DRAINAGE EASEMENT
IN THE MATTER OF THORPE ROAD, ROAD FILE NO. 834, KNOW ALL MEN BY THESE
PRESENTS, that the Grantors, Michael L. and Pamela S. Senske, husband and wife, of the
County of Spokane, State of Washington, for and in consideration of Mutual Benefits, the receipt
of which is hereby acknowledged, grant to Spokane County, a political subdivision of the State
of Washington, a Drainage Easement over, under, upon and across the following described real
property situated in the County of Spokane, State of Washington:
AFFECTS ASSESSORS PARCEL NO. 44041.9089
BEGINNING at the centerline intersection of Thorpe Road and Dishman-Mica
Road, being Station 0+00; thence Easterly along the centerline of Thorpe Road to
Station 7+17; thence 30.00 feet North of and perpendicular to the centerline of
Thorpe Road to the North right of way line being the True Point of Beginning;
thence North 24.00 feet perpendicular to the centerline of Thorpe Road, thence
Easterly and parallel to the centerline of Thorpe Road, a distance of 275,00 feet;
thence South perpendicular to the centerline of Thorpe Road, a distance of 24.00
feet to the North right of way line of Thorpe Road, thence continuing South 16.00
feet perpendicular to the centerline of Thorpe Road; thence Westerly parallel to
the North right of way line of Thorpe Road, a distance of 275.00 feet; thence
North 16.00 feet perpendicular to the centerline of Thorpe Road to the True Point
of Beginning.
All within Section 4, Township 24 North, Range 44 East, W.M., Spokane County,
Washington.

The Drainage Easements, as described herein above are for the purpose of installing, operating
and maintaining drainage areas and drainage facilities to dispose of runoff. The property owner
shall maintain the drainage area with a permanent live cover of dryland type grasses acceptable
to the office of the Spokane County Division of Engineering, with optional shrubbery and/or
trees, which do not obstruct the flow and percolation of storm drainage water in the drainage area
as indicated by the approved plans.

The Grantors will construct the drainage AMU n co ormance with the approved plans on file
in the office of the Spokane County Division of Engineering.
The individual lot owners or their successors in interest shall maintain the drainage facilities in
conformance with the approved plans.
The property owner or his representative shall inform each succeeding purchaser of all Drainage
Easements on the property and his responsibility for maintaining drainage facilities within said
Easements.
The Drainage Easement described herein above is to and shall run with the land. No
modification of the boundaries of said Easement can be made without the prior approval of
Spokane County.
Whenever the individual lot owners or their successors in interest fail to maintain the drainage
facilities in conformance with the approved Drainage Plan, a notice will be given to the
individual lot owners or their successors in interest by the County. If not corrected after ten (10)
days, the County has the right to correct the maintenance failure or have it corrected at the
expense of the individual lot owners or their successors in interest,
Spokane County does not accept the responsibility of maintaining the drainage course on private
lots within Drainage Easements or floodplain areas, nor the responsibility for any drainage
whatsoever, including but not limited to inverse condemnation to any properties due to deficient
construction and/or maintenance of drainage courses in Drainage Easements on private property.
