a a roof containing HVAC machinery, a drainage plan

a. The County Comprehensive Plan identif ies the
South Valley Arterial as a Principal Arterial controlled access
, high capacity facility. In order to implement the Arterial Road
; Plan an additional 0 feet of right of way on the west to 10 feet
of right of way on the east would be necessary. This is not a
condition of your permit, the County Engineers office is only
disclosing to you a future need. Spokane County is willing to
purchase this property to have adequate right of way to implement
these arterial improvements.
b. A parking and traffic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
. any portion of the project which is to be occupied or traveled by
vehicles.
E) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
F) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Off ice. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
Only after all the information and requirements listed above
are supplied or completed and the necessary review has been
~ accomplished will your building permit be released.

A. INTRODUCTION

B. PROPOSAL
The sponsor, Radiology Associates, is requesting approval of a zone
reclassification, File No. ZE-11-86, Multiple Family Suburban to Urban
Resi denti al 22 ( UR-22) Zone (wi th Seaver f3onus Densi ty), for the purpose of
developing a 116-Unit Apartment Complex.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential (single family
and apartments), commercial, sewer trunk line, animal raising, and
vaca nt .
2. That the Comprehensive Plan designates this area as approoriate for
Suburban development.
3. That the existing zoning of the property desc ribed in the apnlication
i s Multi pl e Fami 1y Suburban.
4. That the provisions of RCt,! 43.21C (The State Enviranmental Policy
Act) have been complied with,-and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area is siaitable for the proposed use, or
uses within the proposed Zone Classification.
7. That the applicant has demanstrated that conditions have substantially changed since the original zoning of this area and
accordingly, the proposed rezone is justified.
8. That the proposed use is compatible with existing uses in the

b) That an apartment complex designed witn parking within the
interior tends to Iiave less of a noise impact upon adjacent uses

project prior to release of building permits. Landscaping shall
be installed and maintained such that sight ciistance at access
points is not obscured or impaired.
4. The applicant shall develop subject property generally in
accordance ►,rithin the cancept presented to the Hearing Examiner
Commi ttee. Va ri ati ons ►vhen approved by the Zona ng lldmi ni strator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
, Ordinance. The oriqinal intent of the development plans shall
be maintained. 5. The specific development plan will be submitted for Planning
Department revi ew and approval pri or to i ssuance of bui 1 di ng
permi ts.
6. Al1 current standards of the UR-22 Zone, as amended, shall be
complied with in tiie development of this site.
7. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay
Zone) of the Spokane County Zoning Qrdinance. Accordingly, as a
condition of approval, the sponsor/applicant shall be required
to fi 1 e wi th the Spokane County Audi tor, wi thi n thi rty (3Q) days
of the signing of Findings and Order of the final decision in
this matter, a"Notice to the Public" which shall provide in
material as follows:

8. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
9. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spolcane County
Commissioners' Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements, or file
appropriate documents to tne effect tnat tfie iJOTICE OF ACTION is
waived in accordance with Spokane County Commissioners'
Resolution #82-0458 dated May 4, 1982.
10. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
11. That the struc tures be set back 25-feet from the east property
line, and this yard area be maintained in Type III landscaping.
12. Ttiat a b-foot sight-obscuring fence be provided along the east
property line.
b) COUiJTY ENGINEERING DEPARTMEWI~
Prior To The Issuance Of A Building Permit:
. l. Applicant shall dedicate 10 feet on Fourth Avenue for
right-of-way prior to any use of the property.
2. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
3. Applicant shall improve Fourth Avenue in a manner consistent
with Spokane County TYPICAL roadway section No. 1 minimum paving
width Access Street Standard.
4. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.
5. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any .
building permit on the property.

6. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
requi red for any porti on of the project w'nicn i s to be occupi ed
or traveled by vehicles.
7. The word "applicant" shall include tne owner or owners of tile
property, his heirs, assigns, and successors.
II. The construction of the road improvements stated hereiii shall be
accomplished as approved by the Spokane County Engineer.
9. All required improvements snall conform to the current State of
Washington Standard Specifications for Road and Sridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
10. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
c) COUNTY UTILITIES DEPARTMENT
l. The owner(s) or Successor(s) in interest agree to authorize tne
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or SuCCessor(s) f rom
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Cnapter
36.94.
2. Any water service for this project shall be provided in
accordance,with the Coordinated Water System Plan for Spokane
County, as amended. 3. A sewer connection to the Spokane Valley Sewerage System is to
be constructed. Plans and specifications for the dry sewer
connection are to be reviewed and approved ny the Utilities
Department prior to construction. A sewer connection permit is
required.
4. A developer connection Agreement is to be executed prior to
having a sewer connection permit issued.

d) COUNTY HEALTH DISTRICT
l. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
2. "A publ i c sewer systein wi 11 be made avai 1 abl e for the project
and individual service will be provided to the lot prior to
sale. Use of individual on-site sewage disposal systems shall
not be authorized."
3. Water service sliall be coordinated through the Director of
Uti 1 i ti es , Spokane County.
4. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Departrnent of
Social and Healtn Services,
5, Use of private wells and water systems is prohibited.
e) COUNTY BU I LD I NG AND SAFETY DEPARTME NT
l, The site is located in Fire District #1.
2. Approved numbers or addresses shall be plat-cd on all new and
existing buildings in such a position as to be plainly visible
and legible from the street or road fironting the property. Said
numbers shall contrast with their background.
3. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
4. Building permits will be required for each structure.
5. Where it is desired to have access control gates in residential
developments, the following shall apply:The rninimum width of
roadway, inside of access gate, shall be twelve (12) feet.
There shall be at least two (2) such drive approaches where the
gates are 1 ocated. One may be used for vehi cl es exi ti ng. Ti re
flatting spikes shall not be used unless the entrance is a
minimum of twenty (20) feet wide. The gates shall be provided
with an approved method of emergency operation in accordance
with the fire department standards. Where each drive approach
is less than twenty (20) f2et in width and controlled by gates,
a secondary means of access shall be provided with a clear,
twenty (20) foot unobstructed opening. 6

e) COUNTY BUILDING AND SAFETY DEPARTMENT (continued)
6. Fire hy drants wnicli meet the fire flow are required to be
installed prior to any construction. These hydrants shall be
placed so that.no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of
. tne hydrant shall be no less than 18 inches aoove grade. A
water plan showing each fire hydrant (specifying the gallons per
minute fo-r each fire Iiydrant) and meeting the requirements in
Cnapter 10.04 of the Uniform Fire Code is required prior to
construction of the water service. All required fire protection
facilities shall be installed and made serviceable prior to and
during the time of construction.
f ) WATER PURVEYOR
1, Water Purveyor is Vera Water and Power, and they will supply tne
site with adequate water for domestic, fire and irrigation uses,
although satisfactory arrangements have not been made.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
All air pollution regulations must be met. This includes but is not
limited to the following:
1. .Hir pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weatlier conditions. Naul
roads snould be treated and emissions from the transfer of
eartfien i-Daterial must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occu~r on paved surfaces, measures must be taken i inmedi ately to cl ean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. It has oeen determined that fireplaces and wood stoves are a
significant source of suspended particulates. The small
particles lOmicrons) are respirable and can have an adverse
effect upon the health of the public. We strongly urge that if
wood stoves/fireplaces are used, that burning be done as
efficiently as possible. All wood should be seasoned and stored -
in a dry place. During periods of poor ventilation or elevated
air pollution levels, we request that use of wood stoves and
fireplaces be discontinued.
5. Some objectionable odors will likely result during the
constructi on phase of the proj ect and from motor vehi cl es usi ng
the site following completion of the project and from occupants
of the proposed project.
