The Agreement was entered into by the Parties pursuant to RCW 82.02.020 to mitigate a direct impact identified as a consequence of Developer's anticipated development of its real property located near the Pines/Mansfield Construction Project. That property is more specifically described in the Agreement. which a copy of which is attached and incorporated herein. The Agreement required Developer to pay$151,730 as a mitigation fee representing a proportionate share contribution towards traffic impact improvements deemed necessary at the intersection of Pines Road and Mansfield Avenue,representing the purchase of a certain number of vehicular trips at $303.46 per P.M. peak hour trip. On February 8, 2005, contemporaneous with executing the Agreement, Centennial Properties paid the City $151,730, in full payment of the financial obligation of the Agreement,and Centennial Properties has no outstanding obligations pursuant to the terms 1 of the Agreement.
