shown on the site plan along with
the appropriate povement marking and signoge, for approvdl by the Spokane
County Engineer. The arrangement of parking stalls, turning radii, and travel
clearances shall be in accordance with standard traffic engineering practices.
Back-up maneuvers to/from a County arterial are prohibited.
Utility Condition: Permittee is responsible for arranging for all necessary utility
adjustments, relocations, or improvements as required for completion of the
project, including completion of the required road improvements. The
developer needs to contact the purveyors of each affected utility regarding
private service or utility district improvements, and their design standards,
policies, and approvals.
8. Additional Road Information:
The County Arferial Road Plan identifies the abutting and nearby segments of
32"d Avenue as a Principal Arferial and Pines Road as a Minor Arferial. A traffic
study has been requested for this development by Transportation Engineering.

This existinQ student oarkinQ lot will not be reeraded or existing- runoff Datterns chanaes. The existinp- drainaQe svstem is functioninp- as
desip-ned. The runoff currentlv sheet flows to the north end of the site and is trawed in several low snots. Each of these low soots has a
drvwell for disnosal. Re-shaaine the entire north end of the oarkine lot to nrovide `208' area would reouire maior regradinQ and earthwork.

JUSTIFICATION:
The area available for "208" swales is verv nhvsicallv limited on both hip-h school sites. Central Vallev is limited horizontallv due to
existinp- structures. Universitv will be limited bv the Qenerallv flat terrain. Therefore, everv effort is beinQ made bv the desian teams to
reduce the amount of nolluting- surface area that mav come into contact with stormwater. The HVAC units nlaced on the roofs of both new
schools with be self-contained, nre-fabricated units. These structures are assembled to be `leak-nroof" with no externallv mounted
eauiflment. The Aossibilitv of stormwater contamination from materials located inside the structures will be extremelv low. If there is ever
a snill. the thresholds of the unit are constructed to keen nollutants from escanine. Please refer to the attached information and nhotos from

Background
The Central Valley school district is planning to renovate the existing high school facilities
at 8`" & Sullivan. The existing high school building will be demolished and a new school
constructed. The existing gymnasium will remain. Extensive new parking areas and travel
ways are planned in front of and behind the new school complex. The existing lower
- parking lot at the northwest corner of the site is intended to be re-paved by asphalt overlay
only. A gravel access road will be extended along the north property line to service the
existing athletic fields and rear school grounds. This renovation project constitutes
redevelopment or "substantial improvement" of the property as defined in the `GSM'.
A new University High School complex is also being proposed on the large vacant tract
located at the southeast corner of 32"d & Pines. Both sites are located within the ASA
which requires treatment of runoff from developed surfaces subject to contamination.
Deviation Summary
These two design deviations involve storrnwater treatment requirements for both new high
school buildings and the existing lower parking lot at the Central Valley high school site.
Deviations are required for the following specific issues:
1. Continuation of direct discharge to drywells for existing pavement runoff.
2. Direct disposal to drywells of roof areas with HVAC equipment for the new schools.
DEVIATION 1 .
Analysis (See Site Plan)
As stated in the design deviation request, retrofitting the existing lower parking lot with
208 swale treatment would be a difficult proposition due to the existing drainage pattern
and facilities. The parking pavement is shaped into a"cup & valley" pattern with
pavement runoff directly to interior drywells. The overall grade falls toward the north with
the low point at the northwest corner. However, there are at least two possible physical
solutions to provide full or partial stormwater treatment for the parking lot:
1. Pulverize the entire parking lot and re-grade it with uniform slope to the north; and
provide an adequately sized 208 swale off the north end of the new parking lot.
2. Construct one swale at the northwest corner of the site for a portion of the parking
lot runoff, and dig another swale in the low grassy area to the east for the remaining
portion of the lot. The existing drywells would have to be converted to catch basins
by filling and pouring concrete floors above the port levels. The catch basins could
then be inter-connected by shallow ductile iron piping and discharged to the swales.
Impact
Both of the above scenarios would entail significant construction costs and loss of all or
part of the existing outer rank of parking spaces. However, the loss of parking at the
north end of the existing lot could be offset by expanding the existing parking area to the
east. No cost estimate has been provided to relate the drainage and parking lot rework
costs to the overall cost of the high school renovation project, or analysis provided to
determine what degree of compliance is feasible.
Summary
The stormwater guidelines require bringing the existing site up to current development
standards. Meeting the current guidelines at least in some measure is physically possible
utilizing one or some combination of the two identified alternatives. Adequate space
appears available to locate the new swales and offset parking. Added construction costs
are implied in all building codes and development standards, and the saving of these costs
is not in itself justification for non-compliance.
Recommendation
I do not recommend outright approvat of this deviation unless further investigation
reveals that compliance is economically burdensome to the project, or the loss of
parking, lack of suitable space, or grade constraints cannot be reasonably overcome.
I would support approval of partial non-compliance to the degree unfeasible.
DEVIATION 2
The HVAC roof units are hydraulically isolated from precipitation and the storm drainage
system. The units are fully enclosed by an external metal structure that shelters the
working equipment from precipitation. Leakage or bursts of the working fluid from the
inner equipment and lines are contained internally and drained separate to the roof
downspout system. The HVAC units specified fully meet the `GSM' criteria for hydraulic
isolation, and segregation of the roof areas is not necessary. (See specifications provided)
Recommendation
I recommend approval of this deviation with no special conditions.

I am in receipt af }rour fefter dated November 17, 1999 regarding my
approval of the canstruction of a new University High Schaol and the
accompanying zone change. You have asked for a change in ane of the -
conditions relating to a fire lane. The original conditian required #he District
#o construct a paved fire lane fram 32nd Avenue ta 40t~ Avenue in
conforrnance with the site plan vf recvrd. The fire lane vxras suppased to he
designed to meet Fire Distric# standardsv
You s#ate in your letter that the District na longer desires to construc#
the fire lane as shown an the site plan of record, but seeks tv construct a
rnodified fire lane as shown in yellow on a revised site plan you subrnitted
with your ietter. That site plan has been reviewed by the County
Engineering Departm+ent and also by Fire District #1. 1 have contacted
Scott Englehard of County Engineering and Paul Chase of F€re District #1
as per your request, and both of them have agreed to your praposed
modifications. Therefore, I will agree to amend my decisian to mndify that
particular condition. The amended condition #9 wiCl naw read:

Site Description: The site is generally rectangular in shape and relatively flat. 7he north side
and the eazt side of the site are currently in open space. The central-western part af the site is
developed with Chester Elementary Schoal, play fields, and paeking. The sauthwesfern por#ion
of the site is developed wEth Horizon Junlor Nigh and also has parking and play fields. The

bears a substantial relationshio to and will not be detrimental to the public health, safetv and
welfare; and comolies with the Sookane Countv Zonino Code and other aoolicable development
reaulations.
The subject property is located within the Urban category of the Spokane County
Comprehensive Plan. The Urban category is intended to provide the opportunity for
development of a"city like" environment which includes various land uses. As Staff notes in its
report, policy Ianguage under the Urban category states fhat there are few land use activities
which would be inappropriate within the Urban category. Schools are listed specifically as
being compatible with the Urban category. Many uses do require screening or other
performance standards in order to make them compatible with adjoining uses. In addition, sites
designa#ed under the Urban category are to have paved streets and sidewalks, public water,
public sewer, and other public facilities being in place to serve the use proposed. In this case,
the school will be served by paved and sidewalked arterial streets, as well as public water,
sewer, and other public facilities. Staff has analyzed this proposal's compfiance with ihe Urban
category and with the Comprehensive Plan in general, and finds that this proposal is in
compliance. The Hearing Examiner agrees, and hereby incorporates herein the Staff analysis
which is set forth in the Staff Report of the Division of Building and Planning, on pages 5, 6, 7,
and 8.
Staff has also analyzed the proposal's compliance with the Spokane County Zoning
Code, as required by the decision criteria. Schools are a permitted use in the UR-22 zone.
Staff has found that this proposal generally complies, or can comply, with the development
standards of the UR-22 zone, although some modifications may be necessary as more detailed
plans are submitted during the building permit phase. Staff notes that the site will have to have
a six-foot-high, concrete, masonry, or decorative block wall or solid landscaping or site-
obscuring fence along the east property (ine which adjoins a UR-3.5 zone. There is also to be a
20-foot-wide strip of Type III landscaping along the site's frontage on both Pines Road and
32nd Avenue. The total number of parking spots required will be deterrnined at building permit
time, and all driveways and parking areas must be paved and constructed to County standards.
Additional conditions relating to the site and some off-site improvements will also be part of this
decision.
The applicant requested a modification to one of the conditions of approval
recommended by both the Division of Building and Planning and the Division of Engineering
and Roads. That condition relates to the set-aside of a ten-foot strip of property for future
acquisition for road right-of-way and utilitizs along Pines Road. The same requirement applies
to 32nd Avenue but there was no objection to that particular set-aside. The applicant argued
that there is little reason to think that the property south of the school site along Pines Road will
develop to an extent that Pines Road will need widening at any time in the near future. The
land to the south has substantial terrain problems and it is outside of the IUGA. Because the
school site is a narrow site the applicant requested that the a set-aside requirement be deleted.
The Hearing Examiner will include the set-aside requirement as it is written. It does allow the
applicant to use the ten-foot set-aside area for landscaping and other site development but
states that if the road is, in fact, widened, that those improvements must be removed at the
applicant's expense. If the District is right and there is not significant development south of the
site which requires Pines Road to be widened, then there should be no imposition on the
District regarding the removal or relocation of site improvements.
The primary opposition to the rezone proposal was not expressed as opposition to the
high school itself, but to the lack of mitigation for the adjoining neighborhood to the west. Most

people who testifed at the hearing lived in the Midilome Subdivision, located west of the site
across Pines Road. They expressed concern that traffic cutting through their neighborhood,
which they describe as significant already, will increase when the new high school has been
completed and is functional. The School District disagreed but was generally amenable to
helping the neighborhood address its concerns.
Prior to the construction of houses in the Midilome Subdivision, Chester Elernentary
School and Horizon Junior High occupied a portion of the site proposed for rezoning. After the
subdivision was constructed, it appears that people living in the Ponderosa area, south and
west of Bowdish Road and in other areas south of Bowdish Road, would drive north on Bowdish
and then cut across to those two schoofs, using either 37th or 34th Avenues. People living in
the subdivision cited many examples of drivers going too fast through their neighborhood in
order to access Pines Road.
As part of its SEPA analysis for the high school, the District did a traffic study and
analyzed 16 intersections. It determined that 75 percent of the student population attending
University High School would come from areas north of 32nd Avenue and would, therefore,
acczss the site from 32nd Avenue. The District also agreed to have no access from the site on
to Pines Road and only access the site from 32nd Avenue. The School District further agreed
to place two new traffic signals at the intersection of Pines Road and 32nd Avenue and at the
intersection of Bowdish Road and 32nd Avenue. With these signals in place, the District's
engineers have concluded that most traffic from south Bowdish will drive up to the traffic signal
and turn right on 32nd Avenue in order to reach the school rather than,cutting through the
neighborhood. The District's engineers did a travel-time analysis and concluded that traveling
the arterials would be shorter, time wise, than cutting through the neighborhood. The neighbors
disagree with that analysis.
While there was some dispute on traffic counts at various intersections between the
expert employed by the Midilome property owners and the one employed by the District, the
Hearing Examiner accepts the traffic counts which were submitted in to the record after the
hearing was over and which were accepted by the Spokane County Division of Engineering and
Roads. Those numbers show that the intersection of Pines Road with 38th Avenue, Loretta
Drive, and 34th Avenue will still be at acceptable levels of service (B or better) after the
University High School is complefed. The neighbors and their expert do not necessarily take
issue with that fact, but say that their concern is more for the increased trafric through their
neighborhood streets and the speed at which that traffic travels. Whether those three
intersections operate at acceptable levels of service does not address their concerns. The
District feels, however, that it has met its obligations to mitigate traffic by the installation of the
two traffic lights. They have examired other ways of reducing the speed of traffic within the
Midilome Subdivision through the use of "calming" devices, but nothing has been fina(ized.
The possible consstruction of various "calming" devices and they are used was
introduced into evidence at the public hearing on this matter. There ciearly are ways in which to
slow down traffic that is cutting through this neighborhood. Ideally, if traffic can be slowed
enough, the drivers will opt to continue north on Bowdish to the stop light at 32nd Avenue rather
than take the time to cut through the neighborhood. While street closures have been
suggested by various neighbors, other neighbors, who testified at the public hearing, opposed
the street closures citing the inconvenience in trying to access Pines Road and the two existing
schools. The Fire District also was opposed to the closure for emergency access reasons,
although the neighborhood's expert testified that the closure could be designed in such a way
as to allow emergzncy vehicles to pass through.

The Hearing Examiner does not believe that he has authority to order any street
closures or even to order traffic calming devices. The Examiner is, however, sympaiheiic with
the neighborhood and would like to see the parties develop a way to make cutting through the
neighborhood unappealing. Therefore, the Hearing Examiner will include a condition of
approval which requires the County, the School District, and the neighborhood to explore, to the
greatest extent possible, whatever traffic calming devices are available in order to signiricantly
slow down traffic cutting through the neighborhood and thereby, hopefully, eliminate some of
that traffic. No decision is being made on who will fund any agreed upon devices. That will
have to be dAcided by the parties to the discussions, but the discussions themselves arc the
important first step.
There was also testimony regarding the extension of 40th Avenue through to Pines
Road from the west. 40th Avenue was shown on various plat maps as an arterial going through
to Pines Road from Bowdish, but is no longer in the plans. More recent platting and the
development of a golf course have, essentially, eliminated the possibility of the construction of
40th Avenue. Further, although it apparen"Lly is still in the Arte~ial _Road Plan, a S#aff person
from the Division of Engineering and Roads testified that drainage problems and other
construction problems make 40th Avenue unfeasible and it will probably never be built.
Therefore, other solutions to cut-through traffic must be developed.
3. Conditions in the area in which the orooertv is located have chanqed substantiallv since the propertv was last zoned.
Since this zone change is consistent with tne Urban Category of the Comprehensive Plan,
changed conditions are not'viewed as a strong requirement for a zone change. However, there
are some changed conditions in the record which would support this zone change. The School District testified that the District population is moving eastward so that the current University
High School is no longer well located. Further, the current University High School is on a site,
in the middle of a residential area~ which is too small and expansion would be very difficult. The
District purchased the current site in 1991 for the purpose of building a new high school. It is
much better located than the current site, and is sized to fit the District's needs. There was a
bond issue placed on the ballot by the District and the residenfs of the District passed that bond
issue, fiunding this project for this site. Further, 32nd Avenue has been improved as an arterial,
which means it will carry increasing amounts of traffic so that this site may not be as
appropriate for UR-3.5 single-family-type development. Having the high school on an ar'terial is
certainly a benefit to the public. These changed conditions are sufficient in this case to satisfiy
this particular criterion.
III. DEClS10N
Based on the Findings and Conclusions above, it is the decision of the Hearing
Examiner to approve the proposed zone change subject to the conditions listed below.
Failure to comply with the conditions of this approval may result in revocation of this
approval by the Hearing ExaminAr. This approval does not waive the applicant's obligation to
comply with all other requirements of other agencies with jurisdiction over land development.
HEARING EXAMINER CONDITION
1. The applicant, Central Valley School District, shall initiate and use its best efforts to assist
the Midilome Subdivision Neighborhood Association in working with Spokane County to
minimize the amount of traffic which cuts through that neighborhood. This includes the

Proposed jJniversity High School
Project Description:
The proposed University High School site is located on the southeast corner of the 32"d Avenue
and Pines Road intersection in the Spokane Valley. Currently, this site is undeveloped. The new
school campus will not be located on the present University High School site. Chester
Elementary and Horizon Junior High School are located just to the south. The Midlome East lst
Addition subdivision is located directly to the east. See Attachment "A" for a detailed vicinity
map.
The proposed high school will include a new 162,500 square foot building, approximately 7
acres of new asphalt parking, and 25 acres of new athletic fields.
Soils
Soils are classified as GmB - Garrison very gravelly loam, in accordance with the "Soil Survey,
Spokane County Washington, 1968". See Soils Map, Attachment "B".
GmB - Garrison very gravelly loam, 0 to 8% slopes, very gravelly surface, medium
. textured, somewhat excessively drained soils.
This soil is acceptable for drywell use per the Spokane County Standards.
Topographic Data:
The majority of the site is very flat, with grades varying from near flat to 5%. See the Grading
Plans for more detailed contour information.
Methodology:
The procedures outlined in the "Guidelines for Stormwater Management" (GSM), as published
by Spokane County, were followed for this analysis. The Rational Method with a 10-year return
frequency was used for on-site drainage. No off site drainage will flow on-site.
The rainfall intensity data used in this analysis was taken from Figure 2, page 6-3 of GSM. A
10-year event produced an intensity of 3.18 in/hr for duration's less than 5 minutes.
Storage calculations were performed using the Bowstring Method. Spokane County Standard
Type "A" and "B" Drywells have been used within each new basin. In conformance with

. Spokane County Standards, a'I'ype "A" drywell will dispose of 0.3 cfs, while a Type "B"
Drywell will dispose of 1.0 cfs.
1Vlethods of Treatment:
This project is located within the "Aquifer Sensitive Area". Therefore, sodded drainage swales
will be installed to provide for treatment of the first '/2" of runoff that is generated by the asphalt
plus any adjacent sidewalks. The swale treatment area required at a 6" depth is provided in the
bottom area of the drainage swales. Maximum three to one (3:1) sideslopes have been used on
the swales with a minimum one foot overall depth.
The roof top mechanical units will be self-contained and will not be considered as a pollutant
source. A design deviation has previously been approved to allow the roof runoff to be piped
directly to drywells for disposal.
1Vlethods of Runoff Control:
The runoff generated from the new high school site will be contained within nine (9) on-site
basins. Three additional basins will contain the runoff from the improvements to the Chester
Elementary and Horizon Parking lots. Basin 1 includes all of the main building roof area. Each
of the other basins contains a mixture of asphalt, sidewalk, and open space.

Chester Elementary, and the new basin for Horizon Junior High:
