As you can see our problems are still not resolved. I am sending a copy of this letter to Jeff Forry, Brenda Sims, Jim Red, Bill Hemmings, Scott Engelhard, Kevin Cook, Francine Shaw, John Pederson, Tammy Jones, Paul Jensen, Bruce Rawls, Gary Oberg, Commissioner John Roskelley, Commissioner Kate McCaslin, and Commissioner Phil Harris. 1 know that most of you are aware of the problems we are having concerning this property and any help that we can get in this matter would be greatly appreciated. Markham N. 1519 Barker Road Greenacres, Wa. 99016 (509) 891-1245 or 220-8622 Sept. 12, 2000 Dear Mr. Needham I had a conversation yesterday with Paul Jensen and he told me to write to you, as the "New" Director, to make sure that you are aware of a ongoing problem that exists on our property. I have enclosed a copy of the letters I have sent and received in the last several months concerning this problem. Francine Shaw has a complete book that outlines everything concerning this property. I would like you to get this book from her and review it as well if possible. I will explain very briefly what is going on concerning this property. We have a nearly 1 acre lot located at the corner of Barker Road and Mission Avenue. On this lot are 3 structures. The 1st & 2nd is our residence with a detached garage and the 3rd is a commercial type of structure that is approx. 30' X 90' with a large parking lot in front of it. We bought this property in 1985 and ran a business out of the commercial type structure until December 1999, at which time we sold our business and put this property up for sale. It was shortly after this that we got an offer to purchase. It was only when they went to get the change of use permit to allow them to operate their business that we found out we had all kinds of problems on this property. This property is zoned UR 3.5 and we are caught up in the middle of the new IUGA rules. We are located outside of the 15 year sewer boundary, and are therefore unable to apply for a rezone or a new conditional use permit on this property. As you can see from the enclosed letters, we did get the original special use permit vested. Unfortunately this really is not of much help, as it so limits our possibility for a sale on this property. We believe that the IUGA rules are to restrictive to existing structures. As we would not be looking for expansions or changes to what is already existing, we feel that there would be little or no impact on the existing systems. These rules really need to be looked at because the way that we understand it, our zoning codes and rules are in place to conserve and stabilize individual property values and facilitate adequate levels of community services and utilities. With the current rules, we probably will not be able to sell this property and will have to abandon this building. Certainly an abandoned building would have a more negative impact on this area than some sort of small business. This building has housed a small business for 52 years. We currently have another party interested in this property. She would like to put in a day care center. Under the current zoning codes, she would be unable to do this. We are aware that Tammy Jones is currently working towards getting the codes changed that might allow for a day care center. If this matter does get resolved, it will still leave us out because of the IUGA rules that would not allow for any applications for a rezone or a conditional use permit on this property because of the sewer boundary rules. Sewer is not close to this property and it would be cost prohibitive for us to go to where the sewer is. Kevin Cook is looking into a possible hook up for us into a private line that is being run north on Barker past our property to the sewer at Riverwalk. At this time, we do not know if this is a possibility or not. We are not in a position to throw unlimited amounts of money at this. We will be attending the October 5th hearing on this matter, and hope in the interum you will have a chance to look into this matter for us.
