The County Engineering Department has completed a review of
the above referenced project. The following information must be provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action: ~
Spokane County Zone Change No. ZE-24-86
C} The following improvements within adjacent Right of way
are required prior to the release of a building permit:
l. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. 4th Avenue, Typical Roadway Section No. 1,
Access Standard.
b. Fancher Road, Typical Roadway Section No. 1,
Access Standard.
All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.

2. As an alternative to the required road improvements
the County will accept an RID/CRP agreement
"Notice to Public No. 6" on 4th Avenue, and Fancher
Road.
3. Applicant shall dedicate a 20 foot radius on
Fancher Road and 4th Avenue. .
4. Please submit a copy of a recorded property deed
from the Auditors office for the subject property.
Upon receipt of the deed our staff will prepare the
right of way deed and/or the RID/CRP agreement.
5. Approach permits must be obtained, after a site
plan has been approved, and before the issuance of
a building permit, from the County Engineering
Department for any new or improved driveway
approaches to the following streets: .
a. 4th Avenue
D) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
l. Site Plan.
2. Drainage plan as specified.
3. Other information:
a. A parking and traffic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles. It is illegal to back out onto the Right of Way.
b. There shall be no access to Fancher Road until
it is constructed to County standards and established as a County
Road.
E) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
F) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.

The applicant or his representative has been given a minimum
requirements list. This list is not inclusive of all the
requirements needed but should be used as a minimum guideline.
Without the "minimum" requirements the Engineers Department may
not be able to perform a complete review of the project and could
result in prolonging the period before permit issuance. Only
after all the information and requirements listed above are
supplied or completed and the necessary review has been
accomplished will your building permit be released.

After phone conversations with Mr. Ray Moon and Mr. Clhris Green to discuss Agreements issued for Signature by the Spokane Engineer-
ing Department, Namely No. 6(R:I.D. waiver Agreement) and Right of •
Way Deed, It is our Understanding that:
1) These typesof agreements are common and are required between
the Spokane County Engineering Department and the Applicant (property:
Owner)'for issuing building permits.
. 2). These agreements are not mean't to be a hardship on the appli-
cant (property Owner). .
3) The R.I.D. is enforceable only if property owners sharing a
common road desire, repairs or improvements prior to County initiated
repairs or improvements and available funding for said repairs or im-
provements or improvements from the County, State or Federal Levels.
Furthermore, it is our understanding thatthe County may not initiate
or engage raod repairs or improvements through County funded projects
and pass those costs on to adjacent property owners throught the
R.I.D. agreement.
4) The R.ID. Waiver Agreement and tlie Rxght of Way Deed are signed
with the above understandings and in obtaining the Building Permit(s)
applied for.

EnvirQnmental Checklist for File No. 94007~92 Following is a list of concernsfissues that, at a minimum, need to be addressed for this project.
SCAPCA encourages proponentis to contact their offices at 1101 West College, Spokane, WA
99201 for $dditional information.
* All air pollution regulations must be met.
~ Air poliution regulations require that dust emissions during demalition, construction and
excavation projects be controlled. This may require the use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads should
be treated and emissions firom the transfer of earthen materiat must be controlled as well
as emissions from all other construction related activities.
SCAPCA strongly recommends that all travelled surfaces (i.e., ingress, egress, parking
areas, access roeds) be paved and kept clean to minimize dust emissions.
* Measures must be taken to avoid the dsposition of dirt end mud from unpaved surfaces
onto paved surfaces. tf tracking or spills occur on paved surfaces, measures must be
taken immediately to clean these surfaces. •
* SCAPCA Regulation I, Article V requires that a Notice of Construction snd Application for
Approvel be submitted to and approved by our Agency prior to the construction,
installation or establishment of an air pollution source. This includes eny fuel fired
equipment rated at greater than 400,000 BTUlhour (boilers, hot water heaters, ovens,
etc...). It also includes paint booths, and other sources of air eontaminants.
* SCAPCA Regulation I, Article IV may require registration with this agency.
~ Qebris generated as a result of this project must be disposed of by means other than
burning li.e., canstruction waste, etc...).

A Addition of 5100 SF to existing facility.
6 This facility is being built on an area that is currently paved with an asphaltic material. The existing
paved area drains to two [2] existing drywells [noted on Architect's Drawing A-1.11
C The new addition will receive a standing seam metal roof. Half of the new roof will drain into the
existing drywells, and one half of the roof will drain to the south on an existing gravelled area.
1 Essentially - with this construction - we are removing 1/2 of the area covered by this building
from draining into the existing drywells.
2 This project will eliminate the area of the building which currently drains over an asphaltic paved
surface from running into the existing drywells by replacing that asphaltic paved surtace with a
standing seam metal surface.

and successor(e) in intereat hereby agree to authorize Spokane County to place their
na.rne(s) on a oetition for the formation of a Road•Improvement Dletrict (RID) by the
petition method pursuant to Chapter 36.88 FtCW, which petition includee the owner(e)
p:ooerty, and further not to object, by the signing of a ballot, or not to prote8t
to the formation of a RID by the reaolution method pureuant to Chapter 36.88 RCW,
which reeolution includee the owner(s) property. If a RID ia'formed by either the
petition or re8olution method, se provided for in Chapter 36.88 RCW, the owner(e) or
successor(s) further agrees (1) that the improvementa or cona'truction contiemplated
within the proposed RID are feasible, 12) that the benefita to be derived from the
formation of the RID by the property included therein, together with the amount of
any county participation, exceeda the coet and expense of formation of the RIO, and
(3) that the property within the proposed RID ie aufficiantily developed. Provided,
further, the owner(e) or eucceseor(s) shall retain thv right,' as authorized under
Rcw 36.88.090, to object to any aeaeaement(e) on the property ae a reeult of the
improvements called for in conjunetioci with the formation of a RID by either the
petit{on or , resolution method undei: Chapter 36.88 RCW and to appeal to the Superior
Cou=t the decieion of the 8oardof County Commiseioners affirming the final
assessment roll. '
It is further agreed that at such time ae an RID ie created or any Road Improvement
Project fe eanctidned by Spokane County, the improvemente required (curb, eidewalk,
drainage control and p2.ving to exiating pavement) ehall be at the sole expenae of
the undersigned owner, their heirs, grantees and assigns without any mone.tua-ey
participati-on by Spokane County. The RID waiver ccntained in this agreement shall expire after ten (10) years from
the date of execution below. However, at the expiration date the owner(e) or
succe8sor(s) agree to construct the required improvemants at their own expeneel pay
to Sookane County the then estimated coat of the reqvired improvementa to enable the
county to complete the eamel or furnieh a'bond or other eecure method euitable to'
the County, providing for or securing°:*to~-the County*the actual construction of the
imorovements. ' : . The above conditions and covenant apply to the following described property:
Lots 1 through 24, Block 2 of CENTRAL PARK ADDITION, as per plat thereof rec-
orded in Volume "C" of Plats, Page 14, including vacated 5th Avenue lying be-
tween said Block 2 and Block 3 of said CENTRAL PARK ADDITION and the West Half

After phone conversations with Mr. Ray Moon and Mr. ahris Green
to discuss Agreements issued for Signature by the Spokane Engineer-
ing Department, Namely No. 6(R:I.D. Waiver Agreement) and Right of •
Way Deed, It is our Understanding that:
1) These types of agreements are common and are required between
the Spokane County Engineering Department and the Applicant (property:
Owner) for issuing building permits.
. 2). These agreements are not mean't to be a hardship on the appli-
cant (property Owner).
3) The R.I.D. is enforceable only if property owners sharing a
common road desire, repairs or improvements prior to County initiated
repairs or improvements and available funding for said repairs or im-
provements or improvements from the County, State or Federal Levels.
Furthermore, it is our understanding thatthe County may not initiate
or engage raod repairs or improvements through County funded projects
and pass those costs on to adjacent property owners throught the
R.I.D. agreement.
4) The R.ID. Waiver Agreement and the Right of Way Deed are signed
with the above understandings and in obtaining the Building Permit(s)
applied for.

HEARING EXAMINER COMr-1ITTEE
FINDINGS AND ORDER
A. IfVTKODUCTIOy
This matter having come before the Zoning Hearing Examiner Committee on
Nugust 7, 1985, and the members of the Committee present being
Phillip D. Harris, Chairman, Ron Odell and Gary N. Anderberg.
B. PROPOSAL
The sponsor, Central Park Development, is requesting approval of a zone
reclassification, File No. ZE-24-86, Agricultural to Community Business
(B-2), for the purpose of continuing the existing Recreation Club and
future Retail Uses.
C. FINDINGS OF FACT
l. That the existing land use in the area is Recreation Club,
residential (single f amily, apartments and manufactured home park),
rnoving/storaye company, R-V Park, drive-in theater, and open area.
2. That the Comprehensive Plan designates this area as appropriate f or
Urban development.
3. That the existing zoning of the property described in the application
is Agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Deterinination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfi 1 led.
d. That the land in this area is suitable for the proposed use, or
uses within the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area nd
accordingly, the proposed rezone is justified.

8. That the proposed use is compatible with existing uses in the
area.
9. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
lU. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrirnental to the pu51 ic healtn, safety, and welfare.
11. The followiny are additional findings of fact considered 5y the
Hearing Examiner Committee:
a) That the existing recreational facility has been a good neighbor
in the community. The required landscaping is necessary to
provide a buffer along the north and west property lines.
D. CONDITIONS OR CONTINGENCIES APPLIEO TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
l. That the applicant shall provide the required landscaping prior to
final approval of the zone change to B-Z. The Zoning Administrator
shall inspect the property for compliance of this condition. Upon
completion of the required landscaping, the Zoning Adininistrator
shall change the zoning of the property to Community Business (B-2).

a) COUNTY PLANNING DEPART14ENT
l. Al1 current standards of the Community Business (a-Z) Zone, as
amended, shall be complied with in the development of this site.
2. That the project is subject to Section 7.06, the Aquifer
Sensitive Area Overlay Zone of the ZONING CODE FOR SPOKANE
COUNTY, which sets forth various measures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection rneasures, and stormwater runoff.
3. Applicant shall coinply with '208' recommendations concerning
stor;nwater runoff and provide necessary landscaping for runof,f.
4. Any division of land f or the purpose of sale, lease or transf er,
shall coiiply witn RCW '08-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
5. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements, or file
appropriate documents to the effect that the NOTICE OF KCTIOiV is
waived in accordance witn Spokane County Commissioners'
Resolution #82-0458 dated May 4, 1982.
6. That within three rnonths of this approval (Novembzr 7, 1986),
the applicant shall install the required B-2 landscaping along
4tn Avenue and along Fancher Road f or the full length of the
existing improvements. Specifically, this will require
compliance witn Section 6.26.350, 6.26.3655 8.02.240-(3) and
8.06.040-(2-b) of the Zoning Code of Spokane County.
7. That future expansions to the site will be processed as-follows:
a) Any expansion of the existing recreation club will be
reviewed adrninistratively.
b) Any use of the site, other tnan the recreation club, will
be contingent upon its impact to the traffic hazard at 4th
Avenue and Eastern Road. If the situation can be resolved
by the applicant and the County Engineer, then review of
tne proposed use can be administrative by the Zoning
Administrator. If the problem can't be mutually resolved,
then a public hearing review of the proposed use and site
plan will be required.

b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit:
l. Applicant shall dedicate a 20 foot radius on Fancher Road and
4tn Avenue prior to any use of the property.
2. Access perrnits for approaches to the County Road System shall be
obtained f rom tne Spokane County Engineer.
3. The County Engineer has designated Typical Roadway Section
Nuinber One, Access standard for the improvei-nent of 4th Avenue
which is adjacent to the proposed development. This will
require the addition of sidewalk along the f rontage of the
development.
4. The County Engineer has designated Typical Roadway Section
Number One, Access standard for the improvernent of Fancher Road
which is adjacent to the proposed developrnent. This will
require the addition of approximately 24 to 30 feet of asphalt,
curb and sidewalk along the f rontage of the development.
Applicant may participate in a County Road Improvernent District
for the construction of tnese improvements. Should Fancher Road
be utilized for access to the development, it will be necessary
for the applicant to construct the specified roadway improvement
prior to release of a building permit.
There shall be no access to rancher Road until it is constructed
to County standards and established as a County road.
5. Applicant shall submit f or approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.
6. The applicant shall submit for approval by the Spolcane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any
building permit on the property.
7. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
8. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.

9. To construct the road improvements stated herein, the applicant
may, with the approval of tne County Engineer, join in and be a
willing participant in any petition or resolution which purpose
is the forination of a Road Improvement District (RID) for said
- iinprovernent pursuant to RCW 36.88, as amended. Spoicane County
will not participate in the cost of these improvements.
10. As an alternative method of constructing the road improvement
stated herein, the applicant may, with the approval of the
County Engineer, accomplish the road improvements stated herein
by joining and participating in a County Koad Project (CRP) to
the ext2nt of tne required road improveiiient. Spokane County
will not participate in the cost of these improvements.
11. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
12. All required irnprovements shall conform to the current State of
Washington Standard Specifications f or Road and aridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and S-tormwater
Management in effect at the date of construction, unless
otiierwise approved by the County Engineer.
13. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
c) COUidTY UTILITIES DEPARTMENT
l. The Owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition inethod pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 wnich includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) f rom
objection to any assessment(s) on the property as a result of
irnprovements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
2. Any water service for tnis project shall be provided in
accvrdance with the Coordinated Water System Plan for Spokane
County, as amended.
3. That with issusance of a building permit for furtner addition to
the site, the entire complex shall be required to make
connection to the Ualley Sewer system. Sewer Connection
agreement and permit required.

d) COUfVTY HEALTH U I STKI CT
1. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
2. A public sewer system will be made available f or the entire
project property prior to any expansion on the subject
property. Use of individual on-site sewage disposal systems
shall not be authorized.
3. Water service shall be coordinated through the Director of
Utilities, Spokane County.
4. Water service snall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Healtii Services.
5. Use of private wells and water systems is prohibited.
e) COUNTY BUILDINu AND SAFETY DEPARTMENT
l. The site is located in rire District # l.

f ) WATEk PURVtYOR
l. Water Purveyor is Spokane Suburban Water, and they are supplying
the site with adequate water for domestic, fire and irrigation
uses.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
All air pollution regulations must be rnet. This includes but is not
limited to the following:
1. Air pollution regulations require tnat dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of vrater sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions f rom tne transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
frorn unpaved surfaces onto paved surfaces. If tracicing or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.

g) COUNTY AIR POLLUTION CONTROL AUTHORITY (continued)
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the
construction phase of the project and f rom motor vehicles using
the site'following completion of the project and from occupants
of the proposed project.
E. ORDER
The Zoning Hearing Examiner Committee, pursuant to the aforementioned,
finds that the application of Central Park Development, f or a zone
reclassification as described in the application should be APPROVED to tne
COMMUNITY BUSINESS (B-2) ZONE.

The County Engineering Department has completed a review of
the above referenced project. The following information must be -
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stormwater volumes
generated on site.
2. Calculations for total impervious surfaces
contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
drywells proposed.
7. Elevation of drywell inlets where applicable.
8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Spokane County Zone Change No. ZE-24-86
C) The following improvements within adjacent Right of Way
are required prior to the release of a building permit:
1. You must submit road and drainage plans for street
improvements. These must be prepared by an
engineer. Plans must be prepared for the following
streets:
a. 4th Avenue, Typical Roadway Section No. 1,
Access Standard.
b. Fancher Road, Typical Roadway Section No. 1,
Access Standard.
All required construction (sidewalk/curbing/pavement) within
the Public Road Right of Way is to be completed prior to the
release of a building permit or a financial guaranty in an amount
estimated by the County Engineer to cover the cost of
construction or improvements shall be filed with the County
Engineer. Required plans are to be submitted prior to estimating
the amount of the financial guaranty or permit release.

2. As an alternative to the required road improvements
the County will accept an RID/CRP agreement
"Notice to Public No. 6" on 4th Avenue, and Fancher
Road.
3. Applicant shall dedicate a 20 foot radius on
Fancher Road and 4th Avenue.
4. Please submit a copy of a recorded property deed
from the Auditors office for the subject property.
Upon receipt of the deed our staff will prepare the
right of way deed and/or the RID/CRP agreement.
5. Approach permits must be obtained, after a site
plan has been approved, and before the issuance of -
a building permit, from the County Engineering
Department for any new or improved driveway
approaches to the following streets: .
a. 4th Avenue
D) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceed:
1. Site Plan.
2. Drainage plan as specified.
3. Other information:
a. A parking and traffic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles. It is illegal to back out onto the Right of Way.
b. There shall be no access to Fancher Road until
it is constructed to County standards and established as a County
Road.
E) Utility Condition: Permittee is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
F) The owner of the property or the authorized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.

The applicant or his representative has been given a minimum
requirements list. This list is not inclusive of all the
requirements needed but should be used as a minimum guideline.
without the "minimum" requirements the Engineers Department may
not be able to perform a complete review of the project and could
result in prolonging the period before permit issuance. Only
after all the information and requirements listed above are
supplied or completed and the necessary review has been
accomplished will your building permit be released.
