19-035.03 Michael Terrell: Browns Park 2019 Improvements CONTRACT AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SPOKANE VALLEY AND MICHAEL TERRELL LANDSCAPE ARCHITECTURE, PLLC Spokane Valley Contract#19-035.03 For good and valuable consideration,the legal sufficiency of which is hereby acknowledged, City and the Consultant mutually agree as follows: 1.Purpose:This Amendment is for the Contract for Browns Park 2019 Construction Improvements Project by and between the Parties, executed by the Parties on February 11, 2019, and which terminates on May 15,2020. Due to the failure of ERRG to adequately staff and manage the construction of this project, MTLA has been required to prepare for and attend additional meetings, site visits with the contractor to document lack of progress toward completing the project per the contract documents and scheduled Substantial Completion date of November 1, 2019. To date the project is not Substantially Complete and the contractor continues to dispute the conditions of the contract with the City of Spokane Valley. In addition to additional Construction Administration responsibilities, MTLA has had to provide additional documentation to the City of Spokane Valley and attend additional meetings with city staff as part of the continuing failure by ERRG to complete the project on time. On March 5, 2020 a meeting was held on site between the City of Spokane Valley (Mike Stone), ERRG (Ryan Boorman and Spencer Slominski), MTLA (Mike Terrell) and Senske representatives. The meeting identified a number of critical issues and tasks that remain to be completed before the project could be designated complete. ERRG indicated that it was possible that they work would not be completed until May. As of this date, the project is still not Substantially Complete and ERRG has not resumed construction per the contract documents. In order for MTLA to continue to represent the City of Spokane Valley during the contractor's completion of the project, we are requesting the following additional services fees to compensate for the additional efforts caused by the contractor's failure to perform. I request the following additional scope of work and fee to complete the project. ERRG's past performance and continuing dispute with the City of Spokane Valley make estimating the remaining construction administration fee difficult at best.
