A) For any new impervious surface area a drainage plan for the site shall be prepared in compliance with Spokane County "Guidelines for Stormwater Management". At a minimum the plan must.contain: 1. Drainage calculations for stormwater volumes generated on site. 2. Calculations for total impervious surfaces contained within the site. 3. Finished grade elevations for structures to be constructed on site. 4. Finished grade elevations at the top and bottom of the 208 swale. 5. A typical cross section of the 208 swale. 6. Calculations to justify the number and type of drywells proposed. 7. Elevation of drywell iniets where applicable. 8. Copy of the proposed landscape plan. PROPOSAL The sponsor, Ralph Guthrie, is requesting approval of a Preliminary Plat of PE-1464-84, TEDROW ADDITION, and Zone Change ZE-64-84, Agricultural Suburban to R-1 and MFS, to divide 4 acres into 3-1ots being two lots adjacent 4th Avenue for the existing single-family dwelling(s), and the multiple-family lot will be adjacent the vacated Railroad Right-of-Way of 3+ acres for S multiple-family structures and change the existing zoning from Agricultural Suburban to R-1 and MFS, and there being present, the following applicant or representative: ' Art Noll C. FINDINGS OF FACT 1. That the proposal and inf orm,ation presented in the STAFF REPORT was considered. 2. That the Comprehensive Plan designates this area as URBAN at "Commercial Transition". 3. That the proposal is within the Priority Sewer Service Area (PSSA) boundary. That L ot 3 will require a single sewer pipe to 4th Avenue as required pursuant the provisions for "double plumbing" for Lot 3. ' 4. That the owners of adjacent lands ex pressed disapproval of this proposed use, as the density too higti, increased traffic on 4th Avenue, inadequate parking, land-use compatibility, adjacent animal . keeping, traffic patterns, crime rate, property taxes, pedestrian saf ety, existing single-family area, change of lifestyle, f encing, . and others. 5. That the proposal is adjacent an established single-family neighbor- hood with undeveloped lands adjacent the abandoned railroad right-of- way, which is the "Commercial transition" boundary. 6. That 1.5 parking spaces per dwelling unit of the original SO unit proposal did not provide f or guest parking,(which should be provided while maintaining the no parking provisions on the private driveway). • 8. That the character of the area would be substantially changed with 50 dwelling units on Lot 3 and should be reduced to "somewhere between . MFS and R-2 densities". ' 9. That the matter was continued to allow the sponsor time to submit a redesign to lessen the density to make the proposal more compatible with the existing residential area. 10. That the proposal does comply with the purpose and intent of the Comprehensive Plan decision guidelines for "fill-in" development and compatible land uses, as revised and as conditioned. 11. That the sponsor did submit a Redesign on June 22, 1984 to the County Planning Department which reduced the dwelling units on Lot 3 from SO to 40 or a 20% reduction. 12. That the redesign of Lot 3, as conditioned, does reduce the traffic onto 4th Avenue by 20%. does provide for a more compatible land-use transition from single-family to the south and the restricted industrial to the north by providiag 5 apartments with only 10% building coverage and 90% open area, does provide 15 additional 'parking spaces for guest parking above the required 1.5 per dwelling unit, and does provide for 6 ft. fenciag around Lot 3. 13. That Lot 3(with 131,717 sq. ft.) would allow 12 duplex es or 24 dwelling units with the existing Agricultural Suburban zoning or with R-2 zoning and would allow f or 66 dwelling units with MFS Zoning; therefore, the revised proposal of 40 dwelling units does fall between MFS and R-2 densities. 14. That the abandoaed railroad right-of-way is not designated as a public roadway and 4th Avenue is designated as a"Collector Arterial" that will be improved to said arterial standards when the traff ic increases to warrant the improvemeats. 15. That the provisions of ftCW 43.21C (The State Environmental Policy Act) have been complied with. 16. That additi onal access to Bowdish or Uni on was considered as an . issue raised by testimony but was not a condition of approval; that the committee encouraged adjacent property owners to work with the sponsor for such access via a"Change-of-Condition" hearing. The plot plan entitled "Revised-Plot Plan 6-22-84" is hereby approved as part of said preliminary plat. 3. (amend to read) That the preliminary plat be given conditional approval for three (3) years to July 1, 1987. The applicant may request an Extention-of -Time by submitting a written request f orty-five (45) days prior to the above expiration date. Such .applications should demonstrate the progress made toward finalizing this preliminary plat. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health authorities prior to•application for building permits within said final plat. The arrangements or agreements will include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. The final plat dedication will contain the following statement: "the public water system, pursuant the WATER PLAN approved by County and State Health authorities, the local fire district, County Building & Safety Department, and water purveyor, will be installed within this plat, and the subdivider/sponsor will provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building per.mit for each lot." 10. That no building permit will be issued for any lot within the Final Plat until certified by a Washington State licensed engineer "that the water system has been installed pursuant the approved WATER PLAiN for the Final Plat", signed and stamped by said engineer. The certification may be in the form of a letter but is preferred to be certified on a copy of said WATER PLAiN as a schematic map showing the "As Built" water system. 11. That a current certificate of title be furnished the Planning Department prior to the f iling of the f inal plat. 12. That the following statement be placed in the final plat dedication: "no more than one dwelling be placed on Lor 1 and 2 nor shall any lot be further subdivided for the purpose of creating additional lots, separate ownerships, or building sites without first filing a replat." 13. That prior to issuance of a building permit on Lot 3 f or MFS uses, the applicant shall: a. obtain from the County Engineer access permits for an approach to the County Road System, and b. submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a building permit on the property. c. submit for approval by the Spokane County E ngineer and the Spokane County Health District a'detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. . d, submit a parking plan and traffic circulation plan for approval by the Spokane County Engineer and County Subdivision Administrator prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices.
