2007, 09-11 Permit 07002749 Violation LetterSpokane Valley® 11703 E Sprague Ave Suite B3 Spokane Valley WA 99206 509.688.0036 • Fax: 509.688.0037 ♦ email: September 11, 2007 Vasiliy Sichkar 1522 W Shannon Spokane, WA 99205 RE: Permit # 07002749 Dear Mr. Sichkar; As you are aware, the site you are developing under the above reference permit for a single family dwelling at 2315 Dusk was reported to our office for violations of the City's stormwater discharge regulations. Since that time, Engineer Henry Allen, with the Spokane Valley Development Engineering division of Community Development has been reviewing the situation at your site and has been in contact with you regarding the stoomwater connection and circumstances surrounding that issue. On August 30, 2007, Mr. Allen and I visited your site to get a clearer understanding of both existing and extenuating conditions that affect your property so we can develop an appropriate course of action. What we discovered is that the conditions on your property have implications far beyond the issue of the stormwater connection. Mr. Allen and I observed that the site has significant groundwater conditions that were not included in the information evaluated for issuance of the permit. During our visit we observed standing water, considerable water intrusion onto the property (during a dry summer season), and soil layers that are incompatible with good drainage, all of which have a significant impact on construction requirements for the residence and development of the lot in general. Because the drainage issues and soil conditions noted above were unknown to us during the course of the review and would have triggered significant construction requirements in order to comply with city codes, I believe the permit for this property has been "issued on the basis of inaccurate and incomplete information" (IRC section 105.6). As such, under the authorization granted to the building official in International Residential Building Code (IRC) section R105.6 (adopted by reference by the City of Spokane Valley), I am suspending the permit previously issued by the City so that we can more thoroughly evaluate the situation and assist, as we are able, in the development of a safe and compliant residential site. I further reserve the option to take further action to revoke the permit as allowed by the noted code section, if necessary. The City will continue to work with you to explore possible solutions to the development challenges for this lot. However, as of the date of this letter, the previously issued permit is invalid and does not authorize the construction of the single family residence as described in the scope of work. The City will re -activate the permit at such time as these matters have been resolved and the property brought into a code compliant condition for development.
