The County Engineering Department has completed a review of
the above referenced project. The following information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containing HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Management". At
a minimum the plan must contain:
1. Drainage calculations for stoYmwater volumes
generated on site.
2. Calculations for total impervious surfaces
f contained within the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 swale.
6. Calculations to justify the number and type of
o drywells proposed.
7. Elevation of drywell inlets where applicable.
f 8. Copy of the proposed landscape plan.
B) The subject property is affected by the "Findings and
Order" and the "Conditions of Approval" for the following
land use action:
Final Plat PE-1572-89
C) Insufficient information was submitted with the proposal.
We are unable to proceed with our review. We will need
the following before we can proceeds
1. Site Plan showing the location of the swale for 19th
lane.
2. Drainage plan as specified.
3. Other information:
a. A parking and traffic circulation plan shall
be submitted and approved by the Spokane County Engineer. The
design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving as
required by the County Planning Ordinance, will be required for
any portion of the project which is to be occupied or traveled by
vehicles.
b. The access shown on the northwest corner of
the site needs further explanation. The property is not owned by
the applicant to our knowledge and the access would have to cross
a drainage easement twice.

D) Utility Condition: Permittee'is responsible for arranging
for all necessary utility adjustments or relocation as
required for completion of the improvement.
Ey The owner of the property or the au�horized
representative must complete and sign Spokane County
Engineers "Agreement to Pay Fees". This document must be
returned to the County Engineers Office. Plan review will
not be completed until this document is executed. This
document is attached to these comments. Please return
the completed Agreement to your contact person at the
Engineers Department.
Only after all the information and requirements listed above
are supplied or completed and the necessary review has been
accomplished will your building permit be released.

WHYSPERWOOU AN APPROVED CONCLUSIONS AND
PRELIMINARY PLAT DECISION
THYS MATTER, a request for an extension of time from Bud Aaker has been received and
decided upon, pursuant to Spokane County Subdivision regulation (Chapter III, Section G) and
RCW 58.17.140.
FINDINGS OF FACT
1. The individual signing below has been properly delegated the responsibility for rendering this
decision by the Spokane County Director of Planning.
2. The subject preliminary plat was approved by the Hearing Examiner Committee on May 25,
1989.
3. Spokane County has established specific criteria for considering the extension of ti.me for the
expirarion of preliminary subdivisions, specifically for regular subdivisions, and deparanent
policy for short subd.ivisions. These criteria are found in Chapter III, Section G of the
Spokane County Subdivision Ordinance and have been used as a basis for this decision.
4. The Comprehensive Plan designates this area of the preliminary plat as Urban, and the
location is within the Priority Sewer Service Area. The Comprehensive Plan designation
rema.ins the same has since the original prelirninary plat approval.
S. No additional conditions have been recommended by the various reviewing agencies and
departments, including the County Engineer's Office, County Health District, County
Utilities and the Deparnnent of Building Safety. The conditions attached are updated from
the original Hearing Examiner Committee �indings and Order.
6. This is the first request for a time extension. The total life of the preliminary plat has bezn
approximately three years.
7. The following facts are also relevant.
a. The fu phase of Whisperwood consisting of twenty (20) residential lots, has been
finalized. Common open space has been included with this phase of �Vhisperwood.
b. 1�'here are approximately 651ots remaining to finalize.
8. This extension of time is granted based upon continued progress. Continuation of progress
toward finalizing of all lots/phases should be shown or future extensions will likely not be
granted.
CONCLUSIONS
BASED UPON A REVIEW of (a) the criteria for approving an extension of time of the expiraaon
date for a prelim�nary plat and (b) the above Findings of Fact, the following conclusions are made.
1. A three (3) year tune extension should be granted based on the owners platting progress.
2. The applicant/owner should show continued progress toward complying with Chapter III,
Section G, of the Subdivision Ord.inar�ce before requesting an additional extension of time.

CONDITIONS OF APPROVAL
1. The preliminary plat of record approval is for the property legally described in the
application for the proposal.
2. The final plat shall be designed substantially in conformance with the PUD site plan and
preliminary plat of record as legally described and advertised. No increase in density or
number of lots shall occur without a new application submittal and approval.
3. That the site plan shall include the following in add.ition or in mod.ificarion of the PUD site
plan andlor Preliminary Plat�
a. The community center and recreational vehicle parlang are for use of residences and
guests, no commercial use shall be a�lowed.
b. Type III landscaping will be required along 16th Avenue and Sullivan Road between
the perimeter fence and the property line.
c. Fence shall not exceed 6 feet in height.
4. Upon filing the final plat, or a portion thereof, the zone reclassification of the final plat area
shall be finalized, and the exist�ng zone classificarion shall be changed to Urban
Residential-7 (UR-7), consistent with the proposed zoning approved with the preliminary
plat of record.
5. The final plat shall be designed substantially in conformanee with the preliminary plat of
record. No increase of densiry or number of lots shall occur without a change of condirion
application submittal and approval.
6. The Planning Director/designee shall review any proposed. final plat to ensure compliance
with these Findings and Conditions of Approval.
7. A final plat name shall be indicated before the final plat is filed, such name to be approved
by the Planning Director/designee.
8. Appropriate road name(s) shall be indicated.
9. A specific and detailed site improvement plan will be submitted for Planning Department
review approval as part of the final plat review and prior to the issuance of a building
permit, change of use permit or certificate of occupancy. Appropriate bonds or proof of
construcaon must be submitted at the time of final plat review to cover the estimated cost of
on-site improvements which were required as a part of the project approval.
10. The preliminary plat is given conditional approval for three (3) years, specifically to
September 1, 1995. The applicant may request an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expirarion date.
11. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utiliry easements by appropriate unlity companies shall be received with
the submittal of the finai plat.
12. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all
private, "Tract X" or public roads. The dedication shall contain the following statement:
"Side yard and rear yard setbacks shall be determined at the time building pernuts are
requesteri unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
13. Three (3) current certificates of title shall be furnished to the Planning Department prior to
filing the final plat.
14. Prior to filing of all or a portion of the final plat the applicant's surveyor shall submit one or
more maps outlined in red of the area being finalized. The scale shall match the appropriate
assessor's map scale.
I 5. The plat dedication shall contain the following statement for those lots located on any
temporary cul de sac:
"Lot(s) Block(s) are located on a temporary cul-de-sac. This

temporary cul-de-sac may be extended to provide access to adjacent property andlor
connect to existing roads or new roads as development and/or cuculation needs dictate."
16. The final plat shall indicate yard setback arc lengths on cul-de-sac lots which meet or
exceed the minimum frontage of the underlying zone of the final plat.
17. A plan for water facilities adequate�for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County Building
Safety Department and County Health Distric� The agencies will certify on the Water Plan,
prior to the filing of a final plat, that the plan is in conformance with their respective needs
and regulations. The Water Plan and certi.�ication shall be drafted on a transparency
suitable for reproduction and be signed by the plat sponsor.
18. The water purveyor shall certify that appropriate contractual arrangements and schedule of
unprovements have been made with the plat sponsor for construction of the water system in
accordance with the approved Water Plan. The time schedule shall provide for completion
of the water system and inspection by the appropriate health authonties prior to applicarion
for building permits within the final plat. The arrangements or agreements shall include a
provision holding Spokane County and the purveyor hannless from claims by any lot
purchaser refused a building permit due to the �ailure of the subdivision sponsor to
satisfactorily complete the approved water system.
19. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state health
authorities, the local fixe protection district, County Building Safery Department and
water purvey�r, shall be installed within this subdivision and the applicant shall provide for
individual domestic water service as well as fire protection to each lot prior to sale of each
Iot and prior to issuance of a build.ing pernut for each lot."
20. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant to the
approved V�ater Plan for the final plat including a signed license stamp. The certification
may be in the form of a letter, but is prefeired to be certified on a copy of the Water Plan as
a schemaric map showing the "as-built" water system.
21. The Water Plan and the above four (4) conditions of approval xegarding the Water Plan
may be waiveti by the Planning I�irector/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to an
existing, approved water system will provide adequate domestic and fire protection water to
ensure the public health, safery and general welfare.
22. Appropriate road name(s) shall be indicated.
23. The Final Plat(s) shall indicate by a clear dashed line the required front yard setback 20 feet
from the private road and 15 foot rear yard setback. Common areas and/or individual lots
shall show a building setback of 35 feet from the right af way along 16th Avenue and
Sullivan Road Side yards are allowed to be zero. The ded.ication of the plat shall state:
"The setback indicated on this final plat may be varied from if proper zoning approvals are
obtained."
24. A survey is required prior to the filing of a final plat.
Z5. The PUD final plat shall indicate all exterior boundary setbacks, as well as setbacks from
roadways and individual lot lines.
26. A copy of the homeownersiproperty owners' association articles of incorporation and/or
bylaws and/or covenants and restrictions, together with any other provisions for
ma.intenance of common areas and facilities, shall be submitted for review and approval to
the Planning Department prior to finalizing.
27. The proposal shall comply with the Urban Residenrial-7 (UR-7) zone with Planned Unit
Development (PUD) Overlay Zone as amended.
28. The Planning Departrnent shall prepare and record with the Spokane County Auditor a Title
Notice noting that the property in question is subject to a variety of special conditions
imposed as a result of approval of a land use action. This Title Notice shall serve as public
notice of the conditions of approval affecting the property in question. The Title Notice
should be recorded within the same time frame as allowed for an appeal and shall only be
released, in full or in part, by the Planning Departinent. The Title Norice shall generally

provide as follows:
The parcel of property legally described as is the
subject of a land use action by a Spokane County Hearing Body or
Administrative Official on imposing a variety of special
development conditions. File No. is available for
inspection and copying in the� Spokane County Planning Department.
29. Approval is required by the Planning Director/designee of a specific lighting and signing
plan for the described property prior to the release of any building permits.
30. The applicant shall develop subject properry generally in accordance within the concept
presented and Condition of Approval included by the Planning Departiment to the Hearing
Examiner Committee. Variations when approved by the Planning Departinent will be
permitted. The intent and design of the PUD Plan shall be complied with and all variations
must conform to regulations set forth in the ZONING CODE FOR SPOKANE COUNTY.
The original intent of the development plans shall be maintained.
31. Subsequent extension of time will only be considered upon a finding of substantial
compliance with Chapter III, Section G, of the Subdivision Ordinance; otherwise the
preliminary subdivision approval will become null and void.
SPOKANE COUNTY DIVISION OF ENGINEERING
1. The conditional approval of the plat is given by the County Engineer subject to ded.ication
of right-of-way and approval of the road system as indicated in the preliminary plat of
record.
2. Plans, profiles, and cross-sections as designed to County standards showing proposed
s�eet centerline and curb grades shall be submitted to the County Engineer for approval
prior to construction and/or the filing of each final plat; road plans to be prepared under the
direction of a licensed Professional Civil Engineer.
3. Drainage plans and design calculations showing the alignment of drainage facilities shall be
submitted to the County Engineer for approval prior to construction and/or the filing of the
final plat. Drainage plans to be prepared under the direction of a licensed Professional Civil
Engineer.
4. Construction within the proposed public streets and easements shall be performed under the
d.irect supervision of a licensed engineer/surveyor, who shall furnish the County Engineer
with "as-built" plans and a certificate in writing that all improvements were installed to the
lines and grades shown on the approved construction plans and that all disturbed
monuments have been replaced.
5. No construction work is to be performed within the existing or proposed public right-of-
way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
6. All construction within the existing or proposed public right-of-way is to be completed
prior to filing each final plat, or a bond in the amount estimated by the County Engineer to
cover the cost of construction of improvements, construction certification, "as-built" plans
and monumenting the street centerlines shall be filed with the County Engineer.
7. Dedication of 30 feet of add.itional right-of-way along Sullivan and 16th Avenue is
required.
8. A statement shall be placed in plat dedication that no d.irect access be allowed from lots to
Sullivan Road or 16th Avenue.
9. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
10. Sidewalks are required along the arterial(s) on Sullivan and 16th Avenue.
11. The word "applicant" shall include the owner or owners of the property, his heirs, assigns
and successors.
12. The County Engineer has designated Typical Roadway Section Number Two Major
Arterial Standard for the improvement of Sullivan Road and 16th Avenue which are
a

adjacent to the proposed development. This will require the addirion of roadway
improvements consistent with the adopted Typical Roadway Sections for 16th Avenue and
Sullivan Road. These Cross Sections are on file at the office of the County Engineer.
13. The proposed private road(s) as shown on the preliminary plat serving 851ots with [no
extension possibl%xtension to serve eight (8) or fewer lots/future public right-of -way
tractJ is approved by the Counry Engineer.
14. Private road(s) shall be improved to Spokane County standard for a private road standard
serving 851ots, and are subject to approval under Section 10.207 of the Spokane County
Fire Code.
15. All vested owners shall sign and record private road documents as prescribed by the
Spokane County Engineer. These documents shall be reviewed and approved by the
Spokane County Engineer prior to recording with the Spokane County Auditor. Recording
numbers shall be referenced in the ded.icatory language of the plat.
16. The following statement shall be placed in the plat dedicarion:
"WARNING: Spokane County has no responsibility to build, improve, maintain or
otherwise service the private roads contained within or provide service to the property
described in this plat. By accepting this plat or subsequently by allowing a building pemut
to be issued on property on a private road, Spokane County assumes no obligation for said
private road, and the owners hereby acknowledge that the County has no obligation of any
kind or nature whatsoever to establish, examine, survey, construct, alter, repair, improve,
maintain or provide drainage or snow removal on a private road. This requirement is and
shall run with the land and shall be binding upon the owner(s), their heirs, successors or
assigns, including the obligation to participate in the maintenance of the private road as
provided herein."
17. The proposed subdivision shall be improved to the standards set forth in Spokane County
Board of Comrnissioners Resolurion No. 80-1592, as amended, which resolution
establishes regulations for roads, approaches, drainage and fees in new construction.
18. This proposed subdivision or development proposal is located within a drainage basin
which has been idenrified by the Spokane County Engineer's office as having stormwater
runoff problems. Since this proposed subdivision or development proposal is affected by
or is a contributor to stormwater flows, property owners should participate in the planning
and implementation of a future basinwide stormwater management system. The following
statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to join in any County-approved stormwater
management program and to pay such rates and charges as may be fixed through public
hearings for service or benefit obtained by the planning, design, constructing, mainta.ining
or operation of stormwater control facilities."
19. That the following statement must be placed in the plat dedication: "The private road as
shown hereon is an easement which provides a means of ingress and egress for those lots
within the plat having frontage thereon."
SPOKANE COUNTY HEALTH DISTRICT
1. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health.
2. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the
recorded service area of the water system proposed to serve the plat.
3. A plan for water facilities adequate for domestic use, domestic irrigation use and fire
protection use shall be approved by the water purveyor. Said water plan must have been
approved by the fire protection district and the appropriate health authorities. The health
authorities, water supplier (purveyor) and the fire protection d.istrict will certify, prior to the
filing of the final plat, on the face of said water plan that the plan is in conformance with
their requirements and will adequately satisfy their respective needs. Said water plan and
certification will be drafted on a transparency suitable for reproduction.
4. The purveyor will also certify prior to filing the final plat on a copy of said water plan that
appropriate contractual arrangements have been made with the plat sponsor for construction
of the water system, in accordance with the approved plan and time schedule. The time

schedule will provide, in any case, for completion of the water system and inspection by
the appropriate health authorities prior to application for building pennits within the p1aG

lot/tract purchaser refused a building permit due to failure of the plat sponsor to
sarisfactorily complete the approved water system.
5. A public sewer system will be made available for the plat, and individual service will be
provided to each lotltract prior to sale. Use of individual on-site sewage disposal systems
shall not be authorized.
6. A statement shall be placed in the dedication to the effect that: "A public sewer system wi11
be made available for the plat, and individual service will be provided to each lot/tract prior
to sale. Use of individual on-site sewage disposal systems shall not be authorized."
7. The dedicatory language on the plat shall state: "Use of private wells and water systems is
prohibited."
8. The plat dedication will contain a statement to the effect that: "The public water system, as
approved by county and state health authoriries, the local fire district and purveyor, will be
installed within this plat, and the subdivider will provide for individual domestic water
service as well as fire protection to each lotltract prior to sale of each lot/tract."
SPOKANE �OUNTY UTILITIES DEPARTMENT
1. The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a ULID by resolution method pursuant
to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED, this
condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the properry as a result of ixnprovements called for in conjunction with the
formation of a ULID by either petition or resolution method under RCW �hapter 36.94."
2. Plans and specif'icarions for public sewer system will be provided for Utiliries approval.
SPOKANE COUNTY DIVISION OF BUILDINGS
1. The applicant shall contact the Deparnnent of Building and Safety at the earliest possible
stage of design/development in order to be informed of code requirements
administered/enforced by the department, e.g., State Building Code Act regulations, such
as requi.rements for fire hydrant/flow, fire apparatus access roads, street address
assignment, barrier-free regulations, energy cocle regulations and general coordination with
other aspects of project implementation.
