Dear Mr. Horwath:
Jeffrey Forry, of the Spokane County Department of
Building & Safety, has contacted our office regarding an
alleged violation of Section 301 of the Uniform Building
Code in connection with the car port located at the
above address.
Specifically, it is alleged that no building permit has
been obtained for the car port.
Please be advised that a violation of the Uniform
Building Code constitutes a misdemeanor. As such, it is
punishable by up to ninety (90) days in jail, a fine or
up to $500.00, or by both such fine and imprisonment.
Please take immediate steps to obtain the required
permit. Your failure to do so within thirty (30) days
of the date of this letter may result in a complaint
being filed against you for a violation of the Uniform
Building Code.

Records of the Spokane County Assessor's Office identify
F.J. Horwath as the owner of the referenced property located at
East 8615 Desmet Road, Spokane County, Washington.
David Silva, an inspector for the Department of Building and Safety,
on July 12, 1990 inspected the property located at
East 8615 Desmet Road Spokane County, Washington and observed the
following construction on said property:
A 12 x 20 Carport constructed within the front yard setback
The records of the Department of Building and Safety show that on
07/12/90, 1990, no permit had been issued for the said construction.
On January 16, 1990, the Department of Building and Safety notified
the defendant, in writing, of the permit requirement for the said
construction. As of the date of this affidavit, the records of the
Department of Building and Safety show no permit has been obtained
for the said construction.
